Heartache: Palin appoints former Planned Parenthood board member to Supreme Court

Yeah, but.  Sarah Palin did appoint Morgan Christen to the Supreme Court, but she didn’t have many other options, either.  The Alaska Daily News gives a straightforward account:

Palin announced the appointment of Anchorage Superior Court Judge Morgan Christen this week.

Christen was one of two judges recommended for the post by the Alaska Judicial Council.

She will be the second woman to serve on the state’s high court. Gov. Tony Knowles appointed current Chief Justice Dana Fabe in 1996.

A similar issue arose with Rudy Giuliani during the campaign.  Giuliani, who is admittedly pro-choice anyway, came under fire for the judges he appointed as Mayor, some of whom did not share his stated philosophy of judicial “restraint”.  Giuliani had to explain that the process in New York City is different than that in Washington DC; the executive gets a list of candidates from an independent body and has to choose one of those nominated for an open post.

In Alaska, Palin has to follow the same kind of process, as Peter Andrew explains, via Legal Newsline:

Palin has a month and a half to choose the next member of Alaska’s State Supreme Court.  The problem is the two choices she has to pick from are justices who don’t align with her conservative views.  Alaska’s judges are selected using the Missouri Plan, which combines election and appointment in choosing the judge. The Alaska Judicial Council selects the nominees from which the governor can then make an appointment.  A total of six judges applied, but only two were elected by the Judicial Council, Eric Smith, considered very liberal, and Morgan Christen, who is viewed as more of a moderate.

And from what I understand, neither option was great but of the two, it would appear that Palin may have picked the more liberal of the two, at least according to Alaska Family Council’s Jim Minnery. Minnery wrote Palin in support of the other candidate, Judge Eric Smith saying Smith was “more conservative” and that Christen would be “another activist on the Court.”

This would not seem to be good news for those who love Sarah. There’s one thing conservatives take seriously – and that’s judges.

And the ADN explains that Palin has issues with both:

Aides to the governor wouldn’t answer questions about specific concerns that might have prompted the governor’s request. However, both Christen and Smith have been involved in organizations that might give Palin pause.

Christen’s application included her membership in several charitable groups, including some from her past, but did not mention that she was on the board of Planned Parenthood in the mid-1990s. The organization, which didn’t provide abortions in Alaska until 2003, is now on the opposite side of a Palin-supported bill to require girls under 17 to get parental consent for an abortion.

Back in the 1980s, Smith was executive director of the public interest environmental law firm, Trustees for Alaska. The group currently is on the opposite side of Palin over the listing of Cook Inlet beluga whales as endangered.

Which was worse, Christen or Smith?  It sounds like Palin didn’t have much of a choice in any case.  She could have pushed back by refusing to appoint either, but her predecessor tried that and got roasted for it.  I’d have hoped that Palin would have at least attempted to press the AJC to give her a better range of nominees from which to choose.

This case demonstrates the problem with establishing independent boards to provide essentially political decisions.  The people of Alaska elected Palin to make these kinds of choices, and at least she has direct accountability to them.  The AJC has no accountability for making bad decisions at all.  Maybe Alaskans should consider a more direct system instead.

Update: Conservatives 4 Palin have more on this.  They’re complaining in the comments that they had it first, but I got the email from the other two sites and worked off of their sites.  Happy to link and we do our best to credit the sources, but we dance with the ones that brung us, fellas.

Ummm pay people/ The Alaskans own the land. I.E. no one owns mineral or other rights sub surface. You have to live here 2 years before you get “Paid” and it isn’t all that big a check.

Anybody who voted for Palin in the general election, like I did, should not be criticized too harshly for noticing the same things that everybody else notices about her such as the propensity for bumping into questionable ethics (personal issues we discussed, expensing her home, firing personal enemies, taking children on government-provided travel, lying about the bridge to nowhere, etc.) as well as her not being shut down by Katie Couric and other instances where she has shown that she is a reasonably intelligent woman….but not brainy enough to be POTUS.

Hot Air’s “Gruesome Twosome” (Allah and Ed Morrissey) are two of a very small number of “conservative” journalists/bloggers whom I consider intellectually dishonest enough to be employed by The New York Times.

Palin’s choice was like being given the option between living under Hitler or Stalin. Since Smith is supposedly more liberal, I am sure he would be pro-choice on any decisions concerning abortion. Apparently Gov. Palin chose what she considered the lesser of two evils.

This should be a non-issue, but since the one of the primary objectives at Hot Air these days seems to be to destroy Sarah Palin, I guess it’s “newsworthy.”

She was in a rough spot, I think it’s unfair to make too big of a deal out of the marginal cost of one over the other. There are a number of reasons why I’m skeptical of her as President, but her administrative abilities are certainly not among them.

Minnery of the Alaskan Family Council came out earlier today and said that it no longer objects to appointment of Judge Christen, that if the fault lies anywhere it is with the Alaskan Judicial Council who put Sarah in an untenable position of furnishing 2 candidates (a liberal and an independent), neither of which fit into Sarah’s political philosophy.

The it works here in AK is that a state judicial board recommends 2 from those that are qualified and basically our Gov really had no choice but to pick one of those that are recommended. That is the law. BTW, one things Ed fails to mention is the judge resigned from Planned Parenthood when they adopted the pro-choice policy. There is currently a movement to have the legislature change it so that the gocv can choose from all qualified and not just what the board says.

All I can say is no way I would ever vote for her again. I see the hand writing on the wall she is probably going to become a Democrat, thinking that will move her on up to the White House. And if she does just think how smart and intelligent she will become all of a sudden, the media will love her instead of taking every kind of cheap shot they can think of. You can’t ignore your core people and expect them to support you.

Here is the truth:

1) Go to Sarah Palin’s Facebook to get the lowdown on her pro-life credentials

2)Judge Christen joined Planned Parenthood before they started advocated for abortion; she is an adoption advocate and registered as an independent

3)Minnery of the Alaskan Family Council who first criticized the pick now is withdrawing the criticism and laying the blame at the feet of the Alaskan Judicial Council who put Sarah in an untenable position of having to choose between 2 lawyers neither of which shared her political philosophy

4)Eddie Burke a radio talk show host up in Alaska also opposed the pick until a lawyer familiar with the Missouri Plan and Judge Christen came on the air and talked about the law relating to picking judges for the Supreme Court in Alaska and how he felt about Judge Christen.

Look I’m not telling you to take what I write at face value, but check it out for yourself before reaching a hasty conclusion that is not borne out by the facts.

I just went over to http://www.conservatives4palin.com and read 2 comments regarding the Ziegler documentaty ‘Media Malpractice’. Both say it was well done, that Sarah comes out well, but we are all going to be livid once we see it.

Because of that I will never back down in my defense for Sarah and I hope the people that support her will not let up either. What SouthernDem considers ‘a grain of salt’ we consider one more obstacle of many that must be overcome on the way to Sarah’s victory in 2012.

What the supporters of Sarah do in the next 3 years and 8 months may be the most important thing that they will ever do for America in their lifetime.

Sarah Palin, God Bless her for trying, will never ever be qualified to be POTUS, VPOTUS, or even SCOTUS. I could maybe see her in some Republican administration appointed to a very low risk position though. She’d make a fine Senator or Congresswoman too.

As long as Sarah Palin stands at the forefront of Republican aspirations, and then attempts to fulfill those aspirations with a lofty candidacy for POTUS or VPOTUS running-mate, a Republican will not sit in the Whitehouse oval office with his/her feet up on the desk. Ever.

She’s not even close to being politically astute. She’s not especially bright. And she’s especially slow on the uptake when it comes to learning anything she needs to know, when she knows (or should know) that she’ll be asked.

The same stands true for Bobby Jindal.

The Republican party needs to quit grasping at straws and stop running my political party like it’s some bubble gummer reality TV show on MTV. Pretty packages with a vacant core is for Democrats/Liberals. We need substance, experience, and intelligence. Not “Who Wants To Be America’s Next Top Model?”, or “Who’s Smarter Than A 5th Grader?”

She’s a waste of precious time, money, and energy for this party.

I live in Australia and we are now feeling the full effects of Obama’s nascent Presidency. The Australian stock market largely mirrors Wall Street. Australia is on the brink of recession and unemployment will go from 4% to 7% this year alone.

As for Sarah Palin. Misogyny is alive and well in the United States of America I’m afraid to say.

I re-watched Sarah Palin’s convention speech, her debate performance and some of her stump speeches recently. I have to say what is the most striking about her many harangues is how she nails Obama on so many issues from a lack of political accomplishment, his self-aggrandizement, his pompous Messianic appeal, his elitist thinking about those who ‘cling to their religion and guns’, proposing a trillion dollars in new spending and bringing forth massive tax increases, Obama’s bent to implement socialist policies by giving more orders from Washington so as to ‘spread the wealth’, his ties to radical associates, Obama’s anti-war vote on not funding the troops in Iraq and Afghanistan and his plan to wave the ‘white flag of surrender’ in Iraq, Biden’s claim that Obama was not ready to become Commander-in-Chief and later on that Obama would be tested in the first six months of his Presidency, claiming that Obama is naive, shows poor judgment and is ‘reckless and dangerous’ in proposing to meet with rogue dictators without preconditions, Obama’s comment that American pilots were air-raiding villages and killing civilians in Afghanistan, and her prescient closing statement and warning in the debate ‘that freedom is only one generation away from extinction’.

Sarah is not only brilliant; she is also a Cassandra. You may ask where was McCain, where was McCain? Why wasn’t he taking advantage of the points Sarah scored while she opening wounds and drawing blood from Obama with telling blows and instead undermining Sarah?

Unfortunately, McCain was like the boxing trainer in Sarah’s corner between rounds who kept on encouraging her to do well, but by the same token wanted to temper her enthusiasm for head shots by instructing Sarah to instead to focus more on the the body to supposedly wear her opponent down rather than to take aim at Obama’s face, nose and eyes to knock him out for good and claim the upset. Unfortunately McCain and his handlers would not permit Sarah to deliver the knockout blow to Obama. Instead they instructed her to pull her punches, to let up and clinch, to back away. For that I will never forgive them.

It is no wonder that MSM embarked on a search and destroy mission to take Sarah out, using any means short of murder to marginalize her by discrediting Sarah, mocking and ridiculing her or smearing her. Ziegler, in Media Malpractice, demonstrates this so well. Sarah was too close to the truth and despite McCain’s incompetence and lack of backbone and the MSM daily onslaught against Sarah the McCain-Palin ticket still amassed 60m votes, won 22 states and only lost by 7.2%.

Those who do not think Sarah has a chance against Obama-take a good look at the above voting stats. This is where Sarah will begin from if she in nominated for 2012.

And finally there are only right now two people on our side who are true nemeses to the Messiah: Rush Limbaugh and Sarah Palin. The former is not running for President and I hope the latter is.
