Police video shows disturbing response to teen assault, plus poll

Any of us who have parented teenagers know how frustrating they can be, and one has to imagine that police officers know that better than most. Most of the time, they react better than Deputy Paul Schene did in this video, after a 15-year-old girl responded to a demand that she remove her shoes by flipping one at Schene. He then charged into the cell and now faces criminal prosecution (via QandO):

The video shows Schene and Brunner as they escorted the girl into the holding cell. Schene had asked her to remove her basketball shoes, and, as she slipped out of her left shoe, she appeared to kick it at Schene.

Schene then lunged through the door and kicked her, striking either her stomach or upper thigh area, court documents say. He pushed her against a corner wall before flinging her to the floor by her hair. He then squatted down on her and made “two overhead strikes,” although it’s unclear where the blows landed.

The detective who reviewed the video said it appeared Schene and Brunner had the girl under control when Schene struck her. Schene, who is 6 feet 2 and weighs 195 pounds, did not explain his action to investigators, court documents say.

He and the girl exchanged words. Brunner said she was “real lippy” after being informed she was under arrest and called them “fat pigs.”

The Sheriff’s Office policy manual says deputies should use physical or deadly force only when “necessary to effect an arrest, to defend themselves or others from violence, or to otherwise accomplish police duties according to law.”

Normally, we give police a lot of leeway to control violent or obstructive arrestees, and for good reason. It’s dangerous to second-guess how an officer reacts in two ways. First, in many instances, we don’t get a chance to see the larger context, in which an officer may see a threat not depicted in later exploration of video clips. Second, it pressures law-enforcement personnel to act too passively in situations requiring greater control, leading to dangerous and even deadly incidents.

In this case, though, it’s difficult to see any context in which Schene could justify his actions. Presumably, the teen had already been searched for weapons and was in fairly firm custody at the jail. She committed an assault by flipping the shoe at Schene (and battery if she actually hit him), but she represented no threat at all, nor were there any threats in the vicinity of the secure detention facility. Even before he punched her in the head twice, Schene used an excessive level of force clearly intended for punitive action rather than to secure the girl.

The defense did not want the video released before the trial because it would “inflame public opinion”. I’d guess that would be the case, but the video is publicly owned by the Seattle taxpayers who paid for it. Would the police have released it if the video showed Schene properly reacting to a real threat? I’m betting yes.

I grew up with the idea that you were always extra polite to policemen, and that if you mouthed off to them you would get roughed up, and justifiably. I don’t think this girl was hurt much, at all.

If you’re working a desk job, making a minor mistake out of frustration might only get the copier jammed, or accidentally clicking Reply to All with a private email. You wouldn’t get fired for that, but you might get written up by a stern boss.

Cops have to deal with ne’er-do-wells all the time. This is a case of a minor screw-up. It just doesn’t make sense to fire or prosecute a copy for such a minor screw-up. Yes, put a letter of discipline in his folder, but don’t ruin the guy’s life…he won’t be able to save yours.

I posted this at Whizbang, everything is on topic except the last part which was responding to a post about the length of training officers get.

Everything the Officer did seemed appropriate to get a violent suspect under control. The kick to the lower leg is a practice all officers are taught it is a distracting blow. The hair pulling can be used to control out of control suspects. Everything this officer did in this situation is against any policy and procedure in dealing with this situation. This cop would be thrown off my force in a heartbeat. If as a cop you can not take people talking shit to you find another job. Those 10 weeks of training teach you to use a level of force model that this officer violated. The best cops I know don’t have college and usually had some troubles in early life. Some of the worst cops are college educated know it alls, they just seem to have problems dealing with people that are in trouble. This guy is toast.

I’d rather hear him explain himself before rushing to any judgement. The girl should explain herself as well. If it turns out it was excessive, take action based on that, but at least give the man a chance to try to defend himself.

She didn’t even flick her shoes that high. I don’t get the impression she was trying to hit him. She was having a tantrum. Obviously, the cop who grabbed her by the hair, slammed her head into the floor, then punched her twice while she was already secure was having a tantrum as well.
So she was lippy. How many people have called cops pigs and not gotten the crap beat out of them? Are cops allowed to beat people, especially children, just because they say a few mean words?

I’d like a bit more info before making a judgement. On the one hand, she may have just been kicking the shoe out the door where the police wanted them, on the other hand she may have verbally threatened the officer and then kicked her shoe up high enough for a potentially painful strike… though it still seems like overkill since he could have just slammed the door shut.

Maybe I’m too much of a softie, but I’d say put him on leave pending an investigation. If he buckled under the stress of the job (this may have just been the final straw), get him some help and re-assess his suitability for the job.

Having worked as a Correctional Sergeant in California I can say that no, no we wouldn’t.

The only way you could treat a person like that was if they had a weapon. That office was acting as a 1 man SERT team.

I am sure the girl was talking a lot of smack, but he clearly crossed the line.

My gut reaction is usually to side with the cop, but definitely not in this case. She didn’t wing her shoe at him, she kicked it off her foot like the little brat she probably is.

Like Howcome said above, if a cop can’t take a little bit of crap from an uppity little spoiled brat, he shouldn’t be a cop.

If a cop can’t handle a rude, bitchy, teenage girl without going nuts, how’s he going to handle himself in more difficult situation. This guy should never have been given a badge or a gun. He gives a bad name other police officers who work hard to enforce the law without violating anyone’s rights or safety.

As to giving him a chance to defend himself, he needs to do it from the defendant’s side of court room. Hold him in a cell in the meantime.

The deputies know they’re on camera and at constant risk of prosecution, to include the ever-present frivolous and malicious law suits. That girl must have said some pretty infuriating things to get the both of those deputies that serious about taking her down and teaching her a lesson. Now, she’ll probably have her college AND drug habit paid for by the county, while the deputy watches his future go down the tubes.

She definitely kicked her shoe off in a way that would have set me off. Nowadays, charges of disrespecting a peace officer get snickered at and cops don’t get the cooperation they deserve. I’d be the last person to condone abuse of authority, but some kids need to learn some lessons. The earlier the better. I hope audio and eye-witness accounts prove that she was belligerent and violent. The alternative is troubling.

Fire him and put the bastard in jail. Cops should not be above the law; anyone else (I won’t say “civilian”, because cops ARE civilians) who did the same would be facing felony charges and there’s no reason he shouldn’t as well.

People who’s natural instinct is to forgive brutal, bullying behavior from the bad apples is why this sort of thing happens too frequently. If she had launched some kind of full scale attack on the police officer? Fine- do what’s necessary. Because she kicked off her shoe in his general direction and was lippy? No excuse.

I didn’t notice him lashing out against someone who tossed a shoe at him with quite a bit more power than this girl did to the deputy. Bush behaved with restraint but during the incident and in his comments thereafter.

I myself am a patrol sheriff’s deputy and that footage makes me ill. That guy should not be in law enforcement, IMO. Unfortunately, our profession attracts a few bad eggs and they occasionally slip through the cracks.

But, like others said, I was not there and don’t know the full story. If this cop is a bad egg and has worked in law enforcement any length of time, I would not be surprised if he has a few red flags from past incidents in his personnel file. If he does, they will bubble to the surface.

Its a simple case of a rude girl probably degrading the officers during their entire contact. Once she threw the shoes, she assaulted the officers and crossed the line.

I cant justify his actions, but I understand the frustration he probably had and he went over the line.

He should not be fired though, just suspended and punished.

A 15 yr old girl in a cell with 2 cops is toally defenseless. They must have outweighed her by at least 200 lbs. They should be charged with everything her attorney’s can come up with. I have raised 4 children, and it is never OK to hit a child for what they say.

You didn’t grow up with my sister obviously. We had an inviolate rule around my house for which we got our asses kicked if we disobeyed. Never hit a girl – PERIOD.

My sister was one of the meanest, ugliest, nastiest aggressive terrors I have ever known. She would kick me (her older brother), bite me, hit me – the list is endless. What she did to terrorize my younger siblings does not bear repeating.

The terror continued because she was given a carte blanc by my father who ruthlessly enforced the no hit girl rule. Finally, at age thirteen or fourteen, I informed her that ANY aggression would be met with more aggression until it stopped. I took my licks from my dad, but the terror eventually stopped.

To this day, she is a monster.

Look, when she kicked her shoe of at him she was probably just being an idiot. However, we don’t know her history and so maybe the police officer’s reaction, while extreme, was understandable as a use of overwhelming force before the situation escalated (which I am not as opposed to as some I think).

However, the two blows at the end… she seemed clearly neutralized as a threat. Just because she hadn’t stopped struggling at that point does not justify that level of violence. Police need to have good judgment, and he did not show good judgment there. He needs to be canned I think.

Just because I don’t side with criminals and liberal kneejerk opposition to law and order, does not mean I am unaware of the threat of police violence against even law abiding citizens.

Be respectful and there will be no reason for rage OR question. My guess is that the ‘lippy’ girl was pushing his buttons for a while and deserved what she got. He’ll probably get more punishment than he deserves and she’ll get much more compensation than she deserves. Even dropped charges alone would be more than she deserves.

By the way… I voted that he should be punished. I just think it’s counterproductive to show the public any example that will embolden the punks to entice brutality, like this girl did.

She is a 15 year old girl. A gun and a badge don’t give you the right to do what he did. Especially the hair pull take down. That was pathetic. Was she inappropriate? You bet? Is getting a show flipped at you life threatening? No.

She is a 15 year old girl. Normal restraint will do.

What did she learn from this? Nothing good.

The policeman should face justice. The facts and circumstances are not known by me, but I suspect they point to a severe verdict.

And I agree with others, I bet even a precursory investigation into this guys past will show he has issues relating to women.

If you’ve never been in law enforcement, don’t judge too hastily. Criminals are being released for “he was under stress”, “he’s a good boy but hung out with the wrong crowd” give ‘em the benefit of the doubt PC crapola. Is a police officer not allowed to be affected by anything? If any one of y’all can do better or find better people, go for it. Otherwise, get off of LE’s back.

I am glad some of these posters are not cops and working with me. When this idiot overreacts he brings his partners right along with him. I hope his partner in the video did not get creative in his report or he will be toast too. I learned first as an MP that people are going to talk smack no matter what. I’ve been called a racist, fat, ugly and every other word you can think of to put me down. I have never had an excessive force complaint against me and my partners have all been professionals. If I was the other officer I would be pissed at this idiot for the hell he is going to cause me.

Cop are no cop he assaulted an unarmed and restrained underage girl. The act of flipping her shoe at the officer while petulent and disrespectful is not justification for what happened to her and neither is any words she may have directed at Officer Paul Schane. This man is was an agent of the law, he should be held to higher standard not a lower one.

The test here is objective not subjective ie would a right minded individual have reacted the way this man punk did in a similar scenario.

I think if your answer to that question is yes or you think that this 15 year old girl got what she desreved you need to ask yourself some serious questions about what kind of individual you are and how your outlook on the role of the police force in your community has become so skewed

I’m in psych. I get things thrown at me a few times a week. Under no circumstances would we be allowed to behave like that, none.

The guy needs to go. The girl, hopefully, got a CT scan as being thrown to the floor and beaten can cause a lot of problems.

As I said before this nasty abusive man shoud have shut the door. And where was a female officer?

I imagine that most cops deal with this sort of thing on a near daily basis while maintaining a professional demeanor and not getting violent. I agree that this cop deserves jail time for felony assault, but let’s not paint all (or even most) cops with the same brush.

She most likely called them (much like the odd trolls on this thread) Things that can not be repeated or transcribe in anything but (expletive deleted) Cop are not Pig. They are the ones that run in when everyone else run out. They always should be respected, even when some are wrong. From what little this video shows this Officer did no wrong.

She did wrong by being in that situation of being lead into a jail cell.

I don’t care what she said or what she did prior to that point. At that time she was clearly no threat. At work I get called unprintable names every day, EVERY DAY, and I follow directions and protocol and do not assault my patients for it.

The guy violated plenty of rules and laws. Out he goes and maybe a little jail time will make him a lot less angry.

She kicked off her shoe, and not in a violent way- were it a roundhouse kick, you might have a point. As it is, a 200 pound coward cop beat up a 15 year old girl because she mouthed off.

The responses defending this guy by some of you make me question whether this officer represents only a small minority of police officers.

You think these kids are bad? You should start reading the papers in the UK on a daily basis and see the crap that happens there. Adults murdered continually with these kids getting very very short jail time or none at all.
