Hey, who’s up for renewing the assault weapons ban? Update: Not Pelosi

posted at 2:00 pm on February 26, 2009 by Allahpundit

Gotta give Eric Holder credit: His use of “just a few” here is simply a masterpiece of ominous rhetorical efficiency.

You can’t say you weren’t warned.

The Obama administration will seek to reinstate the assault weapons ban that expired in 2004 during the Bush administration, Attorney General Eric Holder said today.

“As President Obama indicated during the campaign, there are just a few gun-related changes that we would like to make, and among them would be to reinstitute the ban on the sale of assault weapons,” Holder told reporters…

Holder declined to offer any time frame for the reimplementation of the assault weapons ban, however.

“It’s something, as I said, that the president talked about during the campaign,” he said. “There are obviously a number of things that are — that have been taking up a substantial amount of his time, and so, I’m not sure exactly what the sequencing will be.”

Combine this with the fact that demand for guns has been booming for months and we should see the price of semi-automatics blow sky high. Any ban will have to survive two challenges: One, obviously, will be a goal-line stand by the Supreme Court’s conservative majority in applying the Heller decision, but count on smilin’ Anthony Kennedy to “find his conscience” and switch sides if it gets that far. The more serious obstacle is convincing a majority in the House to vote for it. An NRA spokesman tells the Standard he expects 60+ Blue Dogs — roughly the number endorsed by the group two years ago — to oppose a ban, but I think he’s kidding himself. It’s one thing to be pro-gun when there’s a Republican majority and no chance of the ban coming back; it’s another thing to do it when there’s a serious chance of passage and the prestige of a new president from your own party is riding on it. I’ll bet it passes — narrowly. Exit question: Will the Centrist Three in the Senate join with the GOP to filibuster? Specter’s pretty good on guns.

Update: Looks like I spoke way, way too soon. Clearly, Madam Speaker doesn’t think she has the votes.

Attorney General Eric Holder raised the prospect Wednesday that the administration would push to bring back the ban. But Pelosi (D-Calif.) indicated on Thursday that he never talked to her. The Speaker gave a flat “no” when asked if she had talked to administration officials about the ban.

“On that score, I think we need to enforce the laws we have right now,” Pelosi said at her weekly news conference. “I think it’s clear the Bush administration didn’t do that.”

Presumably they’ll revisit the issue after the midterms if they pick up a few more liberal seats in the House.

Examples please, Madam Undead.

Reporter: Can you give some examples, Madam Speaker?
Pelosi: Um, well, I thing it is evident that things did not work under Bush.
Reporter: So, just let me clarify. You are just talking out of your ass then?
Pelosi: I’m sorry, I’m late for a strongarming session.

Pelosi knows this is a hotbutton and will at least pay lip service, for now, to talking down the issue. She knows this will be one area where they could lose big just as in ‘94.

I do agree that an armed citizenry is necessary. At what point does it become needed? Do we have Americans who will actually use their firearms if the time comes? On that I’m not so sure.

catmman on February 26, 2009 at 2:26 PM

Now all we need to do is define what constitutes a “moron.”

First on the list is the ability to spell that which presumably would deny someone the right to vote.

“On that score, I think we need to enforce the laws we have right now,” Pelosi said at her weekly news conference. “I think it’s clear the Bush administration didn’t do that.”

On the one hand, you’ve got to hand it to her for the first part. That’s honest. But then blaming it on Bush is just more of the same ol’ bullshit. The gun laws haven’t been enforced with any rigor since forever. Clinton, in particular (’though not exclusively), was notorious for trying to pass new legislation because “the laws we’ve got just aren’t effective.” Never mind that enforcement was practically non-existent.

Someone did a study here in Maryland in the 90s and examined how the current laws were being enforced in this state. Basically, from bottom to top, nobody in enforcement, the DA’s office, or the courts did anything to actually apply the laws that existed. Obvious possession violators were not being arrested. Nor were they even being charged consistently; those who were being charged were not being convicted (charges were dropped in a vast majority of cases); and those convictions that actually did happen would end up in wrist slaps.

I don’t know if there was evidence for it, but it was claimed that the mandate had come down from Clinton’s Justice Department that the laws were not to be enforced. The obvious intent was so that they could go whining to Congress that tougher regulations and out-right bans were the only way to stem this “horrific problem”, because the laws we have “are so obviously ineffective.”

I hope that Obama pushes this one, and runs into a buzz-saw in Congress. I’m willing to bet that the Blue Dogs are going to have some spine on this one. It’s a pretty big deal for a lot of them. Of course, looking at how they folded in the House on Porkulus, I guess there’s no guarantee.

For every story of a kid killing a step-mother or Daddy’s girlfriend, there are fifty where a grandmother defended herself against a would-be rapist.

And any man who isn’t able and prepared to defend his family needs to grow a pair! You are the first line of defense for your wives and children. The police come by after it’s all over to write up a report and start the manhunt. They are almost never around to do any actual defensive work.

A shotgun, yes, if you are a very bad shot. Your best bet however remains the AR-15 for general-purpose social encounters.

pseudonominus on February 26, 2009 at 2:25 PM

As a 15 year veteran of the police department, I must disagree with you on this.
For home defense I always recommend a shotgun with bird shot! The reasons are simple:
1. Most home intruders are shot at very close range, inside of 6 feet. Bird shot will do a marvelous job of stopping the threat at that range.
2. If you miss, and believe me, when the threat level is maxed out, missing is the rule and not the exception, you won’t kill your children in the next room! Sheetrock will slow down the shot enough that it won’t cause death or serious injury in most cases!
3. It is point and shoot. No leveling, no aiming!
I do, however, agree that an AR or similar “assault rifle” is a MUST HAVE for anyone who is concerned about having to fight for what they believe is worth killing for!

Handguns were banned in England, and afterwards handgun crime increased. Handguns were banned in Washington DC, and afterwards handgun crime increased.

In some towns, ordinances were passed requiring firearms ownership by citizens. Crime decreased. Switzerland is one of the only countries that has remained uninvaded despite world wars. Reason? Firearms in every home, and a good deal of the populace ready to use them to repel invaders.

Gun ownership by law-abiding people deters crime. Banning ownership by law-abiding people does nothing but encourage law-breakers who didn’t follow the regular gun laws anyway.

MadisonConservative on February 26, 2009 at 2:33 PM

pseudonominus on February 26, 2009 at 2:25 PM

I disagree. A shotgun makes perfect sense within a house. Most defensive shots would be made at night with poor visibility, the rounds are more devastating at close ranges, and there is less fear of over-penetration.

An AR is more versatile though.

Remember, you are responsible for every round put down range; life or death situation or not.

Laws that forbid the carrying of arms… disarm only those who are neither inclined nor determined to commit crimes… Such laws make things worse for the assaulted and better for the assailants; they serve rather to encourage than to prevent homicides, for an unarmed man may be attacked with greater confidence than an armed man.

robblefarian on February 26, 2009 at 2:11 PM

In your case this is probably a good decision. I assume that you find it difficult to envision ever needing a firearm for any reason. You would, therefore have little inclination to properly learn about, and practice with, any firearm you might purchase.

But please, do not whine or moan about any predicament you may find yourself in a year or more from now. Please do not curse when your armed neighbor decides it is not in their best interest to provide you protection, and you discover that the authorities you were depending upon for your protection will either be responding to your call an hour later, or maybe not at all.

You have made an important decision, that you are obviously comfortable with, but you do have to admit that you, and you alone, are responsible for that decision. Good luck.

There is only one correct answer: AR-15

That is your one “must-have” if you are serious about defending yourself in the times ahead.

A pistol for immediate self-defense is the next must-have.

The third would be a rifle chambered for .308 or .30-06, for barrier penetration (cars). Your best bet here is an M1-A1, or a Garand, but these are weapons for specialized tasks.

A shotgun, yes, if you are a very bad shot. Your best bet however remains the AR-15 for general-purpose social encounters.

pseudonominus on February 26, 2009 at 2:25 PM

my first gun for home defense would be a 12 gauge shotgun…most of ‘encounters’ you are going to have are going to be at close range…and there is nothing more frightening than a shotgun at close range..the knock-down power, and the sheer intimidation of that bolt sliding home…is tough to beat.

buckshot is a powerful persuader.. and most of the time its going to be dark, and getting a good shot is tougher to come by…

Make no mistake, Senator Byrd doesn’t give a rat’s a** about Obama power grab against the people, just if he does it against the Senate.

I am not enough of a “nut” to be expert on this topic, but I ran into a fella last week that would take care of me if I brought the lower. He also spoke about reliability, machining, etc. till even my eyes glazed over. Lots of discussion on the boards, just wanted your opinion.
Thx upinak!

My God…you’re right. People are only a gun away from killing someone.

And to think that 1,000 years ago people weren’t being murdered, assaulted or robbed because they didn’t have a gun handy.

For actual combat of looters, government agents, etc I agree. However, for prowlers while our country is still stable? Shotgun has a lower chance of wall penetration, and you want to avoid that. Also has better stun capabilities.

How did that child get the gun? Probably unlocked form his dad’s room, right?

How did you sone get that can of detergent and why is he throwing it on you? Ahhh detergent, and household chemcials can make weapons too… but they scar more!

Ahh we are ready here in SW ND.
If there is a school shooting, every kid & 1/2 the teachers will be running to the parking lot for their guns!

Badger40 on February 26, 2009 at 2:35 PM

Sounds familiar. When I was in high school (early 80’s), guns were common in the windows of trucks in the school parking lot. I went to a large high school, too, 1,500 kids give or take. And there was never a single gun incident. We all carried pocket knives as well. Any would-be Columbine punks wouldn’t have gotten very far at my school.

flyfisher on February 26, 2009 at 2:40 PM

Kids kill themselves with pills mostly. As for that 11 yr old..I agree his father should NOT have bought him a gun considering he had issues with the gf. It shouldve been locked up too..like most people do.

This is where you are dumb. All States have laws about children who are under 16 and guns (including shot guns) that the parent in responsible for the guns.

Show me a link to this story!

Hm, another thousand comment thread? Guns are always the best rallying cry for conservatives. I would be astounded if Obama was actually dumb enough to go ahead with this asinine assualt weapons ban.

It will be Deja Vu (1994) all over again.

Equanim1ty found on February 26, 2009 at 2:39 PM

If Dad refused to teach his kids about the weapons kept in the house, that’s his own fault. Keeping them away from guns leads to disasters like the ones you’re talking about, which are actually extremely rare but highly played up by the media. Every month, the NRA puts out a magazine, a section of which is devoted to listing news stories of people defending themselves with firearms against assailants and criminals, and most of the time never even needing to fire the weapons. Read some of those and then ask again why people need firearms.

MadisonConservative on February 26, 2009 at 2:44 PM

Sorry to disagree with you but a .410 shotgun is much better for home defense less smoke and noise in an already confusing situation less recoil for smaller people and smaller ladies but all the kick of a 45 longcolt bullet and in bird shot it really is like the INTERNET “Just point and click.
