Democrats push to add voting House seat for DC

Now that they control both elective branches of government, Democrats have quietly pushed through one of their long-held goals, a voting seat for DC in the House of Representatives. In order to gain Republican support, they have drafted a bill that would also add another voting seat for Utah to maintain the partisan balance. However, as Hugh Hewitt points out, the method of adding two seats to the House fails Constitutional muster:
Debate opened Monday on a bill to give the 600,000 people of Washington D.C. a full vote in the House. A new Democratic president, Barack Obama, and heftier Democratic majorities in Congress have improved the prospects for the decades-long effort that would certainly ensure another Democrat lawmaker in Congress.
Democrats outnumber Republicans by some 4-to-1 in the capital.
In a bit of horsetrading to offset the Democratic pickup, the bill would award a fourth House seat to Republican-leaning Utah, which narrowly missed getting that extra seat after the 2000 national census. With the two new seats, the House would have 437 representatives.
But can the House add seats without a Constitutional amendment, and separate from a census?
Opponents argue that the constitutional amendment route is still the only legitimate way to go, pointing to Article I, Section 2 of the Constitution, which says members of the House should be chosen “by the people of the several states.” The District of Columbia, of course, is not a state.
On the other side, supporters cite language in the Constitution that gives Congress legislative authority over the District “in all cases whatsoever.” They contend that for 200 years federal courts have framed the District’s laws in terms of those that apply to the states.
Congress has authority over DC “in all cases whatsoever” — in managing the District. It does not have the unilateral authority to enlarge itself, especially at the expense of other states. Any addition of representatives to one or two states acts to dilute the voting power of the rest, which is why the Constitution ties representation to the Census. If Congress wants to change that calculation, it has to come through the amendment process and get the approval of three-quarters of the states.
Why don’t the Democrats simply push for a Constitutional amendment? They don’t have the votes, not in Congress and not in the states. They tried that thirty-one years ago, when Democrats had larger majorities in both chambers of Congress than they do now, and they couldn’t get enough states to approve it.
Hugh wonders who would have standing to haul Congress into court to challenge the constitutionality of this bill, which will almost surely sail through Congress and get signed by Barack Obama. I’d guess that one of the states would have to sue, claiming damage to its voting power in Congress with the addition of the two seats. Perhaps that challenge would come first from Texas, but I’d prefer that a few states jumped in together to make the point even more clear.

This type of blatant power grabbing is something that will eventually cause severe problems for the Democrats. The Republicans did the same thing, but with different issues, during the 90′s and for the first Bush term. We all know how that worked out.
Sadly I can see this getting through without to much trouble. The Democrats will say that the poor people of DC need a voice in Congress and if you don’t support it you are a racist. The guilt trip will come and the black caucus will chime in and everyone will fold like a cheap suit. What concerns me the most though is if they get a seat in the House than they will eventually get 2 seats in the Senate. All 3 of those seats will be a 100% lock for Democrats.

Frankly, if they get a voting seat for in the House, then why not treat the District as any other state and end the massive federal financing of the District? Let them turn it into just another Third World capital. Just establish boundaries for the Federal District along the Mall and into the adjoining streets, first. With a fence, and manned gates, too.
Then, watch the exodus…the District has no real tax base. Plenty of people, but no real tax base. Most receive, few give.

Yes, it is unconstitutional. DC was set up specifically to have a non-voting capital district. If the people who live there want representation other than congressional committee, they need to retrocede back to Maryland, like was done with the portion cut from Virginia.

As someone who lives near the area and presumably has more information on local issues than a tourist, let me say that they shouldn’t be taxed. Not like the tax base of the District matters all that much anyway…the District receives $5.55 in Federal largesse for every $1 it contributes in Federal taxes. The tax issue is a non starter.

This would never survive a chalenge in the SCOTUS. It is clearoly unconstitutional based on the original articles as well as the 23rd amendment…
And, it’s a nice over-reach that would, in some cases, be the straw that broke the camel’s back vis-a-vis the Democrats running roughshod over the constitution…
Congress has control over DC only in terms of administrative and funding issues. DC need to become a state if they’re so worried about representation…
I mean, it’s kind of like living next to an airport; everyone knew what the deal was when they moved there, and if they didn’t like it were free to go elswhere…

Ignoring the manifest constitutional defects with this bill, how would this work? Would a special election have to be held in Utah and the District? If so, would the new rep from Utah be at-large or would they have to redraw Utah’s districts, only to have to redraw them again in 2012?
If a special election weren’t held in the District, would the D.C. representative be Eleanor Holmes Norton (the non-voting delegate) or Mike Panetta (the shadow representative)?

Virginia didn’t play Native-American giver, I believe the reason Virginia took the land back is because President Washington owned a lot of real-estate in Virginia and they didn’t want any conflict of interest to appear.
Also, the portion of Virginia in the original District was across the Potomac in Alexandria (later renamed and now Arlington) and mostly unusable/agriculture land at the time. So the feds gave it back, Virginia didn’t take it.

I heard there was language in the ‘stimulus’ bill that granted DC statehood status for the fund distribution and there was speculation that would set the precedent to move towards not only House Reps but 2 Senators. When the constitutional amendment to give DC a rep was rejected decades ago, DC had a much larger population. The representation issue was much more important, and still it was rejected.

There were many reasons for the State of Virginia requesting the return of Alexandria County from the District of Columbia. And I do not argue with history as it was what it was. Though generally one refrains from gifting what can’t afford to be lost, in this case, Virginia gifted the USA a valuable states’ rights precedent.

So, what happens if Congress passes this? Utah gets a 4th seat. Now, when the DC rep is declared unconstitutional, does Utah get to keep it’s 4th seat? There ARE legitimate reasons for Utah to have gotten it, based on the 2000 census–some of those absentee voters, etc. So you can make a good argument Utah deserves the state anyway.
Would Utah get to keep it? Or would the Dems try to take the seat away? And if so, wouldn’t that start a revolution–”They are taking away your representation to suit them!”

DC is a federal property & the designation of the federal capital & not being an official part of a state remains what it is.
So at least the people living there were graciously given the right to vote for POTUS through the amendment.

If you are a DC resident & you want to be represented in Congress, then move somewhere else bcs you knew this going into it.
