Illegal aliens awarded $78,000 in damages against Arizona rancher who held them at gunpoint

Remember this? The verdict’s in and the vicious comments at the Chronicle’s website have already begun: “He should have just shot them and buried them on his ranch. Shoot, shovel, and shutup. Who’s gonna report them missing?” A fitting sentiment on the day Ramos and Compean were sprung given their own attempt to cover up their crime.

That said, how can a guy be liable for holding potentially dangerous trespassers on his property at gunpoint until the cops come?

A federal jury found Tuesday that a southern Arizona rancher didn’t violate the civil rights of a group of illegal immigrants who claimed that he detained them at gunpoint in 2004.

The eight-member civil jury also found Roger Barnett wasn’t liable on claims of battery and false imprisonment.

But the jury did find him liable on four claims of assault and four claims of infliction of emotional distress and ordered Barnett to pay $77,804 in damages — $60,000 of which were punitive.

Barnett declined to comment afterward, but one of his attorneys, David Hardy, said the plaintiffs lost on the bulk of their claims and that Barnett has a good basis for appeal on the two counts on which he lost.

I’m at a loss. All I can figure is that he somehow went above and beyond simply holding them. There was a dog involved. Maybe he gave them the Abu Ghraib treatment? The tort of assault typically involves fear of bodily harm while infliction of emotional distress turns on “outrageous conduct”; threatening to have a snarling pitbull tear their arms off would arguably qualify on both counts, if in fact something like that happened, but is that really any worse than pointing a gun at them? Enlighten me, ambulance chasers.

I remember reading about this story just a week ago and part of the story was the garbage that the illegals dump on his land (and others). I believe the story said it is 10 inches thick with dirty diapers, clothes, wrappers off the drugs that the illegals take to keep them wired to run, etc etc.
The companies, individuals that support illegals should be forced to do garbage detail on his(others)properties for 6 months. They won’t support another illegal alien after they are done.And the judge should be the first one forced to help.

Its always a fine line with cases like these and its simply a matter of what type of persons are making the call against you. Castle Doctrine here in Florida too, the thing is if that happened here it would be safer (w.r.t. potential penalties) to shoot the perp and claim you were in fear of your life than to hold him until the cops show up and allow the cascade of lawsuits that follow.

I live on the Mexican border in Texas and have been listening to this garbage about Illegals having all these rights ever since the two Border Patrolmen, Ramos and Campean were indicted. They of course “broke the law”, and “had no business shooting an unarmed man”, even if the idiot was an illegal alien, drug smuggler. Yeah right, gimme a break! If they are illegal aliens they are breaking the law!! He was permitted to do whatever was REASONABLY necessary under the circumstances to detain them until authorities could be summoned. Any abuse above and beyond that which is reasonably necessary would expose him to tort liability. Basically, he had a right to detain them, but not be an a$$hole while doing it…

First of all, the judge who allowed this to come to court should be thrown out of office immediately. However our legal system is thoroughly corrupt. There was a case in colorado where an ex judge and his lawyer wife sued a guy to take his property because the judge and his wife were trespassing on it. Ended up costing the rightful property owner a half mill to defend.. AND the idiots in boulder did not throw the dirtball judge off the bench(Not the land grabber, the judge who presided)

Appealing this could well cost Barnett more than the 78K in damages. He loses either way, and if he doesn’t appeal, the precedent is ugly. Illegals will be coming in looking for grounds for litigation instead of jobs.

I notice the illegals have now applied for visas, a three plus year exercise in futility. Applications will likely be denied with a history of illegal entry. But it makes them look better in court. The whole thing stinks.

By the time Reid and Pelosi get around to the border issue, I fear the Shamnesty bill will look good.

Barnett should have countersued for infliction of emotional distress…which is what residents in that area likely feel with crowds of illegals running through their properties like locusts.

A friend of mine lives on a ranch in southern Arizona. One night with her husband out of town and pregnant with her first child she hears a noise downstairs. Figuring no one would have reason to be in her house at 2 a.m. she heads downstairs with a Remington 870 and sees three illegals rummaging through her pantry and refrigerator.

So she screams at them at the top of her lungs and starts waving the shotgun around, then gets them to kneel and face the wall with their hands on their heads. Calls up the sheriff and he takes them away. That’s the last she heard of them and hasn’t had an incident since.

You want to stop things like this? Put the fear of God into the lawbreakers.

This will probably get overturned at Appeals but its sickening that the courts ever allowed this case into the court in the first place.

Is anyone here familiar with the testimony? “Maybe” this guy actually assaulted the illegals? I was more concerned with the civil rights part of this case. As far as I can tell, he can still detain these people, just don’t assault them

MEChA and La Raza find it offensive and a violation of THEIR rights, that the U.S. dared to have immigration laws to begin with. They also believe that a lots of the current American territory rightfully belongs to Mexico. These radical basted are the ones that need to be stop. I have nothing against Hispanic. I fought side by side with with Hispanic men who to this day I consider very good friends. But living in Texas, the southern part of this state is gone, Totally! There doing exactly what the frickin tow-heads are doing to Europe, there breeding everyone out! There thinking is to get this state without firing a damn shot? Perhaps there should be a class action suit consisting of all ranchers and property owners on the border against Mexico……. sure, that won’t fly, but an illegal alien has more rights than American citizens. This is a bad decision. Civil rights or not, the ranchers civil rights were violated by their invasion. We all need to stop calling it illegal imigration and start calling it INVASION, perhaps that would cast a different tone to the situation.

I still think he needs to post no trespass signs in 3 languages English, Spanish and Democrat and then start shooting if his property rights are violated.

We should all refer to the illegals coming from Mexico as español invasores (spanish invaders) and mark it as terrorist activity. If you refer to Al-Qaeda it strikes fear in our hearts, we just all need to start referring to these folks as español invasores to change the mindset.

Not surprised an Arizona jury went this way. The pity factor for the illegals swayed them. They felt they had to give these people some award.
My wife grew up in Douglas. In the late 1970′s the high school track team would run during practice along the border to a point where they would pick up backpacks full of marijuana.
The entire student body knew about it, no one was ever busted.
Her uncle was murdered on his ranch just outside Douglas in Double Adobe in 1986. The accused murderer faced trial but was aquitted. He was a California parolee traveling back and forth over the crossing in Douglas.
He strong armed the uncle trying to get a ride to Tucson. No one knows why he resorted to killing the man.

Vicious, or realistic? The commenters are merely pointing out that with no witness, there can be no prosecution. There is a ridiculous idea out there that illegal aliens have rights, and this must be disabused. The more lawsuits like this occur, and the more the government resists protecting its citizens, the more likely border residents are to take matters into their own hands, and the more fatalities there will be.

Deport them, same daym, after DNA and Finger Prints and mug shots…

If they return again, jail them, then deport again…

Arm our borders, no rights for illegals needs to be the call to action…

I live here is southern arizona, the county Mr. Barnett lives in and ranches. Here is the link to our local paper, read the comments. ILLEGALS not WELCOME. This is also a violation of Mr. Barnett’s right. The Arizona statute states an illegal cannot receive punitive damages in the Arizona court system. This should get overturned and he should not have to pay a dime.

The slippery slope began when criminal aliens were accorded the right to sue in a US court. Had they simply been picked up and deported, this could never have happened. Instead, we have a combination of silly politicians, lawyers and jurors conspiring to penalize a citizen land owner for protecting himself – when there is no mention of any real damage being done to the non-citizen criminals. And how could the rancher ever recover his time and court costs, even if he wins on (expensive) appeal? You don’t believe the criminal aliens actually paid for legal representation, do you? Gah!

Armed Mexican soldiers (or people dressed as such) accompany drug runners across our border down here (Cochise County, AZ). It’s common knowledge and witnessed by land owners. Last time I checked this is an act of war. Nothing happens. Until enough intestinal fortitude is mustered to stop these armed invasions, no one is going to take illegals seriously.

It’s time to annex Mexico, carve it up into several states and use their natural resources to benefit all. In the long run the Mexicans will thank us while La Ratza and other scum will cease to exist.
