Illegal aliens awarded $78,000 in damages against Arizona rancher who held them at gunpoint

Remember this? The verdict’s in and the vicious comments at the Chronicle’s website have already begun: “He should have just shot them and buried them on his ranch. Shoot, shovel, and shutup. Who’s gonna report them missing?” A fitting sentiment on the day Ramos and Compean were sprung given their own attempt to cover up their crime.

That said, how can a guy be liable for holding potentially dangerous trespassers on his property at gunpoint until the cops come?

A federal jury found Tuesday that a southern Arizona rancher didn’t violate the civil rights of a group of illegal immigrants who claimed that he detained them at gunpoint in 2004.

The eight-member civil jury also found Roger Barnett wasn’t liable on claims of battery and false imprisonment.

But the jury did find him liable on four claims of assault and four claims of infliction of emotional distress and ordered Barnett to pay $77,804 in damages — $60,000 of which were punitive.

Barnett declined to comment afterward, but one of his attorneys, David Hardy, said the plaintiffs lost on the bulk of their claims and that Barnett has a good basis for appeal on the two counts on which he lost.

I’m at a loss. All I can figure is that he somehow went above and beyond simply holding them. There was a dog involved. Maybe he gave them the Abu Ghraib treatment? The tort of assault typically involves fear of bodily harm while infliction of emotional distress turns on “outrageous conduct”; threatening to have a snarling pitbull tear their arms off would arguably qualify on both counts, if in fact something like that happened, but is that really any worse than pointing a gun at them? Enlighten me, ambulance chasers.

Unless one of parties was injured directly due to the actions of the landowner or the dog under his direction (and unless the jury has completely lost it, pyscological issues should have been tossed) this thing should have been laughed out of court. The non-punitive pieces were only 17.8k so that was what a hang nail at the emergency room…

Reminds me of a CA lawsuit where two burglers break into the same house and one stabs the other one. The injured party sues the home owner for damages and wins. Gota love our legal system.

This is no big victory for Mexican American Legal Defense and Educational Fund. There were originally 16 plaintiffs, only 6 at the trial.

If the jury gave damages to only 4 plaintiffs, it is $ 4,451 of actual damages and $ 15,000 punitive damages for each of the 4 plaintiffs.

So what did Mr. Barnett do beyond lawfully holding the illegals for the Border Patrol to be found liable for assault and intentional infliction of emotional distress?

The trial judge probably gave the proper instructions to the jury, so it is unlikely that the trial judge will overturn or reduce the jury verdicts. It is even more unlikely that the 9th Circuit will overturn these verdicts.

Another downer for Mexican American Legal Defense and Educational Fund and Mr. Barnett is that since all the claims are tort claims, neither MALDEF or Mr. Barnett will get attorneys fees from the other side.

Since it is not an overwhelming plaintiff victory, the trial judge may order each side to pay their own court costs.

Hopefully, Mr. Barnett was defended by lawyers paid for by his homeowners insurance carrier and the insurance company will pay the money damages.

I’m pretty sure his ranch was in the Sierra Vista area which is about 45min to and hour from Tucson..so no..he was judged by Tucson residents..and you’re right..rural folks who live along the border think a lot differently then the regular Tucson population. And Tucson has a very heavy democratic open-border base. Disgrace.

No kidding! I could’ve been one of them! Yeah, I was thinking the same thing earlier..if only the trial was being held up here in Phoenix..he would’ve had a better chance. Even though Phoenix has a heavy hispanic population, they don’t like the illegal problem and tend to be more outspoken about it than the Ariz hispanics further south.

If there’s one constitutional amendment that we need, it is this:

Nobody may sue anyone for injuries, whether physical, emotional, or psychological, that were recieved while committing a crime.

Or this one:

In any lawsuit case, the loser must pay the other side’s legal fees.

These two would get rid of a bunch of frivolous or morally wrong lawsuits, freeing up the judicial system’s time for real cases.

Many of us Arizonans that voted for McCain in the election knew full well his position on amnesty. The fact of the matter is that those illegals that have settled in the state are here to stay. We all know it. Amnesty is just going to put a legal face on already drained resources, already escalating crime, already escalating cultural conflicts.

What has to happen is the borders MUST BE SECURED. That is what has to take place. We can’t do much about what’s already happened, but we can stop it from continuing to bleed through.

Amnesty is a given, regardless of party lines. For them it’s about votes.

Look, I am all for this guy prtecting his property and holding ilegals until the Polezei arrive. That said, if this dude did indeed kick the women that were not resisting, as was alleged, he deserves to have his wallet raided a little bit. He is lucky he isnt charged with a felony and doing jail time.

If I snuck across the border into a foreign country and trespassed on someone else’s land, despite a ton of posted signs warning me not to do so, I would consider myself extremely lucky if all the guy did was kick me. And I certainly don’t think there would be some sort of “Ugly American Defense Fund” to file a lawsuit for me in that foreign country.
