Illegal aliens awarded $78,000 in damages against Arizona rancher who held them at gunpoint

Remember this? The verdict’s in and the vicious comments at the Chronicle’s website have already begun: “He should have just shot them and buried them on his ranch. Shoot, shovel, and shutup. Who’s gonna report them missing?” A fitting sentiment on the day Ramos and Compean were sprung given their own attempt to cover up their crime.
That said, how can a guy be liable for holding potentially dangerous trespassers on his property at gunpoint until the cops come?
A federal jury found Tuesday that a southern Arizona rancher didn’t violate the civil rights of a group of illegal immigrants who claimed that he detained them at gunpoint in 2004.
The eight-member civil jury also found Roger Barnett wasn’t liable on claims of battery and false imprisonment.
But the jury did find him liable on four claims of assault and four claims of infliction of emotional distress and ordered Barnett to pay $77,804 in damages — $60,000 of which were punitive.
Barnett declined to comment afterward, but one of his attorneys, David Hardy, said the plaintiffs lost on the bulk of their claims and that Barnett has a good basis for appeal on the two counts on which he lost.
I’m at a loss. All I can figure is that he somehow went above and beyond simply holding them. There was a dog involved. Maybe he gave them the Abu Ghraib treatment? The tort of assault typically involves fear of bodily harm while infliction of emotional distress turns on “outrageous conduct”; threatening to have a snarling pitbull tear their arms off would arguably qualify on both counts, if in fact something like that happened, but is that really any worse than pointing a gun at them? Enlighten me, ambulance chasers.

I’m as red meat as they come, but that thought had occurred to me earlier.
But it seemed this guy had a pretty impressive record of turning in illegals. Maybe he just finally had too much?
Nonetheless, the thought of punitive damages being awarded to illegals in this case is just too much for me to really bear at the moment.
Maybe we ARE screwed.

I assert the judge who decided this would not have any trouble at all defending HIS property, but it is definate he has a problem with others defending theirs.

Anytime you bring a weapon into play, you are automatically bringing the fear of death, so the notion that something else must have been done to make it abusive is ridiculous.
If that was the case, how come there haven’t been any CRIMINAL charges filed?
No, this was an end-around valid US property rights and goes against basic commmon sense.
Just because a judge decides it doesn’t make it right or even lawful.

Well, at least he still has his ranch…. A year or so ago some guy in borderland Texas that did the same thing lost his entire large ranch when the whole shebang was awarded to the Illegals he stopped and held at gunpoint for the border patrol.
In related news, they had to close three Points of Entry on the border today due to violence. (sorry, I can’t find the link now)

A couple of days ago I spoke with a former border patrol agent and he told me lots of horror stories about what illegals do to AMERICAN CITIZEN’S property including the illegals pooping on people’s property. Gives new meaning to having the s#$t scared out of them.

First off, non legal US residents should NOT have access to US civil courts.
Secondly, those who aren’t legal US residents should NOT have, uh, CONSTITUTIONAL rights…
Try to cross any other country’s border (including Mexico, btw) illegally and you are likely to get SHOT.

But that’s not what happened. THEY trespassed onto his property. He had no way of knowing what their intent was, and could probably make a claim of assault himself. Living in AZ, I know these ranchers in the south go through hell with the illegals. Trashing the land, harming the livestock, building the brush ‘resting’ huts on private land, trying to access barns and, in some cases, knocking on the doors of the home.
Ranchers afraid to leave their women alone don’t go into town unless they take the women with them or leave someone home to guard them. There are many stories of women working in their ranch kitchens and looking up to see a strange man looking at them through the window.
One rancher talks about losing his favorite pastime of sitting on his front porch at dawn because what he thought were piles of trash on his land were actually bodies of illegals murdered by the coyotes who transport them, or by other illegals.
And let’s not even have the discssion about the threat to public health that illegal immigration poses….
But this rancher is somehow guilty…….of protecting his own land, and probably his family. Up is down.

Old Roger Barnett (the rancher) dropped the ball from his end, got in trouble for previous altercations with the “nomadic wanderers” and had every open border freak in Arizona watching his every move, just waiting for something to happen again. IMO he should have feared for his life and whacked them then tossed a dusted throw away gun into the mess and claimed they pointed it at him and he had to shoot first, no witness, no crime, border justice. There is almost no enforcement down there, BP is overwhelmed and the mojados walk across like it’s a day trip, some even go back and forth weekly. When I lived in Nogales I would see twenty to fifty fence jumpers a day, calling BP would get the same response “we’ll get’em further in” and it’s one big joke. That wall should be up and armed guards manning towers to prevent this crap from continuing or soon it will be too late.

What percentage of the cases you read in school were overturned at the appellate level? Pretty high percent, wouldn’t you say?

IIED usually requires an extremely high bar to allow damages–not just conduct which would make a typical member of the community shout, “Outrageous!” but in common law, also requires some physical manifestation of the distress claimed; merely alleging that one was frightened or couldn’t sleep or was stressed is not enough–you need physical symptoms.

If the case was taken on contingency, the attorney will get 30-40% of damages, plus fees, and take his expenses and court costs out of the award, too.
