New California pump rules squeeze small station owners out

When government tries to convince people that their latest regulations won’t be any problem at all, keep this story in mind.  California will force gas stations to replace all of their pumps in favor of newer models that marginally improve the capture of gas vapor at the nozzle.  The improvements will cost tens of thousands of dollars per station, and that may force hundreds of independents out of business:

Dozens, and potentially hundreds, of gas stations around California are choosing to shut down rather than comply with a state mandate that would require owners to purchase new equipment to reduce vapor emissions at the pump.

The requirement, known as Phase II in the state’s Enhanced Vapor Recovery Program, is set to go into effect in April. It requires gas station owners to individually purchase tens of thousands of dollars of equipment designed to prevent harmful vapors from escaping into the air when gasoline is pumped.

But smaller retailers say that the requirement puts an unfair burden on businesses that don’t sell enough gasoline to offset the extra cost – and that don’t contribute much to the problem in the  first place.

California says they’re overreacting.  Why, all they need to do is increase the price of gasoline:

“We do calculate the cost of compliance with the regulation as related to emissions,” Stanich said. “These costs could be recovered by raising gasoline prices by an average 0.68 cents per gallon.”

Well … that’s for the large chains.  For the others?

Lower-volume sellers would have to raise prices more to offset costs, he added.

Got that?  The big retailers can afford the required pumps because they only have to raise the cost of gasoline less than a cent a gallon.  However, smaller retailers will have to increase their prices more, making them less competitive and forcing them to lose business.  And what will that gain California?

April’s regulations promise to cut what are known as reactive organic gas emissions by 7 tons per day statewide, but opponents point to the fact that California produces 2,322 tons of such gases per day.

In other words, California will put dozens and perhaps hundreds of smaller retailers in order to reduce 0.0030146425495262704565030146425495 of the daily emissions in California.  Jobs will be lost, tax revenues reduced, and consumer choice restricted, and California thinks that’s worth a 0.3% reduction in organic gas vapor.  (via Instapundit and Autobloggreen)

Just add this to Osama Obama’s plan to let states set their own emissions/fuel economy standards for automobiles.

No Californian will be able to afford a new car anyway, and would have fewer choices when some manufacturers decide to leave the state rather than pony up for different emissions controls, so the loss of a few (few hundred) stations won’t mean anything.

A few thousand jobs here, a few thousand jobs there…pretty soon you’re talking about real people.

This is not the first time CA has enacted legislation of this sort. I’ve lived in the San Joaquin Valley for 28 years, and approximately every 5 years the state forces Gas stations to remove and update their pumps and tanks. Each time, several small independant gas stations close their doors. Damnedest thing is, the CA state government can’t figure out why residents are fleeing the state in record numbers.

My business partner’s wife is still working in California, as she has (1) year left on her contract before she can move without losing out on some important benefits. She had to file in California, and she was just issued an IOU for 1,800 dollars that they were really counting on.

I can tell you from first hand experience (lived in So. Cal for 30 years), there are loads of fabulous people in California! The scale tipped some years ago with illegals and foreigners who actually believe that voting Democrat means you believe in Democracy… I kid you not! The people’s vote has been compromised, as the rest of the country has witnessed. The Government in California is run by radical Liberals; Pelosi, Boxer, & Feinstein rule the nest. Unions own the politicians, therefore it doesn’t matter what the outcome of a vote is, they just send it to the courts where elections are deemed unconstitutional or some damn thing.

Many great people live in California, and many great people have left California in order to keep their sanity. That being said, the country should boycott California (including Hollywood) in order to force these dynamics to change. The old saying, follow the money.. In this case, shrinking the size of tourism will be the last nail in the coffin for the corruption and thuggery that rules this state. Unfortunately, what happens in California usually finds it’s way to our doors in time.

And FYI i always gas up at Valero because it’s American and even though it is always several cents more. I am willing to pay a little more to support the little guy.
Most people won’t cross the street for 3 cents diff.

California killed off many independent dealers when they mandated double-walled storage tanks. The tanks were needed because the state-mandated oxygenate, MTBE, was contaminating the ground water — just like many opponents of the additive said it would. The tanks didn’t stop the contamination, but it killed many small businesses that couldn’t afford to dig up their old tank, replace it with a more expensive one, and suspend doing business in the interim. I guess Sacramento is back to finish the job now.

They did the same thing a few years back with mandating double walled storage tanks. The replacement cost was something like $10,000 back when it happened. It put a lot of little guys our of business then. So, here comes the second round. If I’m not mistaken,, Hillary said at the time while Bill was President,, the government could not be responsible for business’s that failed because they did not keep enough cash on hand.

Lets see at $10,000 per pump. 2¢ per gallon would require selling 500,000 gallons per pump to break even.

Of course independent stations are only making a few cents a gallon as it is. So I can see how it will put many out of business.

I have to wonder about those numbers.

.68 cents a Gallon and $35K to upgrade? Even ignoring the cost of capital, that looks like it would require over 5 MILLION gallons of gas to amortize it at that rate. This also ignores any extra maintance or operating costs for the more complicated systems.

Give the pumps a 20 year expected life( pure guess probably too large given that the regs can change again and Fuel cells or electric or something else could come along in that time) and it looks like you need to be selling about 700 Gal/day. Or, based on the sign in the article, about $424K of annual sales.

Not entirely fair since the average existing pump would need to be replaced in about 10 years anyway if the lifespan is 20. But that is offset by the fact that The total paid for the pump, assuming a modest 4.5% cost of funds, is over $53K rather than $35K. Unless that part was included in the price quoted in the article.

……. by the way, the State mandated MTBE was found to cause cancer, found it’s way into our water system, and the refineries had to be “re-tooled” to change the “formula” in the gas, which was also mandated by the state, which is why California has the highest gas prices of the nation.

And thanks to the labor and teacher’s unions who receive roughly half of the entire state budget…………

…………… liberal Democrats will continue this folly until the entire system collapses.

I’m in CA and the gas station on the corner that I fuel at recently “upgraded”. Twice now, the pump nozzle has ejected itself from the filler, landing on the ground and spilling fuel everywhere.

Now instead of washing my windshield as I used to while the fuel pumps, I have to stand there with my hand on the nozzle to keep it from flying out.

So all that gas on the ground that evaporated into the atmosphere aided the environment? Glad to do my part…

There was much wailing and gnashing of teeth by the station owners “OMG the apocalypse is upon us no one can afford this GAME OVER MAN!” but in the end they got the new pumps and nothing happened. Total non-event

Of course that was back when the countries economy wasn’t swirling the bowl…and this is California we’re talking about…so uhh yeah just ignore everything I just said

They are working on a way to tax per dairy cow, beef cow or pig over a certain number per ranch.

The major chains are about 10 cents a gallon higher than the independents with the exception of Arco. The thing is all the gas comes from the same refineries. The main reason our gas is a little higher than the national average is taxes.

I lived in Ca when they passed the regulations regarding emissions, and requiring new tanks, and monitors for all stations, and to be done quickly…the gas companies “fought” the environmentalists, and they were saying how resistant the oil companies were…then was found out the oil companies were subsidizing some of the environmental groups and their studies…It seems the oil companies had found a way of getting rid of most of the franchises by putting this huge gov. program on their shoulders, so the oil companies took the independent franchises back.
The environmentalists were played like a fiddle, they were so happy they “pulled one over” on the oil companies…and the oil companies were more then happy to comply, they just raised the prices, and they got all those money making franchises back as company stores.
The little guy, taken for a ride…looks like they are coming back for the real independents, and of course the “green” liberals have taken the cheese, the rats that they are.

Study the situation, before you make an idiotic statement like that. The rural areas of California are the ones that are going to suffer.

My Uncle Market has 6 pumps to retrofit. The diesel is exempt. The cost to retro-fit this station is $104,000. He pumps 15,000 gallons per month. So even if he can get the 3 cents per gallon, that is $450 per month. OK, fine. How much do you think this will cost extra per month to pay for? He serves a small rural town in California and has applied for a waver as he is the only station left in that town. The state denied the first application. The appeal is pending. If his appeal is denied, he is going to shut down his pumps. The next fuel is 34 miles down the road.

Now that seems harsh, but he is 66 years old and he probably will be retiring soon. If the business cannot be sold, he probably will shut it down also. But what is he suppose to do meantime? Take 104,000 out of his retirement savings? Pay a couple of thousand dollars per month to finance it? Are you a small business that has tried to get a loan lately and a decent interest rate?

Liberals, who say they are for the “small guy”, end up putting him out of business with regulation. Regulation that the major’s are lobbying for.

The Florida law just put vapor recovery on the nozzles, something the Peoples Republic of California has had for 30 years. The current regulations go way beyond anything anyone has in the country, and the world for that matter.

Small town station forced to close–low volume wouldn’t justify buying new equipment.
Small town folks forced to buy gas in other towns.
That means more driving.

Why do they hate us?

This is a good question. Actually, I have a theory that applies neatly to nearly everything they want to do (or at least their more leftist elements): They want to kill us.

All of us, not just small businesses.

They think we – Americans – are evil, for any number of reasons (including taking up room on the earth), and guilty, and need to do penance. They want to kill us.

Try it – apply that to every single thing they ever do, which is always punishing. Whether it’s what happens here, or what terrorists might do to us, you name it – it’s always our fault, and we need to die, or at least suffer for our guilt.

Then they will feel lots better.
