Gitmo trials halted by Obama order

Barack Obama didn’t take long to make an impact on the issue of Guantanamo Bay.  Within hours of assuming office, President Obama issued an order suspending all military tribunals for 120 days.  Today’s hearing for Khalid Sheikh Mohammed was among those delayed until May 20th, while Obama decides what to do:

In one of his first acts in office President Obama has ordered the U.S. government to suspend prosecutions of prisoners at Guantanamo Bay for 120 days, military officials said Tuesday.

Papers filed at the U.S. prison camp said the request is made “in the interest of justice and at the direction of the president of the United States.” It seeks a delay in proceedings until May 20.

“The judges will receive the requests and review them, and we anticipate a ruling soon,” said Cmdr. Jeffrey Gordon, a Defense Department spokesman.

Tuesday’s directive was issued verbally through Defense Secretary Bob Gates, according to a military official.

Obama had vowed to close the naval prison at the U.S. base. While Obama’s order does not go that far, it will stop the prosecutions of 21 detainees currently facing war crimes charges.

Recall that the military tribunal process has twice passed Congress as the preferred manner of dealing with these terrorists.  Barack Obama opposed it as a Senator, but it received bipartisan support on both occasions.  In the second and current version, the process includes the right to appeal through the regular federal appellate courts.

In this case, justice delayed is not much of a change at all.  Did Obama not have an idea of how to proceed when he took office?  A four-month delay only means that the detainees will have to wait that much longer to see any adjudication of their status.  Why not allow the tribunals to proceed, at least to get a finding of fact from them?  If Obama wants to invalidate the process later, he can also invalidate their findings.  It’s difficult to see what Obama expects to get from a further delay, especially since one of the main complaints about Gitmo has been the length of time the men have been held without adjudication.

The delay would only be meaningful if Obama intended to free all of the Gitmo prisoners, something that the ACLU has urged.  Somehow, I don’t think Barack Obama would be that foolish.  It would be tough to win re-election as the man who set Khalid Sheikh Mohammed and the other 9/11 actors free simply to win favor from Europe’s elite.

In the end, Gitmo really is two problems: location and process.  If the process gets changed, then there’s no reason to change location.  If the location was all that was at issue, then the process doesn’t matter.  These terrorists have to remain detained to keep Americans from getting killed, especially KSM and the 9/11 plotters.  Their guilt is not in doubt, nor is the danger they represent.

The article you quoted goes on to say that the reason for halting of the trials is that Obama and the civil liberties community was not happy with the trials process and that before they can proceed he and his team are going to review all the evidence in all of the cases and make a determinatoin. Are you claiming he had all that information before he was President? I highly doubt. Oh and I’m going to start keeping track of the number of stories on Hot Air that are original rather than based on some other news agency. If the MSM ever really went away, what would this blog do?

It does? I don’t see that. I thought the problem was supposed to be that we shouldn’t be holding them without charging them. And once they’re charged, they should be afforded trials. I don’t see Obama’s reasoning being detailed. And what I see from the “civil liberties community” is this:

Dakwar said the ACLU believes all charges against the prisoners should be dropped.

“A shutdown of this discredited system is warranted,” he said.

I don’t believe that (or don’t want to). I think he’s using the four months to figure out (based on each case’s evidence) to which country he can send each defendant to receive a fair trial or fair treatment. Then he could come back to the American people and say We don’t need Gitmo, these countries have agreed to take the prisoners.

I agree that Obama seems to be stalling for no apparent reason, and to let KSM go would be catastrophic to his presidency in its infancy (something that will not happen) and I also agree with Ed that the location should not be an issue, but rather the process, but I must ask one question.

In the motion filed for the Sept. 11 case, U.S. military prosecutor Clay Trivett says a continuance is necessary in all pending cases because the review may result in significant changes to the system.

“The interests of justice served by granting the requested continuance outweigh the interests of both the public and the accused in a prompt trial,” Trivett wrote.

The motion was written at the direction of the president and Defense Secretary Robert Gates, he said.

“It will permit the newly inaugurated president and his administration to undertake a thorough review of both the pending cases and the military commissions process generally,” he added.

Seems reasonable.

This is a bell weather announcement, I think it is more telling then indicated.
This vote is in essence just another “present” vote…it just delays him making a decision, so it fits.
He is trying to find a way to have it both ways, but I think he will find out that he actually does have to make a decision and stick with it.
For years he has been able to survive by not taking a “firm” stand, where his votes have largely been diluted by debate, time, and importance.

It’s difficult to see what Obama expects to get from a further delay,

He is looking for an “out”, something that will take this off his desk and onto someone else’s.
This is the first of many “damned if you do, damned if you don’t” scenarios that he will face.
If he continues, he breaks a major promise with the liberals, and if he releases them or gives them wiggle room, it will haunt him to the end of his term.
The scary part, is this is basically a minor decision, the process was already resolved…the terrorists are now his responsibility, a major mistake for him so early.
If he was smart he would have just let it take it’s course and anything wrong blame it on George…

At least he’s following the trail that the Nuremberg trials made. Although many convicted at Nuremberg Nazis should have been rewarded with a bullet to the head for their service to their glorious leader, they were actually released after a few years with the admonishment not to kill any more Jews and a pat on the head.

Clearly, we did. Because that doesn’t appear in the article Ed quoted, though you took him to task for missing what was not there. That said, you’re quoting from this article and before the portion you quoted, it says this:

“It has the practical effect of stopping the process, probably forever,” said Navy Lt. Cmdr. William Kuebler, Khadr’s defense lawyer.

Does that seem reasonable? And then what do we do with them? Keep them forever without charges, or let them all go? Without trials, those are the only options (aside from executing them).

The thing is, these folk are not mere common criminals. They use violence, directed at civilians, to achieve political ends, without benefit of state or acting as a military (uniforms, chain of command).

They should not get regular criminal trials. Our soldiers are not cops, they don’t go through the niceties of Miranda, chain of custody for evidence, etc.

Sure, review each case to make sure that someone wasn’t innocent but just got swept up. The ones who are genuine terrorists, treat them the way pirates used to be treated (and they were merely criminals, going for profit not politics) and hang them.

Maybe Mr. President thinks he’s going to use his “smart power” to negotiate a settlement with the Terrorist Factions. This settlement could include placing the prisoiners in the custody of a another country who would either put them on trial or release them to their country of origin. That way he could say that he negotiated in good faith and those other countries let us down. Either that, or he’s just voting “present”.

This is exactly what he’s planning. He just can’t say that or even explain how he would go about it because it will be a complex deal and involve concessions. He’s going to use his multi-religious global citizen status to be a non-partisan “honest broker” or whatever and get the Muslim leaders and Imams to make some declarations where he can be a hero and “end” the War on Terror.

Of course that truce would just buy them time for the next major plot to nuke NYC or whatever.

This is a sop to the left, both inside and outside the new administration. While there are some ideologues who no doubt will want Khalid freed and sent home on Air Force One, Obama’s always been about doing what politically expedient, and in this case it means kicking the can three months down the road and hoping the BDS crowd won’t care as much about this come late April, since politician Obama knows doing anything but keeping the 9/11 mastermind and others safely locked up would not be good for his poll numbers.

I think he’ll do anything foolish, so long as public opinion polls tell him to do so. This man has no resolve and no mind of his own. Public opinion polls will dictate his every action. And since public opinion is steered completely by the MSM, than I guess that would ultimately make the MSM president, right?

So, what’s your solution? Bush and Congress – including Democrats – have been hashing out a solution to the problem of how to deal with enemy combatants and apparently you think there is a much better way to deal with it…so what it is?
Obama has been part of this process as a Senator for some time now – an extra 4 months isn’t going to produce some new solution to the problem.
