Obama backpedaling on stem cells?

Carrie Budoff Brown seems to think Barack Obama has flip-flopped on another campaign promise, but the difference is procedural, not substantial.  Obama campaigned against the Bush executive order barring federal funding for research on embryonic stem cells and said he would reverse it once elected.  Now Politico reports that Obama has backed away from that pledge, but only because he has a way to share the burden:

President-elect Barack Obama signaled Friday that he might not use his executive authority to reverse Bush-era limits on stem cell research, but instead might wait for Congress to change the policy.

Obama pledged during the campaign to lift the restrictions, and political observers had expected him to move swiftly to reverse President Bush’s 2001 executive order – most likely with his own executive order.

But the president-elect suggested Friday that he would wait for Congress to weigh in on the issue.

“Well, if we can do something legislative then I usually prefer a legislative process because those are the people’s representatives,” Obama said in a CNN interview. “And I think that on embryonic stem cell research, the fact that you have a bipartisan support around that issue, the fact that you have Republicans like Orrin Hatch who are fierce opponents of abortion and yet recognize that there is a moral and ethical mechanism to ensure that people with Parkinson’s disease and Alzheimer’s can actually find potentially some hope out there, you know, I think that sends a powerful message.["]

The irony here is that adult stem cells can deliver the pluripotentiality of hEsc products now, with much more stability.  There is little reason now to fund embryonic stem-cell research, which is one of the reasons why hEsc projects can’t find enough private financing.  Bush didn’t block hEsc research, as some claim, but only federal funding for research into new lines, and since that time, it’s been shown as unnecessary — and hEsc has never actually led to any therapeutic solutions anyway, while adult stem-cell therapies have had considerable success.

Now Obama wants to back away from his pledge to end the executive order, but clearly Politico’s headline, “Obama may not lift stem cell limits,” is either irrationally optimistic or simply ignorant of what follows.  Obama intends on having the policy reversed, but instead of doing it by himself, he wants Congress to initiate the changes.  Can Congress override an executive order?  I don’t believe they can, so at some point Obama will have to vacate it — but he’s not going to impose the actual policy change by executive order.

That makes some sense from a procedural point of view.  Congress should initiate most policy, and the executive should work with and through them to get his agenda passed.  It fits with Obama’s statements from the campaign about his views of the relationship between the White House and Capitol Hill, and his criticisms of Bush’s views on that subject.

That doesn’t make the policy right, however, nor does it amount to a reversal on hEsc funding, unfortunately.  Obama knows he can get Congress to initiate federal funding for research built on the destruction of human embryos.  If he can get that kind of political cover, why not use it to the fullest?

If embryonic stem cells were such a great idea with such grand promise, private industry would be all over it like white on rice. That the research needs government dollars simply reinforces what a loser ESCR really is. Adult stem cells is where all the success is. The state of California passed a referendum a few years back to underwrite Escr, which has provided zero return on investment and no health breakthroughs. The PR on Escr is WAY better than the reality. Smarter to back off of it.

Fertility clinics do not have enough “left overs” to supply for Embryonic Stem Cell Research.
They will have to produce embryos specifically for research to meet the demand.

While it’s going to be incredibly annoying to watch the majority of the big media outlets praise Obama for carrying out policies that are looking more and more like simply a continuation of Bush 43 — policies the same big media outlets attacked to the point of calling them illegal, immoral or even (in the case of waterboarding) war crimes, the mitigating circumstance will be that there are 20-25 percent of Democrats on the left out there who are prinipled, in their own loopy way.

They actually believed Obama was going to move U.S. policy sharply to the left on all fronts and care about those policies, as wrongheaded and potentially damaging as they are (as opposed to say, people who backed the Clintons, who only care about getting power, and going whichever way the wind blows to retain power). The more Obama moves towards the Bill Clinton-Dick Morris triangulation strategy, the more and more their heads are going to reach the explosion point, because this was the group with Level 10 Bush Derangement Syndrome.

Even if Obama, Alexrod and Emanuel are taking a long-range view towards slowly implementing their liberal agenda to avoid angering voters, the far left wants their toys now, and shifts to the right on Iraq, stem cells, tax cuts or anything else linked to Bush is going to drive those on the left crazier than Obama getting away with shifting his positions is going to drive people on the right nuts.

Can Congress override an executive order?

I believe the answer is yes so long as the subject of the legislation falls within the authorization of Congress. As a general rule, if the authorization for an issue falls within the authority of both the Executive Branch and the Legislative branch, the operative law will be the so called “last-in-time” law; that is, if the executive order was the most recently enacted pronouncement on the issue, that will be the operative law. So, in applying this rule to the stem cell issue, if Congress passes legislation that overrides Bush’s executive order, that will be the “last-in-time” pronouncement on the issue and thus the new law.

So, the real fight in these issues is whether the subject at issue is within the authorization of both branches of the government.

What is interesting here is that Obama is willing to concede the issue to Congress thereby creating the precedent that this issue is within the authority of both branches of government. If he continues to do this with other issues, he may be showing his desire to “weaken” the executive branch in order to shift responsibility for policies to him and Congress. He may regret that strategic decision once he realizes that the President is like an NFL quarterback; they get more credit than they deserve when they win and more blame than they deserver when they lose.

It never ceases to amaze me that so much of the MSM got it wrong about embryonic stem cells. Why Pres. Bush never said it out loud is beyond me. Embryonic stem cells are not where it is at. They are found to actually cause cancer. The research with validity and promise are all other stem cells, not embryonic. The fuss about the embryonic cells lost a lot of Republicans seats in the 2006 elections. Remember Michael J. Fox not taking his meds and appearing in political commercials to rag on Republicans and to get out the sympathy vote for those wonderful Dems who care so much about people in need? Michael Steele was the big looser in the elections in MD. Now they are stuck with a cretin who just takes up space in the Maryland delegation in the Senate because he had a D after his name.
Obama is voting “present” on this matter??? I guess Bush wasn’t so deranged after all. Obama is not a leader and cannot make a decision to save himself or us. How did we get stuck with him? Oh, wait, the Republicans ran a guy just like him. Never mind.

The guy is NEVER going to get his hands dirty. He’ll have some fool on his staff, or his team do the dirty work. If that option isn’t available, he’ll do like he’s doing with this, wait for the law to be changed by someone else or have it end because of time limits. Skywise, I think the point is that the embryos in question are already created as a product of in-vitro fertilization and will be disposed of regardless. The cells can be simply all be destroyed, or some can be used for purposes which may be beneficial to living people. Alternatively we could ban in-vitro fertilization, though ultimately fewer human lives lived would be the result.

Under this scenario, the stem cells created have a beneficial effect for living humans and their families. What’s the downside?

you cheapen human life. You’re essentially trading one life for another. This isn’t like taking a hair follicle or some of your own marrow and regrowing it… we’re talking about talking about taking a fully fertiilized human egg a wholly separate life that’s begun growing and slicing it up and turning it into your lower intestine.

In fact, we’re NOW talking about mass producing human fertilized eggs (wholly separate lives) for the very purpose of making spare body parts.

This debate should already be over.

Embryonic stem cells are not genetic matches. You would need a similar screening process for organ transplants to find compatibility.

Using adult cells not only has shown more promise in research – but the cells are identical matches.

Really one of the big overlooked factors here is tissue culture techniques. Embryonic cells and adult cells can most likely be manipulated to do equivalent functions with proper culture media and techniques.

Oh, and no ethical issues.

Not all unused IVF embryos are destroyed- Bush actually appeared at least once with families of “snowflake babies,” adopted embryos who later were born to adopted families.

It’s a small number, but part of the argument against “use them for stem cells, or they end up in the garbage.”

We have Pelosi and Biden touting their Catholicism and proclaiming that Life is still a matter of debate. To Democrats and nefarious criminals everywhere, such “debates” will never be over until you plant the scoundrels where they belong.

What gets me is that when Obama adopts a conservative position its political genius, but would a conservative take the same position she/he would be portrayed as a hateful bigot using divisive wedge issues to separate Americans into Red and Blue camps. Heads I win, tails you lose. The only way for conservatives to win with the media is to focus like a laser beam on policy points that President Obama has said he shares with us. He has been on both sides of almost every issue he has ever confronted. By reduction, conservatives are divisive hate filled bigots who share policy points with President Obama who can never be called a hate filled bigot much less divisive. Hatred and bigotry have lost their meaning under President Obama. Perhaps he will convert the conservatives after all?

Which are going to be destroyed anyways. They use the “left-overs” that fertility clinics otherwise throw away as medical waste.

Why are the clinics not offering up these embryo’s to other infertile couples. Having available, already fertilized embryo’s would be a lot less expensive and painfull than having to harvest your own wife’s eggs. (Few insurance companies pay for invitro.)

Is there a federal law that makes such “adoptions” illegal?
