Can Bush un-pardon someone?

Earlier, I wrote about George Bush’s reluctance to issue pardons and whether he’d start making more controversial calls in his six remaining days. George Lardner wonders whether Bush will get away with rescinding one of his few pardons. Lardner looks at the embarrassing case of Isaac Toussie, whose pardon kicked off a firestorm of criticism and an attempt to undo it:
The most important step George W. Bush has taken with the presidential pardon power came last month, when he repudiated it.
On Dec. 23, he granted clemency to a sordid Brooklyn developer, Isaac R. Toussie, who had pleaded guilty to real estate fraud, and when details of the case came to light — Bush had acted on the recommendation of the White House counsel, without the knowledge of the Justice Department’s pardon attorney — the president washed his hands of the situation and withdrew the pardon one day after signing it.
The about-face has sparked questions about whether there was precedent for Bush’s action and whether it could stand. It’s a debate the courts, which have been weighing in on the supposedly untouchable pardon power for more than 150 years, should be happy to settle. And if judges have any regard for history, they will side with Bush.
Why? As Lardner explains, courts have already ruled that delivery and acceptance are important parts of pardons. In US v Burdick, the president attempted to issue a pardon in order to force a newspaper editor to testify in court. The judge ruled that Burdick did not receive and accept the pardon, and therefore it had no force of law. If Toussie had not yet accepted the pardon, the Bush administration argues and Lardner concurs, then the pardon had not yet been complete and could be recalled.
Perhaps. But it’s far wiser to consider the pardon carefully in the first place. Fred Fielding, the current White House counsel, recommended the pardon after bypassing the normal Justice review process. That meant that Bush didn’t realize the extent of the damage Toussie incurred in his frauds and the amount of resentment still left with his victims — and prosecutors. After the Marc Rich scandal, one would think that any White House would learn the lesson of going through proper channels, if for no other reason than political cover.
Like Lardner, I think this makes for an interesting test for court, which is where Toussie will assuredly go over the rescission. I’d bet on Bush prevailing, and I’d also bet that Barack Obama’s administration will pursue Bush’s case to protect executive privilege in the future.

George – you gotta be a man. When you make a decision you have to stick with it. Apologizing is a sign of weakness. When ever I hear some one say, “I agonized over this decision” or “This is the hardest decision I’ve ever had to make”. It usually means they made the wrong decision. There is a lot less grey area than people are lead to believe.

I do not think you can undo these things. Bush pardons some scum criminal, refuses to comute those border guards sentances, and is too wussy to pardon Libby? I hope Bush is waiting to the last second, hoping the hype over hope will over whelm anything he does.
But I would not count on it.

I wonder if President Bush can pardon himself and Dick too for future need? You know and there are stories already being pushed by the MSM and the far left,(one in the same), that The Messiah and Nan & Harry are going after Bush and VERYONE in the current Administration… Hearing, after hear, after hearing is on tap… Anything to keep the MSM and the wack job Liberals off of The One’s back… Fire them up with the “red meat” of BDS revised…

Very, very sad, but I think he is turning his back on true heros… Most disturbing thing, outside of bailout mania, in his Administration. I have posted in the past my admiration of Bush for his strong stance for defending America, our Military and his honor… He is / has lost all of my fondness and admiration with this disgrace.

How does one legally satisfy the “acceptance” requirement? Do you have to put something in writing, or would jumping up and down and screaming “I got it, I got it!” work just as well? Has anyone ever declined to accept a pardon?

Actually Kennedy pled guilty to a charge of “leaving the scene of an accident after causing injury”. He received a two month sentence, which was suspended.

Hmmmm… this is kind of interesting…
Historicaly, most Govenors could stop an execution with a phone call… it did not have to be a piece of paper… as it was a commutation…
Here, they are saying you need a piece of paper to be deliverd, and accepted? But the prededent is based on a case back when we did not have modern communications…
Hmmm… wonder if Marc Rich was ever delivered a Letter…

And on an even more interesting note…
What is a pardon? If a pardon tells the STATE that the person is not guilty, then the Order is one to the Government, not the individual (like a commutation would be… it changes the sentence…).
Once someone is pardoned, do they have to go to court to get released? or are the just released? It would seem this would be an indication as to whether a pardon is an order to the state, or one the individual has to have and then invoke through the courts…
Because if its an order to the state, once signed and sealed, I don’t see how you can revoke it.
Gonna be an interesting arguement… but I bet the courts punt on this one just like they have punted on so many cases recently.

THAT is why it is important to remember that everytime you bellow about how much you “HAAATE BOOOOSH” or “HAAATE PAAALIN” or how “WORTHLESS” Bush or Palin is —– you’re ONLY Helping THE ENEMY!!
Let’s STOP helping the Enemy, and let’s STOP helping The Terrorists by giving them soundbites that they and The Media can use to beat their message of hate into the world so loudly and longly that they drown out any whisper of the truth.
