Uh oh: Obama Treasury nominee had “undocumented” housekeeper; Update: Whose taxes?

Temporarily undocumented, that is: Her papers expired, then she got a green card.

Oh, and he forgot to pay his self-employment taxes for a few years. But other than that, everything’s cool.

An emergency meeting of the Senate Finance Committee’s happening as we speak.

According to people familiar with the matter, Mr. Geithner employed a housekeeper whose immigration papers expired during her tenure with Mr. Geithner, currently president of the Federal Reserve Bank of New York. The woman went on to get a green card to work legally in the country and federal immigration authorities didn’t press charges against her, these people said.

The second issue involved taxes due while Mr. Geithner worked for the International Monetary Fund between 2001 and 2004. As an employee, Mr. Geithner was technically considered self-employed and was required to pay Social Security and Medicare taxes for himself as both an employer and an employee.

He apparently failed to do so, resulting in Internal Revenue Service audits his last two years at the IMF. As soon as the IRS brought the issue to his attention, he paid the taxes with interest, these people said…

On the tax front, Mr. Geithner’s oversight is not uncommon. The IRS has mandated loose rules for U.S.-born IMF employees unaware of their obligations to pay payroll taxes.

Tapper adds an interesting wrinkle to the timeline that the Journal doesn’t: Geithner paid his back taxes for 2003 and 2004 when the IRS notified him (in 2006), but not until November 21 of this past year — coincidentally, the very day he was named Treasury appointee — did he pay them for 2001 and 2002. Frankly, I like the idea of a tax cheat as Treasury Secretary in this environment; it makes the thought of him spending trillions of taxpayer dollars on new stimulus bills and bailouts that much sweeter.

Somehow these missteps are supposed to threaten his appointment but not the fact that, as president of the New York Federal Reserve, he oversaw the meltdown on Wall Street. Exit question: With Congress already sufficiently terrified by the economy to cut The One a stimulus check for $775 billion plus another $350 billion from the second half of TARP (forcibly, if need be), what are the odds that they’re going to reject his handpicked economic guru — especially given the potential headache of immigration politics becoming involved? No wonder Obama’s not backing down.

Update: Here’s the answer to Tapper’s question. The back taxes for 2003 and 2004 were his own personal self-employment taxes; the ones for 2001 and 2002 were withholding taxes for the housekeeper. Which, supposedly, he didn’t have to pay.

But as Geithner was being vetted for the Treasury post, Obama transition officials also realized that he had also failed to pay all his withholding taxes for his housekeeper from 2001-02. Although he was not legally required to, Geithner paid those back taxes as well, according to a transition official.

Orrin Hatch says full speed ahead on the confirmation!

Update: Now I’m confused. This PDF of the Obama team’s memo on Geithner suggests that the 2001-02 tax problems also had to do mainly with his own self-employment taxes, not the housekeeper’s withholding.

Why doesn’t he have to pay witholding? Unless she is an independent contractor who sets her own hours, I think he is supposed to pay them. He is required to pay half of her SS and Medicare taxes. I assume he didn’t pay those on time either.

I never like this. The rest of us have to follow these rules. I spent 2-3 hours this morning filing out the paper work for a part timer who does work for me. He only made $900- last year, but I have to pay his taxes quarterly and then fill out all the end of year forms.

As much I despise illegal immigration, this thing with the housekeepers becoming a problem for politicians is getting ridiculous.

Why not create a program whereby illegals wanting to work as housekeepers could apply specifically for jobs with politicians. It could be something like a cross between an internship and a reality show.

Also, whats up with people not hiring American housekeepers? Many are in business for themselves and it seems like a decent way to promote entrepreneurship.

He made a common mistake on his taxes, and was unaware that his part-time housekeeper’s work authorization expired for the last three months of her employment. We hope that the Senate will confirm him with strong bipartisan support so that he can begin the important work of the country.”

Sen. Debbie Stabenow (D-MI) says upon exiting the emergency meeting… “He’s [Geithner] been very forthright in relating to us any mistakes…What we talked about has been fully disclosed to the Transition Office.”

The transition contends Geithner paid all income taxes while working at the International Monetary Fund, but made a “common mistake” in relation to “self-employment” taxes in 2001 and 2002.

NBC’s Ken Strickland reports that Baucus says Geithner made “honest mistakes” and that those mistakes should not disqualify him from being the next Secretary of the Treasury. Chuck Schumer and Debbie Stabenow, other committee Democrats, also support Geihtner and think he will utimately be confirmed.

STEPHANOPOULOS: You know, you’ve mentioned Eric Holder. He’s coming under some fire on Capitol Hill by the ranking Republican Senate Judiciary Committee Arlen Specter and some others who are worried about just that, that he’s not going to be independent. Are you confident he’s going to be confirmed?

OBAMA: Yes.

STEPHANOPOULOS: And are you worried at all, troubled at all by the questions that are being asked about his independence, also questions about his involvement in the Marc Rich case?

The funny thing about these little moments of aristocratic law-ignoring is how eagerly the Left defends them. Liberal blogs are always aflame with people who seem positively delighted that the latest rock in the sleazy asteroid belt surrounding Obama is a racist / terrorist / liar / tax cheat. It reminds me of the way liberals swooned over Slick Willy’s daring adventures in perjury, or the way they fawn over celebrities who lecture them on carbon emissions from limousines and luxury private jets. I think there’s a component of the liberal soul that worships demonstrations of raw power – they want their icons to be towering Castro figures of vast power and sophistication. They want to be ruled by Great Men and Women who tower above petty concerns, like filling out tax withholding forms, remaining faithful to their wives, or the beaureaucratic pungee sticks that would bring the rest of us down. This kind of hypocrisy doesn’t bother them – it turns them on.

No way. You just have to be careful. There are plenty of former middle managers who run all kinds of remodeling businesses, and don’t hire illegal help. Also, plenty of legal aliends and others do house/garden work.

You might be right, though, in regards to how many wouldn’t qualify to be secretaries in any admin. for this reason.

I have a Vietnamese guy do some of my lawn work. He is legal, I am sure of that, but does he pay taxes on the cash paid? No Way! I know several in the Asian community and they operate everything on a cash basis. They report just enough to qualify for Social Security and Medicare. Everything else goes in their pocket. The legal immigrants have learned how to game the system and are good at it.

No, it’s not. Your statement isn’t comparable to anything I wrote. I only pointed out the near statistical certainty that you’ve paid an undocumented worker if you’ve ever paid for certain kinds of work. I didn’t suggest that every Mexican is an illegal, or that no lawful aliens work as busboys or housekeepers. But I did suggest that illegals are over-represented in certain lines of work, a point that even politically correct diehards don’t usually try to deny.

His taxes were wrong for 2001, 2002, 2003, 2004, 2005, and 2006.
The IRS found his IMF problem for 2003 and 2004, and he paid the taxes with no penalty. Apparently, this did not make him think he should go back and reevaluate his 2001 and 2002 filing. He has now had to go back and pay SE taxes with penalties for 2001 and 2002, all due to his IMF employement.

This is all in addition to his household employee tax problems, which began in 1995.

I’ve prepared a few tax returns over the years. There’s a slight chance it could be an honest mistake. Heck, a couple times I’ve gotten a new client who makes SE income & who’s never even heard of SE tax.

Which leaves us with two possibilities:

1. Geithner has an abysmal knowledge of the US Tax Code. Just what we want in an incoming Sec Treas.

2. He rolled the dice betting that he wouldn’t get audited.

My bet’s on #2.

This guy didn’t pay is self-employment taxes and they are actually considering puttting this guy in charge of the treasury?

Time for some clear thinking. If this guy was a conservative, Republicans would refuse to confirm this guy and they would laugh him out of the room and insist on an explanation from the newly elected Republican President how he ever got nominated for the position. And Republicans are the ones with sympathy for the taxpayer.

Will there be any opposition from any liberals against this millionaire who refused to pay his taxes?

Sp ‘blinkin’ nice of the IRS not to charge him any penalties, just interest and principal. Now if that was me, well, let’s just say,

GO DIRECTLY TO JAIL, DO NOT PASS GO, DO NOT COLLECT $200!!!!

Americans are not interested in hearing anything negative about Obama or his appointments at this time. It’s a real downer. Who cares if Geithner is a bit sloppy? So was Sandy Berger. Not a big deal at all. This bunch of sour-grapes conservatives kvetching about made-up issues will not succeed in dampening our enthusiasm as The Day Of Salvation Is At Hand.
