Team Obama: Richardson misled us

posted at 5:06 pm on January 4, 2009 by Ed Morrissey

It looks as if Barack Obama and his transition team know how badly Bill Richardson’s resignation reflects on them.  They have started leaking to the press that Richardson’s to blame for the embarrassing spectacle this afternoon of his withdrawal as a Cabinet nominee.  Jake Tapper has the details:

Sources tell ABC News that officials on the Obama Transition Team feel that before he was formally offered the job of commerce secretary, New Mexico Gov. Bill Richardson was not forthcoming with them about the federal investigation that is looking into whether the governor steered a state contract towards a major financial contributor.

Once the investigation became more widely known through national media reports last month, sources tell ABC News, the Obama Transition Team realized the FBI would not be able to give Richardson a clean political bill of health before the new administration is ready to send his nomination up to the Senate for confirmation.

Meanwhile, Richardson and his team has to defend themselves:

The Richardson camp says the governor was forthcoming, with sources close to the governor noting that there had been reports about the controversy in local media such as the Albuquerque Journal as far back as August 2008. The governor discussed the investigation with the Obama team, they say, and believes that he and his administration have done nothing wrong.

I’d guess that Richardson probably didn’t disclose the extent of the problem.  Richardson feels it necessary to resign now after the published reports from the last three weeks, but he had to know these issues when he accepted the position.  If all that has happened since December 15th is that the facts he disclosed to Team Obama were made public, it would hardly require a resignation now.

But beyond that, this is a pretty lame attempt to shift blame away from the incoming administration.  They should have done their own homework on Richardson once they heard about the investigation.  In the end, they have the responsibility to make acceptable appointments for Cabinet positions.  If the extent of the vetting Team Obama is doing is reading resumés and accepting explanations for federal investigations without question or further checking, then they’re pretty obviously incompetent at it.

They also seem to have no compunction about calling Richardson a liar in public.  I wonder how that will play politically with their base.

Are we going to repeat the same mistakes that we made in 2008 by running a candidate that does not respect and spits in the face of our conservative ideals or are we going to back a candidate that truly believes conservative ideals?
2008 is over. McCain is over.
We need to regroup and focus on 2010 and beyond. Not still defending a dusty old rino.
HornetSting on January 4, 2009 at 7:39 PM

I’m not defending McCain, I’m clarifying our recent history. I’m not suggesting that anyone ever support McCain again. He’s done, he’ll never run for president again. But I am not going to be quiet while other people have lied about him in the past and attempt history revisionism as to how we got to this point. Like Bush, he has his faults but he doesn’t deserve to be treated like sh*t (just as the liberals have done) by people who should be able to know better. What I’d like to see is the republican party nominate a person who best backs the majority of our beliefs and who is electable when up against our own media combined with the democrat. You know who has the power to make that happen? A good candidate and the republican voters, one state at a time. And what happens when the less than ideal candidate gets past the better ones and becomes the republican nominee? It’s my suggestion that we support that person so they defeat the democrat. My problem is not with you, but to the people who think that we needed to lose this election and trash and lie about the man who could have been president, and now we have as I said 4 to 8 years of Obama.

We don’t repeat our mistakes by returning to this failed circular firing squad against the person who won the republican primary next time because of a single issue (immigration) that we could have defeated as republicans what the republican president might have tried to do. See my Harriet Miers example earlier. Simple as that.

Right. Teh evil McCain has been in politics since he got back from the POW camp for the sole purpose to make sure that Barack Obama become president in 2008. Not that he saw politics as a constant division between D and R and a failure of what government was supposed to be – and wanted to put America first, work together for a nonpartisan effort when he could to make things better for all Americas. Not at all, that wasn’t mCCain, he was just a democrat plant. Right. Sure./

You all are more idiotic than the liberal truthers who think that george W Bush invaded Iraq for their oil.

You can defend him. McCain didn’t defend HIMSELF! He was a sorry candidate and didn’t want to offend his friends across the aisle, even when THEY were lobbing bombs towards him.
My problem, and I will list ONE, with McCain is that he has NO PROBLEM trashing his own party, but he will not say a bad word against the democrats.
So, I feel that I have a right to question his will to win this election. But, I am over it. McCain and his ilk are DONE in the republican party. We, as conservatives, need to fight our own party tooth and nail to make sure that we go in the RIGHT direction, not back to the mushy middle.
We need to focus on 2010 and 2012 and forget the debacle that was John S. McCain.
Simple as that.

this is obvious. Our power is to vote. Just once.

We, as conservatives, need to fight our own party tooth and nail to make sure that we go in the RIGHT direction, not back to the mushy middle.

It takes the majority of republicans in each primary to vote for the right person. And for a strong conservative to rise above the rest. In hindsight, I wish I donated money to the Romney campaign early on, but I thought he had that taken care of already. As I said earlier, I voted for Romney, and I didn’t support McCain when the primary came to my state. If you’ve got a better idea as to how to get only HornetSting approved candidates to run and succeed, then I’m all ears.

wise_man on January 4, 2009 at 8:35 PM

John McCain ran a pathetic campaign, apparently scared to death to be critical of the Obama connections to terrorists & all around really evil people. McCain handcuffed Palin, and the rest of the RNC people from gong after Obama and his anti-American ungrateful loud-mouthed wife.

If a few of who donated and voted for McCain seem a little unhappy with the joker, all I can say is that we earned the right to be disappointed. The man might just as well been a plant for the Dems all along.

Keemo on January 4, 2009 at 7:58 PM

The conventional wisdom talks about all the “excitement” for Obama that permeated this campaign, but in reality, the defining factor was exhaustion. The public was tired of the media’s endless browbeating, tired of the war in Iraq (even as it was being won), tired of fighting the endless tide of news personalities and celebrities telling them they were greedy, bloodthirsty, and intolerant – guilty by extension of the sins they nailed to the door of the President we had twice elected.

McCain was an avatar of that exhaustion, browbeaten by his old buddies in the press into running a soft campaign of dignified defeat. He seemed to accept the premise that he really had no right to run against the Lightworker, that he was a sort of token opponent, tolerated in the race only because the forms of democracy demanded some kind of a choice for the voters. Unwilling to call out the Democrats for their subprime crisis crimes, or remind the electorate what an embarrassment Obama was as a candidate – unable even to say a bad word about the horrific performance of a semi-delusional Joe Biden at the vice presidential debates, because Joe was his old friend and colleague – he couldn’t do anything more than humbly present himself as a reasonable alternative, for any voter who might have stumbled across a reason not to vote for Obama.

And where was the energized conservative base to help push McCain forward despite himself? They were exhausted too, tired of taking an endless beating from a popular culture, and political opposition, that was barely willing to concede their basic humanity, never mind their right to participate in the political process. And for what? The One Big Thing Bush got right was already fading into memory (although I think history will judge it was an even Bigger Thing than we thought.) Most of what they got out of Bush, and virtually everything McCain promised, was slightly watered-down liberalism. McCain was unwilling to pound Obama on the areas where McCain was truly, incandescently superior, and he was bizarrely unwilling to hit the Democrats in general on the financial crisis, so what was left? McCain ran as an 80s Democrat, against an opponent he could never quite bring himself to define.

Maybe all of this was inevitable. The West in general, and America in particular, really is exhausted. Those Big Mommy government programs and unicorn-studded “stimulus plans” sound pretty good to a defeated electorate that has grown tired of fighting against a velvet Leviathan that keeps promising to take care of them… fighting in favor of a mature, adult free-market system that often seems cruel and unfair to them. Conservatism is an argument, while liberalism is a promise. We need someone who can make the argument again.

Unfortunately, the McCain campaign neglected to remind the voters of the crucial reason to vote against socialism: it’s permanent. You can’t just give it a try, and try something else if it doesn’t work out. Once the new socialism is in place, it becomes eternal. The electorate will never be given a chance to vote against what they just voted for.

wise-man,

I’ve been reading your comments for quite some time now. You’re alright in my book. John McCain is an American hero for his service, commitment, bravery, & sacrifice to his country. A fine soldier; made the uniform proud. However, as a politician, McCain was involved in some incredibly horrific work. McCain-Feingold; McCain-Kennedy; the gang of 14…. McCain wanted so badly to be the “man of integrity” in a business where integrity gets you eat-in alive. Politics is a game of hardball followed by compromise. McCain brought the compromise to every meeting, but simply never had the hardball. Time to move on and let Mr. McCain ride off into the sunset with his beautiful bride and wonderful family.

BEVERLY HILLS, Calif.–(BUSINESS WIRE)–Feb. 25, 2003

CDR Financial Products, one of the nation’s leading investment advisory groups, has announced the appointment of Wayne Rosenwinkel as Senior Vice President of Investment Management and the opening of CDR Financial Products’ new Illinois office.

SEC Settles Enforcement Actions Against Municipal Bond Offerings Participants for Violations That Put at Risk the Bonds’ Tax-Exempt Status
FOR IMMEDIATE RELEASE
2007-208

Washington, D.C., September 28, 2007 – The Securities and Exchange Commission today announced settled enforcement actions against two California companies for their failure to disclose a fee agreement that created a risk to investors that interest on $650 million of municipal bonds might lose its tax-exempt status. The charges against CDR Financial Products, Inc. (formerly known as Chambers, Dunhill, Rubin & Co.) and Anchor National Life Insurance Company, (now doing business under the name of AIG SunAmerica Life Assurance Company) relate to three municipal bond offerings in Florida.

Chairman Christopher Cox said, “Municipal bond investors deserve full and fair disclosure of the important facts about their investments, including particularly the facts that bear on the tax status of their bonds. Today’s enforcement actions demonstrate our continued commitment to upholding integrity in this critical market, and the protection of investors in municipal bonds.”

Linda Chatman Thomsen, Director of the Commission’s Division of Enforcement,” said “The tax-exempt status of municipal bonds is of paramount importance to investors who buy them. In these bond offerings, information was not disclosed that could have jeopardized this status. These enforcement actions reaffirm disclosure obligations that provide important protection to municipal bond investors.”

David Nelson, Director of the SEC’s Miami Regional Office, said, “Our dedication of staff and resources to these enforcement actions should remind participants in municipal bond offerings that we remain committed to protecting those who invest in the bonds.”

Martha Mahan Haines, Chief of the SEC’s Office of Municipal Securities, added that, “CDR and Anchor served specialized functions in certain municipal bond offerings. Their fee agreement could have affected the tax-exempt status of the bonds. As a result, CDR and Anchor should have made sure it was disclosed.”

The separate actions both relate to three bond offerings in Florida in 1999 and 2000. The Commission’s Orders find that Anchor served as the credit enhancement provider, and that CDR served various roles, in the three offerings. The Commission’s Orders further find that the existence of the fee agreement between CDR and Anchor was material for several reasons. Among other things, the bond proceeds were to be used for originating loans, and therefore CDR’s receipt of payment on unloaned bond proceeds created a potential conflict with the offerings’ purpose.

In addition, tax regulations require bond issuers to have a reasonable expectation that most of the bond proceeds would be loaned out within three years. Without knowledge of the fee agreement, the issuers made calculations, disclosures and certifications relating to their reasonable expectation regarding loan origination within the required time without having all information that was material to that issue. Moreover, the fee agreement also created a risk that the Internal Revenue Service would declare the bonds to be arbitrage bonds, with accompanying potential negative tax consequences.

The Commission’s Orders also find that in one bond offering, CDR executed a certificate that was misleading in light of the undisclosed fee agreement.

The Commission’s Order against CDR finds that CDR violated Sections 17(a)(2) and (3) of the Securities Act of 1933 (Securities Act). The Commission’s Order against Anchor finds that Anchor was a cause of violations of Section 17(a)(2) of the Securities Act. Both parties consented to a cease-and-desist order against further violations of those provisions without admitting or denying the Commission’s findings.

The SEC acknowledges the assistance of the Internal Revenue Service in this matter.

CommentGuy on January 4, 2009 at 9:17 PM

http://www.bloomberg.com/apps/news?pid=newsarchive&sid=ahsj462KjqEc

At Wall Street banks, the same departments typically handle the business of selling municipal derivatives and so-called guaranteed investment contracts, which provide local governments a fixed rate of return on bond proceeds until the money is needed for projects like schools and roads. Local governments also rely on the same financial advisers to assist them with those two products.

In November, three firms that evaluate bids for investments sold to government borrowers and also render advice on derivatives—CDR Financial Products Inc., Investment Management Advisory Group Inc. and Sound Capital Management—were raided by federal investigators.

The regulatory investigations are probing matters previously examined by the Internal Revenue Service, which has been using its power to audit tax-exempt bond issues to investigate bid-rigging for investment contracts.

Yield Burning

Municipal borrowers aren’t allowed to profit by investing the proceeds of tax-exempt bonds in higher yielding securities like Treasury bonds. Because those profits, known as arbitrage, must be repaid to the IRS, the sale of overpriced investments to local governments can rob the federal government of revenue, as it did with excessively marked-up Treasury bonds in the so- called yield burning scandals of the 1990s.

The IRS has also looked into whether excessive fees on interest-rate swaps and other derivative products, such as forward purchase agreements, can be used to do the same thing, since borrowers are allowed to use investment earnings to pay for those products.

CommentGuy on January 4, 2009 at 9:18 PM

The Obama transition team has completed an investigation into the vetting of Richardson, and finds that it has done no wrong.

kingsjester on January 4, 2009 at 9:20 PM

the financial class that Bambi is selecting is up to their eyeballs in unethical if not illegal transactions. Bloomberg is politically sympathetic but even they are acknowledging that the SEC while in a quandry will be doing something soon.(barring of course THE ONE running interference)

Fact is I suspect that donk leaning nouveau rich helped bid oil through the roof to create illwill towards the GOP(aka BIG OIL’S lapdogs). The money used to bid up the commodities was borrowed against portfolios leveraged rather heavily in slam-worthy real estate, but when Fan and Fred imploded the 1-900-easy-money for slamming was suddenly gone. All of this has happened before as is alluded to in the article on a smaller scale.

The ’80s S&L games in Texas come to mind….the bailouts being used to pay back the people who bought the donks their power is a method that is so direct it is new and groundbreaking.

With their new office in Ill in 2003 it will be interesting to see if they pop up any where in the Blago mess as well.

Also their ties to some of the major players in the financial bailout mess could ripple the surfaces in some locals.

Surely the MSM will be just as harsh on Team Obama for their failure to properly vet Richardson as they were on W about Bernard Kerick.

Texas Gal on January 4, 2009 at 9:25 PM

I keep trying to play the Mirror Universe game, where McCain won the election and all this stuff is happening to him and the Republicans, but my head threatens to explode. Close your eyes and imagine… in the weeks since John McCain won the election, the Republicans openly stole the Minnesota senate seat by finding boxes of votes for Norm Coleman, and the Republican governor of Arizona arrogantly named McCain’s replacement after being caught on tape trying to sell the Senate seat. A disinterested media has shown no interest in weaving a GOP “culture of corruption” narrative around these events, and rarely remembers to mention the Arizona governor’s party affiliation in news stories.

Meanwhile, Jenna Bush announced she would really like to have Joe Lieberman’s old Senate seat, after McCain names Lieberman as his Secretary of State. A swooning press writes puff pieces about her, declaring her to be a “princess” in America’s unofficial royal family, and insisting that her kindness toward animals and general sweetness richly qualifies her for the Senate. Suggestions she is unqualified for the position are dismissed as sexism.

A war between Israel and Hamas has broken out, and the economy is tanking, but McCain goes water-skiing in Hawaii and stays at a plush five-star resort. The press is cheerfully willing to allow him this well-deserved vacation after a hard-fought campaign. After all, we want him rested and ready for his inauguration, don’t we?

One of McCain’s cabinet picks is forced to resign before he takes office, because of exactly the same kind of pay-for-play scandal that has engulfed the Republican governor of Arizona. The press politely refuses to get started on that “culture of corruption” narrative, and shows about the same amount of interest they showed in McCain’s massive fundraising irregularities, or the suspicious ballot fraud activities of the National Rifle Association, which also played a key role in the recent collapse of the mortgage industry. The holiday week ends with the debut of an abortion-clinic bomber as an online columnist for National Review…

Well I just find it interesting that a Beverly Hills based company finally decides after many years operation to open an office in Ill.

There were a whole lot of questionable deals (like usual I guess) being turned around then.

Seems like a long time to avoid such a spot for business and the date of their opening is real interesting.

Name that party….

After nearly 28 years of consistent popularity, U.S. Sen. Christopher J. Dodd saw his public approval ratings sag to below 50 percent in late 2008 after months of news disclosures about his cut-rate mortgages from banking giant Countrywide Financial and his long absence from duty while he was running for president earlier in the year. Now it’s decision time for Dodd on whether to launch a run for a sixth Senate term in the 2010 election. Dodd has denied wrongdoing, but still refuses to release documents related to his mortgages while the Senate conducts an ethics probe.

Remember that — though Dodd would like you to think otherwise — the Senate ethics probe is no barrier to him releasing the documents now.

The corruption runs through the entire DEMOCRAT PARTY, and the American people awarded them with the whole ball of wax. Anybody wonder why/how Nancy Pelosi became one of the wealthiest woman in America?

Keemo on January 4, 2009 at 9:54 PM
