Blago lawyers up, might resign by Monday

Beleaguered by scandal and isolated after the resignation of his chief of staff and alleged partner in corruption, Governor Rod Blagojevich has seen his options rapidly decrease since his arrest last Tuesday.  The Chicago Sun-Times reports that Blagojevich may resign as early as Monday rather than try to fend off certain impeachment from the Illinois state legislature.  He’s not giving up on the legal front, however, as his selection of attorneys demonstrate:

Gov. Blagojevich will decide early next week — perhaps as early as Monday — whether he should resign, a source close to the governor told the Chicago Sun-Times.

“He was blindsided by this,” the source said. “He needs some time to digest what’s going on. He’s going to make his position clear shortly.”

Blindsided?  Perhaps, but if so, it only demonstrates his cluelessness.  Patrick Fitzgerald has run an investigation into corruption in Illinois politics for years, and while most people believe that Fitzgerald has focused on Chicago and Mayor Richard Daley, Blagojevich had to understand that Fitzgerald would take an interest in Springfield as well.  That’s what makes Blagojevich’s bald attempts at enriching himself and his wife through the sale of the Senate seat so mind-bogglingly stupid.

Blagojevich might be stupid, but he’s smart enough to hire some high-powered attorneys to defend him.  As Natasha Korecki and Chris Fusco report, his choice signals that there won’t be a confession in the offing:

Also Friday, Blagojevich retained the lawyer who defended R&B singer R. Kelly and disgraced media mogul Conrad Black to represent him in his criminal case.

Ed Genson, one of Chicago’s top criminal-defense attorneys, said he was assembling a team of lawyers to assist with the case. Genson typically doesn’t represent clients who plan to plead guilty.

Genson has a .500 record in these high-profile cases.  He managed to get an acquittal for Kelly even with a videotape that allegedly depicted Kelly and a 14-year-old girl having sex.  Black didn’t fare quite as well.  He wound up with a 78-month prison sentence and a $6.1 million restitution order.  Genson knows his way around media-blitz criminal cases, though, and he will spend a lot of Blagojevich’s money in attempting to keep the governor from following his predecessor into federal prison.

Some may wonder why Blagojevich just doesn’t cut a deal and try for lenient treatment.  He may still do that, but Blagojevich may not have much to offer other than himself.  A corrupt governor would be the top of the food chain in most instances, and John Harris’ abrupt resignation yesterday may indicate that Fitzgerald already has the big fish landed.  There may also be another reason.  Anyone reading that complaint will be left flabbergasted by Blagojevich’s arrogance — and that may keep him from understanding his odds in federal court against Fitzgerald.

So now he got himself some lawyers. I find it funny how some have all these attorney’s to represent them. Scott Peterson had a ton of them. He was still convicted. I wonder if we will hear soon that Blago was found dead? And his wife too. They might know more than some want them to. I hope he starts singing like a bird. Bet these tapes might have more on them. Could be a surprise when things get closer to trial.

He should have hired President Clinton’s impeachment counsel, Greg Craig. But I guess there will be no impeachment and The One already selected Mr. Craig as White House Counsel. That selection speaks volumes.

Of course he is arrogant. He has been a corrupt politician for years, always protected by the Chicago Machine. He’s like a high school athlete who knows he can get away with anything, because his coaches always get him out of any trouble. Blago’s stupidity is thinking that he was going to continue to be protected even after he tarnished the halo of the great messiah.

But again, Blago probably was blindsided, because he knows that Obama is just as corrupt, if not more, as him. I’m actually hoping that Blago is as nuts as people make him out to be, because then maybe he will get pissed off enough, realizing that Obama is getting away scot free with all his corruption and illegal activities, that he will squeal on him and embarrass PEBHO as much as he can as revenge for being thrown under the bus.

More likely scenario though is that this painting of Blago as nuts is to get out in front of the story so that if he does squeal on Obama, the press already has its meme that this guy is nuts and nothing he says can be trusted. So Obama gets away scot-free once again. As always.

That whole “nuts” cloud is interesting. It destroys his credibility and gives him a possible legal defense.

Ruining his credibility could certainly make some people happy.

The probability of the insanity defense working is slim and none unless it is somebody just out of the nuthouse, it is a couple of times out of a hundred.

Unless the machine gets somebody on the jury or to the judge…but the machine probably doesn’t like him too much right now.

This one case of having a judge remove a Governor from office for delusion, that’s just a stunt, isn’t it? I mean, democrats wouldn’t expand that tactic, would they?

A silver lining in all of this, despite Blago’s apparent hasty retreat, is who will likely NOT become the next U.S. senator from Illinois. I’d be thunderstruck if either Valerie Jarrett or JJ Jr. has a snowball’s chance at this point. And that would be a good thing.

Bets on who will be put forth? With all eyeballs on the state, it seems that Illinois needs a special election. But maybe the Illinois General Assembly will decide that it’s better to have Blago’s Lt. governor choose–just to put things behind them as quickly as possible.

At the time of the commission of the acts constituting the [insanity] defense, the defendant, as a result of a severe mental disease or defect, was unable to appreciate the wrongfulness of his acts. Defendant must prove it by “clear and convincing evidence.”

The federal standard for the insanity defense. “Clear and convincing” is less than criminal “beyond a reasonable doubt” burden of proof but more than “preponderance of the evidence” civil burden.

Hard to meet. Old standard was tightened up in 1984 after Hinckley got off on insanity.

And that’s the name of the game here in Chicago right now. No one seems to be squirming just yet on how loud Blago will sing, the most important thing is get Blago out quick, so Pat Quinn can take over and get that senate seat appointed to another dirty dem.

How many strings is Reid and Pelosi pulling in the background on this one? They all know if there’s a special election, the Repub’s have good chance of running Mike Ditka, and he’ll win in landslide.

Ditka almost ran about 4 years ago but decided against it.

The real question is going to be how much Blagojevich is going to talk to save himself. Rezko is still talking about some of the deals he did and it seems the media has not wanted to mention much about the fact that Blagojevich wife was Rezko real estate agent in that deal with Obama.

I’m not sure anymore. Quinn used to march to his own tune and wasn’t popular with the Machine cause he was considered a reformer and wanted to clean up Illinois for years. I’m not sure how him finally becoming Governor is going to play out with the rest of the dirtballs here.

I believe one of the advisors in the transcript indicated it would be very possible to put Patti on some well paid corporate boards of diectors,…it was during that exchange Blago made reference to another wife(probably Michelle O) receiving similar treatment as the wife of a rising Chicago thugpolitician, so felt it was his/her due.

Two questions:

2. Can he get a fair, honest trial? What about a change of venue to, say, the island of St. Helens? If it was good enough for Napoleon, it should be good enough for Blago.

It’s available in 4 parts, in many places, but here is as good as any, and you need lots of patience, and paper to print it, and inhumane nerves to make it through the reading. It’s cruel and unusual punishment, for any college graduate work comparable. This will be our country’s mother, after Jan. 20, 2009. We ought to be ashamed of ourselves. The rest of the world ought to laugh at us, not ‘celebrate’ us. Believe me, they are.

I’m still waiting to hear why the “brilliant” Michelle Obama only lasted 3 years in her only lawyer job (at Sidley & Austin, IIRC). One of her relatives was quoted as saying the job “wasn’t a good fit” for Michelle, but I never have seen any explanation for why that was so.

I have a question about all this. What did Blago do that was illegal? He obviously was planning to do something but nothing had been done. Is that a crime? If it is, we have a new definition and why arrest him when they did? FG must be a complete nut. Spend a year plus to get someone for a memory lapse and then make an arrest before a crime.

Is that you Dicky? I think you are right. The charges seem premature. There is plenty of mens rea but from what I have seen no actus reus. Lot’s of talk about a bribe but not actual solicitation. Mr. Green may have eventually arrived but he seems as difficult to find as Obama’s long form birth certificate.

I’m not sure the operative word is clueless but rather shocked that anybody is raising a stink. This is business as usual for filthy Chicago politicians like Blago, Emanuel, and Obama. They are so corrupt they don’t understand that this kind of stuff is illegal. On top of that, at any other time, Blago would be defended by the Democrats but they are too busy trying to keep the taint of corruption off of Obama (it isn’t working) and that means Blago gets introduced to undercarriage of the Obama Express.

Mark my words, Obama isn’t even in office yet and he will go down as the most corrupt politician in the modern age- Nixon and Truman included.

The most reasonable explanation I’ve heard was that Fitzgerald needed to act before Obama took office at which time some yes-man would be appointed US Attorney and sweep all the corruption of filthy Chicago politicians under the rug. Obama and the rest of these filthy politicians needed to go down before Obama can cover up his crimes and those of all his cronies including Emanuel and Blago.

I recall an article on that. She was not willing to work her way up the firm ladder. New associates get dull work – reviewing documents, doing research, trotting along with the partners to depositions, meetings and court (associates are sometimes called “bag carriers”). She wanted to work on big, exciting cases right off.

She also did not play her office politics right – I recall it said that she went to personnel and complained about the department to which she was assigned, and wanted a different one. Definitely a bad mistake. You do time where they initially assign you, and then when they say it’s time to rotate, you politely express interest in where you’d like to be.
