Illinois legislature moves to block Blago

In the wake of the arrest of Governor Rod Blagojevich for attempting to sell the open US Senate seat to the highest bidder, a question remains: how does the opening get filled? As of this moment, Blagojevich can still appoint anyone to the post, including himself, as his remarks on wiretaps show Blagojevich serious considered. The state legislature will move quickly to strip him of that power:
The state’s top two legislative leaders Tuesday said they will move fast to seize control of the process of selecting a replacement for Barack Obama in the U.S. Senate, taking that power away from Gov. Rod Blagojevich.
In separate statements, House Speaker Michael Madigan and Senate President Emil Jones said they will call a special legislative session next week to repeal the state law that now gives the governor the power to fill Mr. Obama’s seat. Both said they will press instead for a special election to fill the remaining two years of Mr. Obama’s term.
“I am prepared to convene the House next Monday to change state law to provide for a special election for the U.S. Senate replacement,” Mr. Madigan said. “I would urge U.S. Sen. Dick Durbin to take note of this action.”
Durbin and several of the Illinois delegation on Capitol Hill called for action to hold a special election as an alternative to appointment. The Democrats find themselves on the defensive and have worked to distance themselves from the always-controversial Blagojevich as they face the specter of a statewide meltdown in Democratic politics. After all, the affadavit used for the complaint notes at least six potential candidates for that appointment, and speculation has already begun to put names to the numbers — and undoubtedly they will all be prominent Illinois Democrats.
Emil Jones has come under scrutiny himself as one of the potential suspects for Candidate #5 — the candidate Blagojevich thought would “play ball”. With that hanging over his head, we can probably count on Jones to push hard for the special election as a way of minimizing his exposure in this scandal. After the wiretaps go to the grand jury, however, all bets are off. The grand jury can indict anyone connected to this case, and Illinois lawyers may find their phones ringing off the hook to defend politicians.
Unlike similar but milder scandals in New York and New Jersey, this could have a strong affect on state politics. It wasn’t that long ago that Illinois elected Republicans to statewide office. Not until George Ryan left the governorship to serve a prison sentence and Jack Ryan lied about his divorce records did that change, and that was within the past decade. If this case leads to a series of indictments against Democrats in high places, that seat Obama vacated could get filled by a Republican, as well as the positions vacated by the indicted. Democrats like Durbin understand this and will try to get ahead of the outrage to the extent possible.
In the meantime, the Illinois legislature has made the right move. If Blagojevich outruns them and appoints someone to the post, the US Senate has a duty to refuse to seat the appointment. Dick Durbin should announce his intention to lead that effort in order to force Blagojevich to back off.

Would the Obama successor be any less tainted if it’s confirmed that the president of the senate (E. Jones) is candidate #5 and has an active role in the effort by the Illinois senate to fill the seat? After all, if Jones is candidate #5 it seems to me he’s just as corrupt as Blogo.

I am waaaaay past winning elections only because the other party is currently perceived as being worse.
The GOP in Illinois are weak, ineffective and liberal. There’s no good reason to get excited about possibly returning them to power.

i would think that at this point, the Gov is only accused, not convicted, so he would still retain all of his powers. Seems similar to me to how Sen. Stevens was allowed to run for re-election since he was not convicted of anything (yet). Accused or indicted isn’t the same as convicted.
As mentioned, no one in their right mind would want to be Blogojevich’s appointee/ Although there are no facts yet as to who Candidate 5 was, THAT is what I want to know.
I’d love to see this drama drag out for the next 12 months or so, with more dirty Chicago politicians bobbbing up to the surface.
When an administration changes hands, is it common that they change federal DA’s? So when Obama takes ofice, will he remove Fitzgerald, or allow him to continue an ongoing investigation?

***IF*** repeat *****IF***** there are any incriminating tapes of PE obama being illegally involved in the sale of the seat, then I would think that Fitz would try to bring things to a head before the inauguration.
Can a president be indicted? I’m not sure about that but it appears that Fitz was going after bush and cheney with the plame thing.
So, we’ll see if there is a quick resolution prior to Jan 20 or this thing goes on its way without tarnishing THE ONE.

I know Blago hasn’t been impeached, or resigned, yet. I just meant I assumed one of those two options is imminent. I was pointing out that by calling for special elections, the Dems are signaling that they have no intention of pushing Blago out. That’s curious. Do they risk keeping this on the front pages for a long time to protect one of their own, or should they take the hit upfront?

Blago is poison now, no Illinois democrat will accept an appointment from him. Met with a few Republican house members last night and the discussion was more about the Democrats running for cover since we all know more heads will roll in the near future.
Illinois Attorney General was on the radio yesterday emphasizing how delusional Blago is. Madigan stated that everyone must now know how delusional Blago is and therefore, he can’t be trusted one bit when he tries to drag others into this mess. She went so far as to say that even those who participated in some of these schemes shouldn’t be held accountable because there was no way for them to know how corrupt and delusional Blago was, therefore, they could not have known they were getting involved in criminal activities.
Gotta love Illinois politics.

For the president-elect, the case made for a big distraction from transition business. It overshadowed Obama’s meeting in Chicago with former Vice President Al Gore to discuss climate change and energy policy. He told reporters the alleged “pay-to-play” over his Senate replacement caught him by surprise.
“I had no contact with the governor or his office, and so I was not aware of what was happening,” Obama said.
As he worked his way up from the state Senate to the U.S. Senate, Obama was often at odds with the Democratic machine in Chicago. Nonetheless, he built alliances that have at times caused him political troubles. LINK

Incidentally, I believe the Lt. Gov. is also represented as having been present for some of the pay-to-play discussion. I wonder if there are there honest elected officials in Illinois.

Obama cannot let Fitz go now even if he wanted to. This is too high profile and would look really bad, especially considering Obama’s deer in the headlights response to the whole crisis yesterday.
The Lt. Gov (Pat Quinn) is a maverick Democrat and is not well loved by the Combine. Durbin and friends are afraid that he’ll appoint someone who isn’t part of the Daley friends and family circle, so they’d rather risk a special election than have Quinn make the appointment. The assumption is that IL is so Democratic and the Rs. there are so disorganized that it would be difficult for the Rs. to pick him off.
However, I think that the Rs. will run a stronger race than the Ds. expect and will be able to take the seat. Mark Kirk (IL Congressman-R)has really been eyeing a statewide race in 2010, and running in a special election has no downside for him. Of course, he’s a moderate (especially on social policy), but he really is probably the only sort of Republican who could win in IL. He represents the North Shore and plays well with the upper-middle class professionals (i.e. “white people”) that Rs really need to recapture to start winning elections again. The RNC will probably pour lots of $$ into this race as a win in the Messiah’s backyard would be an important psychological boost for 2010.

I don’t think the legislature can just pass a new law saying the US Senate position has to be filled by some means other than appointment by the Governor. Isn’t an amendment to the state constitution required in order to make this change? If so what is the process by which Illinois amends its constitution? How long would that take? It seems the more expedient thing would be for the legislature to prevail upon Blago to resign and then have the Lt. Gov. move up and make the appointment through a very transparent selection process.

Dumb question: If the Illinois legislature passes a statute revoking the Governor’s authority to appoint for vacant federal elected positions, doesn’t that bill need to be signed…. by the Governor? Or does Illinois do things totally differently than every other state?

This Blago is guilty as sin — but of what? Are they going to nail him on the children’s hospital deal? The threats to the Tribune? Scummy conduct but seriously, nothing a good trial lawyer can’t get him out of. So, my guess is the machine in Chicago has sent him a message to go quietly and the heat won’t be so hot.
The Black Caesar does not need this sort of distraction even before he takes office. So, he and Rahm will be happy to see Blago disappear.
So, my gut tells me Blago is being told to play along and he will not see a prison cell. But if he names himself to Obama’s seat or plops someone in there between now and next week, they will see to it that he boils in oil.

I live in downstate Illinois. Don’t blame all of Illinois for these corrupt politicians. They are elected by the area above I80 which is Chicago and surrounding areas. The Illinois constitution of the 1970′s changed the Senate from a geographical base to population base. This along with the population increase up north means Chicago and area control the elections. The Chicago Machine is deep and dirty and Obama is involved up to his eyeballs. But I am sure he will be protected by the media and the democrats.
