Breaking: Supreme Court declines to hear Obama birth certificate challenge

Denials of cert rarely come with explanations and this one’s no exception, although the math doesn’t lie: They needed four votes to take Leo Donofrio’s case and between Roberts, Scalia, Thomas, Alito, and Kennedy, they couldn’t get there. End of the line for birth certificate Truthers? Of course not. There are windmills aplenty still to tilt at, as Dave Weigel explains:

How much further will the fight to de-certify Obama go? It won’t stop if the Electoral College votes for Obama, as the skeptics will try to get a congressman or senator to officially challenge the result. Rep. Chris Cannon of Utah was willing to believe that Bill Ayers wrote Dreams From My Father, so the skeptics might have a chance.

And if every vote certification goes off without a hitch and Obama is inaugurated on Jan. 20? Gary Kreep is ready for that.

“When Obama starts signing executive orders and legislation,” Kreep says, “I’ll be filing lawsuits unless and until he proves he’s an American citizen. Some judge, someday, is going to want this proved on the merits. You can run, but you can’t hide.”

David Horowitz ponders the galactic clusterfark that might have been had the Court taken the case. If anything good comes of this, it’ll be Congress and the states revisiting the “natural born” qualification, which must surely be the single dumbest operative clause in the Constitution. Exit question for WaPo, which helpfully informs its readers that “right-wing blogs were outraged” when Souter turned down Donofrio’s petition originally: Care to name one?

Baldilcks, Scalia distributed Wrotnowski’s case for conference on Dec 12th. I’m wondering if Donofrio’s got screwed because Judge Sabatino lied about the procedural history on it. Scalia has been sitting on Wrotnowski’s case for 6 days. Maybe he was waiting to see what happened with Donofrio’s. I don’t know. This morning I declared America dead. But maybe Thomas, Scalia, Roberts, and Alito aren’t dead yet. We’ll see.

Which brings up an interesting side-note on the difference between dual citizens and solely American citizens – if there is ever a big problem, a dual citizen can always leave and go to the other country they have citizenship in. An American with no other citizenship has nowhere else to go. S/he is stuck. This is the contra-positive of the allegiance issue with respect to dual citizenship.

It’s funny, people are concerned that if Obama is declared ineligible, that the left will riot. If SCOTUS decides to not hear any of the cases, then who knows, the right (and pleanty of PUMAs) will riot. Half a dozen of one, six of another. Either way there might be riots, so at least let’s do the right thing and defend the Constitution. What lily-livered, yellow-bellied people live in America that they’re afraid of a little rioting? We, who once fought a bloody Revolution and a bloody Civil War. This would be nothing compared to that.

This other argument, that 64 million votes shouldn’t be cancelled — those 64 million people were voting for someone they thought QUALIFIED for the job. They voted for him under FALSE pretenses. The man they thought they were voting for doesn’t exist. Once many of them find it out, they will be hopping mad that they were duped.

It’s just uncanny how America mirrors Kenya right now. What’s the quantum physics term for matter having an effect on similar matter even if it’s very far away? That’s what this feels like – like America and Kenya are one unit. As one goes, so goes the other. It just feels weird. Nobody in the world thinks that Obama is neutral when it comes to Kenya. We know his heart is there; his book was all about that.

Romeo, I do appreciate your spelling this out time and time again, as I wouldn’t be nearly as good at it, nor would a lot of others.

I do think it is important to make these distinctions every time someone refuses to speak to them and just keeps repeating the same inaccuracies. I believe their intention is simply to wear others down, so people new to the story will never hear the facts.

A self proclaimed expert and a youtube expert, and Berg say they are forgery’s.

I have the quote from the official spokesperson saying that Obama was born in Hawaii…but that is not good enough because Berg say is isn’t right, but no other official is denying, only internet bloggers.

And not one official has said Obama has not met the criteria, not one real expert has come forward with any proof that he was not born in Hawaii…
And……….every person in Hawaii is given a certificate of birth to prove his birth, and not one instance in decades has been found as not be be the case.

We buy air time indicating that the lack of a valid birth certificate and clear citizenship makes it impossible for the Tax Refund checks to go out. It may also lead to the suspension of NBA and NFL games after 12/31/2008.

Actually there is alot of proof. in the 1960’s and after

Hawaii Revised Statute 338-178 allows registration of birth in Hawaii for a child that was born outside of Hawaii to parents who, for a year preceding the child’s birth, claimed Hawaii as their place of residence,”

There are hundreds of instances of infants born outside the U.S. then later recieving a “Cert. of Live Birth” from the state of Hawaii.

Perhaps Obama is one of them?? The ONLY way to know is to see the ORIGINAL BIRTH CERTIFICATE.

The SCOTUS could take this case and resolve it in Obama’s favor, legally.

They would demand to see his original BC and certify that it says that he was born in Hawaii. This aspect is a total deal-breaker, there’s no way around this if it says Kenya – so let’s just assume that the BC turns out to be all in order. But the SCOTUS has to check this.

As to the multiple citizenship aspect, they could rule that multiple citizenship doesn’t affect ‘natural born citizen’ status. There would be tons of problems with this definition, but it would, at least, maintain our law in the present. Of course, that would open a whole Pandora’s box of problems, but they might want to just kick that can down the road until it blows up one day, like the credit crisis did.

If you did a psychological profile of The One (a la CIA) you would find a personality that is probably messed up enough to sit on the Docs in Hawaii. That is right, just sit on them. Even if they were adequate to quench this controversy.

Go and try to deal with Ivy League types like the One. He doesn’t think that the “natural born” provision is important and he could possibly be showing off his legal brillance — and courage. What instructor in a mediocre law program wouldn’t likely get a kick out of playing a game with these opponents? Just a dreamy little diversion like you have after class. Impresses everyone.

Remember, he was found on tape discussing the redistribution of wealth by The Supreme Court for crying out loud! Wouldn’t that idea dazzle a classroom?

Checking the MSM news sites, even though this was being considered by the SCOTUS it’s not in the news. Palin snubbing Oprah is though…. welcome to the age of the ill informed public. I hope Obama is an natural born citizen for the good of the country. But it’s easy to have doubts about that with all the effort to keep his BC from public view, like his college years, like his Annenberg years, like his past associations, like just about everything about him.

I would think that anyone who takes Obama’s word on anything is gullible or a fool, looking at his whole record of “honesty” and “transparency”.

Still some concern

There is still a little worry about this ‘qualifications’ problem and the suits. The Chicago Tribune, Salon, CBS News and others have pulled out outright lies about statements by Hawaiian officials and the nature of a COLB mentioned above.

They don’t lie that much without a cause or reason.

I didn’t mean this case (D’Onofrio) but a bundle of the cases to address all questions of BHO’s eligibility. The SCOTUS’ twisted definition of ‘natural born citizen’ could then be fixed by an amendment detailing a more sensible definition (though I have 0 confidence that this would happen).

The big question is what SCOTUS justices want to go down in history with such perverted rulings in their names. The libs have no problems with authoring insane rulings, so it is a question of which conservative justice would like to go down in history as taking a dive on the Constitution and contributing to an unraveling of the US, even though it would all be legit at this point.

I just thought I would offer this scenario. Of course, it all falls apart if the BC doesn’t say Hawaii, which is the source of most of the fear for those who don’t even want this case taken, I think.

actualy, on a strict constructionist view… the dual citizenship could be the bigger problem.

Its the clear intent of the Founders NOT to have competing loyalties… which is why they put this thing in there in the first place…

They wanted a President to pass both tests for citizenship… ie… born on American soil, and of an American Father… and thats the last set of writings that I’ve been able to find on the subject…

I wonder if people can sue the secstates ex post facto.

IOW, form a political action committee (527?) to start suing the SecStates of each state demanding that they validate the candidates. I’m not a lawyer but I’m wondering if that would work.

IE. I think there is more chance of having snowmobile races in a loiuisian bayou than having the Supreme Court of the People’s Republic of New Jersey demand that the SecState produce evidence of comliance with eligibility. However, maybe that woudl work in a couple of the red states. Better yet, a red state that went to obama. ie.. one with a supreme court that would really care about the constitution even though obawhoever won in that state.

oops, that wouldn’t make the news. as someone said Sarah might be at a turkey butchering or snubbing oprah.. Gotta keep focused..

My wife picked up on something way before the election. It was an article about how Kenya was going to lengthen the runway and facilities to accomodate Air Farce One. Again, this was WAY before the November election.

That seemed a bit odd to me at the time.. Reading through about the Quantum Entanglements and dual loyalties, I’m really starting to wonder. …

I also heard it on some CBS radio news.

Is he saying the Constitution is a living, breathing document? What happens if in two years it’s discovered that barry isn’t a legitimate candidate? Then will it be ok for arnold to run for president?

On further thought, the Kelo group could make the ruling I proposed (again, assuming that the BC is in order, to begin with), but the conservative justices might resign instead of even going along to be the dissent. I would resign, rather than take part in any Court that would come to such a decision.

My first post on this issue was way back around number 130, since then over 500 more post. I have read alot of them. A few things stand out in most of these post:
- if you love Obama, it does not bother them where he was born, they could give a rats a#$. And could care less about what the consitution says. Remember to these people the consitution is a living and breathing document.

- if you dislike Obama, and want to know the whole truth, you get accused of being a wack job, angry right winger, a truther (by a employee of this site, thanks allah)

the funny thing is the one thing that would make each side say na-na-na-a-boo-boo stick you hand in poo poo. is the same thing.

At this point I’ve finally lost all hope in any ‘legal’ methods of fixing our shattered nation. This does it. American voters have elected three bad apples in a row with NO sign of a change in the pattern. Our so-called gatekeepers are totally in the tank. There were two levels of citzenship back then…

Citizen, and Natural Born Citizen.

To be a Citizen under the 1795 statute, you could be born in America. You could be the child of an American Citizen Father. Or the illegitamate child of an American Mother.

Citizens have full civil rights…

Natural Born Citizen was somthing different, and is only mentioned in writings at the time, and the Constitution itself… ONLY the Presidency requires “Natural Born Citizenship”… its a bit higher standard than normal.

And the common understanding at the time was that you had to be born on America soil, and be the son of an American Father… ie meet both criterias for citizenship.

In fact the 1790 Statute on citizenship specificly said that being born on American soil was good enough to be a “Natural Born citizen”, but in 1795 it was REPEALED… to make them “Citizens”… ie… not meet the Natural Born Standard.

Intent is pretty clear to me… they thought about it and said wait, this 1790 stanard?… this is not HIGH ENOUGH for President..

While being the father of a U.S. Army Captain and U.S. Marines Second Lieutenant makes me prouder, I have also been a lawyer for 32 years after graduating from the Harvard Law School, and I think that with all due respect, David, you are not making the issue clear at all, but rather you are being a bit hysterical. The election was not held with the proposition before the voters that the express requirements of the U.S. Constitution for a person to be qualified to be POTUS could be ignored in Obama’s case. If Obama does not satisfy the Constitution’s express requirement of a POTUS to be a natural born citizen, then the U.S. Supreme Court, in disallowing what does not satisfy the U.S. Constitution, is not engaged in a radical assault on the U.S. Constitution.

I am sorry, David, but the U.S. Constitution always matters and we cannot avoid what is now the messy problem of determining whether the express requirement of the U.S. Constitution for a person to be POTUS is satisfied in the person of Obama. It is, however, messy now because of Obama’s actions and inactions. The lawsuits raising the issue have been around for a while, and the current problem stems from the fact that Obama has refused to release the original birth certificate and other documents that would either dispose of the question or show he is not qualified to be POTUS under the express language of the U.S. Constitution. What Obama has released does not conclusively establish that Obama was born in Hawaii and that he is a natural born citizen.

When the issue came up as to John McCain, he did a full public disclosure of all possible relevant documents and hired Larry Tribe and Ted Olsen to address the legal analysis to establish that McCain was and is qualified to be POTUS. Senate Resolution 511 reflects that conclusion. John McCain, a man of character, is a patriot who loves America and reveres America’s Constitution and who acted and acts accordingly.

What, in contrast, is Obama hiding? Why should not Obama adhere to the same level of conduct as John McCain?

So, the issue should be addressed by the U.S. Supreme Court. Granted, this is a terrible situation, but I repeat: it has arisen because of Obama’s actions and inactions.

Debbie Schlussel had this story back on November 13, 2008 she says; “if the signature on the document is in fact his, our next Commander-in-Chief may have committed a federal crime in 2008, well within the statute of limitations on the matter”.

In 2008 the rules in place for a couple centuries now are being ignored. Some are crying foul.

If the democrats had wanted the rules to be kept in EITHER election we would have no problem.

Bear in mind that if Obama is disqualified the most likely next president will be Hillary Clinton. Not exactly my first choice. But for me – as for most who don’t care if they are called “birthers” or any other sticks or stones in vogue – I don’t care as much about who gets in as HOW they get in.

I still want to see the birth certificate, because I do not know if Osama Obama meets the Constitutional requirements to be President.

What I do know is that no one running for — or elected to — such a high office has ever hidden, lied about and evaded his past to the extent Obama has. Not only are great chunks of his history suppressed, but no one from those hidden times has come forth to say anything about him.

Whether this is simply another example of Obama’s arrogance, his insistence that we lesser mortals should accept him because he expects us to, I do not know.

I would not hire a store clerk who was so unwilling to produce evidence that he is who he claims to be, that he has done what he claims to have done.

To allow such an individual to become the most powerful man in the United States is an act of incredible folly.

Moreover, it makes a mockery of the Constitution, and that is totally unacceptable.

If he produces the necessary, simple proof that backs his claim to be eligible, then so be it. He won, and I will accept — if not appreciate — his claim to the office.

But the Constitution is far more important than Osama Obama, and if he can’t be bothered to prove that he abides by it, he must go.

even if obama provides a birth certificate, i will make a two hour long dvd (with a directors cut released, then a take two released later on) which will use the vast powers and knowledge i gained through community college and out of context statements to prove my case. anytime i am given evidence that proves otherwise, i will cry conspiracy or provide them with a list of all the people obama killed on his way to the presidency (though he did conspire with the clintons on at least half of them).

The problem with the supremes chickening out on taking this case is that by doing so, they have left the issue unresolved. For all the lying about Obama actually having produced his birth certificate, intelligent people who have looked at the whole thing and have a half a brain know this is not true. I have a birth certificate that looks nothing like this computer generated thing he posted on the internet and I was born in 1958. There is no actual information on it explaining who was the doctor, what was the hospital, etc etc. These things are and always have been on birth certificates, (not CERTIFICATIONS OF LIVE BIRTH) since well before 1961. Obama has made a tremendous and very expensive effort to hide from public view not only his birth certificate, but any other records that may list him as an immigrant, (Columbia University entrance application) or any other paper work that may tell the truth about him from his own lips many years ago. There is a very definite feeling in the country right now that things are just falling apart. The rule of law seems to have go the way it has in Mexico. It has become a joke. The American way is becoming the game of “get away with whatever you can get away with”. A large percentage of the population is extremely angry about this.

Look people, the truth will come out in this case. Either Obama will be proven to be ineligible for the office or the “ultra right wing” crazies will have egg on their face for pursuing such a ludicris story.

But the fact is, it has not been settled. With that kind of animosity hanging in the air, bad things can happen. Many people thought the JFK assassination was over the fact that a large number of people in the country thought JFK stole the election and was an illegitamate president. I think he propbably did steal the election, but I wouldn’t condone shooting him for that. But with Obama, you have that same problem times TEN, at least. You have a president who, if after the fact is proven to have lied about his citizenship, will anger the entire country to extremes, half who are angry that he lied and should not be president, and half, who just don’t give a damn about the “legal technicalities” and just want him to be president anyway.

The supremes did us no favor by not putting this to rest once and for all.

Before the election I had a letter to the editor about Obama being a member of The New Party. It never ran in my small-town paper which has always printed everything. An acquaintance also had letters to the editor that weren’t printed and when he asked the editor what it would take to get published, the editor said, “You have to write something that won’t get me sued.”

I talked to the paper owner, who assured me that nobody had threatened to sue them and that Josh was just having some family problems and was distracted.

But for a while I’ve seen Fox become less reliable amidst complaints by Obama. And now I’ve seen bloggers and pundits I had respected suddenly saying, “Ooh, gross” to anybody who doesn’t try to blend into the media woodwork.

I think it’s junior high all over again. With media, credibility is everything. The MSM’s credibility is in the sewer except to ignorant people – who in turn think alternative media’s credibility is shot. It seems like Hot Air, Horowitz, Medved, etc are doing the Peggy Noonan trick: wanting everyone to consider them credible – even though the only way to be credible to morons is to be a moron as well.

I remember when someone first mentioned the birth certificate issue to me. I pooh-poohed it, not wanting to be a person who would make a mountain out of a molehill or try to steal an election on a technicality. But because I cared about the person who mentioned it I checked it out. I had no clue that there were contradictory statements by Obama and his relatives about what hospital he was born in. I didn’t know any of that stuff. Still I thought Obama couldn’t have gotten this far without any scrutiny.

When Berg filed suit and Obama chose to fight it, everything changed for me. Obama himself gave this credibility when he chose a high-powered (CAIR) lawyer rather than simply show his BC like McCain did. I realized then that he had NEVER been scruitinized in even the most basic sense – and he was fighting it claw and tooth.

I didn’t want to be a “Truther” type. I wanted to be able to look down my nose and tsk-tsk at those morons who believe everything they’re told. But out of respect for my acquaintance I checked out the facts and gave it a fair shake.

Those who are embarrassed to do the same – the Peggy Noonan types – are disrespecting us just like the MSM disrespects us. They think we’re gullible idiots. Rather than check out the facts and dare to stand on facts, they chose to separate from us and say, “Ooh, gross. I’m glad I’M not a nerd like them. I’M one of the cool gang. I fit in with the popular people.”

But we’ve had a credibility shake-up in the media world just as surely as in the financial world, and we have to start over at square one in the process of building trust. We don’t know who we can trust to tell us the truth, the whole truth, and nothing but the truth.

We can throw around “image” just like Wall Street throws around stocks, but when push comes to shove a man’s word is worth nothing if it never matches reality on the ground. And the people we will find credible are the peope who deal in facts. The “cool people” need to learn they don’t gain any points with the rest of us by “image”, but by reporting reality.

Actually, it’s happened once before – Chester Arthur. His behavior was identical to Obama’s. And now – over a hundred years later – we know why: He knew he was not a natural-born citizen.

The only question that matters is:
was it possible for a biracial child born in Kenya at the time Obama was born (ie under British rule) to have dual citizenship in Kenya and the United States?

Once we have a Kenya law EXPERT testify on this under oath (sorry, not YOU right2bright or allahpundit -)
then we can proceed to:

Was it also possible for a minor to be an Indonesian citizen AND to have maintained dual citizenship while attending Islamic school (as Obama did) and where are the records of such?
If Obama’s team has not responded by the Dec 1 court deadline that was set, is that not contempt of court?
And regardless of the C O L B, if Obama’s selective service documentation is shown to be fraudulent, is that enough to disqualify him from the presidency?

Once again I have to question what Hot Air has to gain by mocking these concerns – has Michele’s ‘baby’ been kidnapped?

I gotta add this, according to the Obama camp, and honestly I don’t know which one because they have clammed up so tightly about this whole issue, Obama’s mother and father flew to Hawaii the day before he was born, in Hawaii. Are we supposed to believe that a woman hours away from labor was allowed to board a plane from KENYA to HAWAII? That didn’t happen in 1961 folks. Planes were slow and they would never take the risk of having a baby on the plane. I don’t even think you could get away with that today.

Excellent post.

However, at this point, I don’t think there’s any way to rebuild confidence in our important institutions. Like a bear market, there will be rallies in confidence, but in the end the trend is down, down, down, because we have all seen how things can really go. In good part, this is due to political correctness – which demands both lying and pretending not to know that something is a lie, to spare the tender emotions of some hypersensitive people and to alleviate the illusory guilt of others. But, those lies can’t be contained anymore than the misvalued risk from the sub-prime loans could be contained. This is the cost, and it’s a whopper.

He could have put this to rest months ago and he did not. (and by the way he did not with the certification of live birth for you obama lovers out there).
