Breaking: Supreme Court declines to hear Obama birth certificate challenge

Denials of cert rarely come with explanations and this one’s no exception, although the math doesn’t lie: They needed four votes to take Leo Donofrio’s case and between Roberts, Scalia, Thomas, Alito, and Kennedy, they couldn’t get there. End of the line for birth certificate Truthers? Of course not. There are windmills aplenty still to tilt at, as Dave Weigel explains:
How much further will the fight to de-certify Obama go? It won’t stop if the Electoral College votes for Obama, as the skeptics will try to get a congressman or senator to officially challenge the result. Rep. Chris Cannon of Utah was willing to believe that Bill Ayers wrote Dreams From My Father, so the skeptics might have a chance.
And if every vote certification goes off without a hitch and Obama is inaugurated on Jan. 20? Gary Kreep is ready for that.
“When Obama starts signing executive orders and legislation,” Kreep says, “I’ll be filing lawsuits unless and until he proves he’s an American citizen. Some judge, someday, is going to want this proved on the merits. You can run, but you can’t hide.”
David Horowitz ponders the galactic clusterfark that might have been had the Court taken the case. If anything good comes of this, it’ll be Congress and the states revisiting the “natural born” qualification, which must surely be the single dumbest operative clause in the Constitution. Exit question for WaPo, which helpfully informs its readers that “right-wing blogs were outraged” when Souter turned down Donofrio’s petition originally: Care to name one?

I wonder what the next “stupid part” of our basic law will be run over by people on the streets? The proof is here – just enough itimidation and anything goes.
The clock is very close to midnight, as we have skipped right past a Democracy to an Ochlocracy. At least many of those arguing to ignore the law are being explicit enough that it is fear of the mob that is the ruling order of the day. Now they will see how the mob develops …

Why am I worried???
At one time a country called Zimbabwe was very prosperous producing 4 times the food it needed. A marxist from another country (rhodesia) named Robert Mugabe took over. Mugabe had a lot of awards including a sort of Knightship from the queen of england and tons of honorary degrees including US univeristies.
Withing about a half dozen years, Zimbabwe went from prosperity to starvation as Mugabe replaced the prosperous white capitalist farmers with his socialist AK47 weilding goons. I read the other day that their inflation rate is something like 230,000,000%.. Look it up. That isn’t a joke and neither are the hundreds of thousands of starving people.
I’m NOT saying that obama is going to do any of that. What I am saying is that we have seen a once propserous country decay into a Mad Max state within a half dozen years thanks to a marxist foreign born president. Of course, the US has a bit more resources and a lot further to fall but it has happened and it could happen again.
Show us the cert and let us believe that you are a true american eligible to hold office and not the guy who grabs his crotch during the national anthem.

Hey, great job. Throw out the ridicule, along with absolutely zero evidence to back up your claim. The truth is there has been absolutely no birth certificate produced. The only birth certificate actually produced to the public turned out to be a fake. The certificate of live birth, which many such as Allah claim is perfectly suitable to end the argument, can be typed up long after the actual birth and basically proves nothing. The ONLY evidence Obama has given is that somebody in Hawaii says they’ve “seen it.” Allah bases his entire trashing of the controversy on a person who says they’ve seen it, and a newspaper report of the birth, which requires nothing more than a phone call to the newspaper. I could call several local newspapers today, and tell them that I’d like to report that Allah Pundit was born this morning, at 6:04 am. It would be printed in the paper the next morning.
Never mind that every single hospital in Hawaii has denied that Obama was born in their hospital. Never mind that Obama’s grandmother has said that he was born in Kenya. Never mind that he traveled after age 18 on a Kenyan passport, which requires Kenyan citizenship.
Forget all that, because … THAT would be a conspiracy!
The amazing thing is that all of this could simply go away, if Obama simply were to produce his birth certificate, but to people such as Allah … this is just an absurd request. I hope Allah doesn’t have any kids playing Little League baseball. I’d love to see him try to avoid producing his kid’s birth certificate, and see how far it gets him.

One thing is for sure, laws need to be changed so that a person must prove these minimal qualifications BEFORE the name is put on the ballot. Why is SCOTUS even being put in this position? The argument seems to be it’s too late now but why the hell could it even happen to begin with?
There’s nothing good about that and it’s a vital clause.
The President should have no other loyalties. Why is this important? Well let’s take Ahrnold. Does anyone here really think he would nuke Vienna if the situation called for it?

Probably Obama would, he’s one mercenary SOB when it comes to his career but I don’t think we should have to count on that.

Top is a good diseration about McCain status… the Constitution is clear that there can be no Ex Post Facto law, and McCain was born BEFORE the law was enacted to make hims a citizen under that statute… which grandfathered back to 1904… ie, if he is made a citizen, by STATUTE, then he is not a Natural born citizen, but a Naturalized citizen (thats the nature of the legal debate).
Bottom is an alleged copy of his birth cert… showing he was born in Colon…

I often read people I disagree with. I think it has contributed to what little mental health and intellectual honesty I possess. And I feel that Allah is a conservative at heart. I just wonder about whether he’s uncomfortable with being an outsider. And, like everyone who works for a living, he doesn’t make all the decisions. But if we aren’t willing to tolerate a little division we’re no better than animals or Democrats.

At this point, that’s not what they’re being asked to do. They are being asked to simply require Obama to produce his birth certificate. Why is this so tough?
What to do about it, if it should turn out that he’s not natural born and he’s been lying all this time, would have to be dealt with later.

Part of our problem is journalists who don’t know how to do their job. They consider “research” simply to be parroting what another journalist has said. As a journalist, I’ve run across this since I began my career. (And because I have always gotten to the original sources, I became a highly-sought after – and apparently rare sort of – journalist.)

Oh, and OF COURSE, the only reason a fake birth announcement would have been placed in Hawaiian newspapers is because the Obamas had a “fortuneteller” predict Obama’s run for office. It couldn’t have been because Indonesian, Kenyan ? citizenship with a teenage American mother is as useless as an elevator in an outhouse, if not a huge pain in the rump.

To explain further.
the bottom like, to Hannitys website allegedly shows McCains birth cert, showing he was born in Colon Hospital.
This is a still existing hospital in Colon, and was in the Canal Free zone back then.
In 1937, the Congress passed a Law which granted Americans born in the Canal Free zone citizenship. In the law, they Grandfathered everything back to 1904.
However, McCain was born in 1936. So, for at least some months, he was NOT considered to have been born on American soil, and was only made so by statute.
One definition of being a Naturalized citizen, is if you are made citizen by statute. If you are Naturalzied, you are Not Natural Born…
Muddy, but the law works off definitions and technicalitys.

Assuming your premise is valid (and I don’t think it is, but never mind that), McCain didn’t win. Obama won. What matters is a) what the Constitution says about eligibility for the office of President, and b) whether the President-elect fits that requirement.
Either he does, or he does not. Nothing else matters. Not even the number of people who voted for him.

What do you think a “blog” is? Why do you think they even have a comment section? So, if I’m understanding you correctly, which I’m sure I’m going to be told that I’m not … people who don’t think Allah should be writing for HotAir should just not read HotAir, and certainly should never comment.
Again, we come here to read the stories that Ed and Allah link to. We usually find ourselves commenting on those stories, but unfortunately, Allah’s personal viewpoints that he purposely makes clear, many times in sarcastic and degrading arrogant tones toward his readers, seems to redirect those comments toward Allah himself.
If Allah doesn’t want the comments directed at him, he can always simply link the stories without the elitist snobbery.

Frankly, while I didn’t vote for the guy, I just don’t believe Obama is fool enough to spend two years campaigning for an office he isn’t qualified to hold. He was qualified to hold a seat in the senate, were there demands for him to prove his citizenship back then? Surely he had to show proper ID to get a paycheck. The laws are very strict about I9 forms now, my organization even held a 2 hour training class on what qualifies as proper ID. You can’t get a job here without proof of citizenship. You can’t get a passport without a legal certificate and I’m pretty sure the man has a passport for crying out loud.

Actualy, for me its all about who VETS this information, and does a citizen have the RIGHT to ask these questions.
Many States have laws that require their Secretary of States to ensure that those on the Presidential ballot fit all the legal Requirments…. they clearly are not doing so or some Sec State somewhere would have brought this to court themselves.

The logic behind that argument is weak at best. Here’s why, Obama’s sister, who was definitely born in Indonesia has a Hawaiian certificate of live birth. It isn’t prescience that drove the decision to have the certificate made, his sister isn’t running for US office. This very fact is part of why so many people have asked to see the long copy, because Obama’s mother could just as easily have done this with him.
But that isn’t the case that was the SCOTUS decided not to hear.

I don’t think it is at all unreasonable that we ask people who run for office to produce a long-form birth certificate to prove they fulfill the “natural born” requirement (whatever that means). How else are we supposed to determine if someone is eligible? Frankly I was a bit alarmed to learn when all of this scuttlebutt started that, until this election cycle, the party committees just basically took the candidates’ word for it that they were eligible. These cases themselves are without merit, I think (to my mind, there’s no question that Obama is a U.S. citizen), but I do think they raise some interesting questions that could stand to be answered. I think this situation should be looked upon as an opportunity to define what “natural born” means, to determine whether having dual citizenship renders one ineligible (I kind of think it should, but I’m not sure how one would square that with the 14th Amendment), and to establish a procedure for vetting future candidates for eligibility.

It all boils down to whether or not one is willing to confirm your neurosurgeon is board certified and qualified or are you willing to accept a fuzzy fax copy from a Kinko’s in Lubbock, Texas to a shifty guy named Dan. Or, are you willing to let anyone who happens along to manage your business finances or are you careful enough to see that their certification as a C.P.A. on their office wall is legitimate or a fuzzy fax copy from a Kinko’s in Lubbock, Texas to a shifty guy named Dan.
It is not too much to ask from the lazy Supreme Court to certify eligibility for the office someone is elected to hold. Otherwise, it is merely another episode of preferential treatment to constitute Obama’s coronation with the fake styrofoam Greek columns instead of the Constitution that these various USSC justice clowns purport to be sworn to uphold.

like others is making the mistake that Obama’s Mom placed the birth announcement in Hawaii newspapers under prophetic guidance (or alleging that the right-wingers feel such). Nope, the birth announcement was made to ensure that her son grows up as if he was born a US citizen. She obviously knew about the ability to get a Hawaii birth certificate with a foreign birth. All evidence (not 100% verified) presumes she 100% wanted to give birth in Hawaii but was denied entrance on plane because they feared she’d deliver inflight, so perhaps the mother acted the way she did because she had it all lined up ahead of time to act that same way. Every American wants their child to be a USA citizen. (forget the “natural born citizen” issue). Maybe she knew about the technicality that because she was 3 months short of being 19 that he wasn’t technically a USA citizen and wanted to obfuscate things the best she could to at least get Obama normal citizenship.
These issues are legitimate issues and deserve discovery and it looks like until criminals are indicted under future Obama-passed laws, that society will not know the truth. I do not believe this issue will go away until the truth is out.

They’ve confirmed, as best they can, respecting Hawaiian privacy laws, that yes, Obama was born in Hawaii. The trouble is, you don’t care what they say.

Pathetic effort. Trig Palin is not a public figure nor is he President-elect.
John McCain’s father was in the Navy, serving his country, at the time of Baby John’s birth. He is, therefore, an American Born Abroad. My granddaughter was born abroad, under similar conditions. She is an American, born to Americans, with no dual citizenship eligible or offered.
My grandson was born in WY, but we ran birth announcements in the paper here. That doesn’t make him born in Texas any more than a printed announcement in the Honolulu newspaper means 0bama was born in Honolulu. He might have been. But given the fact his mother was a clueless twerp, he is just as likely to have been born in Kenya.
I don’t expect 0bama will have the decency to cough up his birth certificate–he has more hubris than W and Nixon combined x2–but that does not remove the responsibility that he should.

There is no doubt in my mind that progressoverpease is right about that one. The world is watching Obama spend a fortune to avoid producing a long form birth certificate and a whole host of other documents.
How does that look?
It makes him look WEAK. It also makes him look like he is afraid of showing the document because it would show he is not a valid candidate for POTUS. This could easily be proven 100% wrong by producing the darn document.
Why start a presidency under these kinds of doubts?

Please provide a URL showing a quote by a Hawaii official stating that Obama was born in Hawaii — I have only seen statements (quotations) that they have his long form birth certificate on file and that is the extent of what they’ve stated. Nothing more. You appear to read the journalist’s conclusions as if they were the source’s statements — a fallacy. PS, Ed has made the same mistake. I asked him for URL for his similar statements and he never provided one showing a quotation or written statement from a Hawaii official validating Obama was born on Hawaii soil.

Try that trick the next time you’re asked for your birth certificate, or your child’s. Go ahead! Just tell them to call the State you were born in and ask them. I’m sure they’ll accept the word of whoever answers the phone.

My sarcasm wasn’t thick enough, I suppose. I agree that it was convenience and not prescience that spurred the Hawaiian birth announcement. As Marine Bio pointed out, Maya has two BC’s, one for Indonesia, one for Hawaii. The mother was a liar and a fraud; the apple didn’t fall very far from the old tree. Nobody will ever care about this.
For the record, knowing what there is to know about Obama, he is a POS on many levels. I feel dirty that he is my President because of Wright, Rezko, Ayers, the land deal, the people who froze to death in Chicago, little Curtis who had his skull crushed by a rusty gate while he rode on his tricycle, FNMA / FMAC, fraudulent donations, “Bittergate,” sexism, nepotism, neo-McCarthyism and Joe the Plumber. If it turns out Obama is a Muslim and a foreigner, that’s just icing on a nasty rat poison cake.

I’m not asking the State of Hawaii to do anything. My expectation of showing the proof is solely directed to Obama and of the Supreme Court to hold Obama to that obligation for the office he seeks. No different from any of us whom have had to demonstrate qualifications for jobs albeit without the pomp and circumstance (and vanity) of Supreme Court involvement.

Hawaii, by statute, cannot give out any Birth Cert information. They cannot confirm, nor deny… all they have said is that he does have a LEGAL Birth Cert….
So, how can they therefore confirm that he was born in Hawaii?
Even if they came out and announced that yes, the COLB that we have seen pictures of is a Valid Hawaii COLB… that still does not say address the legal complication that COLBs and even Birth Certs are routinly modified during Adoption proceedings… and Barrack may have been adopted not only ONCE, but TWICE (Soetoro, then either Grandparents, or an Unadoption?… his name did change from Soetoro then back…).

For the people asserting that Obama’s not a citizen because HE HASN’T PROVED IT TO YOUR LIKING, you’re committing initial logical errors that 9-11 Troofers commit (well, several actually) – I mean, apart from disbelieving Hawiian authorities because they’re not giving you the answers you want and such.
You assume:
1) He’s guilty and has to prove his innocence.
2) You’re pretending that you’re “just asking questions” and “just demanding he prove he isn’t what I say he isn’t.”
Evidence doesn’t work that way. If you think his BC is bunk or a fraud, then it’s on you to produce the REAL birth certificate – if there even is one (cue X-flies theme)
