1. Franken. Looks less like an arrow than a leaky pen.
2. Accept. If not, why not test each ballot for DNA too?
3. Reject. Please. The guy was testing his pen.
4. Franken. Self-explanatory.
5. Lizard people. He X’ed out the Franken oval.
6. Franken. Although people quite this stupid shouldn’t vote.
7. Coleman. Guy changed his mind, or else started filling in the wrong oval.
8. Franken. Please. Either a pen test or a change of mind.
9. Barkley. Arguably an even feebler challenge than the one AmSpec highlighted yesterday.
10. Barkley. See #8 above.
11. Reject. Looks like he was crossing out Franken, not underlining it, but too hard to tell.

I disagree with the Big A on two:
#5- The Franken oval is completely filled in, even if there’s a partial “X” through it. More importantly, the oval next to the “Lizard People” write-in isn’t filled in at all.
#6- Tough call, but I say reject. Perhaps they checked it because they were planning on coming back to it once they made up their mind; maybe they wanted to remind themself that they left it blank. Most likely the voter is simply an imbecile, but if they can’t fill in an oval despite clear instructions, screw ‘em.

My mother has an amazing painting of the Queen wearing a lobster bib and turning into a 12 ft lizard. It’s actually very tastefully done and is reminiscent of Andy Warhol, a contemporary artist Jane Hammond, and Sigmar Polke.

I agree with all of Allah’s points except #6. I would need to know if he voted every contest by checking and circling, or if it was just this one. In the former case, I agree that the ballot goes to Franken, but if this is the only one then it looks like he was trying to make up his mind and finally decided not to vote on this contest.
On #5 he forgot to fill in the Lizard People bubble so if it were my decision I would be inclined to either throw it out or count it for Franken> Buut I agree that the intent seems to have been to vote for Lizard People and discernable intent is what the law requires. Stupid law, but that isn’t the point.
I’m inclined to go for Coleman on #11 because that looks much more like a cross-out than an underline, but I agree it is too subjective.

#4 I would have to give to Franken but it is easy to see the person was to stupid to vote on their own so they took a template in with them, placed it on the ballot and filled in the circles. If you look at the filled in circles on the right side column they all miss align the same amount.

The intent on #5 seems to me to have “Lizard People” on every race on the ballot, not necessarily to vote for Lizard People for every race.
The guy voted “Lizard People” for President, for cryin’ out loud. What would make it so odd that such a person would write “Lizard People” as a write-in candidate even when he didn’t intend to vote write-in for that particular race? He’s obviously having some fun with his ballot.
There does not look like any indication to me that he wanted to cancel out his Franken vote.

As a lot who would vote for Franken are morons, a close examination would reveal their ballots would not be marked as clearly as Coleman voters. A visual recount then would give a lot more votes to Franken. Like Franken, they have difficulty following the rules. So they screwed up their ballot, and might have written in “I mean to vote for Franken”. So I see a manual recount as favoring Franken. Just a couple of hundreds ballots, and he’s won.

The displayed ballot is ambiguous. If the Franken line was completely obliterated, I’d tend to give it to Coleman. But a single line, again, ambiguous.

…the real kicker here is that the election was close at all…the sad fact that a meat-puppet like Franken could be whisker close to a seat in the national Millionaire’s Club, let alone on the strength of the vote of any moron who would write “Lizard People” on the ballot shows me that literacy tests and poll taxes need to be reinstituted…yank that amendment and test them puppies!
…only, this time it’s not to ensure that only one race votes…it’s to ensure that only one species votes….

I predict that the election comes down to a tie vote – until Al Franken rips off that ugly and obviously fake hood-mask he’s been wearing for so many years, and reveals the long-suspected truth that he is a Lizard Person, and the MNSC rules that the vote should go to him.
Poll tax? Literacy test? How about a sobriety test? How many votes would Obama have lost if being under the influence of psychotomimetics, hallucinogens, and/or mood alterers was disqualifying?

It’s the Minnesota version of the Democratic party. It’s what the Democrats used to go by nationally once upon a time. No idea why it’s still used here; perhaps a nod to farmers?

#1. Franken. Challenging this is desperation, but hey, if they go for it, great.
#2. Count it. Please, a fingerprint? Now that is desperation.
#3. No vote. Seriously, if they’re too stupid to fill a circle, they have no business casting a vote.
#4. Reject the ballot. The “no” is pretty substantial, so I can go with accepting it, but a better attempt should have been made, like scratching out the name. The “O” looks like a “D”.
#5. Franken. The oval beside his name is only filled in. If you want to make a case about the “X”, look at the ballot above it, and you’ll see what looks like an “X” through the oval for Lizard People on that one. It all comes down to “follow the damn instructions, stupid”.
#6. Reject, and for the same reason as #3. We can argue intent all day, but this one is just not filled in. If this person was trying to vote Franken, they’re too stupid to do it correctly, and should therefore lose this vote. RTFM, stupid.
#7. Personnally, I would reject this one too. It looks way to much like a double vote. It’s clear that this person started filling Al’s balloon, came to their senses, went straight for Norm’s. But leaving the filled part of Al’s constitutes a double vote. Some attempt should have been made to stress the no vote on one of the candidates.
#8. Al. A dot is not a vote, even if it’s the only one there. Unless there are others voted that way. But still, this is an Al vote or a double. And a dot is not enough to constitute a vote.
#9. Eraser mark > big filled oval? The vote goes to Dean freakin Barkley. Anyone who says otherwise is desperately reaching.
#10. Again, Dean Barkley. Sorry Norm, but you’re reachin on this one. The mark isn’t big enough to constitute a vote, but if it were, it’d be a double vote and not count for anyone.
Back to #7. The larger dot would show intent to vote for Norm. It’s just that the dot on Al’s is big enough to constitute a vote on its own ballot. Personally, I say anything more than 1/3 filled is a vote.
If intent is all that matters, then this would go to Norm (sorry Al, his was bigger, hehe). Anyhoo, that’s my take on it.

Recount progress: Coleman’s lead is down to 160.
Good news and bad news. Good News: Hennepin County is 26% recounted, netting Franken only 2 votes. Both candidates LOSING votes, destroying myth of undervotes.
Bad news: Franken nets 24 votes in St. Louis County, only 29% counted. At this rate he gains 83 votes there. Franken nets 13 votes in Ramsey County, only 15% counted, at this rate he gains 87 votes there. But trends may or may not continue.
Elsewhere, it’s mostly dribs and drabs, with Franken with a net 16 votes, and both candidates losing votes, which undercuts the undervote theory. There are a few large Coleman-favored counties that won’t be recounted until December. We may know the Senator from Georgia before we know the Senator from Minnesota.

I was a MN election judge for 6 years (including the Wellstone/Mondale v Coleman election in 2002).
Nearly all of these ballots were spoiled ballots and the optical scanner would have rejected them.
I voted “reject” for most of them with the exception of an obvious stray mark or a smudge.
When it comes to circled black squares plus filled in ovals, etc. I’m a stickler for the rules and the law. The directions to fill out a ballot are very direct and very simple. I do not want anyone, including me, to ever, ever judge intent. That is very dangerous and rife for abuse. It’s the reason MN went with optical scanning.
If a voter can not directly register intent, then what he has registered counts.
Period! End of story.

Amendment to above list. Didn’t see the Minnesota Statutes link (RTFM Stupid, and stupid = me apparently).
#4 is a take. He made his intent clear. But I still think the “O” looks like a “D”. If that’s the case though, the whole ballot would be null.
#5 is still a Franken. Though the statutes says that an individual’s name written in will be counted whether the oval is filled or not, “Lizard People” is a race, not an individual. Therefore any write in for “Lizard People” is null as only one person may be elected to this office. And since the ballot before it had an “X” through the oval for the write it, it can be assumed that the “X” through Franken’s oval meant the same thing. However, I have no problems if they decide to chunk it.
In response to the votes with simply dots, they can only be used if all the other votes used a similar mark (only a dot in the oval). Otherwise, they’re reaching.

Ah, I see. Question: if they’re truely spoiled ballots, then the voter would have gotten a replacement ballot, and allowed to try again, yes? that is my understanding of how it works here in Florida. And I’ve never, not once, had the Accuvote machine reject my ballot.

As an election judge, I can tell you that his is bogus because the scanner would automatically kick this ballot out and it would go into the spoiled ballot folder. The voter would then be given a new ballot and asked to try again. That is one good thing about these new scanners. Idiots are given a second chance.

It’s a safe bet that any state in the union using paper ballots is going to have many examples like these; stupid people are everywhere, and unfortunately they vote. Or at least try to.
Remember- roughly 50% of the population is dumber than average.
I suspect these ballots are being contested precisely because votes were rejected. I’m not sure what the law states regarding people voting again after submitting a flawed ballot. Could be that the law doesn’t allow for “do overs” once the ballot is submitted; I don’t know.

In Minnesota, the procedure is that the election official immediately writes “Spoiled” accross the ballot and initials it. Then it is put into a special envelope. Every precinct will have a few dozens of these. The voter is then given a new ballot. Either this instance is a joke or something smelly is going on. I suspect the latter. There are a small number of precincts in the Twin Cities that are run by corrupt precinct judges. I doubt that it reaches as far as the ward level, but you never know with liberals.

The more I think about this ballot that was shown to us is indeed a spoiled ballot and the voter would have to fill our a new one, this double marked ballot is a SPOILED BALLOT
and is returned to the election committee so the number of ballots given to a pricinct match at the end ie: number of signed for ballots, unused,and spoiled = number issued. If they are counting this ballot something is really wrong in Minn. Election committee should be charged, you can’t guess who someone voted for, their log would probably show this person cast a second correct ballot. This whole thing really stinks and nobody there seems to care. Apathy is destroying this great country.

I guess I tended towards the “throw it out” response most of the time. I don’t know what people are told elsewhere, but I’ve always been told that if I make a mistake, don’t try to fix it. Its a spoiled ballot -get a new one.
To counter my “throw it out” mentality, I don’t see any problem with writing in someone’s name and not voting for them. It may be a strange thing to do, but maybe “Lizard Man” thought it was necessary to fill in the blanks with something. Of course maybe that implies incompetence, which makes me lean towards throwing it out anyway.

They elected a former wrestler (Jesse Venturea) and complete numbskull Govenor, they elected an ex-football player (Alan Page) who had about two weeks exp as a lawyer on the Supreme Court. A local newscaster to the Senate (Rod Grams, who was great) and a guy who owned a plywood Store and was on TV a lot (Rudy Boschwitz, another good guy) also to the senate. Wellstone got in because they were facinated that he toured the state in a green bus. MN have a high opinion of themselves, but they are in fact a bunch of hillbillies in purple sweatshirts.

some of those ballots are pretty complicated to decipher, but only because of the stupid “voter intent” law Minnesota has. If you can’t read directions properly, then the ballot gets thrown out. some cases, the voters obivously wanted to vote for one candidate but accidentally touched the other candidates bubble. other cases are not as clear, such as the “underline”. I would throw that ballot out, but with their intent law, I would have to give it to Coleman. Who the hell knows though?

Honestly, I don’t do mind reading and cannot conjure that voter’s intent from the cosmos. It looks like they crossed out Franken but perhaps they meant to underline his name. I’d judge a ‘no vote’ for that office only (as I am also not Carnac the Magnificant either).

We use the exact same ballot format in Connecticut and for the love of God, having cast these types of ballots twice (primary and general election this year) I am utterly dumbfounded that anyone with an IQ above room temperature could screw one of these up.
It really couldn’t be easier: take few moments to look over the ballot and then fill in the bubble that corresponds to your choice.
They simply cannot make it easier to cast or easier to verify. Mark the bubble. In the event of a hand recount the votes are right there, clearly visible for all to see.
It’s Geico voting: so easy, even a caveman can do it!

Both campaigns are being downright absurd if Franken is arguing a clear erased mark over his name signifies a vote for him and Coleman is arguing that the voter intended to vote for Barkley in 8 when it’s so obvious that massive filled in bubble next to Franken’s name signifies a vote for him.

Why are we still not using electronic voting machines nationwide? I don’t believe for one second that an e-voting machine is more susceptible to fraud than this debacle we are witnessing.
I take it you’ve never done any programming? or hacking, for that matter. Let’s put it this way: a purely electronic solution would be the easiest to rig.
And you’d never know it was rigged.
