Schumer on the Fairness Doctrine: Just think of it as regulating pornography

He’s making a general point about government’s responsibility to oversee the public airwaves. If you’re willing to concede that they have the power and duty to keep one type of material off the air in the interest of the common good, then at least theoretically you’re willing to extend that principle to other types — like, say, political speech, to ensure “balance.”

This clip’s an even better turnout motivator than the Ayers clip, isn’t it?

At least he’s only talking only about the public airwaves, not cable or the Internet. I think.

The problem in his comparison is that pornography is entertainment, not political discourse. You don’t have the right to go into a public park and have sex so that everyone can see. You do have the right to go into a public park and speak your piece politically.

I’d be interested to see what enforcement mechanism is enacted to allow liberals speedy resolution of complaints that does not rely on occasional license renewals, while excluding AQ from making use of the process to obtain airtime.

I’m not. If the goal is balance, then any 15-minute porn flick would necessarily be followed by 15 minutes of religious instruction and/or abstinence teaching. Which I don’t see happening.

Government interference with political speech is an abridgement of our most fundamental constitutional right and we should not tolerate it. Any serious attempt to enact the Fairness Doctrine should be viewed as an act of war, a modern Fort Sumter.

There’s nothing to stop them from legislating internet and cable content.

My guess is, as soon as anything of the sort is enacted, a suit will be filed in a conservative circuit (like the 5th) on First Amendment grounds. Indeed, I hope it’s done before the Dems stack the appellate courts.

Anyone worried they will expand the supreme court to 12 justices to stack it with the three new justices, and the replacements for Ginsburg, etc., who will surely retire February 1st?

Leventhal on Fox is on the scene at the Philadelphia polling place where the Black Panthers were. Talked to two eyewitnesses who said that there were two guys standing in the doorway, one tapping a nightstick and saying “a black man WILL win this election.” Army vet said he walked right through them, asked the poll staff to have them removed; they either refused or pled no authority; guy calls the cops, cops arrive and escort one of them off; other guys lives in the building where the polling station is, so he’s still hanging around.
