Video: Cavuto goes nuclear on Menendez for spinning Obama’s tax plan

The O’Reilly/Frank meltdown aside, I can’t remember the last time I saw a TV anchor get in a politician’s face this aggressively. NC never quite calls him a moron or liar but he does come right to the brink, thanks to Jersey Bob’s McCaskill-esque tour de force of playing dumb as a simple question is put to him over and over and over again. For the record, and needless to say, Cavuto’s right about The One wanting to bump the top bracket back up to 39.6 percent.

Word on the street is that Menendez’s cryptic comment near the end about the anchors who’ll be leaving Fox is a reference to the Fairness Doctrine. I scanned the first half of the show to try to find what he’s referring to but didn’t hear any mention of Fairness (which, at least in its prior incarnation, wouldn’t apply to cable anyway). It’s probably just a nod to the fact that Brit Hume’s stepping down after the election, as if to say he wouldn’t mind seeing Cavuto follow suit.

I don’t think he was ill prepared. He had his spin notes down and did everything he could to deflect from reality. He knew exactly what he was doing. He just didn’t do it all that well.

Menendez was focusing like a laser on a positive talking point about cutting capital gains. The funny thing is, who is going to have major capital gains over the next few years with the stock market’s recent drops.

How about people who bought after the drops? Letting people know that you aren’t going to tax the crap out of them encourages more people to do it. More buyers translates into higher stock prices for the people who held on through the storm.

In fact, the fear that capital gains rates next year may be higher than they are this year may have contributed to people wanting to sell this year and lock in the current rates.

Look, I love Cavuto, but does he know what the HELL he’s talking about?

Cavuto’s talking about 28% Capital Gains rate and asking Menendez about that and Menendez is talking about 20% Capital Gains rate (for people earning over x/year… allegedly $250,000)…

… then Cavuto is mixing up the current 35% top marginal federal INCOME TAX rate with the new under Obama top 39.6% INCOME TAX rate.

Cavuto looks like a fool!

Exactly at what time frame did Cavuto say this? Exactly when did the argument erupt? Exactly what was the emotionally state of the men by this time… due in some measure to Cavuto’s repeated error?

By the way, I’m a huge Cavuto fan, but he’ll kick himself when he watches the tape.

It’s stunning. Either he is a) a complete idiot, b) he is lying about simple facts, or most likely, c) both.

He will probably be put in charge of the Bad Mortgage Loan Encouragement Committee, so he can destroy the remaining 60% of wealth in the country.

This is funny to me. Menedez is saying that Obama would raise capital gains back to 20%. Didn’t Obama say that he would let it go back to like 28 or 30% when he was interviewed by O’riely. Maybe I am messed up, but I am pretty sure that is what he said.

By the way, I love how the Obama campaign says they won’t raise the Capital Gains tax. That is because they will let the law expire and it will go up on it’s own. If you are retiring and need to cash out within the next 5 years, you have to vote for McCain, it would be detrimental to your pocket book if you voted for Obama.

The intro story mentions Reagan’s and Obama’s tax plans without saying what type of tax.

Cavuto uses the term “capital gains tax” repeatedly for several minutes into it, but uses the numbers for the income tax program. Menendez’ answers with the capital gains tax numbers and can forgiven for this because that’s what Cavuto calls them more than once.

An argument erupts based on this misunderstanding. Only after this does Cavuto correct himself by which time his guest is confused, I’d assume.

It’s right there on tape!

Love Cavuto. But he blew at least the first few minutes.

I had no trouble following Neil. There were a lot of numbers being thrown around because they were comparing Obama plan vs. current vs. Reagan era. But Menendez seemed too intent on his talking points to keep up with Neil.

You know something that will be really good about life after the election? Never again will we be subjected to a talking head parroting, “Barak Obama blah, blah, blah lower taxes blah, blah 95% of the American people blah, blah over $insert number here.”

Where has Menendez been for the last 3 mos? Buried under a rock? He gives a really good example of why Senators should at least have to pass the Civil Service Exam; it might force a retirement of at last 50% of the body – including Menendez.

Holy crap – I am not sure that Menendez knew the difference at the end! I don’t think he was avoiding the subject as much as he really didn’t understand the tax code. To be fair, he is from NJ – which means when in doubt, write a tax check. Does it really matter what it’s for? His way of thinking is that Obama is cutting the taxes in NJ because he is sending a welfare check to each citizen in the state – except for those who make $250K $200K $150K $120K a year. Those people only have to pay 20% on their capital gains!!!
Technically, Obama should claim he is cutting state taxes, sales taxes, and every other kind of taxes –
Woohoo!

Neil knew when menendez started spinning that 28% rate he was pushing capital gains. But I got the feeling Menendez didnt care he had a number he liked and was sticking to it.

Yeah, but only because Menendez switched the topic to income taxes. Neil asked about cap gains, Menendez answered with numbers on income tax. So Neil followed him there. Then they switched back to cap gains and Menendez quoted some wrong numbers. The item that kind of stunned me was when Menendez didn’t seem to know that 40% of Americans pay no income tax. Where’s this guy been?

Wrong. That Senate ass kept saying 20% for those making over 250K. The cap gains rate is independent of income. So when the Senate ass mentions 250K (he later in the segment says 200K btw) Cavuto assumes he’s talking about the INCOME tax. Then he goes back to saying it will be 20%, so Cavuto assumes he’s talking about the cap gains rate.

menenedez had no effing clue what he was talking about. cavuto would have had a better chance talking to my 10 year old about the topic.

Menendez, another perfect example of what my wonderful state has to offer. He fits right in with all the other hacks we generate here including Lautenberg, Corzine, Torricelli, Mc Greevy, etc. NJ voters assume the position like sheep every election and say “excuse me sir may I have another.” This is why eventually we’ll leave this state. I just hope someone is left here for them to tax out of existence.

if you’re an illegal… go home or get thrown out. come back the right way… we’re sick of paying for you with nothing in return. if you’re on welfare… start looking for gainful employment because i’m ripping out the financial IV. on health care, stop looking to gov’t for help… make it a priority yourself to save or acquire, etc. on social security… privatize… start diminishing benefits and transferring the money back to pockets of citizens for their own retirement management.

Cavuto did ask about capital gains, and Menendez immediately changed the subject to income taxes. Later Cavuto flubbed the two terms, but by then it was clear they were talking about income taxes, which Menendez after all had brought up.

All Neil needed to do to end the conversation was to ask Menendez one little question. And that question was: “Have you ever looked at the tax tables in the 1040 booklet?”

you are right on target here. Cavuto is one of the best people at FOX. plus, he’s a smarter interviewer than O’Reilley and without the smugness.

Sen Menedez knew exactly what he was doing and saying in an attempt to confuse the listeners, not Neil. I could actually see Cavuto’s forehead and cheeks turning red he was so upset, but he still held it together and skewered Menedez.

Cavuto was using business shorthand, which the Senator should understand. Terms like “marginal rate.” As early as 1:17 into it, he explicitly said “income” tax. At 3:24, they move on.

Menedez really isn’t up on the numbers, or he’s lying.

Obama’s leaky plumbing

Barack Obama discovers a leak under his sink, so he calls Joe the
Plumber to come and fix it.

Joe drives to Obama’s house, which is located in a very nice
neighborhood and where it’s clear that all the residents make more than
$250,000 per year.

Joe arrives and takes his tools into the house. Joe is led to the room
that contains the leaky pipe under a sink. Joe assesses the problem and
tells Obama, who is standing near the door, that it’s an easy repair
that will take less than 10 minutes.

Obama asks Joe how much it will cost.

Joe immediately says, “$9,500.”

“$9,500?” Obama asks, stunned. “But you said it’s an easy repair!”

“Yes, but what I do is charge a lot more to my clients who make more
than $250,000 per year so I can fix the plumbing of everybody who makes
less than that for free,” explains Joe. “It’s always been my philosophy.
As a matter of fact, I lobbied government to pass this philosophy as
law, and it did pass earlier this year, so now all plumbers have to do
business this way. It’s known as ‘Joe’s Fair Plumbing Act of 2008.’
Surprised you haven’t heard of it, senator.”

In spite of that, Obama tells Joe there’s no way he’s paying that much
for a small plumbing repair, so Joe leaves.

Obama spends the next hour flipping through the phone book looking for
another plumber, but he finds that all other plumbing businesses listed
have gone out of business. Not wanting to pay Joe’s price, Obama does
nothing.

The leak under Obama’s sink goes unrepaired for the next several days.

A week later the leak is so bad that Obama has had to put a bucket under
the sink. The bucket fills up quickly and has to be emptied every hour,
and there’s a risk that the room will flood, so Obama calls Joe and
pleads with him to return.

Joe goes back to Obama’s house, looks at the leaky pipe, and says “Let’s
see – this will cost you about $21,000.”

“A few days ago you told me it would cost $9,500!” Obama quickly fires
back.

Joe explains the reason for the dramatic increase. “Well, because of the
‘Joe’s Fair Plumbing Act,’ a lot of rich people are learning how to fix
their own plumbing, so there are fewer of you paying for all the free
plumbing I’m doing for the people who make less than $250,000. As a
result, the rate I have to charge my wealthy paying customers rises
every day.

“Not only that, but for some reason the demand for plumbing work from
the group of people who get it for free has skyrocketed, and there’s a
long waiting list of those who need repairs. This has put a lot of my
fellow plumbers out of business, and they’re not being replaced – nobody
is going into the plumbing business because they know they won’t make
any money. I’m hurting now too – all thanks to greedy rich people like
you who won’t pay their fair share.”

Obama tries to straighten out the plumber: “Of course you’re hurting,
Joe! Don’t you get it? If all the rich people learn how to fix their own
plumbing and you refuse to charge the poorer people for your services,
you’ll be broke, and then what will you do?”

Joe immediately replies, “Run for president, apparently.”

These interviews are incredibly difficult to watch (due to interruption after interruption), and somewhat amazing, that the Senator couldn’t even answer a question, and stated the same thing OVER and OVER again.

What are these guys robots? Is this what it takes to be a Senator? Is this some kind of “skill” to dodge questions, and play dumb? Where do they go to learn this?

you are right on target here. Cavuto is one of the best people at FOX. plus, he’s a smarter interviewer than O’Reilley and without the smugness.

I’d like all the Cavuto’s, the O’Reilleys, the Hannity & Colmes’s, etc to adopt one simple rule when they invited a spokeperson on their show. You get 2 chances to answer the question, and after the second time it’s posed, if you don’t answer, the anchor cuts your mike and the viewers just see the face and the lips moving…..

I am SO tired of the spin and the constant drone of talking points in place of actually answering questions. This simple rule would apply to everyone regardless of their party affiliation or their opinion on the topic being discussed. Soon, although there would be far fewer spokepeople willing to appear on these shows, at least we’d be assured of a semblance of an answer to the questions asked.

Cavuto is the best anchor on TV bar none. Fox is lucky to have him. They need to get more saturation for his business network because they do a great job there too. Cavuto calls it like he sees it. He’s the best in the business.

One of these days, yes hopefully one of these days, these conservative, or conservative leaning, television and radio hosts will learn do two things:

1) Invest in the technology that enables them to press a button turning off the other persons mic, forcing them to answer the question. They could talk all they want and no one will hear their propaganda. Then, tell them to answer the question or the interview is over.

2) Come with the documentation of your argument. Have it right there in your hand with dates, page numbers, and names.

These guys will lie right in your face – lying is acceptable to them as long as it achieves their goals – unless the good guys get wise to their tactics and come ready to play hardball, this stuff will continue.

Menendez knew exactly what Cavuto was talking about — he was obviously trying to obfuscate and deceive. Cavuto should have out and out called him a liar, because the level of dishonesty Menendez shows in this clip deserves that label.

Early on, Obama threw out several different figures for what he wanted to raise the capital gains rate to. I’ve heard 20%, 25%, and 28%. In the past several months, he has settled on 20%.

Obama wants to raise the top two income tax brackets from 33% to 36% and 35% to 39.6%. In 2008, the break point to jump into the 33% bracket for married filing jointly was $200,000. Unclear to me if Obama would move the break point up to $250,000.

In addition, he wants to remove the Payroll tax cap for those earning over $250,000. At first everyone assumed that would mean an additional 15.3% tax hike. Now Obama campaign is being purposely vague on how much they would raise payroll taxes for over $250K.

If Payroll cap was removed at full 15.3%, top marginal rate would raise to about 55%! On top of that, Obama wants to phase out some credits and deductions that effectively raise it even higher. We would suddenly have close to the highest top income tax rate in the world.

Just remember this. In 2006:
Top 1% earned 22% of income, paid 40% of income taxes
Top 10% earned 47% of income, paid 71% of income taxes
Top 50% earned 87% of income, paid 97% of income taxes
Bottom 50% earned 13% of income, paid 3% of income taxes
Bottom 40% pay no income taxes

This is already a highly progressive income tax system. Obama would significantly increase the progressivity.

Obama wants to give $1000 refundable tax credit to everyone, including the bottom 40% who do not pay any income taxes. Obama calls it a tax cut off of workers’ payroll taxes. This would fundamentally change social security to a welfare program.

The worst part about Obama’s tax plan is that it raises effective marginal tax rates, and thus discourages productivity, at both ends, because he has many deductions and credits that phase out as income levels increase. That is, for lower income earners who do make enough to pay federal income taxes, as they start to make more money, they lose some of their deductions and credits. Combined with payroll taxes, effective marginal tax rates on a family of four making as low as $30,000 would be over 40%.

Menendez clearly does not know the tax code. He was completely perplexed by Cavuto’s claim that there were some who paid no income taxes at all.

Talk-radio listeners and Hot-Air readers, please run for office! Quit your jobs and run! We need you. You demonstrate that you care about information more than image. Now it is time you make an impact and not just an impresion. RUN! Primary Menendez and others like him on BOTH sides of the aisle.
