Indiana SecState: “Multiple criminal violations” involving ACORN

posted at 2:15 pm on October 27, 2008 by Ed Morrissey

Indiana Secretary of State Todd Rokita has completed an investigation into the registration activities of ACORN, and he’s not mincing words about what he found:

Secretary of State Todd Rokita said Monday that his office has found evidence of “multiple criminal violations, including possible state and federal racketeering laws” in connection with fraudulent voter registration applications filed in Lake County.

Rokita said many registration applications filed by the Association of Community Organizations for Reform Now, or ACORN, had incomplete information or indications of fraud or forgery.

Rokita wants criminal investigations begun at the federal, state, and county levels.  The deputy AG has rejected the idea, but the FBI has already started a national probe into ACORN’s activities.  The mention of racketeering makes this a much more interesting case to follow.  If the feds can prove that ACORN execs systematically conspired to break election laws, then the RICO statutes allows the Department of Justice to charge the entire organization’s leadership with a multitude of crimes, which could put them away for a very long time.

If the DoJ wants to see this through to the end, they’d better act quick.  If former ACORN attorney and now-client Barack Obama gets elected President, I doubt that the ACORN probe will survive past January 21st, 2009, at Justice.

Obviously Indiana Secretary of State Todd Rokita is a racist. Any attempt at clamping down on voter fraud is really code words for suppressing minority votes, such as Cartoon Character Americans, Made Up Names Americans, Too Young to Vote Americans, No Longer Living Americans.

Funny how it is that the same type of problem, fraudulent voter registrations, crops up in state after state, and the only commonality is that the organization is ACORN.

I’ve been trying to figure out what the reaction will be if McCain wins.

I think that the level of hate and rage that the nutroots have has left them nowhere to go but either murder or suicide.

On the other hand, perhaps they’ll see that 8 years of screaming at the top of their lungs has not achieved the result they want and all that fury will disappear in a poof of smoke?

Somehow, I doubt it’ll be the latter, but, a girl can always hope.

The anger over this is stunning, and crosses almost all political lines. Only the looniest of the left don’t care, as they would rather steal an election than lose in a fair fight. Others are abandoning the ship on a daily basis. I believe this has legs.

This just came out Ed

Has a little more detail

In a letter to Lake County Prosecutor Bernard Carter, as well as the U.S. Attorney’s Office, the FBI and Attorney General Steve Carter, Rokita urged investigators to treat the inaccurate ACORN voter registration applications in Lake County as vote fraud, “not simply registration fraud.”

I agree, I think this is a winner…no one wants what was perceived last election. And no one wants a “stolen” election except for the most liberal (which are many).
But it is still an “academic” and not a visceral problem. That is, someone has to actually read what is going on, and that diminishes about 40% of the voters. It has to be on some headlines, and that ain’t goin happen.

We know the MSM won’t care, but electoral integrity is one area where oridinary citizens won’t stand for that kind of over-reach.

innominatus on October 27, 2008 at 2:34 PM

OK, yet again Ed fails to mention that ACORN is cooperating with state officials in IDing fraudulent registration forms:

http://www.indystar.com/apps/pbcs.dll/article?AID=/20081018/NEWS0502/810180457/1310/ARCHIVE

As I’ve said repeatedly on here, there is evidence of voter-registration fraud — solid evidence in fact — in Lake County. But, there’s no evidence to show that it’s part of any organized attempt by ACORN at voter fraud to try and sway the election toward Obama. The fact that they IDed suspicious forms themselves and separated them for state officials shows that the ACORN group is committed to weeding out fraudulent forms submitted by its workers.

Tom_Shipley on October 27, 2008 at 2:34 PM

I’m afraid you’re probably right. This fraud IS commonplace.

As I’ve said before, get rid of all these voter registration drives & just let people go to their local county courthouse to register. If you’re too dumb to do that, you’re too dumb to vote in the first place!

And Bob Beckel reminisced about an election he was working on in the past when officials from Lake County responded to his inquiry on vote totals by asking him “How many votes do you need?”

But remember, fraudulent registrations don’t lead to fraudulent votes – cough, cough, wink.

At least 15 investigations, everyone of them is low income, heavily democratic districts…everyone.
So how many does it take to make a case, 25, 30, 50? There are only so many “swing state” cities. I say 15 swing state cities (and the 15 happen to be in swing states, not like California) is plenty to have a FBI investigation.

Tom:

Are you a preprogrammed bot? Last week I posted an article that describes the many ways votes are stolen.

I repeat for you the following section on a 1982 federal investigation of vote fraud in Chicago. These aren’t allegations. There were 61 convictions. All the methods of voter fraud described in the article required fraudulent registrations to work.

Chicago
Extensive voter fraud has persisted to this day. Former Justice Department official Hans von Spakovsky discusses in a recent Heritage Foundatioin report a shocking 1982 election for Governor in Illinois in which 10% of the votes cast in Chicago, 100,000 overall, were found to be fraudulent by a federal grand jury investigation that produced 63 criminal convictions for vote fraud. Spakovsky writes:
What particularly struck FBI agent Ernest Locker was how routine vote fraud was for the precinct captains, election judges, poll watchers, and political party workers he interviewed. They had been taught how to steal votes (and elections) by their predecessors, who had in turn been taught by their predecessors.
One primary method of perpetuating such fraud was for impersonators to vote in the name of dead people, people who had moved away, and fraudulently registered names. Impersonators were sometimes paid in cigarettes, liquor, or cash, known in the trade as “walking around money.” Votes for a straight Democrat ticket, regardless of the actual voter’s preferences, were also cast for the elderly, the disabled, and the sick who were unaware of what was going on. Then Chicago U.S. Attorney Dan Webb estimated that 80,000 illegal aliens were registered to vote in the city at the time, and that was 25 years ago.
Precinct captains filled out absentee ballots obtained by others, and absentee ballots with Republican votes were trashed. Another method was to alter the vote count by repeatedly running straight party line ballots through the counting machine, or altering the counting machine vote totals.
Unfortunately, as Spakovsky notes, the Justice Department has never again engaged in such a thorough investigation of vote fraud. Most likely, the practice continues in Chicago today. Moreover, similar practices have recently been exposed in Philadelphia, where sometimes more votes are cast than the number of residents, and in Wisconsin and Tennessee.
Here is the rest of the article:

http://www.spectator.org/archives/2008/10/22/voter-fraud

Like most Obama trolls you continue to push talking points long after they have refuted as if repeating them often enough makes them true.

One more thing, since you are Canadian you have no business entering into a discussion of the US electoral process. We don’t come to bother you so stay on the other side of the border. And before you come back with a pre-programmed answer about my ignorance of foreign countries I will tell you that my mother Canadian (born in Lipton, Saskatchewan) and my passport has a lot stamps in it.

As I said last time you posted this, citing election fraud in other cases doesn’t mean it’s taking place here. And since ACORN is actively IDing suspicious registration forms, it doesn’t look like they are in on this sort of scheme and I have seen zero evidence that this sort of fraud is taking place. I’m dealing with the facts of this case as we know them.

As I said before, yes election fraud often starts with voter registration fraud. But stabbing someone starts with picking up a knife. Everyone who picks up a knife does not stab someone.

If you look at the evidence, it doesn’t look like voter fraud is being attempted her. Some registrations were copied from the phone book. Some were signed Mickey Mouse or the Dallas Cowboys. Are you telling me that ACORN is going to give homeless people cigarettes to pose as Pluto and Felix Jones on election day?

The simplest answer is almost always correct. The evidence shows that people who work for ACORN have padded the amount of registrations they turn in by forging some in an attempt to get out of work or get more money.

And I don’t know why you think I’m Canadian. I’m American.

Tom_Shipley on October 27, 2008 at 3:03 PM

Their job is not to put the fake votes into the ballot boxes. That is the job of dem precinct captains in inner city wards. Their job is to increase the voter rolls to increase the number of fake votes that precinct captains can place in the box. And yes, last time I went out and challenged ACORN registrars, I was threatened with a knifing.

Voter registration fraud has been an integral part of ACORN’s operation. If they were really concerned about it, it simply would not be happening.

Star20 on October 27, 2008 at 3:11 PM

Most telling is how little condemnation of these frauds is coming from the Obama camp.

bloggless on October 27, 2008 at 2:25 PM

Why would Obama condemn activity his campaign paid almost a million dollars to make happen? And if Obama thought ACORN’s GOTV efforts were so above-board and legit, then why did he initially disguise his payments to them in his spending reports? And why does he continue to deny that he worked with ACORN in the past and actually trained some of their workers?

AZCoyote on October 27, 2008 at 3:15 PM

I called my Sec of State’s office here in NE and he was totally misinformed about Ohio’s situation. So I did some further reading, and it turns out that in Ohio everybody is supposed to show positive ID in order to vote. BUT a person can register to vote by giving the last 4 digits of their SS# and then vote just by giving those same 4 digits.

The county election boards are responsible for deciding which voters are/may be fraudulent. But even though she knows the SS# doesn’t match up, Brunner won’t release the SS and DMV records to the county boards so they can catch fraud.

So an ACORN man could register as Betty Boop under whatever 4 digits he wants, give those same 4 numbers to the poll workers, and vote – even if it’s obvious to all that he is not Betty Boop. The county election board would have no way of proving that Betty Boop wasn’t a man with those last 4 SS digits. If the real Betty Boop came in to vote later, I’m not sure what would happen.

AND even if a person registered with no identifying information, their name has to be on the voter rolls. If someone by that name comes in with no identifying information they have to be given a provisional ballot if they are willing to sign a statement that they are eligible to vote. Again, Brunner won’t give the county election boards the cross-checked info the election boards would need to carry out their job of verifying provisional ballots. So those people would be off scott-free, as long as nobody can prove that “Mickey Mouse” WASN’T eligible to vote. If they can prove he wasn’t eligible, then he could be prosecuted for election fraud. But he can’t be required to show any identification as long as he’s just getting a provisional ballot.

IOW, Brunner is making it so that someone with no other information than an alleged name can vote, and the county election board would be unable to prove the vote fraudulent. How, in this system, would you ever catch ACORN’s fraud? You could catch somebody trying to vote as somebody else perhaps. But that’s not what ACORN is up to, and Brunner knows it.

And this is in a state where fraud is supposed to be so hard because “positive ID is required of all voters” (except those who know their last 4 SS digits or file a provisional ballot that can never be thrown out).

The NE Sec of State’s office thought the OH Repulican party wanted the mismatched voter list for THEMSELVES – not for the county election boards.

And he basically said that if our elected officials screw us, we’re screwed. We can only do anything about it after we’ve already been screwed, when the damage is irreparable. He said for state offices, the candidate needs to sign a sworn statement that they are eligible for the office. But the presidency is different because what is voted on in the state ballot is not the candidate, but the ELECTORS. So the candidates don’t enter their names on the state ballots. The political parties do, and they are not required to verify eligibility. The only protection voters have is if they find out ON THEIR OWN and refuse to vote for somebody who is ineligible. Tough to do when we can’t have access to vital records – the only proof of eligibility or ineligibility. And when the media in charge of the documents we do have won’t put the info out there. So our Constitution is dependent on the MEDIA for its presidential eligibility requirements to be met.

I asked him if that means that media which fails to properly vet a candidate could be tried for treason. He said he couldn’t believe that the media would do such a thing. I told him I knew for a fact that they not only would, but HAVE. I told him I didn’t trust ABC, NBC, CBS, and CNN as far as I could throw them, much less trust them with the integrity of The US Constitution on the line.

We’re screwed. People need to learn that our media is committing treason. Nobody in this country has standing to question our elected officials. The only power we have is the power of knowledge. Without a truthfully informed public, this is not democracy or a nation of laws – nor can it ever be as the Constitution is being interpreted even by the conservative judges.

Tom:

I thought someone said you were a Canadian and I am not confusing you with Dave Rywall who we know is.

Your attempt to deny that ACORN is engaged in such practices is pathetic. ACORN has been systematicly engaged in this kind of activity over the last three elections cycles that we know of. ACORN has had a close working relationship with Obama since at 1992 during the Carol Mosely Brown election. The 1982 Chicago election fraud case refutes your argument that voter registration fraud is different the voter fraud. It’s not. Election day fraud requires the kind of chaos in voter rolls that ACORN brings to the table.

Given the irregularities surrounding Obama’s campaign contributions there is little doubt that he is behind ACORN’s effort to set the stage for massive vote fraud.

jerryofva on October 27, 2008 at 3:24 PM

Under an Obama administration this story has the shelf life of an opened can of sardines on a hot day.

While this may smell to the high heavens, the press won’t cover it and the feds won’t prosecute.

If this election is stolen for Obama, it is most likely to happen in Lake County, Indiana. Watch the returns on Election Night. Indiana could go just like Florida did in 2000 — all returns in showing a solid Republican victory, then at midnight the returns come in from Lake County with massive numbers for Obama. They did this in the primary, and what had looked like a solid Hillary Clinton win turned into a squeaker that robbed Hillary of momentum and pushed a lot of superdelegates into endorsing Obama the next day. Hillary’s people all think there was massive ballot-stuffing in Lake County. They waited until they knew exactly how many votes they needed, and magically got them.

This is exactly what happened in Broward and Miami-Dade in 2000, and led to the whole recount fiasco. Democrats manufactured 50,000 votes between 11:00 p.m. and midnight.

Democrats manufactured 50,000 votes between 11:00 p.m. and midnight.

rockmom on October 27, 2008 at 3:54 PM

It could, but would require about 3X the number of fake votes in a general as opposed to a primary in Indiana. Do you think they have enough ACORN fantasy voters?

Vashta.Nerada on October 27, 2008 at 4:03 PM

BTW, who’s on the list for pollwatching in Lake County?

From what I could find about Kenya, Raila Odinga’s people knew they were losing so they threw out any observers in some areas and started coming up with the votes they needed (IIRC they had some places with more than 100% voting for Odinga) So then Kibaki’s people started doing the same thing and it ended up with everybody saying there was no way to know who really won. That’s when Odinga went to worst-case scenario and told his thugs to go on the rampage (as his campaign plan had prescribed in case he lost the election).

That didn’t happen here in 2000 but I think the stakes are even higher now than then, and I think the agitation among Blacks – who Ayers and Dohrn said in “Prairie Fire” was their main group to agitate – is higher because the guy Ayers groomed for the candidacy is Black.

Someone else said this could be the last week of normal American life. I don’t know the future, but I have a gnawing fear that it may come to that.

Registering people in certain areas is not voter fraud.

Tom_Shipley on October 27, 2008 at 2:48 PM

Are you really this dense?
Illegally registering people, registering people that do not exist, registering ineligible voters…need I go on?
Your answers to an obvious statement should embarrass you…
Do you think it is by chance that these illegal operations only happened in swing states, and in the inner cities and low income districts?
You actually believe that these 15 are just by chance?
Not even a good try…you were at one time kind of fun to have around, to watch and observe a liberal and how they think…but lately you are rather boorish and baffoonish.
Here let me quote you again…

Registering people in certain areas is not voter fraud

That is your argument…the obvious, you just happened to overlook the elephant.

right2bright on October 27, 2008 at 4:22 PM

One overlooked influence of having abnormal amount of people registered is that it skews the polling data.
If there are 62% registered voters in an area (false or not) as democrats and 30% Republican and the balance undecided. That is what they use as their sampling. They call and use 62% dems, 30% Republicans, and the balance as undecided or independents.
That is why so many polls are skewed towards the Dems, they have an inordinate amount of registration that is false. That gives them the opportunity to release these polls with false data, and pretend it is accurate. It is a way of influencing an election…once again illegal.

I LIVE in Lake County, Indiana. There’s a reason why it’s the ONLY county in Indiana that’s being targeted by ACORN.

But I cannot say “why” lest I be branded a RACIST.

I would offer to go by the ACORN offices in Gary, but I rather not risk my life for a few snapshots.

Where’s this list? If I can get off work, maybe I’ll go ride around.

While Lake County is 90% Minority or Union, you have to remember that the rest of Indiana is pretty much in the bag for McCain. South of I-80 or east of I-65 is all red.

Proud Hoosier here.

I live in England, and I voted absentee for Indiana 2nd District.

racketeering

The word we need to move past the Obama blockage in the State justice department

Because courts are systematically denying the indivual has an interest in a fair election, and because the courts are systematically denying that any individual citizen has the right to claim personal damage from a rigged election, it will take RICO to move forward.

If nothing else, at least we might get to hang a few of the perps.

Obama won’t mind. They are all disposable tools

Has Obama denounced Acorn’s actions at all??

malkinmania on October 27, 2008 at 5:28 PM

I remember the 1972 campaign for President. There was the same slow, reluctant leaks of information indicating that something criminal was happening beneath the surface. It all ended with the resignation of Nixon.

I do doubt that will happen today. Too many missing pieces–ethical congressional Democrats comparable with the ethical Congressional Republicans and a belated honor of Richard Nixon that prevented him from fighting as hard as Clinton to keep the Presidency.

Ethical Democrat is truly an oxymoron. And Obama is more likely to jail anyone testifying against him than to leave office.

Not all bad.

we are screwed, and this type of fraud becomes common place. Conservatives will have to win over white liberals to the dark side to begin to have a chance in elections

jp on October 27, 2008 at 2:27 PM

I know it sounds crazy, but I think someday the black community will finally have had enough of being d*cked by the Democrat Party. The black community is really a natural Republican constituency. Machosauce says (in his rant directed at the black community), “They’ve been farming your votes for decades, for you are ballot cattle for the Democrat Party. . . here’s some feed to stimulate your animosity against the rich, as if a poor person can give you a job.” (Yo!) He starts focusing on the black community around 1:55, and delivers the above quote at around 4:30. Watch the whole thing; it’ll make you smile.

I don’t see white libs as a natural Republican constituency, because there is nothing natural about white libs. They have been trained from the cradle that their own interests are evil, and so become traitors to whatever institution they are naturally a part of. It takes some kind of real suffering to knock them out of this form of mental illness, and since we’re not going to do that for them, they are a waste of time.
