Did Frank have a conflict of interest at Fannie Mae?

Now that Congress has passed the bailout emergency liquidity bill, we can expect that both Democrats and Republicans will attempt to define the catastrophic failures of Fannie Mae and Freddie Mac quickly and energetically.  Democrats such as Barack Obama and Nancy Pelosi have already started calling it a failure of “deregulation” and greed, while Republicans have attacked Democrats like Chris Dodd and Barney Frank for blocking action to tighten regulatory control over the two giant lenders.  Bill Sammon at Fox News reports on one potential argument for a conflict of interest that may have Frank on the defensive:

Unqualified home buyers were not the only ones who benefitted from Massachusetts Rep. Barney Frank’s efforts to deregulate Fannie Mae throughout the 1990s.

So did Frank’s partner, a Fannie Mae executive at the forefront of the agency’s push to relax lending restrictions.

Now that Fannie Mae is at the epicenter of a financial meltdown that threatens the U.S. economy, some are raising new questions about Frank’s relationship with Herb Moses, who was Fannie’s assistant director for product initiatives. Moses worked at the government-sponsored enterprise from 1991 to 1998, while Frank was on the House Banking Committee, which had jurisdiction over Fannie. …

The two lived together in a Washington home until they broke up in 1998, a few months after Moses ended his seven-year tenure at Fannie Mae, where he was the assistant director of product initiatives. According to National Mortgage News, Moses “helped develop many of Fannie Mae’s affordable housing and home improvement lending programs.”

Critics say such programs led to the mortgage meltdown that prompted last month’s government takeover of Fannie Mae and its financial cousin, Freddie Mac. The giant firms are blamed for spreading bad mortgages throughout the private financial sector.

The big question here would be what Moses did as “assistant director for product initiatives”.  “Product” in Fannie Mae parlance would be securities created by the lender that were sold to investors.  While that position would not approve the purchase of bad loans, the creation of “product initiatives” would create pressure to purchase more and more loans to generate more and more sales of the securities.  An assistant director would certainly have significant influence on the direction of Fannie Mae in this regard — especially one with a partner in Congress on the Financial Services Committee.

For that reason, regardless of Moses’ actual efforts in creating the bad paper, the relationship provided a serious conflict of interest for Frank.  Frank was supposed to oversee the actions of Fannie Mae as a government-sponsored entity.  If he had a partner, spouse, or family member in position to be affected by Frank’s decisions, then Frank should have recused himself from that committee.  His failure to do so represents a breach of public trust regardless of Fannie Mae’s failure.

It does put an interesting light on Frank’s resistance to regulators regarding Fannie Mae, but doesn’t necessarily explain the collapse, at least not directly.  Most of that happened after Frank ended his relationship with Moses, though, as did most of the damage from Fannie’s overvalued securities, which have poisoned the entire investment industry.  This may not have much bearing on the actual failures, but it shows the lack of ethics among those whom the public trusted to safeguard our interests.

I kinda’ agree with you on this. Bush handled the bailout BADLY. Some talking head commented that he was a spectator and I’d say that just about sums it up.

My only concern with the bus strategy is that I thought I read somewhere that Bush is still very helpful at raising money.

Ideally, Bush would throw himself under the bus… or release the tapes (you know they must have them) of the White House meeting that O! tanked.

I don’t think Bush handled it badly. He asked {summoned} the candidates to the White House with the Congressional leaders to discuss this. He said they had to come up with a solution. He included Paulson and Bernacke.

When you look at the behavior of other members of the government it seems to me that Bush was one of the saner people involved in the process.

No one made any attempt to support him in that effort any more than they did social security. When it came to pissing and moaning there was no shortage of folks out there, but real political support was something else again.

As for Cheney, I like the guy, but he has not made an effort to deal with this at all at any time.

I think Bush has more balls than 99% of his detractors. Whatever his faults are, a lack of balls are not among them.

As far back as September 11, 2003 Bush was trying to get Fannie and Freddie moved over to Treasury because he thought they were out of compliance and out of control. The NYT did a story then about that and stated that Bush was suggesting the most radical change in regulations for the agency in years. The Democrats blocked it. His administration resubmitted that request in budget every year and it was thrown back at him every year.

In all Bush tried on something like 17 occasions to change rules and regs in an effort to head this off. The only Republican in the Senate who was willing to take political heat to do anything like that was McCain and in 2005 he tried to get legislation through. It was killed.

As for speaking to the people, what does that mean? In general or about this in particular?

Considering the fact that Harry Reid shoots off his mouth about a supposed bankruptcy pending for a nameless insurance company and all the insurance companies on the stock market tank..it is obvious that people in positions of power have to be careful what they say and how they say it.

At least Bush tried. If he had come out in 2004 and said this was all going to tank, would anyone have believed him? I doubt it.

As far as that is concerned, Did Bernacke warn about this in strong terms? No one did. Everyone had known for some time there was a problem withe subprime loans and the credit sector, but I don’t remember people saying anything like this was going to happen. We need a Watergate style investigation to uncover how our government influenced Fannie and Freddy in the underwriting of hundreds of billions of dollars worth of bad loans. Surely, this is at least as important as the bungled break-in of Democratic Campaign Headquarters at the Watergate hotel which brought down a President. The American people deserve a thorough accounting of how this happened as we are now on the hook for these same hundreds of billions of dollars worth of bad-debt. Our country has been led to a financial precipice from which we may never re-cover. Hundreds of billions of dollars have been drained from our economy, millions of jobs, and thousands of businesses will likely be lost. As well, we are becoming a hated caricature of our former selves on the world stage as we have involved the rest of the world in our meltdown. Who were the players? What criminal or just criminally negligent activity took place and by whom? What is the role of the Community Re-investment Act. Who are Acorn? Who profited from taxpayer dollars? We need answers to make sure this never happens again. If no action is taken, the credibility of this government at home and abroad will be lost for a generation.

But you know what? I don’t think let us rot from within. For one thing, I don’t think we did rot from within, for another, Bush is president, not God. We have to get past this thing of expecting Presidents to fix everything.

There is a lot more to America than politics and maybe if we are having problems within, we should be looking a little closer to home for the answers.

Very true. And it is not just our economy. The world economy is also caught up in this.

The thing I find so amazing is how so many people seemed to be so oblivious. And I am not just talking about the government either.
