Video: Fred defends Palin

Maggie Rodriguez seems distinctly less than thrilled to have him there, especially when he brings up Ifill. A good job of good-soldiering, although I’m not sure how well his point about non-lawyers not knowing Supreme Court precedent will play. I brought that up myself yesterday as a possible defense to Palin’s blanking during the Couric interview, but the boss (a non-lawyer) was underwhelmed. Americans like their presidents to be “ordinary” but maybe not that ordinary. To wit, from the new WaPo poll:

Independents now say she’s too inexperienced by a margin of two to one, and more indies say she makes them less inclined to vote for McCain than more so. The good news: Word on the street from Byron York is that debate camp went pretty well. The bad news: Psychics are pessimistic.

Palin v. Biden:

I found it odd that Palin could not name another Supreme Court decision with which she disagreed. After all, we know that she is aware of at least one Supreme Court decision other than Roe v. Wade with which she disagrees. Just over a month ago she criticized the Supreme Court’s decision in the Exxon Valdez case, slashing the punitive damages awarded by the trial court. So did she simply freeze up and forget? Was she afraid of a ‘gotcha’ comeback if she named a specific case? Or is she that much of a knucklehead that she can’t even remember what she thought of the Court several weeks ago? My read of the video is that the first is most likely, but I’m sure others will disagree.

Biden, the constitutional law scholar and former Chair of the Senate Judiciary Committee, spoke more smoothly and authoritatively on the issue. Yet while his defense of Roe may have sounded thoughtful at a superficial level, it was actually quite incoherent. Instead of saying that he thinks the abortion right is a fundamental liberty that deserves constitutional protection — which he only hinted at later, and would be a more straightforward way to defend Roe and an abortion right under the Constitution — Biden explained that the Court’s decision is “as close to a consensus that can exist in a society as heterogeneous as ours.” Setting aside his focus on Roe, and his description of Roe’s initial holding as if it were still the law of the land and had not been supplanted by Casey’s “undue burden” test, his rationale is problematic on several levels, particularly for someone who holds himself out as an expert on constitutional law…

UPDATE: Brian Kalt has more thoughts on the interviews here. His conclusion:

I would have been much happier if Palin had given better answers to Couric. But her lack of knowledge of constitutional law would assumedly lead her to rely on others for advice on such matters. She doesn’t know, but surely she realizes it. Biden, by contrast, has the smooth confidence of someone who has been immersed in these issues for decades. But he’s wrong. To me, that’s actually scarier.

What I don’t understand is that Biden did not give a coherent answer himself to the Supreme Court question and he is a lawyer..and he gets a pass.

I had hoped that people would see through the crap the press is doing to Palin, and maybe they will in the end. I also think that the expectations of Palin were so high to begin with, it was almost impossible for anyone to live up to that.

Of course if McCain had picked Romney and they were behind in the polls everyone would say it was because Romney had high negatives {which he did} and that McCain should have picked Palin.

Not all the polls give her these kind of numbers either. Battleground and Rasmussen {last time I looked} were better.

I say we wait and see what happens.

I see open-ended questions directed at Biden followed by specific bills still in Congress addenda being thrown at Gov. Palin. In short, I see a screw of epic proportions, with the result preordained by the MSM. “HILLBILLY SARAH KNOWS NOTHING!” After all, it’s not like Ifill has anything to lose here. Her credibility will be shot, but she’ll have more money coming in from her book and people will have forgotten all about her “objectivity” before she shows up on television again. If not, they will be educated on her objectivity.

It’s not as simple as people on both sides are making it out to be. She WAS NOT asked to name any random supreme court case that popped into her head. She was asked to name a supreme court case she disagreed with besides Roe v. Wade. She blanked and that’s not good, but, it’s not fair to say that she blanked when asked to name any supreme court case she could possibly think of.

O/T: In high school, I was on the quiz bowl team. At my very first tournament (which happened to be being filmed for the local cable access show), the answer was “Dred Scott decision”. I blanked and managed to come up with “Dred Lock decision”. Close, but no cigar…..Should I ever run for office, I expect them to dig up that clip and mock me incessantly.

A Debate is generally not full of gotcha questions directed to only one candidate.

It doesn’t matter what the media says about the debate, it matters what we think. If we think she did well, things will get back on track.

AP, why shouldn’t Palin’s numbers be tanking? What the general public sees is not her shortcomings in interviews — most of the masses don’t watch that kind of stuff — but the snarking of the MSM and the attacks on her from her own party, which are instantly splashed as “news” by Osama Obama’s shills.

Hell, look right here in HA! The tone has changed, because everyone knows exactly what she and John McCain should do. They do this, they don’t do that, and all the “experts,” none of whom have faced that kind of scrutiny in their lives, rush out with criticism and second-guessing.

Conservatives can’t be entirely blamed for the MSM’s total obeisance to Obama and visceral hatred of what Palin stands for and who she is, but they are certainly busy fashioning nails to hammer into her coffin.

It makes me ill.

I have always heard that when one is in combat, one should not be thinking about whether they like their fellow soldiers, but should defend them. We are in a war, with stakes that go beyond serious, yet some — too many — are taking potshots at the people who are closest to our beliefs and values.

Those naysayers won’t be saved by their attacks on McCain and Palin when President-For-Life Obama opens the Ministry of Love. They’ll be for Room 101, just like the rest of us.

And here’s the money quote from the boss:

The blogosphere and the punditocracy made much hay yesterday over Sarah Palin’s inability to name a Supreme Court case other than Roe v. Wade with which she disagreed. Does it bother me? Yes. But not as much as some of the hand-wringing critics who, unlike Palin, are lawyers with instant recall or commentators who make a living chattering about SCOTUS cases on the lecture/cocktail circuit. I would have loved it if Palin had been able to reel off Plessy or Kelo or Grutter or Bakke. I’m concerned that she blanked, but not ready to jump off a cliff. The Beltway/Manhattan crowd seems to have forgotten that her appeal to the base was not that she was a slick intellectual, but that she was one of them. Hockey moms aren’t going to be as upset about her non-answer answer as academics and think-tank dwellers.

Sarah Palin is now in a situation where she knows that every word is being used to verify and compare with McCain’s record/statements. Identifying specific disagreements with the Supreme Court or specific newspapers/magazines does NOT mean she doesn’t know. She has to be careful about offending or appearing to contradict McCain. Does she mention McCain/Feingold? However, McCain had a good response on their differing opinons on ANWR, McCain said “Do you expect two Mavericks to agree on everything?” They should continue this line and let Sarah voice her opinions more clearly, r ecognizing they might not always agree with McCain.

It’s too bad Fred didn’t point out that Couric’s question was what other Supreme Court decisions with which she disagrees. That’s different from knowing other Supreme court decisions. She could have talked about Heller, but she agrees with that. It’s probably that she knows other decisions, but she agrees with those decisions.

As for Palin not giving any examples of Supreme Court cases, I wonder how much of it had to do with not wanting to accidently contradict John McCain on any particular issue. I am not sure about that. McCain did acknowledge the problem wich is more than Obama did, and then of course Obama had to come along after the fact.

It is hard to show leadership on an issue where people do not want to be lead. The partisanship, the desire for score settling have made the Congress look ridiculous. But I still think they need to do this.

It is not going to just go away. And Europe is not going to lend a lot of money until they know what we are going to do.Japan is finishing its slide into recession as well.

This could get dicey. Especially with job losses starting. I am afraid that failure to act could doom the Republicans. Not fair I know, but life isn’t fair.

but, this has felt awhile now like 1976. Palin is Reagan, she’ll lose but come back strong in 4 years and unite the party against the idiot party of Carter/Obama.

(I actually read the article, it’s fairly logical in the way it comes to that conclusion. As much as I’ve read Dem commentators complaining about “two Americas”, and how they would have a coniption if the “other America” had its way with things, it might be better in the long run…. The question is whether or not the Libs being left behind would let the Conservatives go peacefully.)

I’m behind McCain now, in mouth and pocketbook, but I’m still a Fredhead at heart.

He would have made such a magnificent GOP presidential candidate. Win or lose, he would have been all over the media and Obama at every turn.

As for McCain, I think he needs to re-read the last part of his convention speech. Nothing is inevitable. We are Americans and we can do anything. Stand up and fight for what is right. OK, lets see…the housing market tanks and the administration wants to pass a “lipstick on socialism” bill to revive it and “save” the economy; The people of the USA HATE the idea by an overwhelming marjority; and the problem has it’s genesis in the dealings of crooked Dems.

Mac thinks it’s a brilliant idea to vote for the lipstick on socialism bill even though the people, whom he ostensibly wants to vote for him in a month, despise the idea.

Of course they won’t. Socialism needs productive workers to carry the burden. Once the pie starts gettng divided the fragmentation won’t just stop at one division, human nature being what it is. There will always be discontent. That first step sets precedent.
