The ‘Busters have the transcript. This isn’t quite the offensive idiocy it might seem at first blush; she’s asking a (mostly) rhetorical question about constitutional theory to challenge McCain’s stance on Roe, i.e. whether following the Founders’ intent is such a hot idea given that their Enlightenment views weren’t quite fully enlightened. One possible answer: We can correct the Founders through the amendment process. That’s what we should have done to legalize abortion and that’s what we did to ban slavery. Or did you miss that lesson in first-grade history, Whoopi? McCain’s response: Hey, good point! Groan.
Still, insofar as you don’t often see questioners shameless enough to ask Republicans whether they want to bring back slavery (even on MSNBC), it’s a golden TV moment. Exit question: If McCain’s uncontrollable rage is 1/1000th as bad as the left would have you believe, shouldn’t his righteous indignation at being asked this have sent him into an Incredible Hulk-ish meltdown?

I watched the whole thing. The end was what ticked me off when Bahbah Wahwah said to tell Sarah Palin they would only ask her easy questions and were nice to her in the interview of McCain. That was not true they attempted to make Palin out to be a wacko and implying Governor Palin would only have easy questions from those witches is ridiculous. Barbara had better hope ther is no lightning in NY or she might have a new hairdo for the next taping!
McCain messed up by saying that Palin opposes abortion when rape or incest is involved. Maybe he did not, but I have not seen anything that indicates Palin is against abortion in those cases. But he did do a good job explaining states rights and why Republicans feel Roe v. Wade violates the Constitution.
I loved Cindy slamming or dismissing Barbara’s question about the number of houses they own. LOL! That was grand!
The audience applauded McCain quite often and at times that I think irritated the wacko females on the panel. That was great!

And I think she caught McCain flat-footed by rather overtly playing the race card. McCain was right to duck the way he did… I, as a lawyer who knows a few things about con law, would have responded by saying that slavery was corrected by constitutional amendment and that black people should not assume that legislating from the bench will give them better protection. After all, the Supreme Court legislated from the bench in the 1800s (Dredd Scott, anyone?) to prevent free states from emancipating slaves who ran away to their jurisdictions and to prevent the federal government from outlawing slavery in federal territories. And, the Supreme Court nearly legislated from the bench to ban school vouchers to the extent they went to parochial schools (Zelman), against the wishes of a HUGE swath of the black community in Cleveland who wanted their kids to have a chance at a good education.
But, McCain’s not a lawyer and didn’t have the time to think up an articulate answer to a HUGE landmine question.

Actually, Palin’s against abortion in all cases except in the case of a woman’s health. She answered a question in an Alaska Governor’s debate and said she would “choose life” even if her daughter got raped and got pregnant.

Whoopi must think that slavery “got overturned” by the SCotUS or something. She must not realize that slavery was banned by an Amendment.
I don’t think that it is McCain’s inability to respond to this question quickly enough, I think its that he doesn’t want offend his hosts by questioning their intelligence or lack there of. He must have just submitted to being gracious and saying, “Excellent question” and what he might have been thinking was, “this is an excellent opportunity to inform the viewers of constitutional law, but maybe its above the hosts’ heads?”…he probably did come to a crossroads where he decided not to go down the path that would be too long-winded for The View’s viewers and hosts.
I don’t see a problem with having a litmus test. “Do you think that Roe vs. Wade should be overturned?” seems perfectly legitimate if you want to find out if the candidate believes in judicial restraint. If the candidate answers “Yes” and then proceeds to give their conservative viewpoint, then you know they are a *bad* candidate because they aren’t strict constructionalists.
Giving Whoopi the benefit of the doubt, perhaps she thinks that McCain/Palin want to return the Constitution to its original form without all of the Amendments? Hell, I don’t know how to think like a liberal…I’m just taking shots in the dark here.

I think we reached consensus over on Michelle’s site that the 13th amendment abolishes slavery, and the 14th amemdment secures the citizenship rights of former slaves and their descendents. So it is the constitution itself that guarantees Whoopi’s freedom and citizenship.

He could have also reminded Whoopi that it was a democrat, confederate general Nathan B. Forrest, that created the Klan, Bull Connor was a democrat, George Wallace was a democrat, and it was the democrats that threw out the first elected Black Americans – (R) from office. To begin with, Dred v. Scott is one of the better examples of legislating from the bench.
Goldberg also seems to be unaware that slavery is unconstitutional because it’s explicitly prohibited in the constitution. No penumbras needed to ban it.

Every time the witches on “The View” show up in the news (not just on their own misbegotten show), they reinforce female stereotypes. I can’t believe that they don’t see this themselves.
Why does McCain go on this show? In our modern, through-the-looking-glass world, this actually passes for a purveyor of the news as it can get vacuous celebrities on to spout, flog movies and books, etc. That it can sometimes get acutal newsmakers they like and suppong on-air makes those who know they’re not well liked by this has-been clatch of Macbeth witches feel they have to get on.
Why does McCain go on Leno? Exposure. That, and it’s expected. Has he been on with Jon Stewart? I don’t watch his worthless me-fest, so I don’t know myself.
Side question: who in the wide, wide world of sports is Joy Behar? I seem to remember reading that she was originally a comedian. Anyone who watches this show is in the tank for Barry anyway so McCain’s not going to change minds. However, the potential for nut buzz is off the charts.

I can’t get my computer to show me the video, but Whoopi needs to be told that Roe v Wade actually ruled that the 14th Amendment only applies to *legal* persons, which Blacks weren’t when the amendment was ratified. The SCOTUS had just previously ruled in Dred Scott decision that Black humans weren’t – and never could be – “persons” with Bill of Rights protections (”legal persons”).
When was Dred Scott ever overturned? When were Black humans ever given legal personhood?

“do I have to worry about becoming a slave again?” The word “again,” implies that she was a slave at some other time in her life or that she faced the possibility of being a slave at some point in her life. Unless she was born before the emancipation proclamation…I don’t believe she was ever threatened with being a slave. The View is possibly the worst daytime show for discussing issues in an unbiased approach. Poor Elizabeth. I hope the abuse she takes is worth the money she earns.

McCain could have said that the federal government has no business doing anything that isn’t specifically granted to it under the Constitution, and that anything not so enumerated belongs to the people or the states. In other words, he could have cited the 10th Amendment. Constitutionally, the Supreme Court had no business deciding abortion from the federal level and thus, Roe v. Wade should be overturned on that basis. He might also have continued by saying that if we allow courts to add legal doctrine outside the boundaries of the Constitution, then we have a rule of men (even if only nine) and not law.

The government will decides what counts and what doesn’t and there will of course have to be penalties for those who don’t submit to their masters in the government.

Okay, let’s get real here. Slavery was a state issue. Some states were slave states, some were not. Those that were not were supposed to respect the laws of those that were. The Supreme Court upheld that. ABRAHAM LINCOLN, as president issued the Emancipation Proclamation, an executive order, that freed the slaves and effectively ended slavery as an institution protected by the federal government. The 14th Amendment recognized the birth right citizenship of the freed slaves.
It was neither the Supreme Court, the Constitution of the US nor the legislature that ended slavery. It was the President Abraham Lincoln.

What scares me even more than the stupidity of Whoopie and her three liberal cohorts is the reaction of the audience. Whoopie’s comment, as are most by the libtards on that show, was designed to get the exact reaction she got.
This is the result of liberals in charge of education, people too ignorant of history in general, our own in particular to understand the significance of the whole debate over Roe v. Wade, states rights, the proscribed roles of the three branches of government and what the constitution does and doesn’t protect. That’s why they applaud the idiocy spouted by Whoopie, not just today, but nearly every day.
That is why the liberals have targeted education as one way to bring about the America they desire. Because an informed and educated electorate would throw them out of the America the founding fathers envisioned.

An addendum to my earlier post. While I stand by the statement that Pres. Lincoln ended slavery with the EP, it was the 13th Amendment that made it official for the entire country and insured that future states could not adopt the practice. It was somewhat of a formality that made it one of the fastest amendments to be ratified.

The democratic party are still the party of slavery, and hatred they keep people impoverished with socialist programs and government telling them how to live their lives, and brain washing them with pessimism view to keep them in there place.
In the words of Clarence Thomas:
