Huckabee: Romney should have ignored the Massachusetts Supreme Court’s ruling on gay marriage
posted at 7:36 pm on August 25, 2008 by Allahpundit
It comes at 30:45, right after he finishes wondering what the difference is between men marrying men and people marrying animals. (Er, consent?) This plays well with the base and no doubt he’ll enjoy the extra venom it earns him from Team Mitt, but I think he’s dead wrong. Where’s the line? If the governor gets to pick and choose which rulings to enforce, we’re forever on the brink of a constitutional crisis. In fact, if Eisenhower had followed this advice, schools wouldn’t have been desegregated after Brown. What he’s suggesting, actually, in the name of empowering the people is making the judiciary nothing more than an arm of the executive. If that’s the government you want, okay, but in that case you might as well go the whole nine yards and abolish judicial review by constitutional amendment. Short of that, you’re not without options. The governor can campaign for an amendment to overturn an unpopular decision or, in states where judges are elected, to get them tossed out and replaced with ones who’ll vote the way the majority wants. Exit question: The Huck approach or the Romney approach? Click the image to watch.
Update: Good question: “Note that Huckabee’s excuse for soliciting additional taxes — any additional tax schemes; they were all ‘all right by me,’ as he said — was that he was compelled by a state court decision to do so. (Actually, he wasn’t quite, but let’s pretend he was.) How come you didn’t just defy the courts yourself, Huck?”

This guy is such an idiot. Cheers to whoever quoted John Adams earlier in the thread about us being a nation of laws and not men. Does Huckabee pretend to make the laws, enforce them, and ignore them at his will?
I think Romney, who happened to graduate from Harvard Law School, might have a better idea on what to do with regards to the judiciary than this moron who doesn’t seem to know when to go home. Please never run for national office again, Huckabee.

Boy, he really has a bug up his butt about Rommney. Must be the Mormon thang. Tough luck, Huck. Get over it!
Blake on August 25, 2008 at 8:16 PM
Correct and my only beef with him on this issue is that he could have told the SC that they were wrong but he didn’t. On the other hand he did invoke that old law from the first part of the last century, 1913 I think, that said that marriage was only valid for citizens of the state which put a big dent people form other states coming into MA just to get married. Politically it was kind of a slick move.

Remember, Huckabee is not really a Republican.
If the Democrats weren’t so scared of Romney, they would have left him alone a long time ago. Democrats don’t waste this much energy on non-starters.
I’m really disappointed in Huckabee. Time to let go Huck. Turn the other cheek, be one of those good Christians you espouse.

Not only should Romney have ignored the court’s opinion, it was his duty. The Constitution of Massachusetts clearly states that the Legislative branch makes the laws, not Judiciary or Executive branches. To this day, Massachusett’s Constitution says it is illegal for same sex partners to marry.

The basic question is whether the right to define marriage belongs to the individual or to society. Now if you believe it is an individual right and everyone should be able to define marriage as he or she sees fit, then you have to allow for a whole gamut of marriage choices: same-sex, polygonomous, incestual, man/beast etc. The second you say, “wait a second we can’t allow THAT” then your only basis for opposing it is a recourse to societal norms. But then you have effectively conceded that the definition of marriage belongs to society.
But what is society’s definition? At that point you can only point to the decision of the people through either their elected representatives or through referendrum. Which effectively takes it out of the court’s control. That’s my position on this whole issue.
IMHO this is the only effective defense against the assault on the traditional definition of marriage. Arguing on the basis of Biblical teaching is a non-starter with me, even though I agree with the theological arguments.

No, he should pick him because he is a reasonable pick. A better pick for piss-off value would be Rice. Far to many people think Palin should be picked because she is cute but she has limited experience and is in my opinion too young. The only thing she would bring to the ticket would be a nullify effect to a large amount of the BO shtick of being young and inexperienced. My all time pick to really piss-off everyone on both sides would be Clinton. Man that would get heads exploding on every side.

I wouldn’t say that giving pardons was ignoring judges as a govenor has that power…not really smart, but not ignoring judges. What I was getting at was his excuse as to why he had to raise taxes as govenor. He said the courts made hime do it, he didn’t want to, he HAD to because of the courts. So if he says Romeney should have ingonred the courts on the marraige issue, why didn’t he ignore the courts on the school issue?
Bingo, if a govenor ingonres the judges wouldn’t he likely just be removed from office?

Who called you names? Settle in and calm down, sometimes it is just hard to tell what people mean until you get to know them. That being said, the argument to ignore the courts doesn’t really make sense. While I will agree that the court should not legislate from the bench, you have heard that two wrongs don’t make a right. If you think it was wrong and you can make the case, take it to court. There are probably lawyers that agree with you that would be willing to work with you.

I am fine with who ever McCain picks until Huckabee starts up then I feel like I’m going to be fighting mad if Huckabee pulls the puppet strings of John McCain. It is like he is daring McCain to pick Mitt. So Huckabee can stage some kind of revolt? Only problem is he has lost all creditbility.

This strikes me as the domestic equivalent of “bomb ‘em into the Stone Age or get out.”
Jerry Brown supporter Mike Savage used this formula in the Iraq War. He said that Bush was selling America out by not bombing the Sunni triangle into oblivion and then withdrawing from Iraq. Savage, who spent his Vietnam years sending homoerotic letters to Allen Ginsburg, apparently is ignorant of the fact that a war cannot be won by airpower alone; bombing the Sunni triangle and then withdrawing would essentially be handing al Qaeda a victory not only over the U.S., but over future Sunni rebels as well (who, after all, were bombed into the Stone Age).
Furthermore, Savage knew full well that the government would never do this; being a closet leftist, he simply wanted a U.S. defeat, while being able to keep his audience.
Similarly, Huckabee knows full well that defying the court here is not going to keep gay marriage from happening; for that to happen, there must be either some sort of legislative action, be it Congressional law or constitutional amendment, or else such a national backlash against the concept that no court or legislature ever dares pull such a stunt again. What Huckabee is basically advocating is a George Wallace-type stunt, in which he will stand in the doors of the courthouse and then negotiate secretly an agreement to be “escorted” away.
Kenno on August 25, 2008 at 9:02 PM
Critter? Guess you mean that in an endearing way, according to Cindy.
Actually, I was talking about everyone here calling Governor Mike Huckabee names and insulting him. You do not have to demean a person in order to make a point but most here seem to think that you do. Maybe that was cool in grade school, but it is very unbecoming of adults.
If I lived in Mass and had the money, perhaps I would explore a judicial avenue against the court’s opinion, but I don’t.
My point was, Huckabee was right. He was asked the question and he answered it truthfully. Yet, everyone here only sees an attack on Romney.

I think it’s seen as an attack on Romney because Huckabee has made it a point of late to go out of his way to criticize Romney. His continued anti-Romney crusade suggests he’s less interested in party unity than he is in crushing Romney’s political aspirations.
And if Huckabee was right, then why didn’t he defy his own state court when it mandated more money for education?
Slublog on August 25, 2008 at 9:06 PM
That was a good interview. If you listened to the whole thing, rather that reading the select quotes posted on the website, you would be glad that Gov. However, if you just read this blog, you would be appalled at what you think is being said. But it is quite different when you actually listen to it.

jparks1972 No matter how much you hate Romney no one who is an American can possibily excuse Huckabee this time. The governer of a state cannot make the law alone! This is a government of the people.
And if Huckabee is so worked up over Gay Marriage why isn’t he helping Mormons and others get a constitutional amendment to the California Constitution to stop it in California? Instead he is bad mouthing one of the great champions of the institution of Marriage for our society and the world. Romney stands up for Marriage. If there is any issue that Romney has been brave about it is marriage!
And then there is Huckabee and he stands up for anything he thinks will make Romney look bad.
It must be a man crush. That is the only reason he could be sobessed!

If Huckabee’s comment here was a one-off event, I might – MIGHT – buy that.
but every time Huckabee has a chance to open his mouth at length, he finds an opportunity to denigrate his former primary opponent.
Pattern of behavior. Huck long ago lost the benefit of the doubt when it comes to his comments about Mitt. He’s got a personal vendetta against the man, and it’s unseemly.
In fact, he’s probably done more to promote Romney than himself from all his petty backstabbing.

There is a big difference between fighting against gay marriage and fighting against paying extra taxes for education. The educational system in Arkansas needed improvement. And with those tax increases the Arkansas system improved because they had the money to make needed changes.
And the only reason Huckabee had to defend the tax increases for education was because Romney’s supporters donated $550,000 to CFG so they would run those tax ads on Huckabee.

You’re new here, aren’t you?
Pedantic lectures = not all that appreciated, thanks.
Yup, not exactly a recipe for making friends and influencing people. He even used the words “most people here” while seeing just a bare script of the multitudes who post at HA.

So,Day 1 of the Liberal political civil war,
and some on Hot/Air are starting to snap,
crackle and pop,very interesting!
Here in Ontario,Canada, same sex marriage has been legalized,
and that takes the protesters, and so-called “rights groups”
out of the politics equation, now on to the next problem!
And,if Republicans passed it,talk about screwing over the
Democrats, and since I believe in God,I think all of his
children deserve dignity and respect!
What goes on behind closed doors is NONE of my business!!
