Your assumptions betray your ignorance. It is the responsibility of the owner of the trademark, copyright or patent to proactively protect their intellectual property. Negligent or even lackluster attempts to protect their trademark or copyright can be used against them if their ownership is contested. You gotta go after everyone who f*cks with your IP or you weaken its protection. This stuff is cleared up real easy before the fact. I think Camp McCain knew they would get dinged but went for it anyway. I think IP, though quite malleable in a post-napster world, is still very important. IP protection is one of the few rights specifically detailed in our Constitution. John McCain knows this but chose to ignore it, our Constitution that is. Or at least the IP clause. I like humor. I like painfully truthful humor. McCain wins a lot of points for that. But he bottoms out like the General Lee with these other effups. I long for the days of the green backdrop. It's sad depth we've sunk to for the sake of a few laughs during a campaign. McCain wipes his butt with a document for which he was willing to endure inconceivable torture, degradation and pain. long story short

I read Tapper all the time. He is nearly an equal opportunity whacker. He fairly obviously states things in such a way as to get maximum effect in the comments section. He smacks Obama, Hillary, and McCain, although not in equal proportion.

I don’t think a copyright claim could be won by Myers. If you look at the fair use exception, the ad fits in quite nicely: it’s a very small sample of the original, doesn’t harm the existing market for the material, is political speech, and is satire.

But probably not worth McCain’s time to litigate it.
