Video: How not to talk to the judge during sentencing

Via Bill Amos, a symphonie du bleep for lazy Friday afternoon. Interesting case here, actually. The charge was battery stemming from the defendant having spit in the eye of a sheriff’s deputy. The sentence: 13 years in prison, three more than the prosecutor had asked for. Why so long? Because he’s HIV-positive, which makes that loogie a potentially (albeit unlikely) deadly weapon.

He was already in jail for robbery, which doubtless factored in.

Blowback

canopfor on July 18, 2008 at 5:01 PM

What kind of court is that?!?! I cannot believe that idiot was allowed to say 1/2 the stuff he was saying without being removed from the courtroom. That judge STINKS!!!

stvdog on July 18, 2008 at 5:09 PM

Take him out and introduce him to the guys with the short necks and the long rubber hoses. Time for a beat-down. That kind of crap cannot be allowed to stand.

smellthecoffee on July 18, 2008 at 5:14 PM

$.40 would fix that in an instant, Im happy to volunteer to donate the change, and the lead.

Viper1 on July 18, 2008 at 5:23 PM

I guess he communicated precisely what he meant. If only Obama could be so concise.

csdeven on July 18, 2008 at 5:35 PM

Agreed Viper1…agreed.

There needs to be a mass culling of the criminal class in this country.

Jiobaobubai on July 18, 2008 at 5:36 PM

I love how his public defender was quietly edging away from him, when he really got to rollin’.

Virus-X on July 18, 2008 at 5:38 PM

What a charming fellow! Can imagine why he’s a convict.

[Ted Danson is] what we call a wigger

Kini on July 18, 2008 at 2:56 PM

Don’t try to pawn that one off on black people.

baldilocks on July 18, 2008 at 5:41 PM

Ahh, speaking truth to power…..or something like that.

Zardoz on July 18, 2008 at 5:47 PM

What a softy judge. But if I were the judge and reacted how I would want to, I probably wouldn’t be a judge for very long.

Commenting further on the defendant (and how unshocked I am at his behavior) could be dangerous grounds so I will refrain.

Grafted on July 18, 2008 at 6:05 PM

You sort of get the impression there is no way this guy is going to end up being anyone’s prison b***h while he’s doing time?

pilamaye on July 18, 2008 at 6:10 PM

I wish it was Judge Poe just to see what happens!

smellthecoffee on July 18, 2008 at 5:14 PM

I think that was his point. The treatment you a speaking of is common place.

Zaire67 on July 18, 2008 at 7:02 PM

Trash. Weak judge. Bad omen.

spmat on July 18, 2008 at 7:10 PM

I LOVE this guy.

muyoso on July 18, 2008 at 7:11 PM

Free speech zone? At least he did not utter the word “GOD”. Let’s hear it for the First Amendment!

Steve McCullough on July 18, 2008 at 7:19 PM

That’s what we call a wigger

Kini on July 18, 2008 at 2:56 PM

wigger: A term invented and used by white people who would like to but are too afraid to use the word “nigger.” The term may be directly supplanted with “nigger” and no intended meaning will be lost.

It is a racist term and only less offensive than “nigger” in that it is less well-known. Otherwise people using this term should get some cajones and say what they mean.

Try it out on me.

Also, referring to Ted Danson as a “wigger” because of whom he loved and/or dated is the lowest form of bigotry. Your racist family and friends would be proud.

This guy should get 20+ years for his life-threatening assault. This sentence says a lot about how much they value their cops.

The Race Card on July 18, 2008 at 8:24 PM

…send that young fellow to Sheriff Joe Arpaio’s tent city! Heh.

MsUnderestimated on July 18, 2008 at 8:39 PM

Its amazing how many things a little duct-tape can fix.

Would have been funny if Joe Pesce was his attorney as in My Cousin Vinnie.

StuLongIsland on July 18, 2008 at 10:09 PM

I’m betting daddy didn’t hug him.

Alden Pyle on July 18, 2008 at 10:54 PM

Pray for that man. He is in sore need.

Rosmerta on July 19, 2008 at 12:18 AM

Regardless of whether he is a con his basic point still stands. Do we have cops abusing their authority? When someone is in jail the warden and the officers are responsible for the cons safety. They are not there to just keep order. So if officer Diaz is beating up prisoners he should be removed. The punishment was being sent to prison not getting your ass kicked by a cop. If we want cops to kick their asses then we should man up as a society and start sentencing people to getting their ass kicked, hands cut off, castration, and public executions.

sjramos on July 19, 2008 at 1:19 AM

I don’t think I’d call the judge weak.

A bit shocked? Sure. Personally, I think she made a smart strategic move. There’s no need for the judge to come down to hard on him when all that needs to be done is to hand the prisoner the rope and let him hang himself.

That little episode there will go a long way to keeping this critter in jail longer.

And boy do I have respect for public defenders. So much respect. It’s a thankless job, with clients like that, but without them there’s a thin line between us and the state.

ChePibe on July 19, 2008 at 1:43 AM

His people were slaves, he has every right to spew his venom.

What’s up with those pussy ass glasses he was wearing?

mylegsareswollen on July 19, 2008 at 2:08 AM

I’m sure they’ll let him out soon to continue his criminal lifestyle.

tx2654 on July 19, 2008 at 2:29 AM

This man is a victim…

…..or stupidity.

I don’t know, how do you think he got to be HIV Positive?

TooTall on July 19, 2008 at 9:45 AM

Judge Judy would have had him removed from society, ours at least, and probably had him sent back to his mother country without a passport.
