Via Bill Amos, a symphonie du bleep for lazy Friday afternoon. Interesting case here, actually. The charge was battery stemming from the defendant having spit in the eye of a sheriff’s deputy. The sentence: 13 years in prison, three more than the prosecutor had asked for. Why so long? Because he’s HIV-positive, which makes that loogie a potentially (albeit unlikely) deadly weapon.
He was already in jail for robbery, which doubtless factored in.

i love how the prosecuting attorney is mocking him for ‘being such a tough guy’. i wonder if he himself would be acting like such a tough guy if the prisoner was not in shackles with armed guards around him.
not defending the prisoner or anything, i just thought the irony of the prosecutors language was amusing.

If the judge had any… she would have warned him about contempt then sentenced him to far longer for his outburst. As it turns out, she lost control of her court room. That is the judges fault.

Reminds of the story about a guy who was charged with armed robbery and decided he would represent himself in court. During cross examination of the only witness in the case, a woman, the defendant became so frustrated by her terstimony that he screamed “B*tch I should’ve blown your g*ddamn head off!”
Not surprisingly the jury found him guilty.
