Put Gitmo detainees where?

Not Fort Leavenworth, as both Kansas Senators made plain yesterday in a letter to their colleagues.  Sam Brownback and Pat Roberts push back against the oft-repeated suggestion that the US can relocate the detainees at Guantanamo Bay to the detention barracks of Leavenworth, declaring the facility unfit for such a mission on several levels.  The only place that meets security conditions won’t work because of its civilian mission:

In a Senate-wide appeal, two Kansas senators released a letter Wednesday urging fellow lawmakers to abandon a bipartisan idea of moving at least some Guantanamo detainees to Fort Leavenworth, the Kansas Army base that houses the military’s largest prison facility.

The letter puts Sens. Sam Brownback and Pat Roberts, both Republicans, squarely at odds with their party’s presumptive presidential cnadidate, John McCain, who has told numerous interviewers in recent months that he favors closing Guantanamo and moving the detainees to Fort Leavenworth.

“Not all prisons are created equal,” Brownback and Roberts wrote in their appeal. The prison facility at Fort Leavenworth “is not equipped to perform this mission.”

Members of Congress from both parties have long suggested Fort Leavenworth as an alternative to the sprawling prison camp compound in Guantanamo, which today holds 270 war-on-terror captives.

Both presidential candidates have made clear their desire to close Gitmo, and John McCain has specified Leavenworth as a potential destination.  Barack Obama has been less specific, but has implied that the terrorists would get transferred to an American military compound once Gitmo closes.  However, even the commander of Fort Leavenworth — the top of the line for military detention facilities — declares it unfit, which calls into question whether any place exists in the military system within the US.

Leavenworth houses those convicted of serious crimes while in uniform, but these prisoners are not considered nationa-security risks.  The prison has the normal maximum-security safeguards against escape and breakout, but not against the kind of terrorist risk the detainees pose.  Leavenworth also doesn’t have the room nor the extra personnel needed to secure the terrorists.  The commander also objects to keeping foreign terrorists in close proximity to the American military prisoners already housed there.

Another consideration is medical care.  Leavenworth usually transports its prisoners to the hospital in the city, as it lacks medical facilities on the base.  Do we want terrorists to get carted out of prison and through American cities to get CAT scans?  The potential for escape or sabotage should keep Leavenworth off the list entirely.

So where can we put them?  The Supermax facility in Colorado is much more suited to the task, but it’s a federal detention facility, not military.  Prisoners cannot be held there without being convicted of a crime, which would add even more legal complications to their detention.  Congress would have to pass legislation to allow it, and the Supreme Court could ignore it just as it did with Boumediene.

Roberts and Brownback have invited the Senate to take a tour of Leavenworth to see the problems inherent in such a transfer.  Perhaps McCain and Obama should make sure they accept that invitation.

Take the prisoners from Gitmo, transport them to the district court in DC which is hearing the cases and depending on the ruling of the judge, either release the prisoner right there on the steps of the court, ask for them to be placed in a nearby civilian detention facility or export them back to their home of record. Either way the trip from Gitmo is one way. Let see how the experts in the legal profession deal with these prisoners when actually face to face with them and they are no longer merely a face on a milk carton. It may surprise the judges to find out that the prisoners aren’t dressed in orange jumpsuits with black hoods.

The DC jail is about 20 blocks away from the Supreme Court. I am sure, for a price, the DC government would be glad to lease space to the military. Would save a lot of travel expenses and per diem for CIA interrogators.

On the other hand, the SCOTUS might hold that these prisoners are illegal human shields and would have to be moved. Supreme court NIMBY.

I’m not sure the facilities are the same, but, there’s also a prison in Leavenworth for civilians.

If they are the same prison, that means we’d be placing the Gitmo detainees amongst a civilian population anyway. Not the most fine upstanding civilians in most cases (I can attest to this as my big brother is a guess of Leavenworth and the state of Kansas for the next 2 years), but a civilian population all the same.

Of course I am in the NIMBY crowd, but for purely humanitarian reasons. I have a big dog that is an excellent home security system, so if you put a prisoner in my back yard those pictures from Abu GrabAss really would look like a fraternity hazing.
It is so hard to get her to respond to some commands, I blame it on getting her fixed when she was a puppy and she has a lot of anger and hormone issues. So blame Bob Barker.

I’ve written comments before, and deleted them rather than posting them so many times I’m not sure if I posted this idea or not.

Like Just a Grunt says above, bring them into the DC court, and if the judge says release them, then do it on the spot. Right there in front of the judge. Take the chains of, slap them on the back, tell them they are free to go, and let them walk out of the building.

Now for the really scary part. I have relatives who work for a state department of corrections. They know just how dangerous some of their prisoners are, and when those prisoners have served their time, they are released. Just like the paragraph above. You take the chains off, put them in civilian clothes, and put them on the bus.

If someone has a problem with that, take it up with the judge, the supreme court, and congress.

A real money saver would be putting in the Gitmo detainees in the neighborhood with the most Gitmo lawyers. That way we could reduce cost by using a low security prison, since the neighborhood would appreciate that the Gitmo detainees are all innocent victims. An even cheaper alternative would be to put the detainees in house arrest in the lawyers’ homes. I’m sure that the Gitmo lawyers will be glad to help these poor, innocent victims of the BusHitler regime.

I agree with Squid Shark, if they have to be in the continental US, put them in remote parts of Alaska. If someone escapes, they won’t get far. Confederates to an escape plan on the “outside” can’t easily blend into the surrounding traffic and population (Yeah, what surrounding traffic and population?).

POW camps in WWII were in rural Kansas and Texas, but both seem to be too built up nowadays.
