Lawyer of Haditha Marine Chessani: We might sue Murtha

This is actually old news, but now that Chessani’s (momentarily) off the hook it has fresh legs. Murtha’s already being sued by Sgt. Frank Wuterich — the one Haditha Marine who hasn’t yet been cleared — for defamation, you may recall, and as of this writing is still slated to testify in the case. Will he?
In an interview with nationally syndicated radio talk host Michael Savage, the lead attorney for Lt. Col. Jeffrey Chessani said he and his client will look into suing Murtha and the Time magazine reporter Tim McGuirk, who first published the accusations by Iraqi insurgents.
But the attorney, Brian Rooney, said nothing will happen until Chessani, described as a devout Christian and the father of six homeschooled children, is completely “out of the woods” legally…
But Rooney, a judge advocate general officer who served a tour of duty in Iraq himself, said the Marine Corps has until Friday at 10 a.m. Pacific Time to appeal…
Rooney acknowledged to Savage it’s difficult to sue a sitting congressman, but he believes it can be done.
“If he leaves his realm of speaking from the congressman’s point of view … then he can be sued for libel and defamation,” Rooney said.
What he means is that Murtha’s eventually going to invoke the Speech and Debate Clause to try to get himself off the hook. Read the actual language of the clause and you’ll see it’s designed to shield congressmen “for any Speech or Debate in either House…” Minor problem for Murtha: He wasn’t inside the House chamber when he accused the Marines of having killed in cold blood. He was giving a news conference (a snippet of which you can watch here), which arguably is encompassed by the clause if it occurs within the Capitol building. How about gratuitous morning news show appearances, though, like the one below?
He’s ultimately going to have to convince some judge that the touchstone for the S&D Clause shouldn’t be where a congressman is when he’s speaking but rather where he is when he becomes privy to the information he spoke about. That is to say, so long as he’s talking about stuff he learned on the job, he’s free to be as irresponsible with it as he likes, wherever he likes. If he wants to hold a pay-per-view event in which he divulges details of some secret congressional report (PPV because this is, after all, Abscam Jack we’re talking about) then it’s all good. The thing to bear in mind, though, is how gratuitous Murtha’s comments here were. A paradigm case for the Speech and Debate Clause would be if a congressman had some hard proof of government wrongdoing and feared being prosecuted if he revealed it; having the constitutional privilege to protect him would let him speak freely. Murtha had no proof of wrongdoing. He had a bunch of accusations and an agenda, and unlike the other 534 members of Congress, he simply couldn’t wait to let the legal process play out to push that agenda. And now he’s going to try to use S&D as a get-out-of-slander-free card. Perfect.

The Speech & Debate clause has been held to cover more than just what a Congressman says in building itself. I’m at home so don’t have the materials to look it up, but the protection is pretty broad, basically covering every speech pertaining to his job (IIRC). It’s going to be a tough road to hoe here for the Marines. But I think if they do sue, and get denied at trial level, and then appeal (probably denied again at the Ct Ap. level) and then go to the S.Ct. (impossible to say if the Court will hear it & how it will rule), that is going to be an awful lot of publicity for those fine men, contrasted with Murtha’s falsehoods. It should damage him a lot.
So I say go ahead and sue and expose Murtha for the liar he is (and he is a liar because he had no knowledge of what he was talking about — that’s far too reckless to be a mere error to me.)

Because ultimately, EX-Marine Murtha is nothing more than a bloody coward who’s too gutless to take responsibility for his own words.
I don’t have the legal knowledge to gauge the chances of Chessani, Wueterich, or anyone else that might sue Murtha … but seeing his sorry ass dragged through the mud will be worth it, even if he does weasel out of it in the end.

I’m a former US combat Marine (Viet Nam Vet)… Murtha has LOST his right to be equated with the Corps! I’m not familiar with his combat record or what type of MOS he held, but the Marine “brotherhood” needs to ustersize this libelous buffoon now.

It’s hard to imagine a judge (outside of the Ninth Circuit) interpreting the S&D clause to mean that a Congressman has the absolute right to take accusations from less-than-reputable sources and repeat them as truth to any media outlet willing to give the Congressman some airtime.
Imagine if some nut wrote a letter to Congress (falsely) accusing a nominee for a federal judgeship of having an extensive collection of kiddie porn. Would every member of Congress then have the right to go on all the morning news shows the next day and announce that they’re not voting to confirm that nominee because he’s a depraved pedophile? I seriously doubt that’s what the Framers had in mind when they wrote the S&D clause. There have to be some limits and whatever those limits are, it seems to me that Murtha clearly crossed them when he slandered the soldiers.

Congressman Murtha suffers from what is technically know as the semperideliriumnarcissistmaximus syndrome. It is a long word, as German words often are, but basically means he is a crazy selfish old fart with delusions of grander.
He is also suffering from early moderate to sever Alzheimer’s, but unlike another who suffered from that disease, he does not have the class to suffer with grace.
My treatment plan would include:
1) Triturating up to very high doses of Donepezil, Galantamine and Rivastigmine.
2) High voltage electroshock treatment. The judicial placement of several leaches on his head may also be beneficial. Frankly I doubt that either of these would be of much benefit to Congressman Murtha but would make many others feel a lot better so I say let’s go for it.
3) Being placed in a small sound proof private room with the door closed with a couple of Marines may also be needed. Even if it doesn’t make Congressman Murtha feel any better it will bring joy to the Marines I am certain.
Even with this complete treatment plan, his chances of making a recovery are unfortunately quite small, but we in my profession do have the responsibility to at least try.

I doubt he’ll get away with it as that’s not how it works in Canada or Britain and, I assume, Australia and New Zealand, under Common Law where it’s only privileged when speaking in the House of Commons (legislature).
As a matter of fact, a few years ago our Liberals dared a Conservative MP to repeat outside of the House floor what the Liberals were trying to spin as a slander. The Conservative MP did; and the Libs shut up pretty quickly. Oh, and the Conservative Party is currently suing the Liberals over an alleged lie on the Liberal Party web site. So this shouldn’t work for Murtha.

Just to give the devil his due, Murtha (according to Wiki) was primarily a reserve officer and did serve in Viet Nam as a Battalion S-2. He’s got an impressive list of medals (including Purple Hearts), but seeing as he was a senior officer by that time, I have questions as to whether or not said medals were inflated at all.
Now that’s out of the way, the seditious bastard ought to be sued by every single Marine he defamed and then thrown out of the House for whatever equivalent they have to “conduct unbecoming.” I’m a Marine vet myself and was in Iraq when this toad made these comments. The absolute stampede to “justice” by the media was expected; to recieve the same treatment from a congressman who was supposed to be “one of our own” was unconscionable. We say there are no ex Marines, but in his case, I think we can make an exception.

I am hoping for four simple things here.
First, that Lt. Col. Jeffrey Chessani sues the living socks out of bullying loudmouth Jack(ass) Murtha and sues him for every lousy stinking penny he has.
Second, that Lt. Col. Jeffrey Chessani wins his case, takes every lousing stinking penny that bullying loudmouth Jack(ass) Murtha has and gives it to a charity for the families of soldiers who have died in combat.
Third, that after he is sued for every lousy stinking penny that he has, Congress finally sees bullying loudmouth Jack(ass) Murtha for the bullying loudmouth that he really is and censures his worthless ass for the remaining time he is allowed to wander the hallowed halls of the House of Representatives.
And Fourth, that the good people of the district in Pennysylvania who bullying loudmouth Jack(ass) Murtha has been embarrassing for who knows how long finally sees him for the bullying loudmouth that he really is and recalls his lousy stinking ass from Congress and get someone in there who will represent them, and not the special interests of Nancy Pelosi and Harry Reid.
And somewhere in-between all this, I would like to see the Marine Corp move to revoke bullying loudmouth Jack(ass) Murtha’s right to say he ever served in the Corps.
I see any or all of this happen, I will be a happy person indeed.
