Did Democrats argue that Congress can hide legislation from the President?

I’d put this far above the silly controversy over signing statements. According to House minority whip Roy Blunt, the Democrats made more than one mistake in failing to include a large section of the farm bill Congress sent to the White House. They argued that the omission did not make the bill invalid, and that Congress can choose to send only portions of bills for a presidential signature or veto.

Needless to say, this rather creative view of open government prompted a response from Blunt. He sent a memo to the entire Republican caucus that outlines the dangers of this approach:

What Did They Know, When Did They Know It, and What Did They Do About It?:

Ø It appears the Democrat Leadership was informed by the Office of the Law Revision Counsel and the Committee on Agriculture that the bill sent to and vetoed by the President was erroneous PRIOR to consideration of the veto override.

Ø Despite this knowledge and despite requests from staff from the Republican Leader’s office, the Democrat Leadership proceeded with the veto override of a bill they knew was not the bill passed by both Houses of Congress.

Ø Importantly, there were opportunities to correct the enrollment error consistent with past practice and in a constitutionally sound manner if the Democrat Leadership had not rushed ahead with the veto override. Once they moved forward, however, they foreclosed those opportunities.

Ø When confronted on the House Floor by the Republican Leader, Whip, and Rules Ranking Member, the Majority Leader defended the Leadership’s actions and professed a constitutional theory that so long as both the House and Senate had passed the same language in didn’t matter whether or not the Speaker sent the whole bill passed by the House and Senate or simply parts of it to the President.

The Dangers of the Democrats’ New Theory:

Ø Under the theory espoused by the Majority Leader, the Speaker of the House can simply pick and chose (either overtly or as a result of mistake made by an enrolling clerk) which parts of final bills to send to the President. If she is uncomfortable with a provision that was included as part of a compromise she could in theory exclude it from the bill when she sends it to the President.

Ø Importantly, the Speaker’s decision to omit language if challenged by Members of the House through a question of privilege, can simply be tabled by the majority.

Who Pressured the Enrolling Clerk to Quickly Complete the Enrollment:

Ø In a memo prepared by the House Clerk on May 21, 2008, the Clerk asserts that part of the mistake was a result of a ten-year-old flawed enrolling process, yet she goes on to state that “During a review of this process, Enrolling Division staff expressed a concern in receiving direct calls from Leadership and the Committee to accelerate the enrolling process.” Who pressured the enrolling staff?

The balance of power in American government counts on an open process on legislation between Congress and the executive branch. That requires Congress to provide the President with a complete copy of bills to determine whether to sign or veto them. Any hidden provisions not submitted to the executive should render the entire legislation invalid.

Democrats had Republicans in trouble with their base for their votes on this bill. Instead of just taking their time and letting the GOP twist in the wind, they managed to snatch defeat from the jaws of victory with underhanded and potentially unconstitutional maneuvering.

This is really dangerous stuff.

The liberal left has taken debate to the point where words have different meanings depending on what meaning the left needs to prove its point.

Continue that progression and you get laws that have different meanings depending on what meaning is needed to produce a conviction. This then becomes a situation where the law, and the full power of government is used to prosecute a political enemy, and the law ’says’ what ever the party in power wants it to say.

Compare with courtroom procedure, being given a subpoena to turn over documents, only submitting PARTIAL evidence willfully withholding the substantial balance of the document that would disprove your case.

Democrats! Corrupt Losers! The GOP has fodder for the campaign bonfire. It is the fault of DEMOCRAT legislation and policies that we suffer the high price of Fuel and Food. Even the high cost of medical care is linked to malpractice insurance that WE pay for following class action and “frivolous” law suits. “Pass it on” is not a fun game for today’s consumer. I occasionally track legislation thru the house and Senate (for work) and I’m wondering if the final language of the Bill was ever made available to the public.

If the President didn’t get the full text of the bill, then it is unlikely that it was published in full in either the Federal Register or thru the Congressional web portal that allows the public (and MOCs) to review history, progress, ammendments, etc.

If only the paper version sent via courier to the White House was missing some pages, it really isn’t a big deal.

The real question is whether the text, ammendments, and votes were properly released for public inspection.

So now it is to be “word of mouth” legislation. That is completely consistent with the “living document” interpretation of the Constitution and “evolutionary meaning” so that whatever is expedient whenever for all purposes, the Democrats persist in qualifying their virtues based upon “good intentions”. Word of mouth, that is our basis of understanding. The evolutionary process of literacy returns to its place of origin, word of mouth source. Soon enough, it will be mind melding. No words necessary. But for now, it is lack of documentation upon which we exist.

This is the kind of intellectual garbage pushed by the same people who push one-party contracts.

Historically and legally, all contracts require two parties to come together and have a meeting of minds and then there must be a passing of consideration to make the contract valid.

This is why it is totally wrong for manufacturers to claim that you accepted the terms of their license by opening the package: a meeting of minds could not have taken place prior to opening the package because the text of the contract was not available to both parties.

Similarly, it is wrong to claim that illegal aliens and other non-citizens are entitled to the benefits of citizenship. These classes of parties have NOT agreed to the terms spelled out in our Constitution, and have NOT accepted their responsibilities under that contract: clearly, a meeting of minds has NOT taken place.

Being as how so much of the earmarks are not in the bill, but in committee reports, Congress has actually been sending only part of the “legislation” to the Executive for a long time.

They’ve gotten so used to it, that now they feel justified in sending over only part of the bills as well….

It’s my understanding that while the Democratic leadership has to take the hit for this “gaffe”, the house is currently voting to table a resolution submitted by the Republicans to do an investigation and basically start over on the farm bill, called a privilege motion. Party line votes are being recorded and will likely be passed, (tabled).

Some poor clerk is probably already out the door along with the proof-readers.

The point actually returns to the “need” for new legislation being more hype than true. We need no more new legislation, and in fact would do well rescinding new legislation. BACK TO BASICS. We aren’t getting anything out of new legislation other than higher taxes and worse economy. Everything gets outsourced, anyway. And the traditional laws we have are not enforced because the law suits demand judicial preferential treatment in favor of liberals.

Presidents have often asked for, and been denied, the power of the line-item veto. Welcome to the line-item override, of items the President didn’t have the chance to veto.

Time for the House Republicans to sustain the veto. Not only is this bill porky, it’s unconstitutional.

OK, let me get this straight. The Republicans are upset because a bill they wanted to pass, and in fact did vote for and vote to pass, was technically not the bill they sent to the White House, because it was missing 34 pages.

The Republicans voted for this bill en mass. They voted to pass this bill, and then to override the veto en mass. Yeah, lots of difference between the Democrats, and Republicans.

It’s really a shame that the Democrats control both houses of Congress, because Pelosi deserves to be impeached, but she won’t be (unless the “blue dog” Democrats break party lines)…

I 100% agree. The questions the SwiftVets and POWs for Truth asked were never answered. They are honorable men, and the people toss around the “swiftboated” term are the liars who try to paint these honorable men as liars.

According to section 3 of the 14th amendment, John F’in Kerry should not even be allowed to be a Senator without a 2/3 vote of both houses of Congress!

No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath,as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

Throw out Kerry, and replace both senators from MA!

Just imagine….. If the Republicans had more than half a dozen even half way decent candidates across the nation; If the RNC had any competent speechwriters and publicists; if the State GOP organizations were anything but double-dealing political establishment hacks….

There would be a huge Republican landslide throwing these Obama, Clinton, Reid, Pelosi, Kennedy, McDermott, Murtha type jerks out of office and into the septic tank of history.

But when the Republicans, with very few exceptions, can’t do any better than offer mediocre Mediocrats™ (or worse) in opposition to this kind of unconstitutional idiocy, the downward spiral into third world kleptocracy will only accelerate.

There should be a test: Political candidates for any national office should have to pass an in-depth written and oral exam given by Justices Alito, Roberts and Thomas, proving that they have read and understand the Constitution.

I weep for this once great nation.

I don’t weep for the nation. I laugh at the blatant stupidity and asinine decisions of supposedly smart people. I figure, if you’re going down the tubes faster and faster, you might as well enjoy the show. This election clearly shows that the last of the honorable politicians is either dead, or retired. We’re stuck with the D team dreaming of the days when we had a B team running for office.

Well, break out the popcorn, I’m sure that McCain will be here soon to once again demonstrate what a jacka** he is.

Former Assembly Speaker Fabian Núñez, saying he now can speak more openly, is blasting accusations that he spent lavishly on overseas trips and retail purchases as racially motivated.

Núñez, who is termed out of the Assembly in December, lashed out Saturday during an interview on Spanish-language television.

The Los Angeles Democrat said he has no regrets over his spending of campaign funds, despite controversy over tens of thousands of dollars spent on high-priced hotels, wine, gifts and other purchases.

“Everyone’s done it like this,” Núñez said of previous legislative leaders. “The difference is there are some in politics who want to judge me in a certain manner.

“Because of the fact I am Mexican, they think I have to sleep under a cactus and eat from taco stands.”

Núñez’s spending included more than $47,000 in plane fare, more than $5,000 at a wine cellar in France, and more than $2,500 for “office expenses” at Vuitton, the Los Angeles Times reported last October.

In the interview on Univision’s Voz y Voto program, Núñez defended in Spanish his accommodations in fine hotels overseas.

“What’s a luxury hotel? A stay at a Sheraton? … I am, you could say, like a head of state. I’m the leader of the Assembly of the state of California. Where am I supposed to sleep?”

Núñez’s spending became a target last year in the campaign against Proposition 93, which would have altered term limits and allowed him to serve as Assembly leader an extra six years.

“The only thing that really results out of this is that groups that don’t like Latinos use this as a weapon to inflame anti-Mexican, anti-Latino politics,” he said.

Hector Barajas, communications director of the California Republican Party, called Núñez’s racial comments disgraceful and disheartening.

“Questioning someone’s expenses, especially when they’re in public office, is something the public should do,” he said.

Kevin Spillane, a GOP strategist who ran the campaign against Proposition 93, noted that the campaign also accused President Pro Tem Don Perata, who is white, of political corruption.

“Political corruption is colorblind,” Spillane said.

Steve Maviglio, who served as Núñez’s spokesman, said the speaker was justified in feeling that some people exploited controversy over his spending for racial purposes.

“You cannot deny there’s some overtly racial overtones to this,” Maviglio said.

This tool Nunez sounds like the other champion of Hope and Change, Mass. Governor Cadillac Duval Patrick who has been to busy promoting his new book to recognize the collapse of the Commonwealths finances, any fiscal responsibility/accountability by the democrat legislature is non-existent, spend – spend – spend. Folks whom get weak kneed over Obama should take a look at Patrick, he’s a total and complete failure…just words indeed!

I already called my representative’s office this morning to voice my displeasure after I saw that he had voted “yes” on the original. Normally, he votes conservatively. Who is to say what motivated him.

Rep. Boehner said on a radio interview that many of the Republicans who voted “Yes” were doing so because of urgings from their rural constituents.

These costly bills should not be allowed to have unrelated items attached nor should committee items be dropped in as add-ons.

While I do believe that the Legislative Branch of the federal government is the most powerful of the three, this bit about hiding stuff from the Executive Branch is just plain ironic and entertaining to a certain level. Of course it’s a bit of a head scratcher when Congress, on the one hand, whines when the President keeps intelligence from them, a right certainly given to the President, but then they turn around and do the same thing! It just makes them look silly and amaturish when they pull stuff like this.
