Emphasis on suspected: Early reports claim that he’s here illegally but cops are still investigating. My deepest apologies to amnesty shills everywhere for even bringing his status up. Hopefully it’ll turn out he’s a citizen so we can all breathe a sigh of relief and be comfortably outraged by the crime; otherwise this is destined to end up on “Geraldo At Large” as one of those segments in which our fearless host spends six of the seven minutes devoted to it explaining why immigration politics have absolutely, positively nothing whatsoever to do with the matter — even though in theory stronger enforcement would have kept this guy out of the country in the first place. Yes, stronger border enforcement might have kept this particular guy out (Remember, not all illegals here jumped the fence at the Mexican border) but outrage does have to be on the crime itself…not the legal status of the perp.

Indeed it does, but riddle me this: If the judge lets this guy out on bail and he goes out and rapes another 10-year-old, on whom will the outrage fall? The suspect himself, of course — and the judge, for being so derelict in his duties that he enabled the crime to occur.

There’s the Jamiel Shaw case in LA where illegal gangbanger arrested numerous times, released from jail after serving 4 months for a weapon offense shoots and kills Jamiel, 17 years old, one day later as he is walking home. His parents are trying desperately to get the law to change so this city is not a sanctuary for convicted gangster thugs. But the politicians treat his parents like crap. His mother is serving in Iraq, too.

Yes, I agree in that instance, the judge should bear part of the blame, because he made the decision to let him out, which is different than just legal status.

Are you saying border security is to blame? Or the states? Or Congress for not passing tougher laws? The list can go on and on. It’s not that, allegedly mind you, an illegal committed this heinous crime…but that this crime was committed by a person.

American citizens commit horrible crimes too…and it’s usually the liberals who play the “blame game” rather than let it rest where the blame belongs…on the personal responsibility of the criminal.

Actually, one could argue it would be. This was potentially preventable. I know I feel worse about an unhappy event when I could have done something to prevent it.

Put another way, it’s simple addition. To the horror of the rape, you add the injustice of this person’s having access to the child to begin with.

I’m moving back to Rexburg, ID which is about 15 miles south of St. Anthony. I’ll be watching this case closely.

This makes two crazy news stories that come from the area around my home town in the last six months. Some of you long time Hot Air readers will remember last winter the sheriff deputy who shot the dog three times and still couldn’t kill it. That was in the same area, between St. Anthony and Rexburg.

I’m sorry, but I believe that’s an oversimplification. And I still say, who or what exactly will keep illegals out? No one…Left or Right, Democrat or Republican, is going to clamp down on it. Just ain’t gonna happen…McCain’s come closest so far in saying he’ll secure the border. But again, all the illegals here that I know came here legally, but just overstayed their visas. And none of them commit crimes. Especially not like this case.

Bottom line though, this crime has to put the blame on the perp. Not legal status, race, gender, socio-economic upbringing, etc etc. It’s just a sick individual.

As to his immigration status- yes, it matters for two reasons:

1. He shouldn’t have been here in the first place.

2. The fact that he was here implies that as someone living in the US illegally, he’s essentially an outlaw- no ID (or a forged one), no strong connection to family, community or country and it’s laws.

Given that such a person is already “living in the shadows”, skirting immigration, employment and tax laws should we really be surprised that some illegals don’t have much respect for the law or community they live in?

Just as tourists behave differently (and often worse) on vacation than they do at home, I suspect that many illegals behave differently here than they would in their home country, where connections to family and community help keep people in check.

A big friggin’ wall that is maintained, an active, properly manned and equipped Border Patrol. Create an upgraded and updated visa/immigration system to watch for overstayers, as well as make life less miserable for people going through the process of immigrating here.

Properly equip and man internal enforcement system, that cooperates with local and state law enforcement. Enforcing laws that bar businesses from hiring illegal immigrants, focus on egregious corporate offenders and work your way down.

I’m pro-immigration, we should be seeking out the best and brightest and the hardest working, but they should come here on our terms. I think our terms are unfair now, the nightmare people have to go through is obscene, one of our fellow Morons is in the nightmare process of dealing with immigration to get his adopted daughters’ status corrected. I support efforts to make coming here easier and more fair. I have no respect for those that would be rewarded for violating our laws.

The list can go on and should. These are the bodies that we support, and their job is to do their best to prevent crimes like this, but they are derelict in their duties. Border Security should have kept him out, and if that failed, states should have passed legislation to keep him from finding work, or a place to live, and Congress should have enacted this same legislation on a federal level.

A well-maintained wall will keep out a lot of illegals, but certainly far from all. Like I said, so many do come here legally, but just over-stay. You’d need a wall 30,000 feet high all around the country to keep ‘em out.

But if you do want a fence/wall and a secure border, vote McCain. At least he’ll try. But again, no one from either side has done much so far over the decades. I just think, and mostly for political reasons, it won’t get done.

Isn’t there funding right now…in place…for a large portion of the wall? But it’s not getting done.

Had we properly defended our border, sealed it, deported those who overstayed, ect, this would not have happened with this particular individual. Don’t hide his status: it needs to be the center of the story. Our government, both parties, is guilty of criminal negligence when things like this happen with illegals.

A wall, and I’m all for one, will still only prevent a portion of illegals coming here. Even the Berlin Wall, with it’s levels, barbed wire, and armed surveillance, wasn’t ever 100% effective. Where there’s a will, there’s a way.

Thing is, what DO we do about not only new illegals coming in, but the millions here already? Mass deportation? Government officials rounding them up, sticking them on trains and busses out of here?

Like McCain says, it makes no sense to deport anyone until the borders are secure. And again, McCain says he’ll do that. But will Congress go along?

Frankly it makes a lot more sense to use the death penalty in a case like this than in many where it used.

Bank robbers and convenience store stick-up men won’t necessarily kill again.

Guys like this WILL do it again. And again. And again. There isn’t even a question.

I guess it depends on what the death penalty is for. If you think it actually deters criminals from being armed during robberies … fine. But if you want to use it to prevent future crimes from the same people: this is the case to use it in.

When it comes to questions of immigration my trust is small with any politician who talks but hasn’t actually done anything about it. Call me a cynic, but until I see some results I’m not gonna trust anybody, even mr. “straight talk express.” The fact that hes mired himself in this La Raza business doesn’t lend much credibility to his case either.

Z Visas mean open borders? Hardly. There’s so many requirements to not only getting one, but what the government must do to secure the borders as well.

Something has to be done. The Z visa is only probationary. And Bush would probably sign it into law too.

You have a name problem Jetboy. You mention and or defend the wrong names on this issue. If you want to avoid a storm when discussing illegal immigration don’t speak of McCain or President Bush. Both those names raise the hackles of closed border supporters, but I guess you wonder what President Bush has to do with the illegal immigration issue as well.

No a Z-visa with a 24 hr time limitation on background check means that the worst of the problem with ill immigration, namely increased violent crime, is essentially unaddressed. It is an insincere show to address the concerns of the citizenry. McCain’s rhetoric on enforcement is duplicitous and not worth any consideration. He might be the best of the three on the issue, but that says little.

If this guy turns out to have entered the country legally, would you still place the blame on our immigration system? I can think of plenty of individuals who have committed horrific acts after entering the country legally; some, perhaps, should have been caught before they hurt anyone, while others were just sick individuals. I’ve gotta go with JetBoy on this one.

Now here’s something that might cause a bit of controversy… I am pro-life, but I just don’t believe I would let my 10 year old baby girl maintain a pregnancy. No, I know I wouldn’t. But I am not judging this poor little girl’s parents. Just thinking aloud I guess.

For those of you who say there is no way to ship 20 million illegals back to their homes I say how do you know if you don’t even try?

For those of you who believe John McCain would willingly do anything about illegals I have some beach property in NE Pa. I’d like to show you. Some of you may have missed McCain sticking his big toe back into the amnesty pool earlier this week with his speech to LaRaza, but a lot of us didn’t miss it.

If McCain were to be elected (a long shot by any measure) I’m sure his plan will be benign neglect. He just won’t do anything and hope that most of us have very short memories.

Update: Rich Lowry thinks the “triggers” are a scam from the word go, with amnesty granted immediately upon passage of the bill and the “Z visas,” which are keed to the enforcement triggers, only relevant insofar as they allow the bearer to travel. But even if Lowry’s wrong, what happens to the illegals who are here while the feds are working towards the triggers? Let’s say they get bogged down and can’t get them done for another decade. What’s the status of the “undocumented” during that interim period?

I have it straight from the mouths of the Democrats in congress that the undocumented are hard working family people. I suspect he heard Hillary talking about coming out of the shadows and he became confused and things got a little out of control. I trust that the Democratic congressmen and John McCain will go his bail and pay for his lawyer since they are so committed to his cause. I know they will at least dispatch the ACLU.

Jurors found illegal immigrant Juan Leonardo Quintero guilty of capital murder in the death of a police officer.

I had to laugh but this is not funny it’s insane. According to Defense attorney Recer (you gotta wonder what she was thinking, er, maybe she didn’t have enough beers.)

Recer said she worked to figure out what was wrong with Quintero and what he was thinking.

“Because he sure wasn’t thinking like any of us,” she said.

She said Quintero’s “bad brain” has an overactive threat-detection system, usually assuaged by drinking about 24 beers a day. But on that day, Quintero had about six beers.

One of the biggest myths out there. Law enforcement has no legal obligation to do protect anyone. The books are full of case law regarding this.

Federal, state, county municipal … there are ‘no duty’ clauses everywhere … they aren’t even required to give you aid.

In my neck of the woods, while the fire department isn’t obligated to save your house, they might, out of the goodness of their hearts, prevent the spread of the fire to adjacent areas.

The irony is that the state has created ‘good samaritan’ laws out there that obligate you and I to render aid to others.

I don’t see how anyone can argue his illegal status is not relevant. If he was not in this country, he would not be here to rape a child. It would have prevented this child from being raped by this defendant.

I have a 10-year-old daughter, so naturally I clicked on this story right away and watched the video. Disgusting. I really don’t care who the perp was or where he came from, this is a horrible crime. We’ve had plenty of well-publicized cases of child abduction, rape, and murder committed by good old American citizens. The only diference here is that the scumbag didn’t kill the girl after raping her, thank God.

I have this funny feeling that the victim here was one of the kids who lived with this guy. The reporter seemingly went out of her way not to tell us anything about her or her family. Makes me wonder. It’s natural to assume that she was a local white girl raped by the vicious alien scumbag, but that might not be the case. It might be incest, whch would explain the family allowing the girl to have the baby.
