They were not brought into the US as were the German and Italian POWs because they are not POWs in the international legal sense. But once in the US our courts COULD have jurisdiction via lawsuits. That has already been tried and failed since they are in GITMO. Imagine all of these guys in civilian courts with the required rules of evidence. Most would probably be released rather the government go through what would be required; maybe including releasing legal rules of engagement we would rather keep off the record. Remember the year long trial in VA of the dirty bomb defendant, José Padilla, that the courts said must be tried in civilian court because he was an American arrested in the US. It was on its way to the SCOTUS over his military detention when the government reversed itself.

What was done to José Padilla initially was what President Lincoln did to those out of uniform supporting the Confederacy. I can understand why there were many, what we would call, ex-constitutional excesses under Lincoln’s use of the military then with the country in civil war, but I don’t remember arrest and trial by the military being declared unconstitutional at the time. He even issued an arrest warrant for the Chief Justice of the United States, Roger B. Taney, following his opinion in the case of Ex parte Merryman (May, 1861) The suspension of Habious Corpus was declared unconstitutional which Lincoln ignored.

I laugh when people accuse President Bush of becoming a dictator for the Padilla action and other things such as FISA and the Patriot Act. They have no idea of what living under a real dictatorship entails, I’ve been there, done that for a month and that was enough.

As a condition of getting out, a sponsor (who must be a responsible adult with a verifiable address and phone number who owns property and pays taxes and is willing to post at least a $1 million dollar bond) is required. The sponsor is responsible for keeping them out of trouble and out of other people’s yards. If the Gitmo alumnus steps out of bounds, you round him up and also jail and/or fine the sponsor.

This would cut down on the foolishness, as the world would quickly run out of sponsors.

Every time something like this happens, the WH should have at least a top ranking DOD Undersec or Dana Perino or as High ranking a head as they can locate to forcefeed this stuff to the WH Press Corps.
then when the MSM dont report on it, the WH should be going back for another at-bat, slamming reporters right to their faces, on camera, for not doing their jobs.

Where is the WH public communications activity dealing with this now semi-frequent news? Answer: NOWHERE.
