DavePa "Would that include, oh, for example, a former President’s National Security Advisor stealing and destroying top secret documents from the National Archives?"

1. That happened after that Presidential Patron left office.
2. Even so that doesn't rise to the level of "High Crimes and Misdemeanors". And by the way, the only "crimes" the Constitution recognizes are "American crimes", not international and not political. - Only if the Senate approves a treaty, and only then if Constitutional.

This is another self-inflicted wound. What will play is Obama will prosecute Bush and others for "war crimes." This will include of course members of the military. Probably the lot of them.

Obama would rather indict Bush for someone pouring water up KSM's nose, than protect the country from AQ and nuclear attack. Great work Kos!

"...Now, if I found out that there were high officials who knowingly, consciously broke existing laws, engaged in coverups of those crimes with knowledge forefront, then I think a basic principle of our Constitution is nobody above the law — and I think that’s roughly how I would look at it."

Although "investigating" will be a feel-good idea for the far left (or dhimocrapt center), it is possibly the most dangerous thing that can be done. The United States has been blessed with 43 Presidents that, regardless of their passions, generally left the outs and alumni alone. If a President with the current far-left tendencies wants to punish a predecessor for good faith political acts that post facto are declared actionable, particularly if they control the legislature and the judiciary, the stage is set for a truely bad president, with the support of other organizations to decide to not give the successors a chance. Why would a truly powerful and evil President step down if he thought he was going to be punished. This has happened in several countries recently and through history. In addition, historically, the prosecution of Roman consuls for in-office percieved offenses, after leaving, is one of the political stupidities that brought about the fall of the Roman Republic. A note to the nuts on the left, we haven't yet had a President that injured (his own) the American People in the manner of Stalin, Hitler, Caligula, Mao, King John, Shaka Kahn, Herod, Arafat, or any other left pop culture icon.

I wouldn't worry too much about it. That's exactly what the 2006 led Democrats in the House and Senate said they'd do and they ended up looking like the idiots they are.

I hope you’re right. My opinion is very different.

If Obama is the nominee, I think he might very well win. Without my vote, of course, but I still think he could (and probably will) defeat our RINO candidate. He’ll have a big money and enthusiasm edge. And, of course, by electing a minority, we’ll be making history! (That’s how it’ll be sold, subtly, anyway).

I agree but I don't think it will be sold subtly at all. I've already encountered people that say that the only reason anyone would not vote for Obama is because they were bigots. My only worry is that he will make two terms and then his wife will be trying for the next two.

Aren't we all glad now that George W. Bush extended that extra measure of bipartisan bonhomie to Democrats by refusing to pursue prosecution of Clinton administration members after he took office?

Offering bipartisan cooperation to Democrats consistently yields such positive results...

The only problem with the beating Obama will get this fall is that it will be so decisive as to cause the Democrats to better scrutinize the bona fides of future candidates.

I.e. no, it’s virtually certain that he won’t go after anyone lest it set a precedent for partisan prosecutions by incoming administrations in the future, but to borrow a choice term from a paint-by-numbers answer in the foreign policy vein, all options must remain on the table. Zzzzz.

When did Democrats start worrying about setting legal and/or political precedents?

Bush was a successful, popular governor in part because there were Democrats who were willing to work with him for the good of the state. He thought he could bring that same bipartisanship to DC. He tried to win over Ted Kennedy by letting him have a hand in No Child Left Behind, by inviting him over to watch a documentary about JFK, & by naming a building after him. Bush also stopped all investigations of the Clintons. Did Teddy or any Dem fall in love with Bush?

Now, if I found out that there were high officials who knowingly, consciously broke existing laws, engaged in coverups of those crimes with knowledge forefront, then I think a basic principle of our Constitution is nobody above the law...

I wish he'd stop hitting Hillary with cheap shots.

Well, I wish that Bush had investigated and prosecuted the crimes of HIS predecessor instead of giving them a wink and a nod, and pulling the rug over a little farther to keep them out of sight.

So, if Obama wants to do it, I guess I can't complain (I don't think he will find much).... As long as whoever follows Obama investigates and prosecutes him for HIS crimes, which will no doubt be myriad.

Would it satisfy those who insist on prosecuting the Bushleone Crime Sydicate if they had play hearings in the basement? There's already precedent and the media can treat it as bonfide like the Conyers Commission.

The only problem with the beating Obama will get this fall is that it will be so decisive as to cause the Democrats to better scrutinize the bona fides of future candidates.

The fact that Obama has traveled as far as he has on such thin gruel of a record is an indictment of the Democratic party’s competitive field. For all of Mrs. Clinton incompetancies (and they are many), she is right to recognize that in all likelihood, Democrats will indeed suffer from buyers remorse. Unfortunately for her, she is not the anecdote that first crosses the mind of the electorate and the patient (her party) has already been compromised.

Prediction: The most lopsided election since McGovern.

By the way, the WSJ opinion piece is excellent.

"Why can’t Obama start investigating Bush and his government now, during the campaign?"

To begin with, he'd have to start an exploratory committee to find the Rayburn Building, since the only day he's seen it was during orientation when they served him milk and cookies.

I would not want my first term consumed by what was perceived on the part of Republicans as a partisan witch hunt

Note that Republicans would merely perceive such a proceeding as a partisan witch hunt - the Messiah will not go so far as to say that it would actually be a partisan witch hunt (which it obviously would be).

Why does he have to wait. He's a powerful guy. Why can't Obama start investigating Bush and his government now, during the campaign? He should make it the centerpiece of his campaign, taking second place only to the pressing matter of racism in America. Polls put both issues at the top of the voters concerns for 2008.
