Obama: As president, I’ll “immediately” look into whether Bush’s team committed any crimes

A sterling example of a juicy question that leads inevitably to a paint-by-numbers answer. It’s like asking if a terrorist should be tortured in a true ticking-bomb scenario. “Obviously, we’d have to look at all the facts and balance our revulsion towards torture with the need to protect the American people,” blah blah blah blah.
He can’t say that he won’t look into it or else he’s committing to ignoring possible criminality (not to mention denying his base their erotic fantasy of Bush being frogmarched away) but he can’t promise to launch a major investigation or else he’s bound to it and sidetracked in a war with the Republicans from day one. So he gives the only response he can give realistically, one which Maverick himself would likely be forced to approximate if asked.
What I would want to do is to have my Justice Department and my Attorney General immediately review the information that’s already there and to find out are there inquiries that need to be pursued. I can’t prejudge that because we don’t have access to all the material right now. I think that you are right, if crimes have been committed, they should be investigated. You’re also right that I would not want my first term consumed by what was perceived on the part of Republicans as a partisan witch hunt because I think we’ve got too many problems we’ve got to solve.
So this is an area where I would want to exercise judgment — I would want to find out directly from my Attorney General — having pursued, having looked at what’s out there right now — are there possibilities of genuine crimes as opposed to really bad policies. And I think it’s important– one of the things we’ve got to figure out in our political culture generally is distinguishing betyween really dumb policies and policies that rise to the level of criminal activity. You know, I often get questions about impeachment at town hall meetings and I’ve said that is not something I think would be fruitful to pursue because I think that impeachment is something that should be reserved for exceptional circumstances. Now, if I found out that there were high officials who knowingly, consciously broke existing laws, engaged in coverups of those crimes with knowledge forefront, then I think a basic principle of our Constitution is nobody above the law — and I think that’s roughly how I would look at it.
I.e. no, it’s virtually certain that he won’t go after anyone lest it set a precedent for partisan prosecutions by incoming administrations in the future, but to borrow a choice term from a paint-by-numbers answer in the foreign policy vein, all options must remain on the table. Zzzzz.

Clearly B. Hussein Obama has yet to understand the cardinal rule of being President……. One does not go out after one’s predecessor. Besides being unseemly, the 43rd and 44th President will end up seeing each other at every state funeral, presidential library opening, etc for years to come. It would be pretty frosty if the first official act is going to be prosecuting a whole bunch of people that no longer hold political power.

Don’t assemble the Star Chamber quite yet.
In an interesting development in the trial of Tony Rezko, Mr. Obama’s previous claim to have never met Nadhmi Auchi is now called into question. There has now been testimony that Obama went to a party hosted by none other than Mr. Auchi.
Baring celestial interference, it is impossible to imagine a scenario in which Mr. Obama would forget attending a party hosted by an extremely wealthy person who just happens to be an associate of your close friend Tony Rezko.
All of which gets to the heart of the matter. It is my understanding that in a separate bankruptcy filing, Tony Rezko previously claimed to have no assets which could account for his wife’s purchase of the lot next to Obama. Then lo and behold, just prior to Obama’s home purchase, Rezko received money from Auchi. In a red hot real estate market, Obama was able to receive price reduction on the home and Tony Rezko meets the condition of the seller by purchasing the lot at the same time.
Curiouser and curiouser.
moxie_neanderthal on April 15, 2008 at 1:17 PM
I understand and agree. But what can be done that isn’t? It doesn’t seem like any solutions will come from the Republicans, unless there’s another major attack. What do you have in mind?
JiangxiDad on April 15, 2008 at 1:17 PM
The Democratic congress has been ‘investigating’ the Bush administration since they became the majority. With all their ‘investigations’, I think they concluded that something definitatly happened w/ the strawberries. They have since moved onto more important national security issues: whether Roger Clemmens used HGH.

Why does he have to wait. He’s a powerful guy. Why can’t Obama start investigating Bush and his government now, during the campaign? He should make it the centerpiece of his campaign, taking second place only to the pressing matter of racism in America. Polls put both issues at the top of the voters concerns for 2008.

Note that Republicans would merely perceive such a proceeding as a partisan witch hunt – the Messiah will not go so far as to say that it would actually be a partisan witch hunt (which it obviously would be).

The only problem with the beating Obama will get this fall is that it will be so decisive as to cause the Democrats to better scrutinize the bona fides of future candidates.
The fact that Obama has traveled as far as he has on such thin gruel of a record is an indictment of the Democratic party’s competitive field. For all of Mrs. Clinton incompetancies (and they are many), she is right to recognize that in all likelihood, Democrats will indeed suffer from buyers remorse. Unfortunately for her, she is not the anecdote that first crosses the mind of the electorate and the patient (her party) has already been compromised.
Prediction: The most lopsided election since McGovern.
By the way, the WSJ opinion piece is excellent.
moxie_neanderthal on April 15, 2008 at 3:45 PM
Would it satisfy those who insist on prosecuting the Bushleone Crime Sydicate if they had play hearings in the basement? There’s already precedent and the media can treat it as bonfide like the Conyers Commission.
Beto Ochoa on April 15, 2008 at 3:50 PM
Well, I wish that Bush had investigated and prosecuted the crimes of HIS predecessor instead of giving them a wink and a nod, and pulling the rug over a little farther to keep them out of sight.
So, if Obama wants to do it, I guess I can’t complain (I don’t think he will find much)…. As long as whoever follows Obama investigates and prosecutes him for HIS crimes, which will no doubt be myriad.
LegendHasIt on April 15, 2008 at 3:57 PM

lodestonejames on April 15, 2008 at 4:00 PM
Bush was a successful, popular governor in part because there were Democrats who were willing to work with him for the good of the state. He thought he could bring that same bipartisanship to DC. He tried to win over Ted Kennedy by letting him have a hand in No Child Left Behind, by inviting him over to watch a documentary about JFK, & by naming a building after him. Bush also stopped all investigations of the Clintons. Did Teddy or any Dem fall in love with Bush?
jgapinoy on April 15, 2008 at 4:11 PM
When did Democrats start worrying about setting legal and/or political precedents?
Cylor on April 15, 2008 at 4:14 PM
I hope you’re right. My opinion is very different.
If Obama is the nominee, I think he might very well win. Without my vote, of course, but I still think he could (and probably will) defeat our RINO candidate. He’ll have a big money and enthusiasm edge. And, of course, by electing a minority, we’ll be making history! (That’s how it’ll be sold, subtly, anyway).
cs89 on April 15, 2008 at 4:19 PM
Leadership by investigation…Why not? It has worked so well for the current democratic Congress.
Nozzle on April 15, 2008 at 4:49 PM
Aren’t we all glad now that George W. Bush extended that extra measure of bipartisan bonhomie to Democrats by refusing to pursue prosecution of Clinton administration members after he took office?
Offering bipartisan cooperation to Democrats consistently yields such positive results…
philwynk on April 15, 2008 at 5:01 PM
I agree but I don’t think it will be sold subtly at all. I’ve already encountered people that say that the only reason anyone would not vote for Obama is because they were bigots. My only worry is that he will make two terms and then his wife will be trying for the next two.

Although “investigating” will be a feel-good idea for the far left (or dhimocrapt center), it is possibly the most dangerous thing that can be done. The United States has been blessed with 43 Presidents that, regardless of their passions, generally left the outs and alumni alone. If a President with the current far-left tendencies wants to punish a predecessor for good faith political acts that post facto are declared actionable, particularly if they control the legislature and the judiciary, the stage is set for a truely bad president, with the support of other organizations to decide to not give the successors a chance. Why would a truly powerful and evil President step down if he thought he was going to be punished. This has happened in several countries recently and through history. In addition, historically, the prosecution of Roman consuls for in-office percieved offenses, after leaving, is one of the political stupidities that brought about the fall of the Roman Republic. A note to the nuts on the left, we haven’t yet had a President that injured (his own) the American People in the manner of Stalin, Hitler, Caligula, Mao, King John, Shaka Kahn, Herod, Arafat, or any other left pop culture icon.

DavePa on April 15, 2008 at 7:06 PM
This is another self-inflicted wound. What will play is Obama will prosecute Bush and others for “war crimes.” This will include of course members of the military. Probably the lot of them.
Obama would rather indict Bush for someone pouring water up KSM’s nose, than protect the country from AQ and nuclear attack. Great work Kos!

DavePa “Would that include, oh, for example, a former President’s National Security Advisor stealing and destroying top secret documents from the National Archives?”
1. That happened after that Presidential Patron left office.
2. Even so that doesn’t rise to the level of “High Crimes and Misdemeanors”. And by the way, the only “crimes” the Constitution recognizes are “American crimes”, not international and not political. – Only if the Senate approves a treaty, and only then if Constitutional.
