I don’t know if it is more shocking that he was fired, or that he’s been a pizza delivery man – FOR 10 YEARS!!!

thedecider on April 1, 2008 at 10:43 PM

Since when does Pizza Hut company policy trump Constitutional Law?

THE CHOSEN ONE on April 1, 2008 at 10:43 PM

A situation I’d hate to ever find myself in; that’s for sure.

lorien1973 on April 1, 2008 at 10:43 PM

He could go to England and be a General within a week.

Another story says he was a single father raising a daughter on his own. I’d try not to figure “why” he had the job and be glad he’s doing what he needs to do to raise his child as best he can.

lorien1973 on April 1, 2008 at 10:47 PM

He should have been a just victum (democrat) and willingly gave his life to further the cause of economic equality!

dmann on April 1, 2008 at 10:48 PM

Well, that Pizza Hut is officially out of business.

Kudos to the delivery driver. Smart guy.

MadisonConservative on April 1, 2008 at 10:49 PM

dmann on April 1, 2008 at 10:50 PM

Good for him. Nothing new, chain stores or resturaunts fire those who fight back. If he has the nad’s for that, he can find a better job than he one he was fired from. A security guard would be a step up from being a pizza delivery driver.

Hopefully he’s tipped very well, otherwise I can’t imagine not finding another “second job”. Pizza delivery guys around here don’t make squat.

thedecider on April 1, 2008 at 10:52 PM

I say, Good on him! What the perp was doing was wrong! If he wants “Economic Equality” get a job and (I’m gonna use a four letter word here, watch out!) WORK for a living like the pizza guy!

thedecider on April 1, 2008 at 10:52 PM

Depends on the neighborhood. I delivered food (not pizza) in college and I’d clear $200 in some nights. Not bad for a college kid. He has a job, taking care of his business, that’s all that matters.

PS – HEY AP – posting comments in the headlines is all messed up. It doesn’t go back to the headline page like it does here. It just sits there and i have to hit the back button to see the page again.

Vonnie Walbert, vice president of human resources at Pizza Hut’s corporate offices in Dallas, said last week that employees are not allowed to carry guns “because we believe that that is the safest for everybody.”

Maybe Pizza Hut could make their drivers safer still by pasting a sign on the car that says “DRIVER IS UNARMED AND CARRYING CASH.”

Cicero43 on April 1, 2008 at 11:07 PM

I worked at Dillard’s and we were told never to try and stop shoplifters. I did try, of course, but nothing ever happened to them so they came back for more freebies! It was actually part of the profit plan to allow for “shrinkage” of inventory. I’m sure Dillard’s isn’t the only company that does this.

SouthernGent on April 1, 2008 at 11:08 PM

THE CHOSEN ONE on April 1, 2008 at 10:43 PM

Say what? Tell me what other businesses besides law-enforcement and armed security let their employees carry guns while on the clock. Just because you have a CCW doesn’t mean you automatically get to carry at work. I’ve got a CCW but I’ve never been able to carry at any job I’ve had.

Good thing I don’t order anything from Pizza Hut anymore–because I’m trying to dump some pounds.

How do you boycott something that is already being ignored?

TwinkietheKid on April 1, 2008 at 11:25 PM

Spiers, who has a valid handgun permit, said he’s been “pretty much in the dark” about his job since the incident. Vonnie Walbert, vice president of human resources at Pizza Hut’s corporate offices in Dallas, said last week that employees are not allowed to carry guns “because we believe that that is the safest for everybody.”

I can tell. It would’ve been really “safe” if the driver ended up being shot in the head by the robber. The only person not carrying a gun is “safer” for, is the criminal holding you up.

Sadly, this is true in a lot of places. However, the key is to talk to the person who would have final say in that sort of decision, or anyone over their head. HR jockeys are more likely to bristle at asking if CC while working is okay.

Hey Genius, if the driver lives has a permit to carry, no company can demand that you not carry while on the job. If he were at a jobsite i.e. office, restaurant, hotel etc. your pathetic argument would be of note. However, when out on a delivery or on a service call, as long as he doesn’t ENTER a private residence or other business which prohibits concealed/carry permits he’s golden.

Hey genuius, you couldn’t be more wrong if you tried! Talk about talking out of your ass, that’s what you’re doing. I drive trucks doing deliveries and I rarely set foot in any area where I can’t cary but I’m still not allowed because of company policy. Got that? Just because I can carry on any public school campus, any state park and damn near anywhere else inside the state of Oregon doesn’t mean that I’m given the right to carry while on the clock. Nearly ALL businesses are the same. Try pulling your head out and doing a little background checking before doing any more talking out of your ass.

Boycott Pizza Hutt. Obviously, they think a few dead delivery men is better than any negative publicity they might get from people hearing their delivery men may be armed. A company with a policy like that should be shamed out of business.

Seven Percent Solution on April 1, 2008 at 11:49 PM

Also for The Clueless One: In most states it’s perfectly legal for your employer to fire you for simply having a gun locked up in your vehicle. It doesn’t matter if it’s locked up in your trunk or glovebox, you can still be fired. Some states are passing laws to change that but in most states you can be fired.

Hey Genius, obviously you never have known a pizza delivery driver. They don’t drive a company car, they drive their own automobile. Your weapon can remain in your own private automobile in most states with a conceal/carry license. Now, where he went wrong was taking it with him out of the car while going into the complex, but if it remained in his car in most states he would be legal.

THE CHOSEN ONE on April 1, 2008 at 11:51 PM

Where I live they can fire you for any reason at any time. They can just make something up if they want to, gun or no gun.

arteest on April 1, 2008 at 11:59 PM

THE CHOSEN ONE on April 1, 2008 at 11:51 PM

Hey Idiot, it doesn’t matter! The company policy says no guns, that means they can fire him. Get it through your thick head. Just because he was legal doesn’t mean he didn’t break workplace rules. I could go to work tomorrow and call my boss every name in the book. I’d be perfectly legal but he could still fire me. The same logic applies here. Legal or not, his terms of employment say no guns while on the clock. He had a gun while on the clock. He can be fired and the company is perfectly within it’s rights to do so.

They’re private contractors, dude. They pay their own insurance on the vehicle and such. It’s almost like your a carpenter who sub contracts for a builder. On your way to work, some scumbag tries to rob you, bang his dead. Even though it’s company policy, your not part of their company. These drivers don’t sign any written agreements. Maybe we’re on the verge of a Supreme Court Showdown. Wouldn’t that be tasty!!!

not fired. I would like to just point this out because some people here have said he was fired. That being said, if they did anything besides congratulate him for protecting himself, its an outrage. I will never eat at Pizza Hut again. I encourage everyone to call and write them and tell them you feel the same.

The driver was acting within the scope of his employment and on the clock (unlike your example about driving on your way to work, which is your own time, not company time) – but, I’m not familiar with state law there. Also, I don’t think pizza delivery workers are generally private contractors (didn’t see anything about that in the article) – that, however, doesn’t mean he wasn’t or that they can’t be. But, every pizza, or other food delivery person I’ve known was an at-will employee for the restaurant/company.

I thought the story said he took the gun from the perp. Am I wrong? You all remember the shooting at Trolley Square in Salt Lake City – by a muslim – well the mall had signs saying no guns allowed. Boy is that an advertisement – the only one who obeys the rule are the law abiding. Thank heavens for an off duty policeman who was eating in the mall and helped take the shooter out.

Most of this varies from State to State and City to City. I think that was what was so important about the D.C. Supreme Court Case here recently. We are embarking on new soil. Don’t tell me that all the folks that make Bank Drops after closing shop aren’t on company time, and many of them have carry/conceal licenses. My point about the carpenter could have applied during any part of the day. I don’t believe company policies apply to people who use their own vehicles and who subcontract. Again it’s a locality issue and not across the board, but there is no way that IF I HAVE A LICENSE TO CARRY, that because my employer has a rule that I LEAVE MY PIECE ALL THE WAY BACK AT MY HOUSE AND DISREGARD MY DRIVE IN OR OUT OF WORK. NOT TO MENTION MY ERRANDS!!!!!!

Rick on April 2, 2008 at 12:27 AM

I am, I lived in Cedar Rapids, Iowa for a little over 31 years before I moved to Oregon in 2002. Like I tried to tell The Chosen One, it doesn’t matter if he had a concealed carry license or not, he was on the clock so he can be fired. I worked for Amana Refrigeration (the appliance company) for almost 10 years. I could have been fired just for having a gun in my car even though it was locked up. I used to go to the gun range quite frequently after work so I’d throw my AR and a bunch of of ammo in the trunk, I just didn’t tell anybody. If they had asked to search my car while it was on company property I could have been fired right then and there and there’s nothing I could have done to fight it, even through the union.

This is almost a standing headline with Pizzahut and I think Dominos as well. (Not sure about the latter) Every couple of years one of their deliery drivers shoots a robber and then gets fired by the company.

Perhaps AP might want to look into how many of these employees end up in the hospital or dead each year after “Not resisting” the criminals.

You do anything for a living and you do anything to keep you alive.

You do what you have to do and there is so much you can do.

This is America.

Guns are everywhere. Crazy people are everywhere.

How do you protect yourself from crazy people with guns?

Get yourself a gun.

This is America.

It is supposedly a self-controlled, governed by a Constitution, Jungle.

A controlled Jungle is still a Jungle. Anything can happen.

The evil-doer armed and strong devour the innocent defenseless and weak.

You either deal with it and have your own gun to protect yourself or die.

This is America.

Oh it’s worse than that. We had a rash of pizza guy robberies in my response area so I went to the managers of all the pizza places in my area (Papa John’s, Domino’s, Pizza Hut and some of the independent stores) and gave them the list of apartment complexes where the robberies were taking place and advised them not to deliver to those complexes. Every store took my advice (driver’s safety being paramount to them) except Pizza Hut. Their drivers kept getting robbed and one was even shot.

In my opinion Pizza Hut doesn’t care about their employees, so I haven’t patronized them for years. As a matter of fact, when my brother was thinking about taking a job with them to earn some extra cash and I talked him into going to Domino’s instead — they actually have a list of neighborhoods they won’t deliever to because it isn’t safe.

srhoades on April 2, 2008 at 9:09 AM

By the way, I did catch the guy. He was getting into vacant apartments by lifting sliding glass doors and sneaking in. A resident called in when she saw him breaking into the apartment below her. I got there and sneaked round back, he was leaning against the wall like he was waiting to jump someone. About five minutes later, the Pizza Hut guy pulls up and goes to the door. Got him on B&E, felon with a gun and attempted robbery (robbery was added later when previous victims I.D.ed him).

srhoades on April 2, 2008 at 9:22 AM

I am a delivery driver, and have worked for all the Big 3. ALL have the same company policy, which basically is to cooperate with the robber. Even carrying a tazer or mace is a firing offense. Of course, there’s nothing in the rules that explains what to do if you get the psycho who thinks he has to kill you to keep you quiet over the $30 he’s stealing. Bottom line – it’s the company protecting itself from lawsuits, not protecting their drivers or workers. They’d rather have injured or dead employees than some lowlife threatening to take his business elsewhere.
