Cleared: Charges dropped against Haditha Marine Stephen Tatum

Unless I’m mistaken, this leaves Frank Wuterich the only non-officer still facing charges, and even in his case they’ve abandoned any hope of getting a murder conviction. Question for the lawyers: Is there any significance to the Marines saying the case was dismissed “in order to continue to pursue the truth seeking process into the Haditha incident”? That sounds vaguely like an immunity deal, possibly to secure his testimony against Wuterich, but that makes no sense in the context of the charges being dropped since it leaves the prosecution with no leverage.
Here’s the key passage from the inspecting officer’s recommendation of dismissal. In a nutshell: If a Marine hears a machine gun being racked behind a door, he’s not obliged to stand in front of it before deciding if it’s a threat or not. Which is to say, it all comes back to the rules of engagement. Exit question: If the charges against Wuterich end up being dismissed too, is it time to revisit a House censure for Murtha?

Nothing will happen to Murtha, but it should. He is a disgrace to both the Marines and to the Congress. But when you have so many Dems who are a disgrace to the Congress, why single him out?

You’re exactly right SouthernGent… For those of you who don’t know, Michael Savage organized a fund raiser for the defense of these soldiers, and lead the charge to have the truth be told, and to allow these soldiers their opportunity to a fair trial.

I believe Savage has focused on the case involving LtCol Chessani, who remains in legal jeopardy – though not much, one might surmise, given how the Haditha “case” has imploded, and then some. Recall that other charges against other defendants were not just dropped entirely, but that the reviewing officer wrote scathing criticisms of the prosecution and the whole process.
The Chessani case involves Murtha as well – one of his counsel said somewhere that they have new deposition info from former USMC commandant Hagee about how Murtha was briefed on the case. Among the astonishing and infuriating and appalling things – now beyond number since 9/11 – we can add that Murtha wasn’t immediately censured, for two reasons. One, the obvious one, has been “discussed” above. The other reason is one the Chessani defense wants to use in his case: improper command influence. I’m no lawyer or JAG officer, but I recall literally not believing what I heard Murtha saying, on national TV and in print, because of the possible implications for undue command influence, a unique and critical element in military justice.
So far the Marines involved seem to be receiving exoneration on the merits (with perhaps Wuterich the only exception?). But Murtha’s behavior was even more outrageous and irresponsible than most people thought, and might in the end actually affect the courts martial.

I hope the Marines who were slandered move forward with their suit against Murtha and have it brought before the court. Surely no one in the most ethical Congress would desire anything different? Murtha should have his chance to defend himself should he not?

That old fart won’t be taken to task for his slanderous statements about those Marines. The court will never allow it, the Congress doesn’t give a damn. Even in the off chance that the court let’s it roll right up to trial date, there will be a settlement. The whole truth will never be aired. That old geezer gas bag will never sit on the hot seat.

Wuterich is a SSgt, which is a staff non-commissioned officer (E6).
We’ve really got to do something about the rules of engagement over there. Most of this case wouldn’t even exist if it weren’t for the peculiar situation over there. On that note, there was information that the incident in Haditha was pre-planned by AQI to cause a PR problem. At the end of the day the media did exactly what the enemy anticipated.

I listen to Savage once a week on average. The man speaks his mind very honestly. I have a hard time with his negative attitude, therefore I can only hang in there with Michael on occasion. Michael is a strong supporter of the American soldier; Michael has their backs covered, and for this I admire Michael greatly. Michael has more human integrity in his pinky than Murtha has in his 350 pound soulless body.
