Planned Parenthood of Kansas Must Turn Over Records

A Planned Parenthood clinic in Overland Park, Kansas, is under suspicion of violating several Kansas laws. 107 charges were filed by a Kansas DA (formerly Kansas’ Attorney General) Phill Kline, who sounds like a really cool guy. The Overland Park clinic and Phill Kline go way back–they’ve been tangling since at least 2005, when Kline was Attorney General of Kansas.
Today it looks Kline is about to get another bite at them:
A grand jury issued a subpoena to the Comprehensive Health in Overland Park clinic last month demanding the records of 16 patients. The clinic has been battling Johnson County District Attorney Phill Kline, an anti-abortion crusader, over whether the subpoena should be enforced.
After a hearing over the dispute Friday in Johnson County District Court, an attorney for the clinic, Pedro Irigonegaray, said it would turn over records for 16 patients that pertain to two restrictions on abortions under Kansas law. He said it would resolve the dispute.
One restriction mandates that the clinic notify a parent or guardian when a minor seeks an abortion. Another imposes a 24-hour waiting period before an abortion and requires the clinic to provide information to a patient about the procedure and other medical issues.
I’m glad someone is looking into Kansas’ abortion industry. It seems especially slipshod. On the other hand, maybe it’s quite typical–and we just know more about the situation in Kansas because of the efforts of people like Phill Kline.

Pretty busy; that and HotAir has become light on the philosophy and religion topics.
That’s not even an answer to my question. That’s an answer to the question “For whom is this justice?” Which would be followed by my question of “How is this justice?” How is releasing these records “justice delayed”? It seems the only violations in question involve notification of a parent and a waiting period with notification of other options.

Back to the question of justice, nf, I’m thinking that the courts examining the records of a regulated medical business to determine compliance under the law set by elected officials in that jurisdiction might be appropriate in most minds. Hmm?

Because if both parties are underage it is human nature. For the government to broadly exercise subpoena power just because underage sex has occured seems like more government involvement in our lives than is beneficial. If one of the parties reports the matter or if one of the parties is an adult, that would be different.

I guess that’s the thing. I don’t consider a court order “justice delayed,” especially when the court order was incurred because someone thinks a minor who didn’t notify a parent had an abortion.
By the sound of this post it would seem as though “justice” means “resolving a dispute.” And seeing as how this court order really has nothing to do with the moral discussion on abortion it seems as though it was posted simply to have people chant in unison about how abortion is murder. A post like this doesn’t even seem fit for the headlines.

What so if two underage parties engage in sex it’s OK but if one party later regrets it and , perhaps out of spite, reports it then that’s different? How does that make sense? And why is a 14 year old girl having sex with a 15 year old OK but with a 17 year old that’s different?

Sure, not all human nature is good but consensual underage sex is something that millions of Americans have engaged as part of growing up. The problem is when a prosecutor can use any evidence of underage sex (e.g., pregnancy, peeping tom, doctor being told) as a reason to broadly issue subpeonas and collect private information on citizens. A more serious crime should be required to unleash prosecutorial powers.

I would think even the “safe, legal, and rare” crowd would want to see abortion mills run in accordance with the law.

To be honest, I didn’t read the story too closely, other than to note that the State’s Attorney had reason to believe that the clinic had been operating in violation of the regulations, and pursued two specific files for compliance review.
Seemed fair enough. “Delayed” seems to refer to the refusal of the clinic to comply by turning over the files in a timely manner, but that’s why we have judges.
I’m sure it will all work out.

You’ll note I said some (ie.not all) adult (ie. over 16) males want sex with teenage girls (it’s scarcely credible to deny it). Anyway, the point was supposed to be that human nature is not exactly relevant to law-making otherwise vigilantism (for example) would be legal. And I was starting from the premise that underage sex is (correctly) a crime. Why am I wasting my time arguing the point? I am on the right website aren’t I?

I’m kind of in the middle on this whole argument, but hear me out. I’m down with abortion being totally illegal as long as we give kids more sex education than they can handle, early and often. If we don’t give them the tools to protect themselves, I’m all for choice IN THE FIRST TRIMESTER. I absolutely under no circumstances am down with later term abortions. Does RAPE mean anything? I don’t care if it is consensual between two underage. But, consider this, and I think this is where Phil Kline is coming from, what if the abortion performed on an underage woman is to cover up the Rape of the child? Is that not worth pursuing?

Generally I am not in favor abortion as retroactive contraception BUT I have a daughter and if given the choice between abortion and screwing up the rest of her life, I would support her no matter which choice she made. I would want her to have the option.

I don’t think this story is a pro-choice or pro-life issue, it’s a pro-law issue. If the law wasn’t followed, PP or whoever the guilty party turns out to be should face the penalty.

Yeah…I agree he seems that way from that article. My problem with the entire issue is that we as a people refuse to force the lawmakers to makeup their minds. This is either a States Rights issue or it is a Federal Issue. You have 50 different state laws, and one SCOTUS ruling.
Constitutional issue? or States issue? For or against, right or wrong, pro or con, Choice or Life, it would seem until we decide who the hell has jurisdiction over this issue it will never be solved.

That’s the rub isn’t it. Me, I believe that the nano-second that the little fella completes his mission, the deal is sealed. I’ve yet to find anyone who can tell me that the product of that completed mission will be a giraffe, elephant, leopard, or snapping turtle. I think the end product only comes out one way.
Then my ‘keep the Fed’s outta my face’ self kicks in. I lean toward it being a States issue the same way I believe that the death penalty should be a states issue. There are plenty of people who don’t think that way. This issue isn’t going to have a beginning-of-the-end until someone figures out where that beginning is.
