McCain hoisted by his own campaign finance petard

The nation’s top federal election official told Sen. John McCain yesterday that he cannot immediately withdraw from the presidential public financing system as he had requested, a decision that threatens to dramatically restrict his spending until the general election campaign begins in the fall.
The prospect of being financially hamstrung by the very fundraising system he helped create is the latest in a series of bitter challenges for the presumed GOP nominee, who still faces a fractured conservative coalition as he assumes the mantle of party leadership.
The warning from the FEC campaign after McCain launched his Silky-like fund-raising appeal in the wake of the NYT attack:
Within hours of the article’s publication, McCain sought to turn it to his advantage, sending out a fundraising appeal decrying the “baseless attacks” and urging contributions. “With your immediate help today, we’ll be able to respond and defend our nominee from the liberal attack machine,” McCain’s campaign manager, Rick Davis, said in an e-mail.
But McCain’s attempts to build up his campaign coffers before a general election contest appeared to be threatened by the stern warning yesterday from Federal Election Commission Chairman David M. Mason, a Republican. Mason notified McCain that the commission had not granted his Feb. 6 request to withdraw from the presidential public financing system.
The implications of that could be dramatic. Last year, when McCain’s campaign was starved for cash, he applied to join the financing system to gain access to millions of dollars in federal matching money. He was also permitted to use his FEC certification to bypass the time-consuming process of gathering signatures to get his name on the ballot in several states, including Ohio.
By signing up for matching money, McCain agreed to adhere to strict state-by-state spending limits and an overall limit on spending of $54 million for the primary season, which lasts until the party’s nominating convention in September. The general election has a separate public financing arrangement.
But after McCain won a series of early contests and the campaign found its financial footing, his lawyer wrote to the FEC requesting to back out of the program — which is permitted for candidates who have not yet received any federal money and who have not used the promise of federal funding as collateral for borrowing money.
The consequences:
If the FEC refuses McCain’s request to leave the system, his campaign could be bound by a potentially debilitating spending limit until he formally accepts his party’s nomination. His campaign has already spent $49 million, federal reports show. Knowingly violating the spending limit is a criminal offense that could put McCain at risk of stiff fines and up to five years in prison.

I don’t like McCain, and haven’t decided what to do in Nov. yet (I like Obama & Clinton much less). I do have to laugh at this predicament. Yes, I understand the quorum issue, but you campaign with the FEC you have. In this case, McCain is campaigning witht he campaign law he cosponsored. And his staff is complaining at the way the law is being interpreted?

For those critical of the fence idea….
Have you ever driven past a business, school or agency with a fence outside? It undoubtedly costs more than a ladder or shovel, yet people keep putting them up. Why?
They work. Not perfectly, and not all the time, but enough to be profitable for the tenant to invest in the fence to protect whatever’s inside. In the case of the U.S., it’s our national sovereignty. There will be illegals crossing the fence if we build it. Just a lot fewer, and easier to catch or stop if our officers see them than if they are on open ground.
Final thought- If fences don’t work on the northern border of Mexico, why does Calderon & Bush want to build one on the southern border of Mexico? Think about it.

Racist? uhh. Nice try. I’m not the one who want a Berlin like wall on the border with attack dogs, spotlights, barbed wire, and watchtowers. Hell, why not bury some land mines? The way to secure the border is legit fraud proof documentation and rounding up employers who break the law. That’s how you do it. Stop using fourteenth century tactics to stop a modern day problem. Most of you I assume are somewhat educated, right? By the way a fence that covers the entire southwestern border that works would cost more than Iraq. Work smarter, not harder people.

To the “build the fence” coalition on this board today: Have any of you ever SEEN the border between Texas and Mexico? There are places where it’s virtually impossible to build a fence. And, the land is owned by Texas landowners, not the state or the federal government.
Getting South Texans to give up their rights as landowners and the rights to the WATER in the Rio Grande for ranching is going to be a VERY hard sell, indeed.

Think of a fence as being like a chastity belt. Foolish, idealistic do gooders couldn’t free criminal aliens to have their way with our vulnerable Southern boarder (if we made up our minds to keep them out). A fence will not keep illegals from crossing the border. However, a fence backed up by enough enforcement officers will secure the phisical border. That is where the Great Wall came up short, and the Berlin Wall did not.
Overstaying visas is the stinker. We need to kick people out of the US for good if they are cought abusing their visa priveleges.
Also, I feel bad for the people of Darfour, but I don’t want all of them over here. We have a wonderful thing here in the USA, and we can sure pi$$ it away if we don’t protect what we have. It takes money and effort to get foreigners up to US speed, and we just can’t empty every slum or every peasant country and bring them here. It would bring the US to her knees very quickly.

15,000 soldiers on the border doesn’t bother me, but it wouldn’t take that many. If we employed a diverse number of deterants on the border with the latest access control technology, we could damn sure do better than we are doing. We need to do what it takes, and I want results. If we waste a little money in the process, what the hell. We waste millons every hour on far less important issues than the border invasion.

The Americans maintain that Senator John McCain is their equal in natural rights of life, liberty, and estate. His natural liberty is protected by the American Constitutional rights of freedom of speech, press, and peaceful assembly, among others. One justly hates John McCain for his false “reform” laws, because those restrictions of Americans’ liberties undermine his and other Americans’ public discussion of good politics. For the same reason, it seems good for the Americans to support McCain’s and others’ violation of those laws for the sake of their Constitutional rights and natural liberty. According to their own higher principles, in such a vital matter, it seems good for the Americans to flout the laws against their freely financing political speech, publishing, and assembly; they should use every prudent means to protect McCain and everyone else from the enforcement of these unjust laws, and to correct or ruin those who try to maintain them on the books or in force.

Mr. McCain wasn’t my first choice, but the ultra conservatives will deserve to be “hoisted with their own petard”. They, with their abstract dogmas, as much as the far lefties, will have contributed to the destruction of this great land, as we now know it.

I want tough employer sanctions that have real mean teeth. I want tamper proof cards like the new “TWIC” cards.(Transportation Worker Identification Cards). I spoke with my congressman just the other day about this (Nick Lampson), and he said it looks like this technology will ultimately become a national ID card needed for domestic air travel and other things. I want to end Anchor babies. I want to end free education for illegals , free hospital care for illegals, and welfare benifits for illegals. I want people that demonstrate a respect for our laws, and want people that demonstrate contempt for our laws to go back to where they came from.
Sometimes tough love can appear mean spirited, but oh well.
We have plenty of American Citizens that need these resources, and wasting them of foreign nationals is a disgrace.
I believe this problem requires “tough love”, and I am a tough guy that understand solving serious problems requires serious effort and committment..

Totally agree, but let’s not compound the strain on OUR resources by building a fence that is too expensive, has no guarantees, and makes our country look like a fortress. There is a smarter way to do things. Come on America, we are the country of invention and innovation, is a fifth century fence the best we got?

I have spent a lot of time on the Texas border betweem Brownsville and El Paso. Mainly because of Deer hunting (Mule and Whitail)and quail hunting (Blues and Bobwhites), and dove hunting (whitwings and mourning doves).
Near the border you can see on some remote north / south pipeline rightaways the refuse of a bunch of people moving north. Trash everywhere.
I’m not ready to strike any option off the table yet. If a plan in any way represents moving forward to deal with this problem, I am listening. I agree a fence would be ugly and less than 100% effective, not to mention the construction of not only a fence, but the roads in very remote places needed to get materials to where they would need to be.
I JUST DON”T WANT PERALISYS BY ANALYSIS ON THIS ISSUE.

I have watched people attempt to jump the fence around the White House and the spiky thingies slowed them down
I am waiting for a guard to plug one of the huge crowd of demented homeless lunatics who live around the White House receiving instructions from the Mother Ship. They obviously do not dread the ammo because the bolts for the spiky thingies happen every day
Mexicans do not fear the fence at all because they know that spikey thingies are useless. Despite the total lack of fear they do not want a fence.
Could it be an insult to machismo, the idea that a mere fence could stop a guy running to work as a chicken plucker at Tyson’s

In many countries in our hemisphere, squatters can wipe you out. They can claim your land, house, etc. In some Latin American countries, 90 days occupancy is all thats needed for squatters to claim your property.
Another example is Kosovo, where Albanian squatters overran the Serb population.
I am watching, right before my very eyes, the same exact thing happening here. It feels very very wrong to me, and I feel obligated as an American citizen to try and bring attention to this problem.

We need a comprehensive reform bill that alocates guest worker identification and enforcement of illegal hires. We had a chance to do it ten months ago, but the right wing of the party got all pissy, because we didn’t respond to the border with a Normandy type military response. Now we get nothing until perhaps after the election. Even then it won’t be as good as we had it, because dems will pickup more congressional seats and perhaps the white house. I doubt the latter.
Also, we need to declare war on Mexico. They are loaded with wealth, but ten to twelve guys hold the key to that. My father is in furniture and says down there one dude controls the iron, another controls timber, etc… The real enemy here is not the people trying to feed there famalies, it’s the officials and the aristocracy of Mexico. So instead of sending troops to the border, lets SEND TROOPS ACROSS THE BORDER ALL THE WAY TO THE CAPITOL AND KICK SOME ASS ON THESE PUNKS!!!!
