Democrats place anonymous hold on Semper Fi Act; Audio: Marines welcome anywhere in the U.S., says Reid

What a disgrace. Some Democrat has placed a sneaky hold on the Semper Fi Act, giving Code Pink at least a temporary victory and giving Berkeley at least a temporary reprieve from the consequences of blocking the Marines from recruiting in Berkeley. According to a statement from Sen. DeMint’s office:

Washington, D.C. – U.S. Senator Jim DeMint (R-South Carolina) made the following statement in response to the decision by the City Council of Berkeley, California not to apologize to the Marine Corps and their families and reaffirming their support for radical anti-war protestors to “impede” military recruiters from conducting their work.

Senator DeMint introduced the Semper Fi Act to rescind over $2 million in hidden earmarks for Berkeley, California in the Fiscal Year 2008 Omnibus Appropriations bill, and transfer the funds to the Marine Corps. Until yesterday, Senate Democrat leaders used parliamentary maneuvers to block consideration of the bill. Last night, Republicans asked to pass the Semper Fi Act by unanimous consent after no Republican member opposed its passage, but Democrats have placed an anonymous hold on the bill.

“It’s a national embarrassment that these officials refuse to apologize to our troops and their families and continue to support actions against military recruitment. It’s time for Berkeley to realize that actions have consequences,” said Senator DeMint. “Americans across the nation are outraged at Berkeley’s insult to our troops who have fought and died for their ability to live in freedom. It’s truly heartening to hear the outpouring of support for the Marine Corps in South Carolina and throughout the nation.”

Berkeley City Council members voted to rescind a letter to the Marine Corps recruitment office asking them to leave town, but left in place a provision that encourages “all people to avoid cooperation with the Marine Corps recruiting station, and applaud residents and organizations such as Code Pink” that “impede, passively or actively” the work of military recruiters. Berkeley also voted against a formal apology to the Marine Corps and will still allow Code Pink a special parking space in front of the recruitment office to conduct weekly protests.

“Let’s be clear, it’s not a question of the sincerity of anyone on either side of this issue. However, some of the hateful rhetoric and official actions against the Marine Corps that have come out of Berkeley has had real consequences on our troops, their families, and our recruiting,” said Senator DeMint.

The bill is cosponsored by 10 senators including Republican leaders Mitch McConnell (R-Kentucky) and John Cornyn (R-Texas). U.S. Congressman John Campbell (R-California) introduced a companion bill in the House of Representatives and now has 71 cosponsors, including Republican leaders John Boehner (R-Ohio), Roy Blunt (R-Missouri), and nine other members of the California delegation.

“In Saddam Hussein’s Iraq or the Taliban’s Afghanistan, such opposition would not be allowed a voice at all. But thankfully we live in a free democracy under the protection of our brave Marines. Protestors have the right to vocally insult our troops but patriotic Americans also have the right to seek a democratic response to discourage activities that actively impede the legitimate functions of our military.”

“I will continue to work with my Senate colleagues to stop the special taxpayer favors Berkeley has received through unnecessary earmarks,” said Senator DeMint.

One Berkeley earmark provides $243,000 in taxpayer dollars for the organization Chez Panisse to create gourmet organic school lunches in the Berkeley School District. Another earmark would spend $975,000 in taxpayer dollars for the University of California, to create a new endowment and cataloging the papers of Congressman Robert Matsui. U.C. Berkeley already has a $3.5 billion endowment.

Will any reporter assigned to either the Clinton or Obama campaign ask what either of those candidates for Commander in Chief think about Berkeley’s shameful actions or DeMint’s reponse? Of course not. This entire episode is disgraceful on the part of Code Pink, the city of Berkeley and the Democrats in Congress. And the media, for failing to cover it.

Update (AP): Hey, it’s the thought that counts, right?

While initially apparently unaware of the Berkeley City Council’s action, when informed, Reid said: “Well if they said that, I am disappointed. The Marine Corps should be welcome in any place in the United States.”

Update (Bryan): Yeah, Reid said that yesterday, before the anonymous hold was put on the bill and after he had tried the adjournment trick to stall it. It’s not what you say but what you do that defines you, Harry.

ctmom – they tried to do this with the pork database, too, but after a zillion or so phone calls from bloggers the holder was identified and the bill was passed.

We’ve really got to hold their feet to the fire on this kind of sneaky crap.

Laura on February 13, 2008 at 5:14 PM

Frustrating that there is a threat to withold something they should never have had in the first place.

They should at least threaten any and all future “earmarks” as well.

“To infinity and beyond”

We know their scum bags for hating on the Marines ( I take personal offense), but why did they need the 2 million from the fed to begin with?

Page 45 on the 2006 CAFR for Berkeley: total assets 581+ million with 211+ million in liabilities.

m1a1usmc on February 13, 2008 at 5:18 PM

Is there an alternative name for the “pork database”? It offends my inner-muslim.

m0nkeyb0y on February 13, 2008 at 5:19 PM

Earmarks are not about “need.” They’re political paybacks to politicians’ biggest campaign donors. They’re also supposed to be history, because all the “ethical” Dims who were voted into office last election promised us that they were going to clean up this type of corruption in the legislature. Haven’t they done a nice job?

AZCoyote on February 13, 2008 at 5:25 PM

Earmark database works too, m0nkeyb0y. :-) But the idea is that it IS offensive, how much of our money they waste.

Where is the accountability for Dems or Republicans? Its just a shady deal….depressing. Must be nice to make promises with other people’s money.

All I can say is Semper Fi…and what goes around comes around.

The Berkeley and Democrat wheels may have won this round but you know what dogs do to wheels.

Where’s our favorite “Democrat” senator, Lieberman? Considering how gung ho he is on the war, he’d be only too happy to vote with the Republicans on this.

StuLongIsland on February 13, 2008 at 5:48 PM

No telling, Stu. You’d think someone could at least leak it, if they knew. Offices are closed today, but I hope people pick this up again tomorrow – I would hate for us to just let this slip under the radar and let Berkeley keep the federal funds after they way they’re treating the Marines.

Why don’t the marines send some the few and the proud to make sure the door the the place stays clear? Two should be enough, one for make a hole and the other to tag and bag em.

Why don’t the Marines have the owner of the Strip Mall they are at sue the Berkeley City Councel, the Berkely Police and the State Trooper of California and Code pink for defacing private/public property due to protesting?!

The Cops sure as heck didn’t do anything, the City screwed over a business owner(s) place of business and caused a scene where it was unable to operate properly (other businesses) due to the protesting?

Oh I could go on forever on this!

Mary Landrieu’s staffer called back. Couldn’t give me a yes or now. He doesn’t believe she did it, for that matter, I don’t either but I told him we really need a definitive yes or no on this, that all senators are being contacted.

At the beginning of the conversation, he said, semper “fee” act. Good grief…

Laura on February 13, 2008 at 6:17 PM

It is imperative that we flush trash like Reid and Pelozi down the tubes. We need a GOP Congress. This is going to spread if we don’t collar inbred pukes like Code Pink. Put Reid with them and it is impossible to believe human beings have evolved to this.

This summer is going to be so much fun! The Democrats will implode at their convention, I wouldn’t be a bit surprised to see a wholescale riot on the convention floor. I just might pay to get cable again for one month so I can watch that floor show. I got popcorn!

And somewhere in mid to late September we will start seeing nice ad campaigns connecting the Pinko dots between Al Qaida, Code Pink (who has sent money to fund Al Qaida in Iraq among other things) and the Democratic party which some of their VIP’s like Nancy Pelosi, Harry Reid and Murderin’ Murtha just happen to have nice pictures of them posing with their Code Pinko BFF’s.

RushBaby – hopefully there will be more response tomorrow when the offices open back up. When they get a call from a constituent, it’s a good deal harder to blow off, and unless they get enough calls, they’re not going to feel pressured to deny this.

A blog that actually gets read (not my moron-blog) should do this or it’s not going to get anywhere. (Hint, hint, Bryan!)

All of them must be unemployed if they have the time to demonstrate in the middle of the day. I say we should use them to pick lettuce. Give them a job. Stop the illegals. Kill two birds with one stone. Arizona is nice this time of year, isn’t Sheriff Arpaio?

Dr.Cwac.Cwac on February 13, 2008 at 7:47 PM

This is why we MUST vote in our local elections no matter what you think of McCain. We cannot let these traitors get a 60-vote majority in the Senate! Don’t even get me started on the HoR!

SouthernGent on February 13, 2008 at 7:50 PM

I wouldn’t waste my time trying to find if my senators were responsible for the hold. No human ever answers their phones. They say one can leave a recorded message but I have not yet seen any evidence that they either record or listen to the messages. My senators are Boxer and Feinstein who are not famous for being proAmericav much less promilitary. (Though Feinstein is known for throwing her husband a half billion dollar Pentagon contract. Fortunately she was also on the ethics committee at the same time.)

snaggletoothie on February 13, 2008 at 7:56 PM

I wouldn’t waste my time trying to find if my senators were responsible for the hold.

We were able to pin down Stevens on the pork database secret hold. We can do it for this, too. And I got a human being from Boxer’s office on the phone today. Press 3, and wait about 2 minutes and you’ll get through. Granted, she was a young, friendly, clueless girl, who didn’t know the answer, but just having the phone ring with the question is a Good Thing. We need to pressure them into letting this get to a floor vote. The Marines deserve the show of support.

Laura on February 13, 2008 at 8:07 PM

I’m still betting on either Boxer or Feinstein. I’ve never gotten a straight answer out of either of these loathsome biddies, and doubt they’ll ‘fess up now.

Larry Craig is taking his usual “wide stance” on the issue, I presume.

The Dems, the liberal activists, and the radicals are riding the tides of successes they have enjoyed ever since 9/11 and the start of the war in Iraq and the start of the Patriot Act. Since that time, it’s been all down hill from there with the Republican President Jorge’ Boosh and other so-called Republicans pushing for ILLEGAL immigrant amnesty, then the series of Republican gay sex e-mails with interns and public bathroom fiascos, not to mention all the corruption charges resulting in hard prison time for other Republicans, etc ad nauseum. It’s a disgrace the way the RNC has conducted themselves.

In less than 20 years the Republican party has completely destroyed the house that Ronald Reagan built. Now they reap what they sow. The bill wouldn’t have even been necessary and this whole thing would never have happened if the lefty whack jobs hadn’t been empowered and emboldened by the politiocal party the majority of us still cling to by tooth and nail… which may not last much longer on my end unless they can get their shit together real soon.

I wish all the major Right-to-Life organizations would just send a few dozen bus loads of protesters to Berkeley and have them behave exactly the same way as Code Pink is doing.

The hypocrisy would shine as brightly as the sun. And watching them explain the double standard would be rather entertaining.

Remember, people, if we don’t support the GOP nominee, this is what we get. And I don’t think Code Pink wants “strict constructionists” being put on the court.

argos on February 14, 2008 at 8:52 AM

Why should our Representatives be able to place “anonymous holds” on legislation?

If they are unwilling to stand up and defend their actions in public, shouldn’t that automatically disqualify them from continuing to hold the office?

Why not get a National ballot and vote concerning all aspects of government… from the lowely State Legislature, all the way up to Congress and Senate. Anyone who makes Laws!

And say if you can’t be honest, defend the reason why this or that law should or should not be, NOT have closed door sessions and give the people of the Republic (America) an explanation on the goings on..or.. You will lose your Seat and all the Benifits of your perspective position. Make it a Federal Law for those who do not have a State Law for it and make it a State Law for those who want it in their State.

I bet you are going to see a large bunch of individuals leave. And since it would be a Nation wide vote, even if they are Senators or Congressmen, they have to do the bidding of the People. Ironic how some things can actually be done.

But that is my opinion. And we know it will never happen.

upinak on February 14, 2008 at 11:28 AM

Dear Laura I called this morning and talked to a guy at Boxer’s office. He was very firm in telling me that holds are done anonymously. He seemed shocked when I told him that, “it’s an old senate tradition” doesn’t justify a public servant denying information to her constituents. Feinstein’s office doesn’t even answer their phone: it rings for a minute and then turns into a busy signal. Seems dumb to me since there must be some people calling who might even consider voting for her. Maybe she’s not going to run again.

snaggletoothie on February 14, 2008 at 12:16 PM

snaggletoothie, thanks!! I’ve got Boxer down as “Refusing to deny” – and you’re spot-on with your reply to the “tradition” comment. Why would a senator care more about upholding a sneaky and unAmerican Senate tradition than in supporting the troops?

(Well, we know why, but it’s good to call them out on it occasionally.)

Laura on February 14, 2008 at 1:42 PM

snaggletoothie on February 14, 2008 at 12:16 PM

FYI if you get a ring then directly after a busy tone… they HAVE hung up on you. There are phones, that can cut you off without picking it up.

I would bombard with more calls.

upinak on February 14, 2008 at 1:46 PM

Irony. The Marine Corps tends to recruit whoever has the determination to make something of themselves. This usually means that you aren’t going to enlist too many people of privilege – mostly lower or middle class people. Funny that Democrats would claim to be the party that so fervently helps that constituency (though its always through redistribution of wealth) and yet deprive that very same group access to the promising life the military offers. On the surface its obvious why banning those recruiters is wrong, but its the underlying effect that’s disgusting to me.

blankminde on February 14, 2008 at 9:56 PM

Just to recap, the Berkely Council only rescinded the letter they were going to send to the Marines asking them to leave. Everything else is still in place. The special parking place for Code Pink (that is directly in front of the recruiting office so they can park their huge gas-guzzling vehicle there), the edict about encouraging people to impede “actively or passively” the work of the recruiters, etc…
So this is why Sen. DeMint, the co-sponsors, and us..want the bill passed.

I’m also wondering if in our own towns and cities, we can encourage our City Councils to have Code Pink designated as some sort of “unwelcomed invaders” like this? Return the favor?

serpentineshel on February 15, 2008 at 9:57 AM

Laura, I am not sure where the heck Stevens is concerning this. I don’t think he KNOWS what the Semper Fi Act is. At least Young is on it.

Still waiting on Murkowski…. But Stevens lost my vote. I am voting inde it seems for the next run.

Thank you for your email regarding H.R.5222, the Semper Fi Act. This bill would rescind federal funding appropriated for the City of Berkeley, California, including the university, in the Consolidated Appropriations Act enacted this previous December.

Our freedom has been obtained at the highest cost-secured by our fighting men and women who willingly serve, ready to give the ultimate sacrifice for the protection of their country and liberty. One aspect of our freedom is “Freedom of Speech.” While I sympathize with your feelings, the actions of the city were the collective result of the citizens of Berkeley exercising their freedom. As you know, I am an outspoken supporter of our armed services-and I readily criticize actions such as those of Berkeley.

Incidentally, I and others have urged residents of Berkeley to demand this action be reversed.

Recent development in the Senate

Recently, the Senate passed the Recovery Rebates and Economic Stimulus Act, legislation meant to positively affect the economy. The bill, which the President has signed, contains an amendment I joined Senator McConnell and others in offering. It authorizes disabled veterans, and seniors to count their veterans’ disability payment or Social Security payment toward the earned income test. It also prevents illegal aliens from receiving rebate checks. With best wishes,

Cordially,

TED STEVENS
U.S. Senator
