Would-be burglars shot by Houston man were in the US illegally

posted at 5:24 pm on December 6, 2007 by Bryan

I’m sure you’ve heard some of the story, but in case not, last month Pasadena, TX man Joe Horn shot and killed two men who were breaking into his neighbor’s property. The entire incident was recorded, as he was on the phone with 911 when he exited his home to shoot the two men.

It turns out that the would-be burglars were in the US illegally, and both were known criminals.

Miguel Dejesus and Diego Ortiz were both from Colombia. Dejesus spent six years in a Texas prison for drug dealing, then was deported. Obviously, he came back illegally. Ortiz was arrested by Houston police on a drug charge. We don’t know much more about him, because Houston is a “Sanctuary City” and does not cooperate with Homeland Security or with the press in matters involving criminal aliens.

That last sentence probably answers why they weren’t deported again: Houston’s sanctuary policies.

And they were already being watched by the Texas Department of Public Safety during their most recent illegal stay in the US for allegedly using fraudulent documents to obtain valid Texas drivers licenses.

According to a DPS memo obtained by 11 News, the department was investigating the use of Puerto Rican birth certificates by Colombians seeking to obtain Texas driver’s licenses.

Both Ortiz and Dejesus had applied for licenses. Dejesus listed his country of origin as Puerto Rico, but both men were Colombian.

Apparently, the DPS is investigating hundreds of immigrants who may have used illegal papers to get Texas licenses.

But that’s not all.

A much wider probe has been launched into an organized syndicate of Colombians who are engaged in illegal weapons sales and home break-ins – just like the one Ortiz and Dejesus were involved in last month in Pasadena.

How many more of these stories do we have to hear before Washington gets a clue and secures the border? Too many.

Horn’s one mistake? Using language like “I’ll kill ‘em” (or something along those lines). If anything hangs him, it’ll be that. I would argue that it’s just a turn of phrase in common use when people are stressed and frustrated/angry…not a literal premeditation.

Texas law permits deadly force in defense of property.

crr6 on December 6, 2007 at 5:31 PM

The thing that really infuriates me about this is that the race baiting charlatans in Texas made this yet another “white oppresses black” issue.

If the shooter had been black, and the robbers white, you’d have seen no protests on the streets. As it should be. This should not be a racial issue.

The more things change, the more they stay the same.

I spoke with one of John Horns neighbors he said that Horn was the best guy on earth. He has set up a pay pal fund that goes to the : Joe Horn Defense fund at the Chase bank.

I’m sure some of the anointed ones around here will argue in favor of the deceased despite the activities they were engaged in, as well as for the full prosecution of Joe Horn. This way they can distinguish themselves from us benighted, mouth-breathing, knuckle-dragging troglodyte reactionaries that believe in the defense of private property from criminals like this.

It’s old law in the US, and still Texas law to shoot trespassers, and even more justified that they were trespassing while committing a crime. What should he have done? Sit by and wait for them to run away? I’ll make sure and sit by and wait for the cops to show up in 5 minutes or so while your house is being burgled, or you’re being beaten up, or some woman you care about is being raped.

Wouldn’t you call THAT sick?

This country is scary.

The DA may prosecute Joe Horn for killing thieving, drug-dealing illegal aliens.

What chance does he stand against the State???

Well, two Border Patrol agents shot a drug smuggler in the a$$ (and did not kill him) at the Mexican border and got 10 years. Right is wrong. Up is down. Left is right. Joe Horn is doomed unfortunately.

During the holiday season, it’s common for criminals to case out houses. That’s exactly what happened to me last night – the police were called, etc. etc. etc. these guys were looking in my window, obviously up to no good. Now, the over and under is put together, under my bed – just in case. I have small kids to defend and if someone is in my house who shouldn’t be, I’ll shoot – and Texas law will be on my side.

Just a few more details about this criminal alien ring in Pasadena…

They are well-armed and very violent. They have asaulted and killed others. Mr. Horn had every reason to believe that his life was in danger when he tried to stop the burglary and they both came after him. Now other criminal aliens in the gang will have to think twice before invading more homes. That makes Pasadena a little safer today, thanks to Mr. Horn and no thanks to sanctuary policies.

Redhead Infidel on December 6, 2007 at 6:04 PM

Joe: good start!!

Houston: People who believe in “sanctuary cities” should not be allowed to lock their cars or homes, and should be required to share their SSN and bank account numbers with everyone who asks until they get their heads right.

Here in Texas many of us own and know how to use our guns.
More responsible homeowners with guns = Less criminals.

On Sept. 1 or Oct. 1 Texas passed our Castle Doctrine law which, in addition to saying a person does not have to retreat when faced with a threat, also makes it much more difficult for a victim defending himself to be sued in civil court. We’ve had a number of people shooting others while protecting their property at nighttime – which was a pretty big no no even before the Castle Doctrine. One guy has actually shot 2 different crooks on 2 different occasions in about a 2 or 3 week period while protecting his stuff. We refer to these fine, upstanding citizens as Castle Doctrine Bad Asses.

It’ll be interesting to see how things move along, not in the criminal courts but in the civil courts. Prior to the Doctrine one was almost guaranteed to spend upwards of $100,000 just defending themselves after shooting someone in self defense because over 90% of the time the perp’s family would get all lawyered up and sue.

I hope Mr. Horn has absolutely no legal worries ($$$), criminal or civil, under the cloak of the Castle Doctrine.

Then telling the 911 guy that he’s going to shoot them…making him hear the sound of the sot gun, and then going out and shooting them. That disturbs me…

If they broke into his housse, or he saw them in his neighbors house, and he shot them, I wouldn’t have a problem with it. I will even applaud him, but the circumstances here, with him calling 911, and the conservation makes me think he should be charged. He basically executed because he could.

Chudi on December 6, 2007 at 7:11 PM

Race has nothing to do with this issue. that’s what Quannel X would like you to believe. here in Houston, we’ve been watching this with great interest. since the state passed the Castle Doctrine, we can use deadly force if we feel our lives are in danger. the question here is, did this man feel his life was in danger.

Bill O. seems to miss that point, focusing on the color of the robbers’ skin. if they were yellow, brown, blue, or mauve, the man still would have shot.

danger is danger, and we are hoping he’s cleared of any wrongdoing.

madmonkphotog on December 6, 2007 at 7:15 PM

No jury in Texas is going to convict this guy. If anything, he’s going to have lots of folks asking him to move into their neighborhood.
And yes, the thieves deserved it. If you get drunk and drive 100 mph, you deserve what you get. If you break into someone’s home, there may be an armed person waiting for you, and you deserve what you get.

That is not what you said in your previous post. You stated that the robbers were begging him not to shoot them and he executed them in cold blood. You’re being dishonest here Chudi.

And the 911 operator was not there on scene. He can recommend but he doesn’t have authority to order a private citizen around.

Anyway, your tactics of trying to shame the rest of us for not being ‘disturbed’ by Mr. Horn’s actions aren’t going to fly around here. What is disturbing is when criminals like these two thugs victimize whomever they want to and no one wants to ‘get involved’ to help the victims. Mr. Horn can be my neighbor anytime.

infidel4life on December 6, 2007 at 7:24 PM

Chudi on December 6, 2007 at 7:46 PM

Maybe he did. Maybe he didn’t. I still don’t really care- they were burlars, and that they were robbing a neighbors house instead of his own is little more than a technicality for me. I wouldn’t have done the same, but likewise don’t mind that he did.

The next house they burlarized could’ve been occupied, and the residents “executed”. Whatever the law, I’d be practicing a bit of jury nullification were I on the jury by voting “not guilty”.

If you break into a house, that presupposes your intent to do harm to its residents. The grey area is that the homeowner doesn’t know what kind of harm you want to do.

So he has to prepare for the worst.

The criminals, as they were dying, probably didn’t think they “deserved it”. But I doubt they were surprised that they “got it”.

Zach on December 6, 2007 at 9:29 PM

Again…
To you folks who believe Mr. Horn was wrong:

He called 911 to report the robbery.
He waited on line with the dispatcher for several minutes hoping the Cops would arrive in time to stop them. If they had, he would not have shot the SOB’s.

Again, if the Cops had gotten there in time, the SOB’s would be deported and would soon be back to burglarize someone else’s home. All thanks to Mayor Goofy White’s Sanctuary City policies.

Believe me if those SOB’s had the balls to break into a home in broad daylight, they would have the balls to do worse… rape, murder, etc.

Its PAST time to let criminals know that innocent people have had enough! I’m not about to sit back and let them invade my home and possibly take the life of my friend or loved one.

Lots of cliche’s work here but my favorite is:
When you play with fire your gonna git burned.

ConstantSorrow on December 6, 2007 at 9:50 PM

That means, for these thugs,no more crime,
and especially,no more house break-ins,
sounds like they were Dirty-Harried,and
I think,thats a good thing.

canopfor on December 6, 2007 at 9:51 PM

uhh dude. The guy who shot them wasn’t the homeowner. It was the next door neighbor. There was obviously no threat to him considering they were going away from the house when he walked out and shot them.

crr6 on December 6, 2007 at 9:38 PM

You need to understand Texas law, in this state you are well within your rights to use deadly force to stop any robbery. And protecting your neighbors property is the same as protecting your own.

Justice was served. It may be hard and a bit ugly, but that is the way it should be handled when you have jackball politicians like the Houston Mayor that will prevent the police from checking the status of these creeps and let them bond out to victimize someone else. And they would, but Mr. Horn put a stop to that vicious cycle.

crr6, I live in a nice part of town in my city in Texas and there’s been a rash of robberies and home invasions lately, at night, while the homeowners are asleep. It happened to our neighbor and we are all being VERY vigilant.

I had three guys casing my house and my neighbor’s house last night – so please don’t insult me by saying that they are “no threat.” To me, anyone walking up my driveway in the middle of the night, peeking in my windows and in those of my neighbors, are a BIG THREAT. PERIOD.

And, if I have to explain to my two small children why there are dead guys in the house or on the lawn it’ll be something like this: “They were trying to break into our home and hurt us. Don’t worry, baby, Mommy took care of it.”

The guys stealing your neighbors stuff next door are just as likely to hit you next. It’s call preventative medicine and it works every time.

The following is from the Castle Doctrine of Texas…I have copied and pasted it EXACTLY as it is written:

Sec. 9.32. DEADLY FORCE IN DEFENSE OF PERSON. (a) A person
is justified in using deadly force against another:
(1) if the actor [he] would be justified in using force
against the other under Section 9.31; and
(2) [if a reasonable person in the actor's situation
would not have retreated; and
[(3)] when and to the degree the actor [he] reasonably
believes the deadly force is immediately necessary:
(A) to protect the actor [himself] against the
other’s use or attempted use of unlawful deadly force; or
(B) to prevent the other’s imminent commission of
aggravated kidnapping, murder, sexual assault, aggravated sexual
assault, robbery, or aggravated robbery.

Zach under the law it was a threat when they entered his prperty and he shot them on HIS lawn. His lawn meaning incase you don;t understand his property.

I would rather explain two dead guys in the yard to my kids than go to the funeral of someone I love.

Right! There may be some things that are screwed up in our state. (like mayor white) but we can deal with scum still. And with the MS13 problems here, we need that kind of law.

I am a Native Texan, relocated (misplaced?…lol) for the love of 3 girls. One is my wife and the other two are 5 yrs old and 10 months old. I am now in New England (nuff said), but let some ass-wipe break into my house and it’s A.M.F. (see 9:37PM post for definition of A.M.F.

Joe Horn makes me proud to call Texas “home”.

Bravo. By defending another person’s rights and property you defend your own, and there’s no better way to teach the kids strength and self-reliance than by living it. But you knew all that.

ReubenJCogburn on December 7, 2007 at 1:03 AM

To my knowledge, Oregon does not have a Castle doctrine (more’s the pity). That, however, does not stop me from sleeping with a loaded pistol within arm’s reach and with a primed burglar detection system (two VERY protective whippets. I pity the testicles of any invader).

I first heard about this case from an LA talk show that was pretty down on Mr. Horn. After reading more about the case, I only hope that my neighbors are as conscientious. My only hope is that if I witnessed such an act that I would have the courage to stand off the burglars in such a bold manner. I mean let’s face it, for all he knew these two could have been armed and intent on protecting their ill-gotten goods with deadly force. I see no wrongdoing in protecting yourself from obvious miscreants with deadly force, especially when they make a move towards you that could easily be interpreted as hostile. Call me crazy.

All of a sudden deporting these criminals looks like it would have been the compasionate thing to do no? LOL Tanc/Hunter 08′ Joe Horn….. The real “Homeland Security” Chief!!

Joey1974 on December 7, 2007 at 6:02 AM

Theft is not a capital offense, and shouldn’t be.

RightOFLeft on December 6, 2007 at 7:09 PM

‘Capital offense’ and ‘authorized use of deadly force’ have no legal relationship. Executions for capital offenses have the benefit of time instead of urgency…deliberation instead of a reaction to a threat.

It’s hard to have pity for illegal immigrant thieves but listening to that audio did the trick. Joe Horn is a sick man.

That made me stand up and cheer. I’m a well-armed Mommy too. And my kids (13 and 9) know how to shoot, too. If burglars trespass on our property, they will likely die for their mistake. I’d have no qualms about it and would not lose one night of sleep worrying about dead criminals. I feel all warm and cozy just thinking about it.

Spoken like a true Texan…..folks, I believe we have a winner.

My husband and I live in a very safe community south of Houston, on the coast. My girlfriends always laugh at me for locking up tight (they don’t lock up at all), especially when the hubby is traveling. But my fear stems from the huge number of illegal aliens moving thru my neighborhood on any given day, yard guys (no, I do not use illegal help), contractors, etc. All I’ve got to say is if I see some guy exiting my neighbor’s window with santa sack filled to the brim, I would not hesitate to take him down. There are toooo many stories here in the Houston and surrounding areas of innocent homeowners being attacked, robbed, raped and murdered by just such unsavory characters. Perhaps if the criminals had to ponder if a big ass shotgun is on the other side of the door they might think twice.
