Hard to tell the traffic’s down by the number of comments. You had one post that exceeded 600 comments and another that topped 300 in the past couple of days–that’s pretty good for HA, isn’t it? Seems like we usually average about 50-100 comments per post. You got us pretty worked up at least twice, even in your drug-addled state.

Flag laws aren’t completely consistent from state to state, but the federal mandates are that no other country’s flag is to fly above Old Glory, and no higher if flown on a separate mast. Some states demand that any other national, state or provincial flags cannot be flown on the same must under ANY circumstances, and MUST be lower even when flown on separate masts.

One other federal regulation I’m clear on. The Stars and Stripes dip for nothing and nobody. An example of this is during the opening ceremony of Olympic Games; as each national contingent arrives at the host nation’s dais, they dip their flag. All but the U.S., that is. Military honor guards and color guards dip all other flags during the National Anthem or invocation/benediction prayers at formal ceremonies, but the National Ensign remains upright.

Late breaking Reno update - ID theft details that started the whole thing:

A Fernley woman’s complaint that someone at her old job was working under her name and Social Security number prompted the six month investigation that led to last week’s arrest of 54 workers at area McDonald’s restaurants, officials said Tuesday.

The woman, whose name was not available Tuesday, became suspicious when she received a W-2 form early this year that reported more income than she had earned, said Lyon County Sheriff’s Sgt. Russ Cadwallader, who took the complaint.
The woman soon discovered someone at the Fernley McDonald’s where she used to work had been using her identity.
An initial investigation determined both the employee and the manager of that McDonald’s had been using stolen identities, Cadwallader said.

This is the FIRST story in RGJ about the real victims, instead of the 2-a-day “what about the children” sob stories. My comment to the paper:

When RGJ next covers a home invasion and burglary, will the reporters interview the sobbing wife of the burglar, and sympathize with the children whose father is going to jail, or will they interview the homeowners?

What this country has been missing for decades is direct citizen involvement to protect traditional values. We don’t see that anymore. Everyone is too pansified, regulated, lawyered, afraid, politically correct, or just downright ambivalent to get personally involved these days. Except for the Left. Those clowns invented direct action to the detriment of the country, unfortunately. Everyone else, however, does nothing, except occasionally complain.

Well, this guy did something, and by doing so, he sent a message. I bet no other business pulls that stunt. His simple action improved the country. I think that deserves a bit more respect and admiration than a sarcastic “yeah, super”.

It’s not “illegal” in the sense that we usually think of things being illegal. There are a set of rules and regulations in the U.S. Code dealing with the display of and respect for the flag, but they are not enforceable unless the organization displaying it are government agencies (like the post office.) For civilians, they are largely voluntary.

I’m all for US citizens voluntarily enforcing those rules and regulations regarding the flying of our flag then.

Maybe that’s where the problem starts. “Illegal” becomes just another “rule” or “regulation” that is considered to be “unenforceable”. Maybe that’s exactly how we came to have 12 to 20 million “illegal” people in our country.

Maybe we should redefine “illegal” as being “criminal” and deal with those actions as such.

The thing is, the veteran can get in trouble for this, since he destroyed the private property of another individual. The owner of the flag might even have an assault case against him depending on how Nevada’s laws are defined. However, the owner of the establishment can’t be arrested or fined; it was his private property, and his own free speech rights as defined by the Constitution and upheld in a number of Supreme Court decisions.

i agree that to display another flag above Old Glory is improper and disrespectful. To declare that it is illegal,however, is far from clear. Look at the text of 4USC7(c), the federal code pertinent to this:

“(c) No other flag or pennant should be placed above or, if on the same level, to the right of the flag of the United States of America, except during church services conducted by naval chaplains at sea, when the church pennant may be flown above the flag during church services for the personnel of the Navy. No person shall display the flag of the United Nations or any other national or international flag equal, above, or in a position of superior prominence or honor to, or in place of, the flag of the United States at any place within the United States or any Territory or possession thereof: Provided, That nothing in this section shall make unlawful the continuance of the practice heretofore followed
of displaying the flag of the United Nations in a position of superior prominence or honor, and other national flags in positions of equal prominence or honor, with that of the flag of the United States at the headquarters of the United Nations.”

True, the second sentence begins “No person shall…” But note that the first sentence begins “No other pennant or flag should be placed above… the flag of the United States of America.” The word “should” is not synonomous with “must” or “required” or “illegal to do otherwise.” Rather, “should” is suggestive that it is good citizenship to fly the American flag highest, not declarative that the coercive power of the law will punish those who do otherwise. Which by the way, if you read the entire code section there is no mention of punitive measures for failing to comply with 4USC7(c), again indicating that this is an advisory code rather than a law that can clearly be broken.

I think instead of cutting down flags we should simply not patronize the businesses of extablishments that display the Mexican flag above Old Glory.

Oh, whoa - that was awesome! That guy just did something that lots and lots of us wish we had the nerve to do. I know, I know - he “stole” the flag, the property wasn’t his, yada, yada, yada. But you know, he did nothing violent, and it is just time, past time actually, that Americans begin to take back our country in any non-violent way possible.

You are correct. Also see Texas v. Johnson and U.S. v. Eichman . While they deal explicitly with flag burning cases, the decisions affirm the right of individuals to desecrate the flag, based on their 1st Amendment rights to free expression.

The bar owner flew a Mexican flag above Old Glory to support the Hispanic community? Are all hispanics now to be considered Mexican? And he says he’s a citizen of the United States. How about revoking his citizenship? Let him pick whatever Hispanic country he would like to live in, and he can fly the Mexican flag there. So many soldiers made the ultimate sacrifice so that ungrateful idiots like this can be free. The veteran who saved the flag is now a hero all over again. God Bless him.

C’mon—the guy would have to be brain-dead to miss the symbolism of putting the Mexican flag above the American flag on American soil. He could not possibly have been surprised when Americans took offense. I accept that he probably did not know if it was breaking any laws, but not that he had no idea it would be offensive. And apparently people’s outrage went on for hours before the news crew showed up and the vet cut the flag down. You’re telling me the bar owner remained blissfully and innocently ignorant of the problem all that time, that he “just didn’t know he was doing it wrong,” despite an angry crowd outside his establishment? Don’t think so. It’s far more likely he knew exactly what they were angry about and was being defiant in leaving the flags up there the whole day like that.

Isnt there also something about our Flag never bowing to anyone? I am thinking of the Olympics with the parade of Nations and all of them dip when passing the VIP except the USA.

It was pretty amusing to see the bar owner just stand there and watch. He never made a peep while Jim was doing his duty as a Citizen. It was only after Jim walked (or stalked!) away that this guy identified himself by getting the other flag.
I guess flying the mexican flag isnt worth confronting a VVet with a Bowie knife!

Just the attitude that has us where we are today, no men to stand up for what is right. The Vet did exactly what I would have done. The guy who put up the flags knew exactly what he was doing and showed that his loyalty lies with mexico and those from there who are in the U.S. illegally and thumb their nose at the country they are in. I honestly think it is time to burn the business down. If we had more men like this vet doing what NEEDS to be done, there would not be the problems we are having from $#%&hole countries like Mexico. Mexico has lived next to the big hammer for a long time and still cannot get their act straight, they are not our friend and it is time to treat them as what they are and what this guy showed they are…our enemy

If congress does not overcome their cranial sphincter inversion soon, we are going to see more and more of such acts, and in response, the criminal law-breaking illegal undocumented residents will react and eventually, this is going to be fought in the streets. We are heading towards looking like a third world country (which we often do in the news lately anyway what with the types of protests the Truthers and insundry anti-war/anti-WTO/anti-establishment tend to hold).
