Photoshop call: Mock MoveOn.org

Over at mm.com, I report on MoveOn.org’s bullying of t-shirt/mug designers who have satirized the left-wing group and received cease-and-desist letters.
Check out the banned logos that caused the moonbats to sic lawyers on Cafe Press shop operators.
Blue Crab Boulevard sent his own new and improved MoveOn.org logo (pictured above).

Somebody need to wipe their butt on that “cease-and-desist letter” and send it back to them for their answer (not really of course because that might be assault, but figuratively speaking).
This is the same kind of B.S. CAIR tried to pull on the Young America’s Foundation, trying to stop Robert Spencer’s speech. And in the eloquent words of Jason Mattera, CAIR was told:
Now these t-shirt/mug designers and Blue Crab Boulevard need to tell MoveOn.org to go to hell and take the Democratic Party with them !! That’s the way to shut them up… just like CAIR shut-up, MoveOn.org’s “cease-and-desist letter” has no legal merit whatsoever and of course they know it.
Sorry MoveOn.org… everyone has free speech… NOT JUST YOU !
Maxx on September 29, 2007 at 10:49 AM
Try it now Tony.

Please don’t, we already have far more than we could possibly need. Plus, ours are purebred libs. Annoying but not really dangerous. I’d hate to see what would happen if they start breeding with Berkeley types.

Limerick on September 29, 2007 at 10:57 AM
First thing they’d do is ban hockey … it’s too violent, it’s too white and too competitive. The losing team gets their feelings hurt and lose their self esteem. And no more snow ball fights! It turns little boys into warmongers! Then they’ll ban English and make French the official language.
Then all of Canada will be “Pansies on Parade”!
Tony737 on September 29, 2007 at 10:59 AM
Hmmmm, that’s weird Lime, on my screen it just says ‘try it again’.
I tried the first one and still no luck.
The good news about this Treo is that I get to take my HotAir buddies with me, the bad news is it’s kinda limited.

From Michelle’s article:
If this legal nonsense continues, the Parsing Poet ought to use the Prince tactic and come up with some kind of grotesque symbol, something that couldn’t be mistaken for anything but MoveOn.org, and refer to it on all of his T-shirts as “the smear artist” or “con artist formerly known as MoveOn.org.”
That’s a 2-for-1: he gets to slap an identity on these clowns that they wouldn’t wish on themselves in their worst nightmares, AND he draws attention to their attempt to crush free speech (while still calling them by name). Done right, that ought to get him press coverage…
So, what kind of a symbol would work? Maybe a Prince-style Mars symbol fell-ting itself…

RE-POSTED from my comment #35 at MichelleMalkin.com:
I spent many years in Graphic Design, 14 of those in my own company. It is my understanding that, by law, no one can copyright or trademark ordinary words (”move” and “on”) or widely-used common expressions (”move on” 2 words). You can, however, copyright or trademark the graphic expression of the phrase, as they did by eliminating the space between the words and capitalizing the “O” thus: MoveOn. Upon establishing their “corporate” web site, MoveOn.org, that, too, can be copyrighted and/or trademarked. The copyright or trademark does not prohibit others from mentioning them in speaking or writing, but it does prohibit the retailing of any item containing either logo without express permission from them.
I am not a lawyer (any copyright/trademark lawyers here?), but here is also my understanding of HOW TO GET AROUND THAT:
Alter the name just enough to not be the way it is expressed in their official logo. For example one could probably (?) get away with referring to them as the “move-on gang” (hyphen added), and you might also get away with reference to their web site as “move on dot org” (words separated, no CAPS) both expressed in all lower case.
Another way—and I’m not entirely sure about this one, so don’t point to me if you try it and it doesn’t work—would be be to intentionally and ridiculously misspell one or all of the words.
Again, not being a lawyer, I may be way off base here. Please, if there are any copyright/trademark lawyers reading this, please chime in. If I am wrong, I want to know!
leepro on September 29, 2007 at 5:05 PM
Very good. Love the Soviet logo.
Helloyawl on September 29, 2007 at 5:23 PM
Why bother with all the legal mumbo jumbo? Just declare “satire”.
Coronagold on September 29, 2007 at 5:27 PM
Under the “fair use” laws, within the category of satire, this “MoveOn.org” pastiche is perfectly legal, and will be laughed out of court.
But harassment is the intent.
The makers should alter the design a little to avoid the court costs of the case -that they will win, technically, but may lose their shirts on, in the meantime, as they tediously prove their “innocence”. (Unless they come across a rare judge with a strong sense for the absurd who throws out the case instantly.)
A logo something like:
MooveOn.org should suffice.
A group of cartoonists fought Disney Co. and lost a lot of money in their “satire case” against the ghost of Walt and phantom of Mickey (as documented in the funny book “The Pirates and the Mouse“), so avoid their route at all costs [sic].
Just tweak, and re-attack.
CAFE PRESS, you got the attention, now use it wisely, and don’t try to fight them in court, where they have Croesus Soros’s money to harrangue you with.
Take the funny, and run!
profitsbeard on September 29, 2007 at 5:41 PM
The printed words “MooveOn.org” do not constitute a “logo.” The graphic, as depicted above, is the actual logo. It is prohibited by copyright/trademark/fair-use laws for anyone to use it to promote anything other than that for which it was designed.
BE AWARE that I am not defending the MoveOn animals! I’m merely trying to illustrate ways the we may avoid lawsuits. As a great example, see above:
leepro on September 29, 2007 at 6:08 PM
leepro-
Since the graphic capability of this comments section doesn’t allow for the actual “logo” image, I merely meant:
add one letter to the original design, and you elude the trademark pests.
(As Coca-Cola’s graphic logo has been spoofed many times by a mere letter change.)
profitsbeard on September 29, 2007 at 6:14 PM
Cool. You are correct. Didn’t mean to “jump you,” if that’s what it sounded like.
