Marine to sue Murtha over irresponsible Haditha accusations

Well, the Marine Corps investigator has now dropped all charges against 3 of the 8 accused Marines in the case, and only one Marine still stands accused of crimes at the scene. The others are charged with various after-the-fact issues that arose from investigations of Haditha, not the events themselves. Murtha’s aim, of course, in accusing the Marines of murder “in cold blood” was to pin the blame on Bush. But in the process of blaming Bush, he slandered those Marines.
One of those Marines, Col. Jeffrey Chessani, plans to sue Murtha once he’s exonerated.
Brian Rooney, one of the attorneys at Michigan’s Thomas More Law Center representing Lt. Col. Jeffrey Chessani and a former Marine captain himself told NewsMax.com that his client, who is alleged to have failed to fully investigate the killing of 24 Iraqis in Haditha November, 2005 and not reporting an alleged Law of War violation, may follow the example of another Haditha Marine, SSgt. Frank Wuterich who is suing Murtha for libel.
Recall that Murtha claimed to base his accusations on internal Marine Corps investigations and reports. Well, I have the 31-page report that the investigating officer issued that exonerated several of the Marines. From page 20:


Based on that reasoning, the case against Wuterich is likely to fall apart too. He is the last Marine against whom charges from that night remain. If the charges against him fall, game over. Jack Murtha will have slandered Marines who acted according to their training during the course of ongoing combat.
Now, in the wake of this, will any Democrat pundits step up and criticize Murtha for rushing to judgment against US troops? Well, here’s Matthew Yglesias, lazily slandering Yuval Levin and by extension pretty much all other conservative opinionaters over farm subsidies, subsidies that hardly any conservatives ever actually supported. If Yglesias had bothered to do any research before just asserting, he would have known that. But that’s evidently too much to ask of a man who makes his living offering his opinions. And here’s Kirsten Powers, lazily smearing pro-immigration enforcement pundits as “nativists” and racists in lieu of making any actual, logical arguments to back up her anarchic position on immigration law. I’m sure she’s not referring to anyone connected to Hot Air, which happens to be owned and operated by the one pundit most closely identified with immigration enforcement, right? But if not, who? Well, she doesn’t specify. It’s easier to paint with a broad brush and then hide behind the “Heavens, of course I’m not talking about you!” defense. It’s lazy is what it is. Gathering facts and marshaling them on the way to making actual arguments is evidently too much to ask of yet another liberal who makes a living offering opinions on issues of the day. It’s much more fun just to call people names.
But nope, no criticism of Murtha. Don’t you people support the troops in any tangible way, ever?
In fact, if one thing seems to unite liberal lawmakers and pundits these days, it’s the art of the lazy and counterfactual smear. “Bush LIED!” “All conservatives from the South are raaacists.” Etc. Smear Marines here, bloggers over there, the president just for fun, whatever, whoever and wherever, why bother to do any research when smears are so handy and easy to write and will land you gigs at USA Today and Time magazine?
Well, I’m cheering on any Marine who chooses to sue Jack Murtha over his Haditha comments. He got himself way out ahead of the facts, and now the facts are sneaking up to bite him on the backside. He deserves it, and it’s about time someone got some justice over one of these slanders.
Update: It’s evidently even too much to ask the NY Times to do any fact-checking at all. Good thing they have all those layers of editors!
Update: I added the paragraph that immediately follows the passage that I’d already posted from the IO report, as it directly refutes Murtha’s claims that the Marines entered the house with the intent to commit murder. They’re both from page 18 of the report, which Adobe Acrobat renders as page 20.

While I agree with you, I also see the gravity of this situation. The fact that a former Marine and now U.S. Congressman is able to get away with this is very troubling for our nation and our national discourse.
I do hope the Marines sue. They will win.

Doesn’t look like Murtha will be able to say “well I didn’t mean it like that” when he says on the video “that is exactly what I mean” and then goes on an accuses them of cold-blooded murder of women and children.
The House should have kicked this slimebag out the week he made this bold faced accusation without a shread of evidence.

Richar Jewell just passed away. He was fausely accused of a crime and spent years living it down. He was guilty in the press without even a trial
Now these marines are going to exonerated. And they were allso guilty in the press before their trial.
Id like to see some kind of censure of Murtha for violating the constitution in using his postition to attack someone who works for the US government. People in positions of power are NOT allowed to abuse their positions to make false accusations.
Murtha and other dems stepped way over the line and abused the powers of their office. The constitution garauntees the right to trial and the presumption of innocence.
Democrats did a trial by media and went on a lynching. Its one of the most disgusting displays of abuse of office I have seen in a long time. And Murtha should be shown the door for his major role in it.

The Clintons would not allow Marines on duty at the White House wear their uniforms because it made them uncomfortable according to Buzz Peterson in his book “Dereliction of Duty.” If the head of the snake leads why wouldn’t the rest follow in their disdain for those who serve. Murtha is scum who just follows the leaders of his party.

The question is, once Murtha is found guilty in all of these lawsuits, will he do the “honorable” thing by admitting that he made a mistake and step down?
Or better yet, will any of the democratic leaders publicly state that he should resign?

Every Marine I know who is still proud of his service refers to himself as a FormerMarine. I refer to myself as former Navy. To me the “ex” implies all ties have been severed.

If some one tries to kill you, gunning them down is justifiable homicide, if Congressman Murtha tries to ruin your life (unjustifiably) for politics sake, a lawsuit seems appropriate.

I served in Vietnam, I’m still a Marine( my psychosis, I suppose), but your right, former Marine is acceptable. I refer to Murtha as ex and did so to his face. As a Marine I would normally forgo any lawsuit attempts to apply more visceral effect to Murtha, but I’m sure willing to make an exception in this matter. Adapt, adjust and overcome Gyrenes…… Semper Fi!

Bryan, to your question whether any Democrat pundit will step up and criticize Murtha, the short answe is no. As with the spurious Duke Lacrosse team charges and Rathergate, the charges may be factually incorrect but it fits with their view of America, racism and the military so they will smugly trot out the fake but accurate sceanrio and circle the wagons around the King of Pork. The man is an embarrasment and one wonders how the good people of Pennsylvania can continue to elect such a moron. I will be cheering for the marines to sue his fat ass off.

I’ve called Murtha’s office a bunch of times asking when they’d issue an apology. One lady told me, “Well, there’s still three more Marines under investigation,” after I’d told her that three had already been released.
I’m glad these guys are suing, not that it will get much press time.

He needs to resign right now. A campaign should be mounted to bring pressure to bear on him, until he resigns his seat. If the GOP is going to remove Sen Craig, (which they should) then murtha needs to go.

While I believe what Murtha did was an actionable offense, I’m not sure the Marines can win in court. Unless this actually damaged them in some way (emotional damage doesn’t count unless it’s tied to another claim).
However, some jurisdictions follow the rule that slander per se is actionable if “the words charge an offense punishable by death or imprisionment.” Here, “murder in cold blood” would certainly fall into the imprisionment category.
Other grounds for a suit would be “slander of a person’s trade or profession” which is slander per se if the statement charged “dishonesty, sloth, immorality, or drunkeness.” Murtha’s comments fall into this category as well, but like I said; they have to show damages. I could be wrong though, I’m only in my second year of law school. :)

On the one hand, I’d like to see Murtha tried and executed for treason for this statement. On the other hand, I’m little worried about implication for open political conversation of a lawsuit against him. I feel such a lawsuit violates the intent of Article I, Section 6 of the US Constitution:
The Senators and Representatives shall receive a Compensation for their Services, to be ascertained by Law, and paid out of the Treasury of the United States. They shall in all Cases, except Treason, Felony and Breach of the Peace, be privileged from Arrest during their Attendance at the Session of their respective Houses, and in going to and returning from the same; and for any Speech or Debate in either House, they shall not be questioned in any other Place.
In the end, I just wish that America would come to it senses about our fine military and vote Murtha out of office.

Democrats never ever resign because they did something wrong (there wouldn’t be one single democrat elected to any office period if they did) and they always protect/cover for each other. Hell Murtha will probably get a standing ovation from his fellow Democrats should he loose the libel suit.

I thought that only happened in Illinois. I come from a small suburb of Chicago with a population of about 15,000 people. There are THREE different Congressional districts there. My Rep. was Danny Davis. YIKES!
Of course, gerrymandering is fair when it benefits Democrats…well, you know the drill.

Congressman Murtha suffers from what is technically know as the semperideliriumnarcissistmaximus syndrome. It is a long word, as German words often are, but basically means he is a crazy selfish old fart with delusions of grander.
He is also suffering from moderate to sever Alzheimers, but unlike another who suffered from that disease, he does not have the class to suffer with grace.
My treatment plan would include:
1) Triturating up to very high doses of Donepezil, Galantamine and Rivastigmine.
2) Electroshock treatment daily at maximum non-lethal voltage.
3) The judicial placement of several large leaches on his head may also be beneficial.
4) Being placed in a small private room with a couple of Marines for psychological counseling may also be needed.
Even with this complete treatment plan, his chances of making a meaningful recovery are unfortunately quite small, but we in my profession do have the responsibility to at least try.

Slo Go got their info from John Murtha. Which is why this is more than a simple case of slander. These marines faced imprionment and Murtha muddied their chances for a fair trial by insisting that they were guilty.
And that is why Murtha needs removed.
