Program statistics from April 16 to July 31, 2007 (provided by Davidson County Sheriff’s Office):

Total arrestees received in Davidson County jail: 13,331
Arrestees who are foreign-born: 1316 (9.9%)*
Arrestees processed for removal: 994
*Total foreign-born population in Davidson County is 10.1%

Out of the 1316 arrested during this period 994 were processed for removal, i.e., here illegally. So 75% of those foreign born arrested were in the country illegal.

Not all arrested were for violet crimes. Some were for driving without a license. A victimless crime one could argue until you’re involved in a accident with one only to learn he/she doesn’t have insurance.

This is America and most are welcome, just do it legally.

I love Newt but Fred has been serving as my surrogate Newt. If Newt runs on his own accord I’d return to my first love.

Fred will let Newt take the lead but then see where it goes. I think its a smart way to do things rather than getting yourself pigeon holed into a position that you cant change later

You make the exact point that many of us point to as why fred? is the most unqualified candidate or non-candidate on either side. fred? isn’t interested in leading. He wants to poll his way to the nomination`by floating ideas. He has no specific ideas that haven’t already been voiced by other conservatives.
He has sat out this long because he is waiting to see what voters are looking for and then he will adopt those ideas.

He is trying to fake his way to a base of support just like he did in Tennessee. We need a leader. Someone who is willing to get out on a limb with his vision for America and then let us decide if we want to follow him. Both Rudy and Mitt! are explaining what they want to do and leaving it up to us to follow their lead.

What fred? is doing and robot could do. We just imput the polling data and fred? will do what the majority wants.

More mushy talk from Newark’s prosecutor in the recent killings gang executions:

Prosecutor Dow downplayed any racial motive.

“We are pursuing this as a horrendous robbery that went terribly wrong,” she said. “The mayor has made clear that given the great diversity of this city and the large influx of all nationalities, we, as a people, need to come together and not make race an issue. Here, it certainly is not.”

No mention of ILLEGAL ALIEN GANGBANGERS, though.

That move certainly doesn’t line up with the theory of using Newt as an attack dog. Politico may be displaying some juicy insider “savvy” in asserting there’s some kind of convergence between Newt and Fred, but does the general public think Fred when they hear Newt speak?

It looks more to me that Newt is goosing the GOP — including Fred — to step up to the plate on at least the criminal illegal issue, and not operating as some kind of clandestine mouthpiece for Fred.

They’re banking that this will give them enough support to push through amnesty for those whose only crime is to enter the country legally.

As such, I would prefer to see us haranguing our state representatives on subjects such as involvement of police in vetting the citizenship status of those arrested and convicted; notifying the feds of those here illegally to be picked up for status violations; and cracking down on municipalities playing the sanctuary city routine.

I don’t mind targeting one’s Federal Reps on this, but we shouldn’t let our State (and local) reps duck the fire, either. They have more a direct responsibility for police protection than the Federal government and that is what is failing here wrt illegal aliens committing crimes while living among us.

One of the nice things about taking the local and state, or the bottom up, approach is that those reps are better held to account and their activities are a little more transparent. Another nice thing about it is that it would dilute and weaken the powers that pushed the shamnesty.

Bottom line is that each state shouldn’t be able say “this is a federal responsibility” and slough off protecting their residents because Congress can’t create a majority to take any specific action.

“An arrest warrant has been issued for a fourth suspect wanted in connection with last weekend’s execution-style killings that left three Newark college students dead and a fourth seriously injured, authorities said this morning.

Rodolfo Godinez, 24, also known as Rodolfo Gomez, a Nicaraguan (illegal??) national whose last known addresses were in the Ivy Hill section of Newark is being sought by authorities. Newark Police Director Garry McCarthy called Godinez “a principal player” and said he would be charged with three counts of murder, felony murder and weapons charges.”

I hand-deliver letters to my 2 Senators’ and Rep.’s offices almost weekly on this issue, and yesterday called and emailed all 3 asking for an explanation from Chertoff why the lives of the 3 students in Newark were snuffed out by that ILLEGAL ALIEN criminal animal.

After you read this blog, go complain to your elected representatives. Weekly – daily – whatever it takes.

I’ve mentioned this before: My understanding is that it is a civil, rather than criminal offense to reside in the US illegally.

Illegal entry/residence may be under the civil codes but the assessed punishment is Federal jail time (the amount depending on the offense(s), deportation and the inability to apply for legal residence.

A civil offense is still a crime, with real punishment.

Illegal entry after excluded, deported, or removed: Subsection 1326(a) now makes it an offense for any alien who has been denied admission, excluded, deported, or removed, or has departed the United States while an order of exclusion, deportation or removal is outstanding and thereafter enters, attempts to enter, or is at any time found in the United States, unless such alien received prior written consent from the Attorney General.

The basic statutory maximum penalty for reentry after deportation is a fine under title 18, imprisonment for not more than 2 years, or both. However, with regard to an alien whose “removal” was subsequent to a conviction for commission of three or more misdemeanors involving drugs, crimes against the person, or both, or a felony (other than an aggravated felony), the statutory maximum term of imprisonment is 10 years. Moreover, if deportation was subsequent to conviction for an aggravated felony, the statutory maximum term of imprisonment is 20 years.

Although subsection 1326(a) now refers to any alien who has been “denied admission, excluded, deported, or removed, or has departed the United States while an order of exclusion, deportation, or removal is outstanding,” subsections 1326(b)(1) and (b)(2), relating to aliens with prior criminal convictions, refer only to aliens “whose removal was subsequent to a conviction.”

Penalties: The basic statutory maximum penalty for violating 8 U.S.C. § 1324(a)(1)(i) and (v)(I) (alien smuggling and conspiracy) is a fine under title 18, imprisonment for not more than 10 years, or both. With regard to violations of 8 U.S.C. § 1324(a)(1)(ii)-(iv) and (v)(ii), domestic transportation, harboring, encouraging/inducing, or aiding/abetting, the basic statutory maximum term of imprisonment is 5 years, unless the offense was committed for commercial advantage or private financial gain, in which case the maximum term of imprisonment is 10 years.

In addition, significant enhanced penalties are provided for in violations involving serious bodily injury or placing life in jeopardy. Moreover, if the violation results in the death of any person, the defendant may be punished by death or by imprisonment for any term of years.

Section 1325. Improper entry by alien

(a) Improper time or place; avoidance of examination or inspection;
misrepresentation and concealment of facts
Any alien who (1) enters or attempts to enter the United States at any time or place other than as designated by immigration officers, or

(2) eludes examination or inspection by immigration
officers, or (3) attempts to enter or obtains entry to the United States by a willfully false or misleading representation or the willful concealment of a material fact, shall, for the first commission of any such offense, be fined under title 18 or imprisoned not more than 6 months, or both, and, for a subsequent commission of any such offense, be fined under title 18, or imprisoned not more than 2 years, or both.
(b) Improper time or place; civil penalties
Any alien who is apprehended while entering (or attempting to enter) the United States at a time or place other than as designated by immigration officers shall be subject to a civil penalty of –
(1) at least $50 and not more than $250 for each such entry (or attempted entry); or
(2) twice the amount specified in paragraph (1) in the case of an alien who has been previously subject to a civil penalty under this subsection.

Civil penalties under this subsection are in addition to, and not in lieu of, any criminal or other civil penalties that may be imposed.
(c) Marriage fraud
Any individual who knowingly enters into a marriage for the purpose of evading any provision of the immigration laws shall be imprisoned for not more than 5 years, or fined not more than $250,000, or both.
(d) Immigration-related entrepreneurship fraud
Any individual who knowingly establishes a commercial enterprise for the purpose of evading any provision of the immigration laws shall be imprisoned for not more than 5 years, fined in accordance with title 18, or both.
