Does a pre-trial dismissal of this sort preclude reintroduction of the case under double-jeopardy? If not, a very thin silver lining might be that the prosecution could close all the gaps, clean up their side of the case and have it brought again.

2 utter shames are apparent from the most cursory reading of this one. The judge seems very clearly predisposed to avoid any chance of this suspect from being convicted on the charges, which smells to high heaven. And the prosecution side seems to have let several things slide that made it more possible for the judge to do so.

Either way, if written records show that the dismissal was based on lack of an interpreter, and there is both audio and personal evidence of the presence of an interpreter, is there no recourse against the judge’s dismissal of the case?

The court system of Montgomery County MD has spent 10 times as much this year as last on interpreters. This sounds like a new scam. Well with the Democratic leadership of hometown girl Pelosi I guess they just wanted to celebrate! Follow the money.

Whats with detective Hazan why is their a mention of a police scandal and why is all the evidence thrown out and why/if/is there no DNA

This is not a FUBAR this is a problem with the police, the witness, and the state not responding for THREE years for requests for evidence?

Is the system that bad?

AM I reading this right?

This guy could walk if he’s guilty cause, well one sentence said all of the officers are what? Controversial? What the heck is going on in Maryland?

There’s more to this – it seems the prosecution has a story from a child with no evidence not even a day or a month when it happened.

(Yes I read the indictment - in these type cases without a confession from the accused they are almost impossible to determine but ask Patterico he has the learnin)

I’m also confused, was this a year long as first reported or just maybe 2 incidents, it reads like he touched her once. (Not that it makes a difference – I orginally though this was a year long rape he’s not being charged with that)

The more I see crap like this and that insipid “debate” last night the more I’m convinced that UBL was right in that we don’t have the stomach for anything REAL. Give us Miss Hilton’s miniskirt around her shoulders and we’re all good but give us something serious and IMPORTANT and we fold up like a cheap suit.

This…among many other things…disgusts me.
