Kanneh update: The indictment

Court records, meanwhile, show that an interpreter was “sworn” by a Maryland court on the same day Savage dismissed the case, FOXNews.com has learned. Loretta Knight, a clerk with the court system in Montgomery County, Md., claimed she had been unable to find an interpreter to stay on the case, even after an exhaustive search that included the Liberian Embassy and courts in 47 states. But a look at the court docket for July 17, the day the case was dismissed, shows the entry “Interpreter sworn.” Several items below in the docket, Judge Savage “grants defendant’s oral motion to dismiss case based on a speedy trial violation.”

A review by FOX News of the audio from that hearing shows, however, that an interpreter was present throughout the entire court proceeding, during which time Kanneh’s lawyer, Theresa Chernosky, argued that her client had not been able to get a good job because of unresolved rape charges. Chernosky is heard also telling Savage that her client works at a gas station, and has not signed up for school because of the uncertainty about his future.

The translator can be heard throughout the entire hearing.

This backs up what State’s Attorney John McCarthy said earlier today–that a translator was available and ready for the trial. What McCarthy didn’t say was that the judge evidently dismissed the case due to lack of an interpreter when one was right there in the courtroom translating the proceedings.

And then there’s this, also from the Fox story:

Records from a case-worker report dated Oct. 31, 2006, show that the case worker visited Kanneh’s residence to check on him and instead found another sex offender, Sehkou Massaquoi, at the home along with two male children who shared the last name of the defendant.

The more I see crap like this and that insipid “debate” last night the more I’m convinced that UBL was right in that we don’t have the stomach for anything REAL. Give us Miss Hilton’s miniskirt around her shoulders and we’re all good but give us something serious and IMPORTANT and we fold up like a cheap suit.

This…among many other things…disgusts me.

There’s more to this – it seems the prosecution has a story from a child with no evidence not even a day or a month when it happened.

(Yes I read the indictment - in these type cases without a confession from the accused they are almost impossible to determine but ask Patterico he has the learnin)

I’m also confused, was this a year long as first reported or just maybe 2 incidents, it reads like he touched her once. (Not that it makes a difference – I orginally though this was a year long rape he’s not being charged with that)

Whats with detective Hazan why is their a mention of a police scandal and why is all the evidence thrown out and why/if/is there no DNA

This is not a FUBAR this is a problem with the police, the witness, and the state not responding for THREE years for requests for evidence?

Is the system that bad?

AM I reading this right?

This guy could walk if he’s guilty cause, well one sentence said all of the officers are what? Controversial? What the heck is going on in Maryland?

The court system of Montgomery County MD has spent 10 times as much this year as last on interpreters. This sounds like a new scam. Well with the Democratic leadership of hometown girl Pelosi I guess they just wanted to celebrate! Follow the money.

Does a pre-trial dismissal of this sort preclude reintroduction of the case under double-jeopardy? If not, a very thin silver lining might be that the prosecution could close all the gaps, clean up their side of the case and have it brought again.

2 utter shames are apparent from the most cursory reading of this one. The judge seems very clearly predisposed to avoid any chance of this suspect from being convicted on the charges, which smells to high heaven. And the prosecution side seems to have let several things slide that made it more possible for the judge to do so.

Either way, if written records show that the dismissal was based on lack of an interpreter, and there is both audio and personal evidence of the presence of an interpreter, is there no recourse against the judge’s dismissal of the case?
