Breaking: Victory on “John Doe” provision? Update: “This is a huge win,” says Peter King

Big thanks to anti-amnesty all star Noam Askew for catching this and tipping me. The AP reported this morning that the new Homeland Security bill had been all hammered out in conference committee — except for one niggling provision that they couldn’t quite agree upon. Twelve hours later, they’ve agreed:

The last obstacle was cleared when negotiators crafted language to satisfy a Republican demand giving immunity from lawsuits to people who report suspicious behavior. The issue grew out of an incident last fall where six Muslim scholars were removed from a flight in Minneapolis after other passengers said they were acting suspiciously. The imams have since filed a lawsuit, saying their civil rights were violated.

God only knows what the GOP has accepted by way of “satisfaction.” Keep your eye on the Washington Times. We’ll hear soon enough.

Update: The Sun’s got it but, maddeningly, without a description of the language. Take it as a good sign that Boehner and Peter King announced that the agreement had been reached, though. They wouldn’t be crowing if they had caved.

The final disagreement centered on the language of the bill. The Democratic chairman of the House Homeland Security Committee, Rep. Bennie Thompson of Mississippi, supported the provision but wanted to limit the immunity protection to those who report activity that is specifically terrorist-related.

Mr. King yesterday rejected such a limitation, saying it would “negate the whole bill.”

“It totally undermines the whole amendment because how is a private citizen able to make a decision about whether or not suspicious activity they see is going to be for a terrorist crime or an ordinary crime?” he said in an interview yesterday afternoon. “If they see somebody buying explosives, how do they know it’s going to be for terrorist purposes, not just an ordinary crime?”

Update: Still no language but it sounds awfully good.

After nearly a week of intense, behind-the-scenes wrangling, congressional negotiators late Tuesday agreed to include in the pending Sept. 11 security bill sweeping liability protections for citizens who report suspicious activity they fear might be linked to terrorism…

“This is a huge win — a hard-fought victory for House Republicans and, more importantly, for the American people,” King said.

“In a post-9/11 reality, vigilance is essential to security. Despite the Democratic opposition to this important homeland security measure, I’m thrilled to announce that common sense has prevailed and heroic Americans who report suspicious activity will be protected from frivolous lawsuits. The American people were heard and our country is safer because of it.”

The man to thank, besides King himself: Joe Lieberman.

Update: And not a moment too soon.

Update: Here’s the final language.

I called my junior Senator — professional nitwit Barry Obama — to get an explanation for his vote against the original provision, but his office could offer none. They did mention that they had received quite a few calls asking why he voted against it, other than the obvious (politics as usual from a “different sort of politician”.

God only knows what the GOP has accepted by way of “satisfaction.”

Instead of lawsuits they get beheadings.

Editor on July 24, 2007 at 11:41 PM

Yeah John Doe. OT I haven’t seen anything on the righty blogs about changes in the network neutrality provisions. ATT wants their pound of flesh. Better get hoppin on this one Allah.

sonnyspats1 on July 24, 2007 at 11:42 PM

The grass roots Crime Watch organization has been working with law enforcement for many years. They hold meetings and elect a block captain. None of the members are required to have law enforcement credentials. If a perpetrator is exhibiting suspicious behaviour then a call is made to 911 regardless of race. The Gardian Angels is another group of citizens who are active in preventing crime. Many County Sheriffs provide marked patrol cars deemed citizen observers to volunteers here in Florida. The Democrat reaction to the John Doe ammendment is an earmark to the ACLU and lawyers lobby. The left can only earn a living within the bureaucracy of big government. I remember George W. Bush in 2000 wanting to pursue serious Tort reform, to end frivolous lawsuits.

we got the John Doe provision back

Dayaneu – it is enough

Defector01 on July 24, 2007 at 11:55 PM

Even if they did pass the provision with acceptable wording it sure does make you think about what the Democrats would have done if they had 60 senate seats and the White House and so no need to negotiate. The stakes for the ‘08 elections keep getting bigger. While they’ve been out of power the Dems have all become Libs and the Libs have gone completely socialist, self hating american, surrender monkey, moonbat crazy. Karl Rove better have some serious Trump cards up his sleeve. This election is going to be, in many ways, a repeat of the French contest. Not Dem. vs. Repub. This is going to be Socialist vs. Conservative.

Hell, it always has been, Downtown. It always has been.

Methinks it’s good enough for “Heut ist Mein Tag“… hopefully it will hold up vs Dirty Harry

What he said.

Beer and BBQ awaits you. 08 is just a cocktail. 2012 will be slammers.

Limerick on July 25, 2007 at 12:43 AM

Why did this have to be such a fight? Calling Joe Lieberman…

RushBaby on July 25, 2007 at 12:44 AM

Boehner has been a bad mamajama as the minority leader. Vice President Boehner? How awesome would that be?!?! Fred Thompson in the White House flanked by a chain smoking Ohioan… *salutes*

Theworldisnotenough on July 25, 2007 at 12:48 AM

Dammit! Is there ANY issue on which the Dems *aren’t* on the wrong side? It used to be that both parties would argue about what was best for our country, now the Dems argue about what’s best for our enemies!

O/T: As I write this I’m in a hotel room in Indy that used to be a train car. Pretty cool. The hotel used to be a train station. Pretty cool. But (and there’s always a BUT) there’s still an active train line here so as I type this an actual train is rumbeling the whole place … at 1 AM! Who thought this would be a good idea???

That was just csdeven chasin after that red pick-up.

It is 1970 re-deux. Gravel stabbing Columbia in the back as Hollywood burns a hole through their nasal septum.

That was just csdeven chasin after that red pick-up.

Hehe. Fred is getting the nomination, and the bashing themedia tries to do to his conservative credentials will only help him in the general. They may be on to that and realize he is bulletproof, so we may see them paint him as Jerry Falwell coming from the pulpit to the White House… wait and see.

Theworldisnotenough on July 25, 2007 at 1:13 AM

Hey every once in a while the right thing gets done – and with a minority no less in congress

EricPWJohnson on July 25, 2007 at 1:26 AM

Minority being Republicans

EricPWJohnson on July 25, 2007 at 4:12 AM

Apparently Peter King is the only member of Congress with a lick of common sense. As for the Democraps….they have never had to worry about the common sense thing. You can’t worry about what you don’t have.

lynnv on July 25, 2007 at 7:47 AM

This is great news, but I have become so cynical towards congress, I catch myself wondering just how this law will work against us someday.

I need a vacation.

csdeven on July 25, 2007 at 8:27 AM

This is going to be Socialist vs. Conservative FREEDOM.

D0WNT0WN on July 25, 2007 at 12:06 AM

or…collectivism vs. individualism. But Hillary prefers “progressive”. Never refer to them as progressive, without single-quotes around the word, as they are nothing close to it, other than their own freedom/progress.

I need a vacation.

Step away from the Fred-threads and you’ll be rejuvenated soon :)

Democrats: On the wrong side of everything

wryteacher on July 25, 2007 at 9:09 AM

Whew! For once the right thing was done, but they certainly made us sweat it out.

4shoes on July 25, 2007 at 9:17 AM

Entelechy – ‘Progressive’ is the new Stalinist.

MCPO Airdale on July 25, 2007 at 9:41 AM

We need more like Peter King. Sometimes I wonder if he is the only one left in Congress fighting the good fight and not putting politics above doing the right thing.

tommuck on July 25, 2007 at 9:42 AM

I gotta believe that all those faxes and phone calls we made, thanks to the facilitation of the very useful NumbersUSA folks, made an impact too.

If you haven’t already, you should consider getting involved with NumbersUSA as they provide an amplifier for our voices.

I’m encouraged that we didn’t hand the islamists yet another victory here at home in the US.

Eternal Vigilance.

techno_barbarian on July 25, 2007 at 9:45 AM

Sounds good so far.

oakpack on July 25, 2007 at 9:47 AM

Now—if this turns out successfully—Why is nothing being done about the borders? I asked before and I’m saying again…Pols have the mandate, they have the money and yet the thing is at a standstill(or almost at one).Reasons?

jeanie on July 25, 2007 at 9:55 AM

Good news. You’d think it’d be a ‘no-brainer’. Pity we have to fight for things like this.

Spirit of 1776 on July 25, 2007 at 10:46 AM

Hats off to Liebs for his support.

This is going to be Socialist vs. Conservative.
D0WNT0WN on July 25, 2007 at 12:06 AM

Yes, but only if conservatives win in the GOP primaries. If not we’re screwed.

infidel4life on July 25, 2007 at 10:46 AM

Sheesh, it seems like the GOP has had more congressional wins since they lost congress than they did when they had the majority…

marc@hubsandspokes on July 25, 2007 at 12:19 PM

We must take at least the House back next year! WE MUST! I don’t want any of Hillary’s great ideas to ever pass the House…EVER!

SouthernGent on July 25, 2007 at 12:22 PM

I just cannot believe that this provision would be opposed by anyone with any amount of common sense.

It’s true that it used to be that one could disagree with the Democrats, but still believe that they only wanted what was good for America.

I just don’t believe that anymore.

Rightwingsparkle on July 25, 2007 at 1:06 PM

Peter King is about the only competent elected Republican in the state of New York. I watched the few others turn to crap, especially that dippy Pataki. Say, I haven’t heard anything lately about his Presidential aspirations. Thank goodness.

Thank you Peter King. Thanks too, to Boehlert and Lieberman and the rest. I think mass agitation is the only way we are ever going to get Congress to do the right thing… except on immigration. They will never do right with that.

Mustafa Hemmroid on July 25, 2007 at 1:07 PM

“may be” conducting “preattack security probes” at U.S. airports.

And you “may be” “using” too many “quotes” and “giving away” your “bias” as “someone” who “should” be “fairly reporting” the “truth”.

Subtlety isn’t your strong suit is it?

FireDrake on July 25, 2007 at 1:10 PM

FireDrake: What the hell are you talking about?

I’m used to being ignored here, but that’s better than getting comments from other logs.

Mustafa Hemmroid on July 25, 2007 at 1:13 PM

It’s good to know we can make a difference. All those calls helped. And of course, thanks to Michelle for keeping this issue in the forefront.

katieanne on July 25, 2007 at 2:22 PM

Gee, wonder if the Dems looked at some polling data on this issue and figured out it’s about as popular as amnesty and thus decided to cave … ya think?

thirteen28 on July 25, 2007 at 2:38 PM

Congratulations. Lately, everything HotAir touches turns to gold. Just don’t get cocky.

Kralizec on July 25, 2007 at 3:43 PM

No reason to celebrate, go read the language…

It still allows people to be sued, because it has to be a “reasonable” fear… CAIR using Saudi money can still sue all the way up to the jury, and bankrupt normal Americans.

Trial Lawyers and Islamists 1… Americans 0

Romeo13 on July 25, 2007 at 4:06 PM

Where in the hell are the real Republic politicans? Oh, wait, the majority of the ones we have now do nothing but prostrate themselves to special interest! What kills me is the American Public seems to be blind to this self-serving behavior. Where have we gone wrong? Where is the Love of Country? Can we change it and bring it back?

stanfil2 on July 25, 2007 at 6:59 PM

Entelechy – ‘Progressive’ is the new Stalinist.

MCPO Airdale on July 25, 2007 at 9:41 AM

How true – must be stopped at all cost. If this county goes that way, then there’s no hope for the rest of the world.
