Video: Geraldo spins Zina Linnik suspect’s immigration status

From yesterday’s “Big Story.” Shilling for amnesty is his full-time gig but spreading false information about murder suspects is turning into a nice side project. First it was the wanusmaximus debacle after the VTech killing, now it’s Zina Linnik’s alleged killer, whom Geraldo helpfully informs us was a naturalized U.S. citizen and thus, since it’s exceedingly difficult to deport people once they’ve been granted citizenship status, “this has absolutely nothing to do with immigration status.” Wrong:

Adhahn was an immigrant. Why wasn’t he deported after his 1990 conviction for incest?

Because federal law didn’t require it. Adhahn, 42, came to America in 1977. He became a legal permanent resident, but never filed for citizenship.

Under federal law, a single conviction for a “crime of moral turpitude” doesn’t warrant deportation for a legal permanent resident, Lori Haley, a spokeswoman for Immigration and Customs Enforcement, said Friday.

“One conviction wouldn’t render him deportable, because he was a legal permanent resident more than five years,” Haley said.

Haley added that immigration officials knew about Adhahn’s 1990 conviction at the time.

The same laws say a second conviction could have triggered deportation. Adhahn was convicted of intimidation with a weapon in 1992. The case was filed in Tacoma Municipal Court. Immigration officials didn’t know about that conviction.

“We weren’t aware of the 1992 conviction at the time,” Haley said. “That happened in Municipal Court, so we were unaware.”

So this does have a little something to do with immigration status, huh? Specifically, it has to do with the scandalous incompetence of the feds in failing to keep tabs on convicted criminals in the system so that they can move quickly to bounce them when they become deportable. The death toll keeps rising and Geraldo keeps spin spin spinnin’. I wonder if Gibby will have him back on to “clarify” or if it’ll fall to O’Reilly to take him apart on Wednesday night.

I wish. O’Reilly has worn way thin with his two sides to every story attitude. He and Jerry are way too chumsy. MM would be the choice to have at him. Jerry should go the way the Al’s and Jesse’s should – into irrelevance. Other than ratings, why would anyone have Jerry on? His position on this issue is predictable AND deplorable. I don’t watch any segment on any show this idiot is on. He practically smirks his way through his talking points. I’d watch the father of one of these innocent victims “debate” him in person though. When that single conviction is for a misdemeanor carrying a sentence of less than a year. A misdemeanor conviction for a crime of moral turpitude that carries a sentence of one year does trip immigration enforcement. Are we to believe that a violent rape of a 16 year old was plea bargained down to a six month misdemeanor?????? Oy!

Aside from the deportation argument, this guy obviously was on the street less than two years after pleading down a rape charge. I wonder how much time he served for the intimidation with a weapon conviction?
These violent offenders and repete drunk drivers continue to get slapped on the wrist until someone gets killed.

I don’t know what the law is now since I am no longer in a trial court. However, from 1986-1992 I was a public defender and gave that advisement thousands of times. Maybe, Haley is stating the law correctly as it is currently written. But, since the creep should have been deported in 1990 if he pled to a one year misdemeanor, it is irrelevant what the law is today.

Somewhere over the last couple of days I read where it was bargained from rape to incest. Hard to believe that incest is a misdemeanor carrying less than a year – but maybe it is.

There are so many things wrong with this story: Pedophiles bargaining and the criminal justice system. Losing track of a registered sex offender. mmigration – getting more than one strike before deportation. It’s hard to know where to start. The feds and cities, states not talking to each other so that additional convictions don’t count towards deportation.

Lots of people have some explaining to do.

There use to be some b.s. school of thought that when the victim and perp were related, it was better to get counseling rather than mandatory prison. Better for who??? It’s no longer the case in California: Diddle your kid and go to prison.

I watched the story live. After his ill-conceived rant, he admitted, when pressed, that he did not know that much about immigration law and how it applies to such things. How can that be as this is not the first story concerning immigrants and sex crimes? Still, Fox News will continue to allow him to voice an opinion as an authority on immigration issues.

He also failed to mention that this 7 year vet was dishonorably discharged as a result of the rape conviction. To listen to him you would think the man was a Medal of Honor winner, not a perverted scumbag.

In an earlier thread on this subject, I said–erroneously, as has become apparent–that the perp had become illegal because he had committed a felony and had become subject to deportation.

Question for the legal eagle types reading (including you, AP): if the feds had know about the second conviction (the weapons charge), how would the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (p.547) have affected this guy’s legal resident status, if at all?

The big thing that seems to be lost on Geraldo is that the Linniks are immigrants too. Legal immigrants who have never done anything to deserve deportation. But he takes the side of a man who was convicted of incest, DISHONORABLY discharged for rape from the army, and now stands accused of killing an innocent 12 year old. Way to go Geraldo.

If the sanctuary status is allowed to continue in Muni’s, states, counties, anywhere in this nation, then we will continue to have multitudes of innocent people harmed and killed by illegal immigrants.
They are not responsible for all of the crime, but they are responsible for a very large amount of crime across the nation at a much higher percentage than any other group.
It’s obvious that a well connected chain of communication needs to be in place to catch the bad guys. Even when they’re already sitting in jail there must be some type of communication to an agency that will actually do something and deport those who should be.
But if the sanctuary town/city/county/municipality of any kind decides to harbor said criminal and protect said criminal, all they really have to do is… NOTHING. Send no report , tell no one of the illegals status and the illegal immigrant walks. Hell, they most often wont even ask or do any type of database search for the status of probable illegals .
With holes that size (that can be fixed easily with current laws being enforced plus completely halt any federal money to law breaking muni’s) we will not see an end to these horrible crimes. Crimes that are 100% completely avoidable.

FACT: If the illegal alien is not in this country, he/she can NOT commit horrendous crimes inside of this country.

Geraldildo- how is that NOT immigrant related?

I couldn’t watch the video, I was already too upset about the outcome of that story. Yet another innocent child abused horribly, murdered. I never want to see Gera-hole again, even if someone is calling him to task, he is the enemy, he is no better than the perpetrator. He blames the victims essentially by apologizing for these monsters. It’s hard to believe he himself is a father.

I agree with the sentiment. I just hope we don’t lose sight of the facts when calling Geraldo to the mat. He is an apologist. He does ignore the blight that illegal immigration is on our society. (I know this creep was legal, but he should have been deported after his first felony.)

Think it’s time for one these media moguls to pick up where Fox started and has now left . conservative. I didn’t say far right, just right of center. If Fox can dominate on cable why can’t a conservative outlet do well on a national program(soup channel)?

The vast majority of illegal aliens do not commit murders, or heinous crimes. Most are just here illegally for the jobs.

But many illegal aliens do, and have committed non-violent offenses such as identity theft, social security number theft, credit card theft, etc. Arizona and Illinois rank the highest among all of the states for document fraud, identity theft, etc.

Should SSN theft and identity theft be a **deportable offense**?

John McCain, Ted Kennedy, Lindsey Graham, John Kyl, Hagel of NE, and most of the Democrats say NO.

Most of the victims of SSN theft, regardless of party affiliation, say YES.
