“Deport the Criminals First”: Illegal Gangster Arrested 27 Times Without Deportation Before (Allegedly) Murdering 13-Year-Old

Prosecutors allege that Mwenda Murithi was a leader in the Imperial Gangsters and on the evening of June 25 he gave the order to shoot at a rival gang, killing 13-year-old Schanna Gayden, an innocent bystander.

Murithi, 26, was charged with first-degree murder along with the alleged gunman, Tony Serrano, 19.

The question at trial will be whether there is proof beyond a reasonable doubt that Murithi is guilty of that charge.

The question I have, though, is why Murithi was in the country at all that night.

It turns out that Murithi had “emigrated from Kenya on a student visa” which was terminated for dropping out of school.

He became not just an uninvited guest in this country but a most unwelcome one: Chicago police records show Murithi was arrested 27 times from June 2003 until his arrest in connection with Schanna’s slaying on a Northwest Side school playground.

The charges weren’t horrible — mostly possession of cocaine, possession of marijuana, obstruction of traffic, drinking alcohol on a public way and other offenses commonly associated with the career of drug-dealing gang-bangers. Police said four of the charges were felonies; the Cook County state’s attorney’s office said Murithi had two misdemeanor convictions, one of which resulted in 30 days in jail this spring.

But still. It’s disquieting that anyone with that kind of track record for trouble spent so little time behind bars. And it’s outrageous that Murithi was still in the United States June 25, more than four years after he became an illegal immigrant and began racking up arrests.

Yes, it is. If Murithi had been deported any one of those 27 times he was arrested, it’s likely that Schanna Gayden would still be alive.

So whose fault is it? Watch as the buck gets passed:

Not us! said the Chicago Police Department. “We don’t ever ask about immigration status,” said spokeswoman Monique Bond. “We leave that up to the courts.”

Not us! said the Cook County state’s attorney’s office. “We don’t check,” said spokesman John Gorman. “That’s for [ICE] to do. We’re not involved.”

Not us! said ICE. “Law enforcement agencies can contact our Law Enforcement Support Center for timely and accurate information” 24 hours a day, Rusnok said. If “the person who is being inquired about is subject to removal, [ICE] can place a detainer with the Police Department ordering the department to hold the person … to allow ICE officials to take the person into custody and begin removal proceedings.”

Somewhere in all that buck-passing, 13-year-old Schanna Gayden lost her life.

The way to prevent such tragedies is simple. We must reallocate ICE resources so that all inmates in every jail and prison in the country are screened for their immigration status — so that all illegals are deported after serving their sentences. We must deputize local law enforcement officials to help identify illegals. We must end “sanctuary city” policies that prevent local law enforcement from making such inquiries.

If we do these things, we can concentrate our limited deportation resources on the least desirable illegals: the ones who commit crimes while in this country.

Some efforts have begun in Washington, D.C. to make some of these changes. But it’s not enough. Until we are identifying each and every illegal inmate in the country, it’s just not enough.

How many Schanna Gaydens need to die before we take action?

If you get a gang tattoo, we deport you, or maybe just shoot you. One DUI, we deport you. Get in a fight in a bar, and we deport you. Get in a car accident without legally required liability insurance, we deport you, etc., etc., etc.

Stay clean and employed, pay your taxes, pass the tests in English, tell us you want to be a citizen of the US of A, I’ll be your sponsor. Simple as that.

I just don’t think it is OK to reward law breakers. Sneaking into the US is spitting in the face of our laws. I don’t want these lawbreakers to be able to stay. I want a new guest worker program that attracts good, honest people, not the cheating illegals. Granting amnesty will only encourage the next round of cheaters.

Like Reagan said” if you subsidize something, you get more of it: if you tax something, you get less of it.” That same principal is right on with illegal immigration. The United States government has plenty of culpability in the illegal immigration problem from their shameful dereliction of border responsibility including non-enforcement on employer sanctions. Just because we caught cancer from smoking doesn’t mean we should do what it takes to irradiate it. The lying, cheating, and corruption in which the illegals are immersed in from the minute they get here and all through their time here becomes culturally ingrained. We need immigrants with clean attitudes, not institutionalized cheaters.

Here’s a very similar story that has happened near where I live.

TACOMA, Wash. — The body 12-year-old Zina Linnik, who was abducted from her Tacoma home on July 4, has been found, Tacoma Police Chief Don Ramsdell announced late Thursday night.

Ramsdell said investigators found the body at an undisclosed location in Pierce County after gaining information from a subject, who is currently being held on charges relative to his immigration status….

Ramsdell did not name the subject from whom investigators learned the information. However, police on Monday said they took 42-year-old Terapon Adhahn into custody as a person of interest in the case. Adhahn was then held by immigration authorities, police said.

Adhahn, a level-one sex offender, was detained after police raided a Parkland home on Monday, where they found girl’s undergarments. Police also seized a grey van that matched the general description as the one broadcast in the Amber Alert. Adhahn was at the home, at the time and said he is remodeling the home for his sister…

Adhahn was accused of rape in 1990 and pleaded guilty to incest. He is being held by immigration authorities, but there is a possibility he could end up in the Pierce County jail for failing to register as a sex offender.

Apparently Adhahn was suppose to be deported in 1995 after going thru sex rehab. Instead, he’s still here, illegally. He’s also a registered voter in Pierce County.

Fair enough. I’d argue that if someone is not getting into trouble with the law (other than being here illegaly), holding a job, learning english and paying taxes, then they’re the kind of citizen I want in this country. The rest can go.

My whole argument started by saying we need to work on this problem in a logical way. The govt can’t do one thing right on immigration, let alone EVERYTHING that needs to be done. I say start with the wall and rounding up criminals who are already on the books, and go from there.

Fair enough, BadgerHawk, but the longer we postpone dealing with the illegals here now, the harder it becomes to run them out. No doubt we need to deal with the border and come up with a process for verifying who is legal and who is not. Overstaying visas is a huge problem in which we need to figure out a solution.

But, creating incentives to motivate illegals to go home is critical if we seriously want to deter the next round. The problem of moving out the illegals is hard, but throwing up our arms and caving in to their criminal ways will only drive more of the same. And, the illegal culture and mindset will continue to hurt this country down the road by lowering our standards for the rule of law even further.

We need to have an IRS style no tollerence for cheaters, and make darn sure cheaters have negative consequences, not rewards.

Look at this discussion now. We are talking about letting the cheaters stay if they didn’t break more laws. This attitude shows that their presence has already corrupted many peoples sense of fairness and lowerd our standards for the rule of law. It also lowere these standards for employers, mayors, hospitals, schools, police, Presidents, and Senators.

Just look at the double standards created. If I go to the Hospital I have to pay. I pay school tax and have to get car insurance. They operate above the law and in many ways and have more rights than me: and I am paying the bill. I have no desire whatsoever to subsidize these cheaters or their cheating employers. If people wanty to come here, they must play fair. You and I both know crime shouldn’t pay, but some people are really slow learners.

Last year a drunken illegal immigrant caused a car crash that killed an Indiana University student here in Bloomington (IN). He was going like 65 mph in a 25 zone. After the crash, he ran to Delaware, where they caught him and sent him back here for trial. See the above link for more details.

The vast majority of illegal aliens do not commit murders, or heinous crimes. Most are just here illegally for the jobs.

But many illegal aliens do, and have committed non-violent offenses such as identity theft, social security number theft, credit card theft, etc.

Should SSN theft and identity theft be a **deportable offense**?

John McCain, Ted Kennedy, Lindsey Graham, John Kyl, Hagel of NE, and most of the Democrats say NO.

Most of the victims of SSN theft, regardless of party affiliation, say YES.
